Please contact the Planning Division office for information on the schedule of hearings for these items. 2. 24-1205 Public Hearing: Action on a Conditional Use Permit (PLN2018-13109), Mitigated Declaration, and Mitigation Monitoring and Reporting Program for the Existing Muslim Community Association (MCA) School Expansion at 3080 Alfred Street and 3003 Scott Boulevard. Recommendation: 1. Adopt a Resolution to adopt the Mitigated Negative Declaration and Mitigation Monitoring and Reporting Program for the Muslim Community Association School Expansion; and 2. Adopt a Resolution approving the Conditional Use Permit to allow an expansion of the Muslim Community Association School at 3003 Scott Boulevard and 3080 Alfred Street, subject to conditions. 3. 24-744 Public Hearing: Action to Modify an Existing Conditional Use Permit (PLN24-00260) to Allow a Rhythmic Gymnastics Use in an Approved Personal Fitness Facility in the Light Industrial Zoning District at 2342 Walsh Ave. Recommendation: 1. Determine the project to be categorically exempt from the California Environmental Quality Act (CEQA) formal pursuant to CEQA Guidelines Section 15301(e)(1) (Class 1 - “Existing Facilities”); and 2. Adopt a Resolution to approve a modified Conditional Use Permit to allow rhythmic gymnastics in addition to an existing personal fitness facility at 2342 Walsh Avenue, subject to findings and conditions of approval. Adopt a Resolution to deny a Variance to expand into the front setback by 6’-6” to create additional living space for a residence located at 1296 Chapel Drive 5. 24-325 PUBLIC HEARING: Action on Conditional Use Permit (PLN23-00148) for a New Unmanned AT&T Telecommunication Facility with the Installation of a 60-Foot-Tall Monotree at 3111 Benton Street Recommendation: 1. Determine that the project is categorically exempt from formal environmental review per Section 15303(d), New Construction of Utility Extensions, of the CEQA Guidelines; and 2. Adopt a Resolution to approve a Conditional Use Permit for a new unmanned AT&T wireless telecommunication facility with the installation of a 60-foot-tall monotree at 3111 Benton Street, subject to findings and conditions of approval. Under Section 1094.6, any lawsuit or legal challenge to any quasi-adjudicative decision made by the City must be filed no later than the 90th day following the date on which such decision becomes final. Any lawsuit or legal challenge, which is not filed within that 90-day period, will be barred. If a person wishes to challenge the nature of the above section in court, they may be limited to raising only those issues they or someone else raised at the meeting described in this notice, or in written correspondence delivered to the City of Santa Clara, at or prior to the meeting. In addition, judicial challenge may be limited or barred where the interested party has not sought and exhausted all available administrative remedies.
