REPORT, IF ANY, ON STUDY AND CLOSED SESSIONS City Attorney Sue Gallagher reported Council meet in Closed Session and provided direction to real property negotiators for Item 2.1 and Item 2.2, direction was provided to legal counsel for Item 2.3 regarding existing litigation, and Item 2.4 was continued to the next meeting. 6. CITY MANAGER’S/CITY ATTORNEY’S REPORTS Police Chief Ray Navarro presented a tribute to Detective Mary Lou Armer and her service in the Santa Rosa Police Department and the community for over 20 years. STATEMENTS OF ABSTENTION BY COUNCIL MEMBERS Council Member Tibbetts announced he would be abstaining from Consent Item 12.14. Council Member Sawyer announce he would be abstaining from Item 11.1 - Approval of Minutes due to being absent from the meeting and, out of an abundance of caution, he would be abstaining from Consent Item 12.15. Council Member Olivares announced that out of an abundance of caution he would abstaining from Consent Item 12.15. 10. MAYOR'S/COUNCIL MEMBERS’ REPORTS Council Member Rogers reported SCTA and Mayors and Council Members meetings have continued to meet using Zoom or teleconference with discussions on the impact of COVID 19. Council Member Olivares provided a brief update on attending meetings with other Council Members from other jurisdictions on food security and food distribution sites. Cheryl submitted comment on various topics. 14. REPORT ITEMS 14.1 REPORT - SONOMA COUNTY COVID-19 EVICTION DEFENSE ORDINANCE (MOVED FROM THE MARCH 31, 2020, CANCELLED MEETING.) BACKGROUND: On March 24, 2020, the Sonoma County Board of Supervisors, acting in its capacity as both the Board of Supervisors and the Board of Commissioners of the Sonoma County Community Development Commission, unanimously adopted an ordinance providing an avenue for relief from evictions for tenants suffering from substantial loss of income or medical expenses related to the COVID-19 pandemic or any local, state, or federal government response to the COVID-19 pandemic. City of Santa Rosa Regular Meeting Minutes Page 17 of 18 City Council Regular Meeting Minutes - Final April 7, 2020 The ordinance establishes an affirmative defense, which may be used in court as protection against eviction, for tenants who can demonstrate, though documentation or other objectively verifiable means, that their failure to pay rent results from a substantial loss of income or substantial out-of-pocket medical expenses associated with the COVID-19 pandemic or any local, state, or federal government response to the COVID 19 pandemic. The ordinance does not relieve the tenant of the obligation to pay rent, nor does it restrict a landlord’s ability to recover rent due. The Ordinance provides a sixty-day period after the termination of the local Public Health Emergency for payment of all unpaid rent. The Urgency Ordinance became effective upon adoption and it applies throughout the County, in both incorporated and unincorporated areas. No action is required or requested of the Council at this time. RECOMMENDATION: It is recommended by the City Attorney that Council receive a report on the provisions and operation of the Urgency Ordinance of the County of Sonoma and the Sonoma County Community Development Commission Establishing an Affirmative Defense to Eviction Arising from Income Loss or Substantial Medical Expenses Related to COVID 19. No action by Council is requested at this time.
