Attachments Staff Report Staff Report Attachment 1 Staff Report Attachment 2 2003 Conveyance Staff Report Attachment 3 Photograph of Monument Resolution 11.2 ORDINANCE ADOPTION - ARMORY DRIVE REZONING RECOMMENDATION: This ordinance, introduced at the November 19, 2013, Regular Meeting, by a unanimous vote, rezones 11 parcels, totaling 7.44 acres, from the Planned Development (PD 72) zoning district to the General Commercial zoning district (six properties), the Public Institutional zoning district (three parcels) and the Medium Density Residential zoning district (two parcels), all of which are located along Armory Drive. REPORT ITEMS 12.1 REPORT - COMMUNITY ADVISORY BOARD 2013-2014 COMMUNITY IMPROVEMENT GRANT RECOMMENDATIONS BACKGROUND: Annually, the City budgets an amount for Community Improvement Grants, which are solicited and reviewed by the Community Advisory Board (CAB). The City Charter Section 10 and Resolution 25805, Section 7, provide the authority for the City Council to establish this allocation for public improvements within each of seven areas: North, South, Central/Core, Northwest, Southwest, Northeast, and Southeast. This year the CAB received 26 applications totaling $21,187.73. They are recommending 16 grants to the City Council for funding totaling $11,762.17. RECOMMENDATION: It is recommended by the City Manager’s Office City of Santa Rosa Regular Meeting Agenda and Summary Report Page 5 of 10 CITY COUNCIL DECEMBER 3, 2013 and the Community Advisory Board that the City Council, by motion, award the 16 Community Improvement Grants recommended by the CAB totaling $11,762.17 for 2013-2014. Attachments Staff Report Staff Report Attachment 1 Staff Report Attachment 2 Staff Report Attachment 3 12.2 REPORT - COMMUNITY ADVISORY BOARD 2014 WORK PLAN BACKGROUND: In August 2012, Council adopted Resolution 28174 clarifying the roles, duties, and areas for the Community Advisory Board (CAB). These responsibilities were divided into the following categories; issues of concern to the residents of the City (public safety and other), budget priorities for Capital Improvement Projects, participation in neighborhood planning meetings, strengthening public involvement process, building community, assisting neighborhoods and other organizations to build civic capacity and enhance civic engagement, and public improvements. The Community Advisory Board 2014 Work Plan incorporates these responsibilities. The Board selected Bicycle and Pedestrian safety as their annual issue of concern, have created a Capital Improvement Projects subcommittee, have been participating in neighborhood and community meetings, voted to support the Santa Rosa Together civic participation initiative, voted to support a block party initiative, and have voted on their recommendations for the 2013-2014 Community Improvement Grants. RECOMMENDATION: It is recommended by the City Manager’s Office and the Community Advisory Board that the City Council, by resolution, approve the CAB’s 2014 work plan pursuant to Resolution No. 28174. Attachments Staff Report Staff Report Attachment 1 Staff Report Attachment 2 Resolution 12.3 REPORT - CONTRACT AWARD - SINGLE SPACE ELECTRONIC PARKING METERS City of Santa Rosa Regular Meeting Agenda and Summary Report Page 6 of 10 CITY COUNCIL DECEMBER 3, 2013 BACKGROUND: In January 2013, the Department of Economic Development and Housing (EDH) received an informal survey from downtown merchants that indicated customers preferred credit card enabled single space meters to the existing multi-space meters. On April 30, 2013 Council approved a request from EDH to go out to bid to replace the multi-space meters on Third, Fourth and Fifth Streets, between B and E Streets, with single space meters. On July 24, 2013, Request for Proposals (RFP) 13-37, solicited by the City for single space electronic parking meters was opened by the Purchasing Agent. Four bids were received and the evaluation panel scored the proposal from IPS Group, Inc. the highest and agreed they offered the best value to the City. RECOMMENDATION: This resolution, recommended by the Finance and Economic Development and Housing Departments, approve award of a contract with IPS Group Inc., San Diego, CA for a period of three years with up to four years of extension options for single space electronic parking meters and related services, in the total amount of $258,121.50, subject to approval as to form by the City Attorney. Funding for this procurement of the equipment has been budgeted in Fiscal Year 2013/14 Project Account Key 45025 ($146,725.50), and ongoing communication and transaction fees will be budgeted in subsequent years when approved by City Council from Operational Account Key 320409 ($111,396.00). Attachments Staff Report Staff Report Attachment Resolution Resolution Exhibit A 12.4 REPORT - APPROPRIATION REQUEST FOR ADDITIONAL FUNDS FOR FACTFINDING PROCESS BACKGROUND: In August of this year, after meeting and conferring in good faith, impasse was declared by both SRAA representing Santa Rosa City Attorneys Unit 17 and SRCEA representing Units 4 - support services, 6 - professional and 7 - technical. Both associations have requested factfinding. City of Santa Rosa Regular Meeting Agenda and Summary Report Page 7 of 10 CITY COUNCIL DECEMBER 3, 2013 The City of Santa Rosa has not used factfinding in the bargaining process before. However, factfinding has been used for years by schools in their bargaining, and although there are some differences in timelines and allocation of costs, the legal process and the information required is quite similar. Our Human Resources Department has neither the expertise nor the staffing to carry out this very detailed, defined legal process, and must contract with an outside firm to assist in preparing and to represent the City. During the 2013-14 budget process, this outcome was not anticipated, therefore the funding was not included in the Human Resources 13/14 budget request RECOMMENDATION: It is recommended by the Human Resources Department that the Council, by resolution, approve the appropriation of $180,000 in additional funds from the general fund reserves to the Human Resources outside services account 040101-20. Attachments Staff Report Resolution 12.5** REPORT - PASEO VISTA UTILITY CERTIFICATE APPEAL BACKGROUND: On September 18, 2013, the Community Development Department denied a Utility Certificate for water service for the Paseo Vista residential project located outside of the City of Santa Rosa (unincorporated County) but within the Urban Growth Boundary. The Department’s decision was based on review of the proposal for consistency with City Council Policy 300-02 (Utility Certificates for the Extension of Water or Sewer Service to Unincorporated Areas). The Community Development Department found that the project is not consistent with City Design Guidelines and public improvement standards as required by the Council policy. One of the main issues of inconsistency is that the project does not incorporate 5 to 6 foot wide planter strips between the curb and sidewalk as required for new streets. On September 30, 2013, the applicant appealed the denial action, and requested that the Council waive the requirement for planter strips and approve the project. City of Santa Rosa Regular Meeting Agenda and Summary Report Page 8 of 10 CITY COUNCIL DECEMBER 3, 2013 RECOMMENDATION: It is recommended by the Department of Community Development that the Council deny the appeal and uphold the Community Development Department’s decision to deny a Utility Certificate for water service for the Paseo Vista residential project. PUBLIC HEARINGS 13.1 PUBLIC HEARING - ORDINANCE ADOPTION - MODEL CODE - AMENDMENTS TO BUILDING AND SAFETY CODES BACKGROUND: The State of California has adopted and published new Model Codes. Such model codes go into effect in every City and County in the State of California 180 days after publication. The effective date for the City and Counties is January 1, 2014, for the California Building Code, California Historical Building Code, California Existing Building Code, California Plumbing Code, California Electrical Code, California Mechanical Code, California Energy Code, and the California Green Building Standards Code. The Health and Safety Code allows local jurisdictions to change or modify the State adopted model codes based on local geologic, climatic, or topographical conditions. The International Code Council has also published the 2012 International Property Maintenance Code that is proposed to be adopted by reference into the Santa Rosa City Code. These codes are the updates to the City of Santa Rosa Regular Meeting Agenda and Summary Report Page 9 of 10 CITY COUNCIL DECEMBER 3, 2013 California Code of Regulations, Title 24. City staff is proposing amendments to these codes to address local conditions, to be consistent with regionally adopted fire sprinkler amendments and to be consistent with regionally adopted green building codes. RECOMMENDATION: The Department of Community Development recommends that the Council, by ordinance, adopt by reference, with local amendments and administrative changes, the 2013 model codes as adopted by the State of California, and the 2012 International Property Maintenance Code. Attachments Staff Report Staff Report Attachment 1 Staff Report Attachment 2 Ordinance 13.2 PUBLIC HEARING - MODEL CODE ADOPTION - AMENDMENTS TO CALIFORNIA FIRE CODE BACKGROUND: Every 3 years the State of California updates the California Code of Regulations, Title 24 (CCR-T24), through the State code adoption cycle. The State of California adopts and publishes amendments to national model codes and updates codes specific to California during this cycle. Such model codes with State amendments and California specific codes go into effect in every City and County in the State of California 180 days after publication. The new 2013 CCR-T24 were published in July of 2013. The Health and Safety Code allows local jurisdictions to change or modify the State-adopted model codes based on local geologic, climatic, or topographic conditions. Government Code section 50022.3 identifies the procedure for the adoption process of codes that established the requirement for first reading of the ordinance title and establishment of the public hearing date. On November 5, 2013, the Council introduced the ordinance and directed staff to set and notice a public hearing on December 3, 2013. RECOMMENDATION: It is recommended by the Fire Department that the Council, by ordinance, adopt by reference, with local amendments City of Santa Rosa Regular Meeting Agenda and Summary Report Page 10 of 10 CITY COUNCIL DECEMBER 3, 2013 and administrative changes, the 2013 California Fire Code.
