Council Member Combs concurred with the request. The purpose of this item is for the Council to discuss whether to place this matter on a future Council agenda and direct the City Manager to provide information regarding the impacts of this agenda item on other tasks. 9. CONSENT ITEMS 10.1 RESOLUTION - INCREASE AUTHORIZATION UNDER MASTER AGREEMENTS TO PROVIDE PROFESSIONAL SERVICES RECOMMENDATION: It is recommended by Engineering Services that the Council, by resolution, approve an increase in authorization of $6 million to execute Project Work Orders under Master Professional Services Agreements (MPSAs) with a cumulative not to exceed sum of $15 million for Fiscal Year 2014-15. Attachments Staff Report Resolution 10.2 RESOLUTION - SUPPORT FOR THE APPLICATION FOR CAP AND TRADE LOW CARBON TRANSIT OPERATIONS PROGRAM (LCTOP) FUNDS RECOMMENDATION: It is recommended by the Transportation and Public Works Department, that the City Council, by resolution: 1) authorize the Director of the Department of Transportation and Public Works (Director), or designee, to request $9,162 and $236,713 in LCTOP funds from the California Department of Transportation to assist in the purchase of up to ten 40-foot clean diesel fixed route buses; and 2) authorize the Director, or designee, to approve and execute any and all documents related to the request and the acceptance of these funds. REPORT ITEMS City of Santa Rosa Regular Meeting Agenda and Summary Report Page 6 of 9 CITY COUNCIL MARCH 17, 2015 12.1 REPORT - ORDINANCE AMENDING CERTAIN SECTIONS OF SANTA ROSA CITY CODE TITLE 15 - SEWERS TO MAINTAIN COMPLIANCE WITH ENVIRONMENTAL PROTECTION AGENCY INDUSTRIAL PRETREATMENT PROGRAM REGULATION REVISIONS BACKGROUND: “Title 15 - Sewers” of the Santa Rosa City Sewer Code had its last major revision in 2008 to meet the Environmental Protection Agency (EPA) Pretreatment Program requirements and “Statewide General Waste Discharge Requirements for Sanitary Sewer Systems - Order No. 2006-0003.” The purpose for this revision to Title 15 - Sewers is to codify changes in definitions and requirements mandated under EPA Pretreatment Program provisions for industrial dischargers. RECOMMENDATION: It is recommended by the Utilities Department that the Council introduce an ordinance amending certain sections of the Santa Rosa City Code Title 15 - Sewers: 15-04.030 to add the definition of Non-Significant Categorical Industrial User and update the definition of Authorized Representative, 15-06.120 to complete Significant Non-Compliance criteria and 15-08.100 to add chemical lists to local limits. Attachments Staff Report Attachment 1 Attachment 2 Ordinance Presentation PDF 12.2 REPORT - CERTIFICATION OF THE JENNINGS AVENUE PEDESTRIAN AND BICYCLE RAIL CROSSING FINAL ENVIRONMENTAL IMPACT REPORT BACKGROUND: On November 12, 2013, a Notice of Preparation of the Draft Environmental Impact Report (EIR) for the Jennings Avenue Pedestrian and Bicycle Rail Crossing project was issued. On October 17, 2014, the Jennings Avenue Pedestrian and Bicycle Rail Crossing Draft EIR was released for public review. The 45-day comment period is scheduled to end on December 1, 2014. The Council held a public hearing on November 18, 2014 to elicit public comments and to provide comments on the Draft EIR. The Final EIR was released for public City of Santa Rosa Regular Meeting Agenda and Summary Report Page 7 of 9 CITY COUNCIL MARCH 17, 2015 review on February 11, 2015. The Council will consider certification of the Final EIR. RECOMMENDATION: It is recommended by the Community Development and Transportation and Public Works Departments that the Council, by resolution, certify the Final EIR for the Jennings Avenue Pedestrian and Bicycle Rail Crossing project. Attachments Staff Report Attachment 1 - Location Map Attachment 2 - Hyperlink - Final EIR Attachment 3 Hyperlink - Draft EIR Attachment 4 - Correspondence Resolution Presentation PDF 12.3 REPORT - JENNINGS AVENUE PEDESTRIAN AND BICYCLE RAIL CROSSING AT THE SMART RAIL CORRIDOR PROJECT SELECTION BACKGROUND: The proposed Jennings Avenue Bicycle and Pedestrian Crossing at the SMART rail corridor is identified in the City’s General Plan, the Bicycle and Pedestrian Master Plan 2010, and specifically in Policy C-5.8 of the North Santa Rosa Station Area Specific Plan. The Jennings Avenue Pedestrian and Bicycle Rail Crossing Draft EIR analyzes an at-grade pedestrian and bicycle rail crossing, with a potential closure of an existing crossing at West Sixth Street, West Seventh Street or West Eighth Street and a pedestrian and bicycle rail overcrossing, at the same level of detail. Based on comments received during the Public Review period, the Final EIR includes an at-grade pedestrian and bicycle rail crossing with no closure of an existing crossing elsewhere in the City. RECOMMENDATION: It is recommended by the Transportation and Public Works Department that the Council by resolution 1) approve the proposed at-grade pedestrian and bicycle crossing at Jennings Avenue and the SMART corridor with no closure of an existing crossing as analyzed in the certified Final Environmental Impact Report (EIR) for the Jennings Avenue Pedestrian and Bicycle Rail Crossing Project and direct staff to submit an application to the California Public Utilities Commission City of Santa Rosa Regular Meeting Agenda and Summary Report Page 8 of 9 CITY COUNCIL MARCH 17, 2015 (CPUC) for the crossing; 2) find that the benefits of the project outweigh the significant noise impacts as described in Exhibit B, Statement of Overriding Considerations of the attached Resolution, 3) adopt the mitigation measures set forth in the Mitigation Monitoring Program; and 4) direct staff to implement and complete the Mitigation Monitoring Program as part of the approved Project. PUBLIC HEARINGS Public Hearing matters will begin no earlier than 5:00 p.m. or as soon thereafter as the matters are reached on the agenda. 13.1 PUBLIC HEARING - RESOLUTION AUTHORIZING WEED AND RUBBISH ABATEMENT BY THE CITY OF SANTA ROSA FIRE DEPARTMENT BACKGROUND: On February 24, 2015, Council declared by resolution, weeds and rubbish as a public nuisance. The second procedure required by Chapter 9-08 of the Santa Rosa City Code is to publish a notice for a public hearing, at which time a person or persons may voice an objection to the Weed and rubbish Abatement Program. After hearing any or all protests, the Council, by resolution, may grant or overrule any protest and authorize the Fire Department to abate the nuisances. The City Council grants or overrules any such protests. The City Council, then, by resolution, may authorize the Fire Department to abate all weeds and rubbish on or upon private property within the City of Santa Rosa. City of Santa Rosa Regular Meeting Agenda and Summary Report Page 9 of 9 CITY COUNCIL MARCH 17, 2015 RECOMMENDATION: It is recommended by the Fire Department that the Council, by resolution, overrule any protests and authorize the Fire Department to abate the nuisances.
