CALL TO ORDER Mayor Johnson called the meeting to order at 7:02 p.m. PUBLIC COMENT Mayor Johnson opened the public comment period at 7:03 p.m. Page 3 of 14 City Council Meeting 7/6/10 Mayor Johnson said the public comment period is limited to a total of 15 minutes and individuals are limited to two minutes each according to the rules approved in February of 2004 by the City Council. John Krause of 227 Grand Avenue stated he notice the Mayor’s agenda has an amendment to the contract for legal services for the zoning ordinance. That contract was approved in December 2008 or January 2009. The deputy mayor thought the mayor would give a status update on that project last fall. He asked that when this item is addressed on the agenda that the mayor provide some specific information. Kathy Garrison, the capital region president of CSEA stated she represents the workers at City Hall and the Department of Public Works along with about 45,000 other workers in her jurisdiction. Over the past 10 years since she has held this position, she has never seen a unit of government spend money in a time of financial crisis to block her from addressing elected officials. About a week and a half ago she sent all the commissioners a letter asking for their support for CSEA members to obtain a fair contract. She also shared some of their frustrations regarding the extended process and some of the unfair obstacles the mayor has placed before them. One of the complaints she shared with all of them is that the mayor chose to hire a law firm to block our attempts at a fair contract. They believe that the cost of the lawyers and the savings that could have been realized by some healthcare concessions could have exceeded the cost of the new bargaining agreements. She is curious how much the City had to pay to try to block her right to speak here tonight. She thinks they all can agree that a budget for the City should reflect the priorities for those of you who are elected. Unfortunately the mayor of the City has shown the workers who make this City run no respect for their work or the services they provide. It is truly amazing that the mayor has prioritized some bricks and mortar that residents will soon call a recreation center with no regard to the people who actually have to work there and maintain the property. She guesses the ribbon cutting ceremony on the 27th will be interesting. Back to why she wrote to all of them; simply…. Mayor Johnson advised Ms. Garrison she has about 30 seconds remaining of her 2 minutes allotted. Ms. Garrison went on to say…..because we need your help. She told the mayor she is almost done. Mayor Johnson advised Ms. Garrison she was down to 15 seconds. Ms. Garrison continued to speak stating the mayor’s law firms correctly sites the City’s charter with regards to the sole authority the mayor has for negotiating collected bargaining agreements. That might be his right but they would argue that by keeping out the rest of the City’s elected commissioners does a disservice not only to those workers under their jurisdiction but also to the taxpayers of the City. How does a mayor who is an attorney effectively understand the nuances involved in the Department of Public Works. She thinks the elected… Mayor Johnson advised Ms. Garrison that her time was up 2 times. Ms. Garrison continued to speak saying……leaders should be part of this process because the long range approach… Mayor Johnson ‘gaveled’ Ms. Garrison and told her she was out of order. Ms. Garrison continued to speak over the mayor and continued her sentence stating…..that the mayor has taken is obviously…  Audio feed was turned off at this point. When it was turned back on, Mayor Johnson advised Ms. Garrison that she was in blatant disregard of the collective bargaining process by her comments this evening; they are both untrue and fallacious to the point of being absurd. Ms. Garrison yelled from her seat to the mayor that public comment period is not really a debate. She said to him that he has his lawyers and they have letters from lawyers back and forth because they asked for a fair contract. She told the mayor he has blatant disregard for the workers in this City and you are putting Page 4 of 14 City Council Meeting 7/6/10 the taxpayers in this City at risk and liability. You can’t just unilaterally change health care coverage when someone has a pre-existing condition and a treatment plan that may not be covered by the new policy. Mayor Johnson stated that Ms. Garrison was not at a single negotiation session that he attended with CSEA. Al Callucci of 9 Lexington Road stated there is a 1992 state law that governs those contracts and pre- existing conditions would have to be included in any new health plan. We are three weeks away from the ‘prime time’ and we are behind schedule. The public is willing to help. A couple people have volunteered to help clean the algae. He has found that triploid grass-eating carp would take care of the algae and are very inexpensive - $18 each. The contact person at the County is John Hamilton. After 5 years the carp would have to be retired and another bunch brought in. Mayor Johnson closed the public comment period at 7:12 p.m. PRESENTATIONS Recognition of Robert Mitchell, Director of Saratoga County’s Veteran’s Service Agency Supervisor Yepsen stated Robert Mitchell has served as the director of Saratoga County’s Veteran’s Service Agency for 22 years. He retired after 35 total years of service at the County. He has done an unbelievable job at the County to bring veterans to us. She thanked Mr. Mitchell for his service. He has advocated and navigated the veteran’s system. Mr. Mitchell also visited a different American Legion Post each month in Saratoga County to update them on the latest information from the VA. She thanked him for his help with the Guardian House and presented Mr. Mitchell with a Guardian House pin. Supervisor Veitch stated he has enjoyed working with Mr. Mitchell. He thanked him for all he has done. Mr. Mitchell thanked everyone. He stated serving as director was a privilege. He thanked the veterans and their families. Commissioner Wirth thanked Mr. Mitchell for his experience and for what he has done and accomplished for the City. Mayor Johnson expressed gratitude on behalf of the Council. City Center Authority Annual Report Mr. Baker presented hard copies of the 2009 City Center Authority Annual Report to the Council. They had the ground breaking of their current addition in September 2009. They have been able to continue to host events during the construction. They ended the year 5.1% ahead in revenues from what was budgeted, they also transferred less out of their savings of the room occupancy tax – 20.4% less was brought into the operating year, expenses were 4.5% less than budgeted, and they ended the year with a balance of $12,000. That balance had over $33,000 of construction expenses into their operating expenses that could not be pulled out and put into the construction fund. They did see a decrease in the number of people attending events but hosted more events in 2009 than in 2008. In the end 2009 was a solid year. Mayor Johnson commended Mr. Baker on keeping the center open and operating smoothly through the construction process. Stormwater Management Program Annual Report Al Flick presented the Council with a copy of the Stormwater Management Program Report. He explained an annual report is required. What they are trying to do is maintain the quality of the water bodies around Saratoga Springs. Stormwater has been identified as one of the leading causes of water pollution around Page 5 of 14 City Council Meeting 7/6/10 the United States. This is their 7th annual report; they filed a joint report with Saratoga County this year. The County has taken care of the public education and awareness while the City is handling the construction industry and administers our own discharge and good house keeping program. DEC re-issued permits this year and now run for 5 years. In the past permits were issued on a yearly or biannual basis. The MS-4 permit has Lake Lonely listed as an impaired water body for phosphorus and pathogens. The state is saying by 2013 we have to come up with a plan to deal with pollutants of concern. The permit for the construction industry states anyone in the excavating business has to have trained staff. Another part of the construction permit is to push better site design of projects to reduce stormwater run-off. They want to keep in on site versus discharging it. As DEC defines permits they keep adding work to it. We are required by law to keep the pace on the work they add. The problem right now is funding. There is additional information regarding the stormwater program on the City website. Paul Male advised a stormwater pollution plan had to be done for the recreation center. There is an underground system at the new recreation center which is the first one the City owns. Executive Session Mayor Johnson moved and Commissioner Franck seconded to move to executive session for discussion regarding proposed, pending or current litigation; personal private information of a person or corporation, or matters leading to the appointment, employment, promotion, demotion, discipline, suspension, dismissal or removal of a person or corporation, including and update on the Anderson case at 8:36 p.m. Ayes - All Council returned from session at 9:04 p.m. Mayor Johnson advised no decisions were made in executive session; therefore there is nothing to report to the public. This will be held this Friday, July 9th at the East Side Rec. The grant amount is $3,500 and is open to all youth in Saratoga County. Mayor Johnson moved and Commissioner Wirth seconded to authorize the mayor to sign the contract as described. Ayes – All Discussion and Vote: Accept Donation, Eagle Scout Project (10-181) Linda Terricola advised that Ben Spingarn has contacted them to donate the building and installation of 5 benches as the new recreation facility. This is part of Ben’s project for the Eagle Scouts. Marilyn Rivers has reviewed the specs. Mayor Johnson commended the Eagle Scouts on this project. Moved Johnson moved and Commissioner Ivins seconded to accept the donation as described. Ayes - All Discussion and Vote: School Bus Contract for Camp Saradac (10-182) Linda Terricola stated this is an annual agreement. The number of trips has been reduced to 6 this year. The cost is less than last year - $25 per bus per day and mileage is $.93 per mile. The transportation will begin this Friday. Mayor Johnson moved and Commissioner Wirth seconded to accept the contract as described. Ayes - All Discussion and Vote: Authorization for Mayor to Sign Change Order for Spring Run Trail (10-183) Paul Male, city engineer advised the original contract was for $1.6 million. This change order is for a decrease of $51.49. A number of quantities were decreased and a couple were increased; all changes resulted in the decrease of $51.49. Mayor Johnson moved and Commissioner Ivins seconded to authorize the mayor to sign the change order. Ayes - All Discussion and Vote: Authorization for Mayor to Sign Agreement with Almost Uncommon for Saratoga Springs Summer Concert Series (10-184) Mayor Johnson stated the contract is for 2 dates – July 11th and July 25th in Congress Park. The agreement is for $150. Mayor Johnson moved and Commissioner Wirth seconded to authorize the mayor to enter into the agreement as described. Ayes – All Page 7 of 14 City Council Meeting 7/6/10 Discussion and Vote: Authorization for Mayor to Sign Agreement with Sonny and Perley for Saratoga Springs Summer Concert Series (10-185) Mayor Johnson stated the dates for this concert is July 18th for $300. Mayor Johnson moved and Commissioner Wirth seconded to authorize the mayor to enter into this agreement. Ayes - All Discussion and Vote: Authorization for Mayor to Amend Contract for Professional Legal Services for City of Saratoga Springs Zoning Ordinance Amendment or Re-codification (10-186) Mayor Johnson stated this is for the firm Miller, Mannix, Schachner, and Hafner. This is for the continuation of the review of the zoning ordinance that began last year. They are using as much in-house staff as possible to reduce legal costs. The zoning ordinance was adopted in 1990 and has been amended over 300 times since then. There has been a chapter by chapter review of the ordinance. The zoning advisory group did a draft revised table of contents. The hourly rate for this firm is $160/hour and will be capped at $4,295 which is in the budget. Commissioner Franck confirmed the law firm is giving guidance. Mayor Johnson stated they do review what our staff does. At some point we need the legal analysis that helps us get through the process. Mayor Johnson moved and Commissioner Wirth seconded to authorize the mayor to enter into this amended agreement. Ayes - All Discussion and Vote: Invoice for General Labor Matters (10-187) Mayor Johnson stated Harris Beach has been on a monthly retainer basis to provide general labor advice. The invoices before the Council start in February 2010 and run through June 2010 for a total of $10,000 (the retainer amount of $2,000 per month). Purchase requisitions were not obtained therefore these invoices must be approved by Council for payment. Mayor Johnson moved and Commissioner Wirth seconded to authorize the payment of these invoices. Commissioner Franck explained this type of scenario occurred a couple meetings back with DPW. He has to vote against this as the proper procedure wasn’t followed and if he voted for this he would be breaking his own office rules. Ayes – 4 Nays – 1 (Commissioner Franck) Discussion and Vote: Authorization for Mayor to Sign Agreement with Saratoga Springs Preservation Foundation for Racetrack Inventory (10-188) Mayor Johnson stated this is agreement between the City and the Preservation Foundation for their performance to assist with the inventory of the race track. The amount is $10,000 being paid to the City from the Saratoga County IDA and then the City will reimburse the Preservation Foundation for their performance. Page 8 of 14 City Council Meeting 7/6/10 Mayor Johnson moved and Commissioner Wirth seconded to authorize the mayor to enter into this agreement with the Preservation Foundation. Ayes - All Discussion and Vote: Resolution Authorizing Waterfront Park EPF Application (10-179) Mayor Johnson stated this resolution authorizes the City to apply for further funding through the NYS Office of Parks, Recreation and Historic Preservation for improvements to the Waterfront Park. We received $200,000 matching grant from the state last year. This is to keep the application process moving in case we decide to continue to develop this land. The amount is not to exceed $400,000. The funding for our portion of this is within the Open Space Bond Act and will address that issue when the time comes. Mayor Johnson moved and Commissioner Wirth seconded to adopt the resolution. Commissioner Scirocco asked if this comes with any restrictions. Mayor Johnson stated the money must be used for this parcel. This project was set forth in phases due to the overall expense. The goal is to develop the parcel in accordance with the landscape plan done by the City. Commissioner Ivins confirmed this approval is pushing forward the application process and not appropriating any funds. He asked if we have a time period of when we will hear a response. Mayor Johnson stated no funds are being appropriated. The timeframe of response is not going to be quick. Commissioner Ivins stated he is going to vote for this and hope the economy is ‘rounding the corner’ and the City will be in a better financial state. We will have to look at the finances of the City at that time and determine if it is viable. Ayes - All Discussion and Vote: Permission to Hire a Temporary Part Time Data Entry Clerk to Work on the Heritage Area Management Plan Update (10-189) Mayor Johnson stated there is a need to review the Heritage Area Management Plan. It is estimated it will take 8 – 12 weeks to complete and the rate per hour is $12 - $15 per hour. The item is within his budget. He advised there was a $10,000 grant received which will help fund this. Mayor Johnson moved and Commissioner Wirth seconded to hire for the Heritage Area Management Plan update. Ayes - All ACCOUNTS DEPARTMENT Award of Bid: Traffic Control Signal Design and Engineering to Creighton Manning Engineering (10-190) Commissioner Franck moved and Commissioner Wirth seconded to award the bid for Traffic Control Signal Design and Engineering to Creighton Manning in the amount of $11,500. Commissioner Franck stated Creighton Manning was the second lowest bidder. The lowest bidder failed to provide the requested information. (10-191) Commissioner Franck moved and Commissioner Scirocco seconded to award the bid for Chemicals to Slack Chemical Company for phosphate (30/70 blend), Thatcher Company for sodiumsilico fluoride and copper sulfate, and Koester Associates, Inc., for phosphate (23/77 blend) for various prices. Ayes - All FINANCE DEPARTMENT Discussion and Vote: Annual Update Finance Policies and Procedures Manual (10-192) Commissioner Ivins moved and Commissioner Franck seconded to approve 4 of the 6 parts of the annual updates to the Finance Policies and Procedures Manual. Commissioner Ivins stated he is pulling the third party agreement and the custodial agreement at this time. Franck seconded. Ayes - All Discussion and Vote: Annual Internal Controls Update (10-193) Commissioner Ivins moved and Commissioner Wirth seconded to approve the update to public safety, Visitor Center, and recreation internal controls as previously distributed to the Council. Commissioner Ivins advised the changes to public safety changes were requested and approved by the department. The Visitor Center has not had an update for a long time and was needed as cash is being handled for tours. This was approved by the Mayor’s Department. The recreation updates incorporates practices and needs for the new recreation center. This was approved by the Recreation Department. Ayes – All Discussion and Vote: Accept Donations – Saratoga’s All-American Celebration (10-194) Commissioner Ivins moved and Commissioner Franck seconded to accept the donations for the All-American Celebration. Commissioner Ivins stated donations were: $500 from the Downtown Special Assessment District, $100 from Grey Gelding for barbeque fest registration, $100 from the Universal Preservation Hall, $100 from Lillian’s Restaurant, $100 from the Saratoga Downtowner, $250 from Clough Harbour Associates, $250 from Saratoga Honda, $100 from Roohan Realty, $100 from Breadbasket Bakery for desert registration, $685 in car show and other donations for a total of $2,285. Commissioner Ivins thanked all who contributed to the event. Commissioner Franck also thanked all who worked on the celebration. Also, the fireworks were great. Ayes - All Discussion and Vote: Department of Public Works Payroll Transfers (10-195) Commissioner Ivins moved and Commissioner Scirocco seconded to approve the Department of Public works payroll transfers as previously distributed to the Council. Page 10 of 14 City Council Meeting 7/6/10 Commissioner Ivins stated these were transfers from capital outlay to labor, overtime and social security lines to core area mobility infrastructure projects. Ayes - All Discussion and Vote: Department of Public Safety Payroll Transfers (10-196) Commissioner Ivins moved and Commissioner Wirth seconded to approve the Department of Public Safety payroll transfers as previously distributed to the Council. Commissioner Ivins stated these were transfers to August traffic control and dispatch clothing allowance lines, transfers from sergeants, police chief, police captains, investigators, and public safety dispatchers’ lines. Ayes - All Discussion: City Finances Commissioner Ivins stated the governor is taking part of the AIM funding; it was reduced by 5% or $89,000. The budget has been amended and is reflected in the consent agenda tonight with a revenue transfer to sales tax. The projections are that sales tax is going to exceed the budget by $89,000. Commissioner Ivins stated they have received responses from approximately half the employees who are eligible for retirement. He will be sharing the numbers with the Council soon so a decision can be made before the deadline at the end of August. PUBLIC WORKS DEPARTMENT Discussion and Vote: Authorization for Mayor to Sign Contract with CT Male (10-197) Commissioner Scirocco advised 3 proposals were received to design the reconstruction of the waterline on Beekman Street. CT Male was the lowest at $27,400. Under this proposal, they will design the waterline and prepare the specifications for the project. He hopes to have this project start after Labor Day. The project will go from West Circular Street to Church Street. Commissioner Scirocco moved and Commissioner Franck seconded to authorize the mayor to sign the contract with CT Male in the amount of $27,400. Ayes - All Discussion and Vote: Putnam Street Parking Deck – Debrino Caulking Contract (10-198) Commissioner Scirocco stated the Putnam Street parking deck is in need of complete cleaning and maintenance. They received quotes from 2 companies of which Debrino was the lowest bidder at $8,100. Commissioner Scirocco moved and Commissioner Wirth seconded to authorize the mayor to sign the contract with Debrino Caulking in the amount of $8,100. Ayes – All *Commissioner Scirocco announced he received a letter from a resident regarding the intersection of Grand Avenue and Birch. He would like to have the City engineering staff work with Public Safety to figure out a way to put a 4 way stop in or something to mitigate the issues in that area. The DPW staff can do Page 11 of 14 City Council Meeting 7/6/10 some of the work. He would also like to investigate if there is funding, maybe through the capital account. He will be working on this over the next couple of weeks. PUBLIC SAFETY DEPARTMENT Discussion and Vote: Authorization for Mayor to Sign Agreement with County for Stop DWI Program (10- 199) Commissioner Wirth stated each year the City receives funds from the County of Saratoga to pay for overtime associated with DWI patrols. The funds from 2009 helped in producing 314 DWI arrests. Commissioner Wirth moved and Commissioner Scirocco seconded to authorize the mayor to sign an agreement with Saratoga County to receive the funds for the DWI patrols in 2010. Ayes - All Discussion and Vote: Authorization for Mayor to Sign Bulk Purchasing Agreement with Albany Fire Dept. (10-200) Commissioner Wirth stated in March of this year Deputy Commissioners Boxley and Dudla met with the Albany Fire Department pertaining to the bulk purchasing of fire equipment to save the City money. The primary purpose is to purchase goods at a reduced rate. The agreement has been reviewed by finance and the City Attorneys Office. Commissioner Wirth moved and Commissioner Franck seconded to authorize the mayor the sign this agreement. Commissioner Ivins asked what the difference is between this agreement and the state contract. Deputy Commissioner Dudla stated this is an agreement more than it is a contract. We are not bound by this agreement; if a lower price is found we can go that route. Ayes - All Discussion and Vote: Authorization for Mayor to Accept Donation of $16,000 from NYRA to Assist in Paying for the Positions Needed for Traffic Control at the Race Track for the 2010 Meet (10-201) Commissioner Wirth stated for years public safety has hired summer help. Deputy Commissioner Dudla met with NYRA and was able to obtain $16,000 to cover the cost of traffic control for the race track. He thanked Deputy Commissioner Dudla for his efforts in obtaining this money. Commissioner Wirth moved and Mayor Johnson seconded to accept the donation of $16,000 from NYRA. Commissioner Ivins confirmed this money is above and beyond the reimbursement for fire. Commissioner Wirth stated that is correct. Ayes – All Discussion and Vote: Council to Approve the Hiring of Temporary Positions for Traffic Control at the Race Track for the 2010 Meet (10-202) Commissioner Wirth stated there are 9 part time seasonal temporary people they will be hiring at a rate of $10.50 per hour. SUPERVISORS Joanne Yepsen Announcing: September 25 Air Force Band of Liberty Concert at SPAC Supervisor Yepsen reported the Air Force Band of Liberty will be performing as SPAC this year at 3 p.m. Tickets will be available at City Hall when printed. The concert is free of charge. Invitation: Fredrick Allen Lodge 3rd Annual Fashion Show: Sunday, July 11 at 3:30 p.m. Beekman Street Supervisor Yepsen reported a fashion show will be held on Beekman Street Sunday, July 11th. Beekman Street will be closed. Fasig-Tipton / Senate Bill on Auctions Supervisor Yepsen reported a bill was passed on the state level that would affect auctions in New York State. When this bill was introduced it did not take into account horse auctions and how they are handled. They were able to get the language changed in the bill to exclude horses. The bill that was passed will affect and regulate art auctions only. The Impact and Future of Racing on Saratoga Springs Supervisor Yepsen reported she is going to try to pull community leaders together later this month to be prepared for next year’s meet. Matt Veitch Public Safety Committee Mid-Year Update Supervisor Veitch reported there have been 20 resolutions in this committee totaling $1,575,753.58 of which $376,473 was re-appropriations from 2009. They did bond $11.8 million dollars for the County radio system. Social Programs Committee Mid-Year Update Supervisor Veitch reported there have been 6 resolutions to date totaling $1,063,370.00. There were no re-appropriations this year – all new money. Public Works Committee Mid-Year Update Supervisor Veitch reported there were 3 resolutions this year. There were re-appropriations for bridge work and $118,000 in new grants for the Geyser Road bridge. Page 13 of 14 City Council Meeting 7/6/10 Saratoga County Chamber of Commerce Available Free Services Supervisor Veitch reported he received a letter from Joe Dalton last week regarding free services available to the public. These services can be found on the Chamber’s website at www.saratoga.org. Someone looking for a full, part time, or volunteer job can register their availability on their job zone for free. Saratoga’s All-American Celebration 2010 Supervisor Veitch reported he enjoyed chairing this event. The event was named in honor of Private Taylor Miller, whose mom has served on this committee for the past 3 years. The events came together well, everyone had a great time, and the fireworks were great. He thanked Commissioner Ivins, Deputy Commissioner Jarosh and all the committee members.
