PUBLIC HEARINGS **16.1 PUBLIC HEARING - BUNYA BUNYA TREE REMOVAL APPEAL (THIS ITEM WAS CONTINUED FROM THE FEBRUARY 27, 2024, REGULAR MEETING) BACKGROUND: The Salvation Army (appellant) submitted an application to remove a Bunya Bunya tree in September 2022, which was denied by the Director of Planning and Economic Development and appealed to the Planning Commission. On September 14, 2023, the Planning Commission voted 5-2 to uphold the Director’s decision. On September 25, 2023, an Appeal Form was received pursuant to City Code Chapter 17-24, the appellant submitted the subject Appeal application, appealing the Planning Commission’s decision. REPORT ITEMS 15.1 REPORT - POLICE DEPARTMENT ANNUAL MILITARY EQUIPMENT REPORT BACKGROUND: The passage of Assembly Bill 481 added several new statutes to the Government Code (GC § 7070-7075). These statutes require any state or local law enforcement agency that uses or wants to acquire “military equipment” as defined in the statute to create a written policy detailing the acquisition and use of the equipment which is adopted by ordinance. City of Santa Rosa Regular Meeting Minutes Page 14 of 16 City Council Regular Meeting Minutes - Final June 4, 2024 RECOMMENDATION: It is recommended by the Police Department that the Council, by resolution: 1) approve the Santa Rosa Police Department Annual Military Equipment Report which complies with the requirements of AB 481; 2) review Ordinance No. ORD-2022-007; and 3) renew Ordinance No. ORD-2022-007, codified as Chapter 2-38 of the Santa Rosa City Code per California Assembly Bill No. 481. The OIR group reports directly to the City Manager and reviews internal investigations, conducts audits of City of Santa Rosa Regular Meeting Minutes Page 15 of 16 City Council Regular Meeting Minutes - Final June 4, 2024 policies, practices, and records, and conducts community outreach. RECOMMENDATION: It is recommended by the City Manager that the Council receive a presentation by the OIR Group LLC of the annual report of Santa Rosa Police Department oversight. WRITTEN COMMUNICATIONS 17.1 FEDERAL AND STATE LEGISLATIVE UPDATE • State Bill -- Support Letter for AB 2515 (Papan): Prohibits a person from manufacturing, distributing, selling, or offering for sale a menstrual product that contains regulated perfluoroalkyl or polyfluoroalkyl substances (PFAS). Provided for information. • Federal Bill - Support Letter for H.R. 7944 (Curtis): Enacts the Water Systems PFAS Liability Act which would ensure that water and wastewater systems and ratepayers are shielded from liability from PFAS in our water systems. Provided for information. • Federal Bill - Support Letter for H.R. 7849 (Thompson): This bill would enact the Disaster Resiliency and Coverage Act of 2024. The bill would provide pre-disaster mitigation grants and tax incentives for households to reduce the risk of real property damage due to natural disasters, including floods, hurricanes, and wildfires.
