No action will be taken on these matters except to possibly place a particular item on a future agenda for Council consideration. 7.1 SONOMA COUNTY DISTRICT ATTORNEY’S OFFICE SAFE NEIGHBORHOODS PROGRAM Interim Police Chief Hank Schreeder will introduce Deputy District Attorney Esther Lemus who will present the Sonoma County District Attorney’s Office Safe Neighborhoods Program aimed at identifying crime concerns in neighborhoods countywide and addressing the issues through public/private partnerships. 7.2 UPDATE ON PROPOSED SONOMA COUNTY ROAD SALES TAX The City Manager and the Transportation and Public Works Department will present the proposed Sonoma County Road Sales Tax ballot measure that is intended to distribute a quarter-cent sales tax among each city and the County. The County Board of Supervisors is scheduled to consider the matter for action to place on the November 2014 ballot earlier in the same day and the results of any action will also be provided. 8. Funds for this operational expense have been allocated in the FY 2014/15 budget of the Finance Department, Key Number 050302, Object Code 5321, and will be allocated in subsequent fiscal year budgets when approved by Council. REPORT ITEMS 12.1 REPORT - ORDERING SUBMISSION OF UTILITY USERS TAX BALLOT MEASURE, APPROVING BALLOT LANGUAGE, PERMITTING THE FILING OF REBUTTAL ARGUMENTS, AND PROVIDING DIRECTION REGARDING BALLOT ARGUMENTS IN SUPPORT OF MEASURE (CONTINUED FROM JULY 15, 2014, REGULAR MEETING) BACKGROUND: The City’s Utility Users Tax consultant has recommended that the City’s Utility Users Tax ("UUT") ordinance (Chapter 3-32) be modernized to address recent legal issues and changes in technology to avoid loss of revenue. The Long Term Financial Policy Subcommittee recommended 2-1 to place a UUT modernization ordinance on the ballot in 2014. On March 11, 2014, the Council directed the City Attorney to prepare a ballot measure for modernization of the UUT for the November 2014 ballot. The Council conducted a study session on May 20, 2014, at which Mr. Maynor, the City’s consultant, provided additional information regarding the need to update the ordinance. At that time, the City Council also suggested that the current cap of $1,000 per utility service be removed City of Santa Rosa Regular Meeting Agenda and Summary Report Page 8 of 19 CITY COUNCIL JULY 29, 2014 as part of the update. RECOMMENDATION: It is recommended by the City Attorney and the Finance Department that the Council, by resolution, (1) order the submission of a ballot measure to the voters at the November 4, 2014, General Municipal Election to implement proposed amendments to modernize the Utility Users Tax (“UUT”) Ordinance as directed by the City Council; (2) provide for the filing of rebuttal arguments on the measure; and (3) direct the City Attorney to prepare an impartial analysis of the measure. The City Attorney further requests direction by the Council as to whether the City Attorney should prepare a ballot argument in support of the proposed ballot measure. AND 3) COMMITTED CITIES CONTINGENT LIABILITY FUND AGREEMENT BACKGROUND: The City has been negotiating with the County and other cities in the County for almost ten years to seek a long term solution to the County’s operation of a waste disposal system within the County and potential liabilities associated with the landfill system. Initially, the County proposed to divest itself of the landfill site and reach a settlement with the cities. In 2009, the County Board of Supervisors did not approve the proposal after objections were made to the landfill not remaining under public ownership. The County formed the Solid Waste Advisory Group (SWAG) with representatives from each city, including City of Santa Rosa Regular Meeting Agenda and Summary Report Page 9 of 19 CITY COUNCIL JULY 29, 2014 Santa Rosa, and the County to identify key goals and a long term solid waste strategy. The SWAG met for approximately two years and recommended that the best long term solution was public ownership and private operation of the landfill. The County negotiated a Master Operations Agreement with Republic Services of Sonoma County to operate the landfill which was approved in April 2013. The agreement becomes effective upon approval by the cities of a Waste Delivery Agreement with Republic to commit their waste stream to be disposed at the Sonoma County Central Disposal site and a Settlement Agreement with the County. In order to provide security for the cities against possible contingent liability in the future for the landfill system, the cities determined that a $5.00 per ton fee should be charged as part of the gate fee and be administered under the terms of a Committed Cities Contingent Fee Agreement. As a result of the ongoing negotiations, these three proposed agreements are now presented for the Council’s approval. In the interest of establishing consistency in salary and benefits across miscellaneous units, the City’s negotiation team proposes to amend the Memorandum of Understanding for Unit 8-Transit as follows: · Effective July 13, 2014, all unit employees to receive a two percent (2%) cost of living salary increase. · Effective January 11, 2015, an adjustment of the vacation accrual ranges to better align with comparable cities. There is no change to City of Santa Rosa Regular Meeting Agenda and Summary Report Page 11 of 19 CITY COUNCIL JULY 29, 2014 the maximum accrual at 25 years. · Effective July 12, 2015, all unit employees to receive a two and one half percent (2.5%) cost of living salary increase, which will be partially offset by one and one half percent (1.5%) contribution to PERS for a total employee contribution of nine and one half percent (9.5%) pursuant to state law. RECOMMENDATION: It is recommended by the City’s Negotiating Team and the City Manager that the Council, by resolution, approve the Amendment to the Memorandum of Understanding between the City of Santa Rosa and the Service Employees International Union, Local 1021, representing the City’s bargaining Unit 8 - Transit and extend the term of agreement to expire on June 30, 2016. It is further recommended that Council authorize the Mayor to execute the amendment. Attachments Staff Report Attachment Resolution Exhibit Presentation PDF (uploaded 7/28/2014) 12.4 REPORT - ADOPTION OF THE MEMORANDUM OF UNDERSTANDING FOR UNIT 9 - FIRE SAFETY MANAGEMENT REPRESENTED BY THE SANTA ROSA POLICE MANAGEMENT ASSOCIATION BACKGROUND: The City’s representatives and representatives from Unit 9 - Fire Safety Management, represented by the Santa Rosa Police Management Association (PMA), have met and conferred concerning a successor Memorandum of Understanding. The PMA represents both Police and Fire management employees, however this MOU covers only Fire Management employees. Fire Managers have previously negotiated for the same salary increases and concessions as their respective subordinate unit, Unit 2 - Firefighting, in order to maintain equity and address compaction issues. To conform to the Unit 2 - Firefighting contract, the PMA has agreed to City of Santa Rosa Regular Meeting Agenda and Summary Report Page 12 of 19 CITY COUNCIL JULY 29, 2014 the same salary increases and additional contributions to pension. The specific changes to the new agreement include the following: PERS Contribution and Salary · Effective July 13, 2014, employees shall receive a two percent (2%) cost of living salary increase, which will be partially offset by an additional one and one half percent (1.5%) contribution to pension for a total pension contribution of ten and one half percent (10.5%). · Effective July 12, 2015, employees shall receive a two and one half percent (2.5%) cost of living salary increase, which will be partially offset by an additional one and one half percent (1.5%) contribution to pension for a total pension contribution of twelve percent (12%). Increased Vacation Accrual - Effective July 1, 2014, increase vacation accrual to by 24 hours at year 15 and additional 24 hours at year 20 with some minor adjustment to accrual ranges. This will align with Unit 2. Benefits Changes · Alignment of Domestic Partner Program with State of CA - Effective July 29, 2014, the City domestic partner insurance coverage shall align with the State. Future enrollees in the domestic partner program must meet the definition of a domestic partner as defined by the State. · Combination of Dental and Vision and Premium Contribution - Effective January 1, 2015 enrollment in dental and vision insurance shall be combined and employees will contribute 5% of the combined dental and vision premium cost. · Changes to the Vision Care Allowance - Effective January 1, 2015, the vision care benefit will be modified to provide an increase in the frames allowance from $120 to $150 and the contact lens allowance shall increase from $105 to $125. RECOMMENDATION: It is recommended by the City’s Negotiating Team City of Santa Rosa Regular Meeting Agenda and Summary Report Page 13 of 19 CITY COUNCIL JULY 29, 2014 and the City Manager that the Council, by resolution, adopt the Memorandum of Understanding for and on behalf of the City’s Unit 9 - Fire Safety Management, represented by the Santa Rosa Police Management Association. The adoption of this two-year agreement will be effective July 29, 2014 and will end on June 30, 2016. It is further recommended that Council authorize the Mayor to sign the Memorandum of Understanding for and on behalf of the City’s Unit 9 - Fire Safety Management, represented by the Santa Rosa Police Management Association for the period of July 29, 2014 through June 30, 2016. Attachments Staff Report Attachment (Draft) Resolution Exhibit (draft) Presentation PDF (uploaded 7/28/2014) 12.5 REPORT - ADOPTION OF A RESOLUTION OF INTENTION TO APPROVE AN AMENDMENT TO THE CITY OF SANTA ROSA’S CONTRACT WITH THE CALIFORNIA PUBLIC EMPLOYEES’ RETIREMENT SYSTEM AND INTRODUCTION OF AN ORDINANCE TO AMEND THE CONTRACT BACKGROUND: Consistent with Council’s goals and the options forwarded to the Council from the Mayor’s Task Force on Pension Reform, the City of Santa Rosa has engaged in on-going pension reform discussions with the City’s bargaining units since FY 2006/2007. In July 2012, the City amended its contract with the California Public Employees Retirement System (CalPERS) to establish New Second-Tier Retirement Benefits under Section 20475 (Different Level of Benefits Provided For New Employees). The City has now reached agreement with the classic members in Santa Rosa Unit 2, Firefighting represented by International Association of Firefighters, IAFF, Local 1401 and all members in the Santa Rosa Management Association for and on behalf of the City’s Unit 18 - Miscellaneous Mid-Management, and the unrepresented employees in Unit 11 - Middle Management to pay an additional contribution to pension. City of Santa Rosa Regular Meeting Agenda and Summary Report Page 14 of 19 CITY COUNCIL JULY 29, 2014 Public Employees’ Retirement law and CalPERS have mandated contract amendment procedures. The adoption of a Resolution of Intention and an Ordinance are part of the process. The Resolution of Intention must be adopted prior to the first reading of the Ordinance. Final adoption of the Ordinance must be a minimum of twenty days from its introduction and is scheduled for August 26, 2014. The contract amendment would become effective once CalPERS has processed all of the required documentation. RECOMMENDATION: It is recommended by the Human Resources Department that the Council: 1) Adopt the Resolution of Intention amending the contract between the City of Santa Rosa and the California Public Employees’ Retirement System; and (2) introduce the Ordinance to amend the contract. This General Plan Amendment package includes one amendment to the General Plan Land Use Diagram and General Plan text amendments to update three elements of the General Plan. City of Santa Rosa Regular Meeting Agenda and Summary Report Page 15 of 19 CITY COUNCIL JULY 29, 2014 **1. Calistoga Cottages. This item is an Appeal of the Planning Commission’s adoption of a Mitigated Negative Declaration, approval of a Tentative Parcel Map to subdivide the subject parcel into four single family lots, and decision to recommend the City Council approve a General Plan Amendment and Rezoning. This project includes a request for a General Plan diagram amendment to change the General Plan land use designation of 0.99 acres located at 408 Calistoga Road from Very Low Density Residential (0.2 to 2.0 units per acre) to Low Density Residential (2.0 to 8.0 units per acre), and a request to rezone from RR-40 (Rural Residential) to R-1-6 (Single Family Residential). On June 26, 2014, the Planning Commission held a public hearing and adopted four resolutions (5-0-2) to adopt the Mitigated Negative Declaration, recommend approval of the General Plan Amendment and Rezoning, and approve a Tentative Parcel Map. On July 7, 2014, an Appeal of the Planning Commission’s action was filed by Paul Bussard and Lynn Denley-Bussard. 2. Housing Element Update General Plan Amendment. The proposed General Plan text amendment would update the City’s Housing Element to address housing needs in Santa Rosa from 2015 to 2023. On June 12, 2014, the Planning Commission held a public hearing and considered the proposed General Plan Amendment. The Commission adopted a resolution (7-0) recommending that the Council approve the General Plan Amendment and find that the project is within the scope of the General Plan 2035 Environmental Impact Report. 3. Open Space and Conservation and Noise and Safety Elements Update General Plan Amendment. The proposed General Plan text amendment would update two elements of the General Plan to address flooding, dam inundation, stormwater, and fire protection. On June 12, 2014, the Planning Commission held a public hearing and considered the proposed General Plan Amendment. The Commission adopted a resolution (7-0) recommending that the Council approve the General Plan Amendment and find that the project is within the scope of the General Plan 2035 Environmental Impact Report. City of Santa Rosa Regular Meeting Agenda and Summary Report Page 16 of 19 CITY COUNCIL JULY 29, 2014 RECOMMENDATION: 1. It is recommended by the Department of Community Development and the Planning Commission that the Council, by resolutions, deny the Appeal and adopt the Mitigated Negative Declaration for Calistoga Cottages and deny the Appeal and approve a General Plan diagram amendment from Very Low Density Residential (0.2 to 2.0 units per acre) to Low Density Residential (2.0 to 8.0 units per acre); introduce an ordinance denying the Appeal and rezoning the property located at 408 Calistoga Road from RR-40 (Rural Residential) to R-1-6 (Single Family Residential); and, by resolution, deny the Appeal and approve the Tentative Parcel Map subdividing the 0.99-acre parcel into four single family residential lots. 2. It is recommended by the Department of Community Development and the Planning Commission that the Council, by resolution, approve the General Plan text amendment for the Housing Element Update as identified in the Draft Housing Element dated March 5, 2014 and as amended by Exhibit A to the resolution. 3.
