This is the time when any person may address the Council on matters not listed on this agenda, but which are within the subject matter jurisdiction of the Council. The first public comment period on non-agenda items (Agenda Item 13) will begin no earlier than 5:00 p.m. and will be limited to ten speakers selected randomly by the Mayor. Each speaker will be allowed three minutes. Speakers who do not have an opportunity to speak during this time will be allowed to make public comment under Agenda Item 17. To address the Council you are requested to complete a yellow Speaker Card and give it to the City Clerk. CONSENT ITEMS 12.1 RESOLUTION - RATIFICATION OF PURCHASE ORDER AND PAYMENTS TO PLAYCORE WISCONSIN FOR PLAYGROUND EQUIPMENT AND INSTALLATION AND WAIVER OF ANY DEFECTS IN PURCHASING PROCESS RECOMMENDATION: It is recommended by the Finance Department City of Santa Rosa Regular Meeting Agenda and Summary Report Page 4 of 7 City Council - CANCELLED OCTOBER 10, 2017 and City Manager that the Council, by resolution, ratify the Purchase Order and associated payments made to PlayCore Wisconsin dba Gametime Inc. for playground equipment and installation at 2375 West College Avenue, and waive any defects in the purchasing process. Attachments: Staff Report Resolution Presentation 12.2 RESOLUTION - RATIFICATION OF PURCHASE ORDERS AND APPROVAL OF PAYMENTS TO PUBLIC RESTROOM COMPANY, AND WAIVER OF DEFECTS IN THE ASSOCIATED PURCHASING PROCESS RECOMMENDATION: It is recommended by the Finance Department and City Manager that the Council, by resolution, ratify the Purchase Order and approve the associated payments made to Public Restroom Company for the purchase and installation of a turn-key public restroom and storage room, and waive any defects in that purchasing process. REPORT ITEMS 14.1 REPORT - ADOPTION OF MITIGATED NEGATIVE DECLARATION AND MITIGATION AND MONITORING PROGRAM; APPROVAL OF THE FULTON ROAD WIDENING IMPROVEMENT PROJECT BETWEEN GUERNEVILLE ROAD AND PINER ROAD City of Santa Rosa Regular Meeting Agenda and Summary Report Page 5 of 7 City Council - CANCELLED OCTOBER 10, 2017 BACKGROUND: A proposed Mitigated Negative Declaration (MND) was issued for public notice and review for 30 days, beginning on June 23, 2017 and ending in July 24, 2017. Comments from the public notice and review have been addressed, but no substantial revisions to the IS/MND have been identified. The City must adopt the MND for the Fulton Road Widening Improvement Project between Guerneville Road and Piner Road, approve the Project, and adopt a Mitigation Monitoring Program (MMP) for the Project in order to proceed with the next steps in implementing the Project. Upon adoption of the MND and approval of the Project by the City Council, a Notice of Determination (NOD) will be filed with the Sonoma County Clerk’s Office and the State Clearinghouse, completing the environmental review process. RECOMMENDATION: It is recommended by the Transportation and Public Works Department that Council, by resolution, 1) adopt the Mitigated Negative Declaration (MND) for the Fulton Road Widening Improvement Project between Guerneville Road and Piner Road; 2) approve the Project; and 3) adopt a Mitigation Monitoring Program (MMP) for the Project. PUBLIC HEARINGS Public Hearing matters will begin no earlier than 5:00 p.m. or as soon thereafter as the matters are reached on the agenda. 15.1 PUBLIC HEARING - DISTRICT BASED CITY COUNCIL ELECTIONS: COMPOSITION OF DISTRICTS (CALIFORNIA VOTING RIGHTS ACT) - SECOND PUBLIC HEARING BACKGROUND: On August 29, 2017, the City Council adopted a resolution declaring its intent to initiate proceedings to transition the City of Santa Rosa Regular Meeting Agenda and Summary Report Page 6 of 7 City Council - CANCELLED OCTOBER 10, 2017 City from at-large to district-based Council member elections pursuant to Elections Code Section 10010 and Government Code Section 34886 (RES-2017-13). Pursuant to Elections Code Section 10010, the City Council is required to hold at least five public hearings in connection with the establishment of electoral districts, before the Council moves to consider an ordinance to transition the City to district-based elections. Two of the public hearings must be held before any map or maps of the boundaries of the proposed voting districts are drawn. These two initial public hearings provide the public an opportunity to provide input regarding the criteria for, and the composition of the proposed districts. This is the second of those two initial public hearings. Two additional public hearings will be held after the proposed maps are drawn, to allow for public comment on the draft maps. A final public hearing will be held in connection with the Council’s adoption of an ordinance establishing district-based elections. RECOMMENDATION: It is recommended by the City Attorney that the City Council hold a second public hearing to receive additional input from the community regarding the composition of new voting districts to be established for the district-based election of Council members beginning in 2018, in accordance with Elections Code Section 10010.
