Call to Order A regular meeting of the Solid Waste Management Agency Joint Powers Board was called to order by Councilor Lee Garcia, Chair, at 5:04pm, on April 17, 2025, in the Grant Conference Room, 240 Johnson Street, Santa Fe, NM. II. IV. Approval of Minutes A. Regular Meeting - March 20, 2025 MOTION A motion was made by Commissioner Johnson, seconded by Commissioner Bustamante, to approve the minutes as presented. Request for Approval of Amendment No. 6 to the Services Agreement with Town Recycling, LLC of Albuquerque, NM, for Processing and Marketing of Recyclable Materials (RFP No. 19/06/P); and 1. Extend the Term of the Agreement through May 30, 2026. 2. Increase the Compensation by $640,000 for a Total Amount Not to Exceed $4,875,000. Approved on consent. B. Request for Approval of Amendment No. 1 to the Services Agreement SWMA April 17, 2025 Page 2  with Enchantment Transport, Inc. of Albuquerque, NM, for Scrap Tire Hauling for The Buckman Road Recycling and Transfer Station (ITB No. 24040); and 1. Extend the Term of the Agreement through April 18, 2026. 2. Increase the Compensation by $17,250 for a Total Not to Exceed Amount of $52,050. Approved on consent. C. Request for Approval of Amendment No. 2 to the Services Agreement with Rusty's Weigh Scales & Service, Inc. of Lubbock, TX, for On-Call Scale Calibration, Maintenance and Repair Services (ITB No. 24/32/B) and 1. Increase the Compensation by $25,000 for a Total Amount Not to Exceed $50,000. Approved on consent. VIII. Matters from the Executive Director None. IX. Matters from Staff - Agency, City, County A. Danita Boettner, P.E., Landfill Manager, Santa Fe Solid Waste Management Agency Ms. Boettner said we had our Free Trash Day this past Saturday. We had 275 customers at BuRRT and 110 at Caja. It was very successful. Our next events will be free household waste and electronics on May 3 rd, and tires and green waste on May 3 rd and 4th. Our next Free Trash Day will be in September. There is a calendar of event dates on our website. In June, the Board approved the purchase of a compacter. We recently received the large compactor we purchased. It weighs 120,000 pounds. Our operators and mechanics have been trained on it. Compactors have a life span of seven to eight years. Chair Garcia asked about the maintenance on the compactor. Ms. Boettner said it comes with a warranty of seven years or 5,000 hours. Preventative maintenance is done by us. SWMA April 17, 2025 Page 3  Commissioner Johnson asked about the life span of the previous compactor. Ms. Boettner said we purchased a medium size compactor five years ago. It is still operational. It is our back up now. B. Deborah Trujillo, Division Director, City of Santa Fe Environmental Services Division. Ms. Trujillo was not present at the meeting. C. Les Francisco, Solid Waste Superintendent, Santa Fe County Public Works. Mr. Francisco said last weekend we worked with the City on Keep America Beautiful. We picked up 105 bags for them. We had 298 customers at the three collection centers with green waste. Commissioner Greene said the County approved several green waste days that are coming up. Mr. Francisco said correct. We will be having Green Waste Days every Saturday for the rest of April, May and June at Stanley, Eldorado and Jacona. We will have additional days in July, August and September on the weekends. Commissioner Cacari Stone said there seemed to be confusion with the Neighborhood Association on the south side. The City informed us that green waste had to be in bags to be picked up. We had big branches. The City refused to pick them up. Where is the confusion with the City. Mr. Francisco said we are the County. We helped the City with picking up trash bags for the Keep America Beautiful event. Everything had to be bagged. Commissioner Cacari Stone said she talked to Carol Branch about the branches. She thinks bigger green waste should be allowed next year. Mr. Francisco said if you have a punch card, they can be dumped. Call Jacqueline Beam and coordinate with her to have community waste picked up for free or to dump community waste for free. X. Matters from the Board SWMA April 17, 2025 Page 4  A. Discussion and Possible Action Regarding SFSWMA Policy 2006.1 – Free Disposal Fees Program. Mr. Kippenbrock said Councilor Michael Garcia asked for this item to be added to the agenda. Councilor Michael Garcia said we have talked about this in the past. He wanted to rejuvenate the conversation. One of the challenges communities incur in these community clean ups is what happens to the trash and the fees involved. He would like to see us encourage community clean ups and not have them have to face the financial impact that comes with this. He would like us to work, as a Board, on how we can offset the impact. That was the purpose for adding this to the agenda. Mr. Kippenbrock has added the current policy to the meeting packet. Mr. Kippenbrock said we have had this policy since the early 2000s. We have provisions to help with volunteers engaging in clean ups and individuals facing economic hardships such as a mobile home fire. By far, we deal with the clean ups the most. As Executive Director, he can approve up to 10 tons. Other than that, it has to be approved by the Board. 10 tons is about 5 roll off containers. Commissioner Johnson said it sounds like we have something in place. He thinks we can promote that more. Is there something else we are contemplating adding, Councilor Garcia. Councilor Michael Garcia said he would like up to promote this. Also, there are instances where entities are inundated with trash from wind or other issues. He wants us to work with them to remove it at no cost rather than penalize them or issue a citation. Commissioner Greene said this is available, but nobody knows. Do we want to extend this to schools and others and take the cost off the table. We do need to do additional education to the community, understanding what the limits are. Chair Garcia said businesses and properties get letters from the City or other entities to clean up their properties. Do they qualify. Mr. Kippenbrock said if the trash is not associated with the property owner or business owner they could qualify. It is more for churches and groups. Commissioner Bustamante said we have to make sure we are not in violation of Anti-Donation. Entities could use this to take their trash for free when it is individual or business trash and misuse the opportunity when they are not associated with a clean up day. These are not free operations. SWMA April 17, 2025 Page 5  Commissioner Greene asked how are we getting around that in Santa Fe County with the free green waste events we are having in the next few months. Mr. Francisco said it is free for constituents, but not for commercial. We have our fine lines. Councilor Michael Garcia said he appreciates this conversation. Encampment clean ups can be on private or business property. What do we do when the entity has to clean up an encampment. Would this policy suffice. Mr. Kippenbrock said yes. We also do illegal dumping sites. We have received applications from land owners who are trying to clean up their property and we have denied them. The Board denied them. Community clean ups, roadside areas and common areas are permissible. There was continued discussion on clean up issues. It was decided that this item would be on the agenda for the next meeting for continued discussion. Mr. Kippenbrock will circulate the current policy. Commissioner Greene thanked SWMA and Director Kippenbrock for quickly facilitating the recent issue with the City of Espanola. The trash they brought was from Santa Fe County. Commissioner Greene asked about the assessment that was discussed a year or so ago regarding allowing Rio Arriba County to use our facilities to dump trash. He has learned that Los Alamos County is partnering with Rio Arriba County to build a new facility up there. He would still like to see an assessment done so we can possibly assist them until they have their facility. Mr. Kippenbrock said he will do an assessment and bring the general numbers, including the effect it would have on the life span of the landfill, to the next meeting. XI.
