STUDY SESSION 3.1 COUNTY OF SONOMA STRATEGIC PLAN The County of Sonoma is in the process of developing a Five-Year Strategic Plan that will inform policies and projects that are prioritized over the next five years. The Board of Supervisors has identified five Strategic Pillars: Healthy and Safe Communities, Organizational Excellence, Racial Equity and Social Justice, Climate Action and City of Santa Rosa Regular Meeting Minutes Page 2 of 21 City Council Regular Meeting Minutes - Final January 12, 2021 Resiliency, and Resilient Infrastructure. County staff have completed an extensive employee and community engagement process to help refine the goals and objectives, and will be bringing the draft plan to the Board of Supervisors for review on January 26th. In this study session, County staff will provide an overview of the Strategic Plan process and components. Council Member Alvarez rejoined the meeting at 2:21 p.m. PUBLIC COMMENT Jen Klose, Executive Director - Generation Housing, spoke surprised not to see housing called out specifically, and encouraged the collaboration between the County and City to address the housing issue. Duane De Witt submitted comment the city and county collaborating on equity and social justice and asked the City to open the chamber with social distancing. This item was received and filed. 3.2 REVIEW OF TEMPORARY SICK LEAVE REQUIREMENTS AND OPTIONS FOR CERTAIN EMPLOYERS In response to the pandemic, on July 7, 2020, the Council enacted Ordinance 2020-006, which required certain employers provide temporary sick leave benefits for employees. This ordinance was intended to fill the gaps of employers not covered under federal law. Both the ordinance and federal law sunset on December 31, 2020. This Study Session is being held for the Council to discuss and provide feedback to staff as to whether to readopt Chapter 10-47 and, if so, whether any changes should be made to it. City of Santa Rosa Regular Meeting Minutes Page 3 of 21 City Council Regular Meeting Minutes - Final January 12, 2021 Attachments: Staff Report Attachment 1 - Ordinance ORD-2020-006 Presentation Raissa de la Rosa, Deputy Director - Economic Development, presented and answered questions from Council. PUBLIC COMMENT Jack Buckhorn, Executive Director - North Bay Labor Council, spoke asking that the sick leave ordinance is extended, retro-active to January 1 and to include employers with less than 500 employees, do not refill bank, cover all employers, take advantage of tax credit. Ananda Sweet, Santa Rosa Metro Chamber of Commerce, spoke stating employees should not be put in position of going to work while sick, not adding to costs for employers, and social safety net programs such as paid leave for parents due to school closures should come with identified public funding source. Marty Bennett, UNITE HERE Local 2850, spoke urging council to renew and amend the paid sick leave ordinance, critical for workers to have access to emergency paid sick leave, that emergency paid sick leave is a racial equity issue, would like amendments to cover employers with less than 500 employees, and make the ordinance retro-active to January 1, 2021. Council gave direction to staff to bring this item back once it has been worked through by the Economic Development Subcommittee. STAFF BRIEFINGS 7.1 COVID-19 RESPONSE UPDATE This will be a standing item on the agenda. No action will be taken except for possible direction to staff. City Manager Sean McGlynn reported the regional stay home order was extended indefinitely for the Bay Area, Sonoma County continues to administer COVID-19 testing, more information is available at socoemergency.org/tests, vaccinations are actively underway in Sonoma County, the County has partnered with Safeway to administer those vaccinations, and more information is available at socoemergency.org/vaccine. This item was received and filed. 7.2 COMMUNITY EMPOWERMENT PLAN UPDATE This will be a standing item on the agenda. No action will be taken except for possible direction to staff. Magali Telles, Deputy Director - Community Engagement, provided an update on: the Community Empowerment Plan which has been completed, copies will be submitted in English and Spanish to the community members that participated in the listening sessions and the report will then be shared with Council on February 23; the Multi-Cultural Roots project; the lowrider patrol car which is on schedule to be received by end of the month; the Chief's community advisory board; and the Ethnic Studies with a Cop pilot program. Paul Lowenthal, Assistant Fire Marshal, provided an update that a community meeting will be held Wednesday, January 20 at 5:00 p.m. covering the Skyhawk park and open space update, watershed protection update, tree concerns, private/public debris removal, and rebuild; the City is still waiting for PG&E to schedule a tree meeting they previously offered to City of Santa Rosa and other agencies, a California Public Utilities Commission (CPUC) meeting has been scheduled for Friday, January 22 at 12:30 p.m.; and addressed community concerns regarding storm-water repairs and open space at Sky Hawk. This item was received and filed. 7.4 WATER AND RECYCLED WATER SUPPLY UPDATE Santa Rosa Water staff will update the City Council on current water and recycled water supplies. The Council may discuss this item and give direction to staff. This item was received and filed. 7.5 CITY INVESTMENTS City staff and a representative from the City’s investment management firm, PFM, will brief the Council on the legal requirements for investing City funds, including the types of investments that may be purchased. PUBLIC COMMENT Mico spoke on the low rider cop car and commended the City for joining with them on this project. D'mitra Smith spoke on the Ethnic Studies comments, meaningful police reform, asking when CAHOOTS will be implemented, ban the use of tear gas and projectiles, when will the people who are responsible for vehicular assault be held accountable. David Escobar, Latin Rollers Car Club, spoke echoing the comments by Mico and thanked the City for the effort of community engagement; and a big portion of the local car clubs are enthusiastic for Santa Rosa Lowrider Car Club. Raquel spoke regarding the Ethnic Studies with a Cop program, the belief that police does not equal safety in the community, a letter expressing deep concern about the program, invited Council to the California Department of Education Facebook page showing the impact of police in schools, and does not want the program replicated in any form. Kimmie Barbosa spoke on the lack of transparency around the Ethnic Studies with a Cop Program, students expressing they do not feel safe with police officers at schools, and hopes the advisory committee does not have engagement opportunities with law enforcement and youth. Libs spoke echoing the comments of Kimmie, abolishing the police. Kris spoke on the Ethnic Studies with the Cop, not interviewing students across the county instead of the those in the class, how much did the low rider cost and why were those funds not used to address systemic racism. City of Santa Rosa Regular Meeting Minutes Page 7 of 21 City Council Regular Meeting Minutes - Final January 12, 2021 Michael Titone spoke on an open letter on the Ethnic Studies with a Cop program sent to Council and not receiving a response, his concern the name of Ethnic Studies with a Cop will be changed not revealing that law enforcement will be involved in future versions of the program, and healing will require law enforcement to take accountability for what happened. Kelsey Vera spoke echoing the comments on the Ethnic Studies with a Cop program and how shocked she was when hearing about the program, feels the program is very performative, and the movement to take police out of schools. Baylee spoke echoing the comments from Kimmie, Libby going forward. Tavy Tornado, Love and Light, spoke on transparency around people and law enforcement, does not want law enforcement in schools, Ethnic Studies should be taught to law enforcement, and abolish the system. Amanda spoke on the Ethnic Studies work she has done over the years, being disheartened to hear about the Ethnic Studies with a Cop program, the dangers of having police around young people, more education needs to be done with police officers, that the City should make an public apology and hold police accountable. Lee spoke echoing the comments of previous speakers, her experience of being with teenagers who expressed their true feelings about law enforcement, asked the human rights violations report be addressed, the mental health of children who are subjected to officers that they fear, a public apology is needed, and that the City should listen to the voices of the people. Duane De Witt submitted comment on Item 7.4 and asked the City to work with County to install water retention basins to help with aquafer recharge. City of Santa Rosa Regular Meeting Minutes Page 8 of 21 City Council Regular Meeting Minutes - Final January 12, 2021 Duane De Witt submitted comment on Item 7.5 that moneys invested by City to put them into accounts for repairs needing to be done around the City, and suggested the Citycharge for the water that is sent to the Geysers. City Manager McGlynn will report back to Council on costs for the Ethnic Studies with a Cop program and an update related to a CAHOOTS-type program on January 27. City Attorney Gallagher addressed the Human Rights Commission report will be a combined item with the After Action Report relative to the protests that took place in summer 2020, and an audit report on use of force to be held sometime in March. This item was received and filed. 8. CITY MANAGER’S/CITY ATTORNEY’S REPORTS City Manager had nothing to report. City Attorney Gallagher reported on the steps to realign the Community Advisory Board (CAB) districts to align with the City Council Districts, and confirmed the City Council has the authority to make the realignment, as the Charter does not define the districts, and delegates the City Council the authority to draw the boundaries by resolution. City Attorney Gallagher also reported on a request from staff for Council to hear an additional closed session item on the agenda and make the necessary findings to hear an item not on the published on the final agenda per The Brown Act. The closed session item concerns real estate property located at 2437 Lomitas Ave. The property is a key barrier to future evacuation routes for Fountaingrove and Hidden Valley neighborhoods. Staff requested that finding of good cause be made to hear the item in closed session with real property negotiators under Agenda Item 18 as there is a need for immediate action and this information came to their attention subsequent to agenda being posted. This finding requires a 2/3 vote of the Council members present. City of Santa Rosa Regular Meeting Minutes Page 9 of 21 City Council Regular Meeting Minutes - Final January 12, 2021 Mayor Rogers assigned the realignment of the CAB districts to be discussed at the upcoming Goal Setting meetings. Mayor Rogers entertained a motion related to the addition of the closed session item as described by City Attorney Gallagher. Mayor Rogers opened the floor for public comment, and seeing no public comment, Mayor Rogers called for the vote. A motion was made by Council Member Schwedhelm, seconded by Council Member Alvarez, to make findings of good cause to add Item 18 - Closed Session regarding real property negotiations related to 2437 Lomitas. City Manager stated staff will send an update through the City Connections newsletter. Vice Mayor Rogers announced the appointment of Anne Baumgartner to the Art in Public Places Committee and Margueritte Finn to the Bicycle and Pedestrian Advisory Board, and encouraged members of the community to apply to various boards so Council can diversify their appointees. Council Member Fleming strongly expressed condemnation to the white supremacist riots that happened in Washington DC and that the community stays safe. Council Member Alvarez announced the appointment of Mark Walsh City of Santa Rosa Regular Meeting Minutes Page 10 of 21 City Council Regular Meeting Minutes - Final January 12, 2021 to the Board of Public Utilities and concurred with Vice Mayor Fleming on the events in Washington DC. Mayor Rogers echoed the comments regarding the events in Washington DC and, without objection from the Council, he will be sending a letter to congressional partners in support of calling for the resignation of the President, invoking of the 25th amendment and/or impeachment. The letter will be circulated to Council Members for signature.
