CALL TO ORDER AND ROLL CALL Mayor Rogers called the meeting to order at 3:00 p.m. Present: 6 - Mayor Chris Rogers, Vice Mayor Natalie Rogers, Council Member Eddie Alvarez, Council Member Victoria Fleming, Council Member John Sawyer, and Council Member Tom Schwedhelm Absent: 1 - Council Member Jack Tibbetts 2. ANNOUNCEMENT OF CLOSED SESSION ITEMS - NONE. 3. STUDY SESSION 3.1 BENNETT VALLEY GOLF COURSE COMPLEX STUDY SESSION It is recommended by the Transportation and Public Works Department and Real Estate Services that the Council hold a Study Session to receive information, ask questions, discuss and provide feedback and direction to staff regarding the future of the Bennett Valley Golf Course Complex. Assistant City Manager Jason Nutt answered questions from Council. PUBLIC COMMENT Steve Urbanek spoke in support of the existing operations at Bennett Valley Golf Course as a community asset, asked if Howarth and Finley parks are self supporting and stated he would like to see City of Santa Rosa Regular Meeting Minutes Page 2 of 12 City Council Regular Meeting Minutes - Final February 2, 2021 more information from the current operator. Luke Lindenbusch, Generation Housing, spoke in support of the process to identify the future of Bennett Valley Golf Course and encouraged the City to use a holistic approach to leverage public land. Dan Galvin spoke on the popularity of the Bennett Valley Golf Course and in support of existing operations. Gregory Fearon, Treasurer of Bennett Valley Golf Club, spoke on the history of the golf course and the error of looking it as an enterprise fund. Jim spoke on the presentation not being focused on how to make the golf course more profitable, the number of rounds currently played at the course, and for Council to consider how to protect the resource and improve the profitability of this asset in the community. Brennen spoke in support of continuing the existing use of the golf course as an asset in the community. Louis Capuano, President of Bennett Valley Golf Clulb, spoke on the club membership making up a significant amount of rounds played at the course, the course being voted as one of the best courses in the County and the course losing accreditation if it is lowered to a 9 or 12 hole course. William Brooks submitted comment in opposition to closing the golf course and felt it is the best municipal course in the state. Ed, Handicap Chairman for the North Bay Golf Club, submitted comment in support of keeping the course open. Tom submitted comment in support of the existing operations. Council Member Tibbetts joined the meeting at 4:21 p.m. Council provided direction to staff to pursue a contract for a consultant to perform a highest and best use (feasibility) analysis for the golf course and to bring back to Council action at a future meeting. Paul Lowenthal, Assistant Fire Marshall, provided a brief report on behalf of the Glass Fire Task Force; the deadline for right of entries and debris removal has been extended to February 15, 2021; and that the Watershed Task Force reported no significant issues after recent rain event. PUBLIC COMMENT Duane De Witt submitted comment on Items 7.1 and 7.2 requesting the City work with County to post information to the bulletin boards related to these items. This item was received and filed. 8. CITY MANAGER’S/CITY ATTORNEY’S REPORTS City Attorney Gallagher provided an update on recent developments on eviction protections related to COVID-19, and reported a tentative ruling was found in the City's favor in the All-Electric Reach Code litigation, noting a final ruling has not yet been received. PUBLIC COMMENT Gregory Fearon spoke reporting the Board of Supervisors published their staff report eight days prior to the meeting. 9. STATEMENTS OF ABSTENTION BY COUNCIL MEMBERS No statements of abstention were made. 10. MAYOR'S/COUNCIL MEMBERS’ REPORTS Vice Mayor Rogers announced her appointment of Jeff Holton to the Planning Commission, Michael Burch to the Design Review Board, and Alvin Hamilton to the Cultural Heritage Board. Council Member Tibbetts announced his appointment of Kristin Kiefer to the Art in Public Places Committee. PUBLIC COMMENT ON NON-AGENDA MATTERS Ken Kreischer spoke on Council meeting's housekeeping language regarding being respectful and the recent public comment made by Council Member Fleming from the Public Safety Subcommittee. Alex Krohn submitted comment on the dangers of placing small cell towers in front of homes. Duane De Witt submitted comment on his concern that taxpayers are being burdened with new buildings being built in downtown and for the City to use the AT&T building for government offices. Joanna Mekay submitted comment on the policy being drafted by staff regarding local control on small cell tower placement. 14. REPORT ITEMS 14.1 REPORT - 2021 FEDERAL LEGISLATIVE PLATFORM BACKGROUND: The 2021 federal legislative session is now underway. To be best positioned to respond to what is anticipated to be a very active session, City staff have identified federal legislative priorities in a proposed 2021 federal platform for consideration by the City Council. Defined priorities, approved by the City Council, will help communicate the City’s federal legislative and project priorities to the California Congressional Delegation, Congress, and federal agencies. On July 7, 2020, Council adopted urgency ordinance ORD-2020-006 adding Chapter 10-47 to the Santa Rosa City Code to address some of the gaps in the federal law. Both the federal law and City ordinance expired December 31, 2020. This new urgency ordinance would replace the expired Chapter 10-47 and require that employers provide COVID-related paid sick leave benefits similar to those previously required by federal law and the now expired City ordinance. This new urgency ordinance would be effective upon adoption through March 31, 2021. Under the City Charter, five affirmative votes are necessary to adopt an urgency ordinance. RECOMMENDATION: It is recommended by the Economic Development Subcommittee that Council adopt an urgency ordinance to require employers to provide COVID-related paid sick leave benefits through March 31, 2021, to replace the expired ORD-2020-006 previously adopted by Council. PUBLIC COMMENT Peter Rumble, Santa Rosa Metro Chamber of Commerce, spoke in support of the ordinance, stated the Chamber will help spread the information, expressed appreciation for the Council on hearing input and getting additional advice from tax City of Santa Rosa Regular Meeting Minutes Page 11 of 12 City Council Regular Meeting Minutes - Final February 2, 2021 counsel. Ananda Sweet, Santa Rosa Metro Chamber of Commerce, spoke echoing Mr. Rumble's comments and expressed concerns with some of the language in the ordinance. Jack Buckhorn, Executive Director North Bay Labor Council, spoke on his appreciation of the work Council has done, the language that sets a floor and opens the door for employers to be successful, asked for language to be created requiring posting of the ordinance at businesses, and he is willing to help with distribution of notice. Marty Bennett spoke on the noticing requirements in Section 10-45.080 in the City's minimum wage law and the importance of translating the notice for posting online and in the workplace. Maddy Hirshfield spoke echoing the comments of previous speakers and thanked City Council and staff for the time that was put into the ordinance and the importance of noticing so people know their rights.
