CALL TO ORDER Mayor Yepsen called the meeting to order at 1:21 p.m. PUBLIC COMENT Page 3 of 6 City Council Meeting 12/31/14 Mayor Yepsen said the public comment period is limited to a total of 15 minutes and individuals are limited to two minutes each according to the rules approved in February of 2004 by the City Council. Mayor Yepsen opened the public comment period at 1:22 p.m. Bonnie Sellers of 73 Fifth Avenue requested a lot of garbage cans be put on Broadway for tonight’s events. Commissioner Scirocco advised they have it covered. Mayor Yepsen closed the public comment period at 1:23 p.m. CONSENT AGENDA Nothing at this time. MAYOR’S DEPARTMENT Nothing at this time. ACCOUNTS DEPARTMENT Nothing at this time. FINANCE DEPARTMENT Discussion and Vote: Budget Amendments (Increases) (14-500) Commissioner Madigan moved and Commissioner Mathiesen seconded to approve the 2014 budget amendments (increases) which were distributed with the agenda. Ayes – All Discussion and Vote: Budget Amendments (Decreases) (14-501) Commissioner Madigan moved and Commissioner Scirocco seconded to approve the 2014 budget amendments (decreases) which were distributed with the agenda. Ayes – All Discussion and Vote: Budget Amendments – Interfund (14-502) Commissioner Madigan moved and Commissioner Scirocco seconded to approve the 2014 budget amendments – interfund which were distributed with the agenda. Ayes – All Discussion and Vote: Budget Transfers – Regular (14-503) Commissioner Madigan moved and Commissioner Mathiesen seconded to approve the 2014 budget transfers – regular which were distributed with the agenda. Ayes – All Discussion and Vote: Budget Transfers – Benefits (14-505) Commissioner Madigan moved and Commissioner Franck seconded to approve the 2014 budget transfers – benefits which were distributed with the agenda. Ayes – All Discussion and Vote: Budget Transfers – Interfund (14-506) Commissioner Madigan moved and Commissioner Franck seconded to approve the 2014 budget transfers – interfund which were distributed with the agenda. Ayes – All Discussion and Vote: Budget Transfers – Revenue (14-507) Commissioner Madigan moved and Commissioner Franck seconded to approve the 2014 budget transfers – revenue which were distributed with the agenda. Ayes – All PUBLIC WORKS DEPARTMENT Discussion and Vote: Authorization for the Mayor to Sign Agreement with Fitzgerald, Morris, Baker, Firth, PC (14-508) Commissioner Scirocco advised this contract is for legal services related to the City’s municipal water system and to include services already provided. Commissioner Scirocco moved and Commissioner Mathiesen seconded to authorize the mayor to sign an agreement with Fitzgerald, Morris, Baker, Firth, PC for the provision of municipal water legal services for an amount not to exceed $15,000. Funding is in line F3638314 / 54720. Mayor Yepsen asked what the relation this contract has to the landfill as the landfill is mentioned in the contract. Commissioner Madigan advised that piece of the contract should be removed. This does not relate to the landfill. Mayor Yepsen asked what exactly are the legal services needed related to water. Commissioner Scirocco advised this is for water connection fees. Stephani Voigt, assistant purchasing agent, stated she asked this contract to be done to comply with the purchasing policy and to confirm it will be paid for out of DPW’s budget. Page 5 of 6 City Council Meeting 12/31/14 Mayor Yepsen confirmed that the motions stands with the understanding that the piece regarding the landfill will be removed from the contract. Council agreed. Ayes - All PUBLIC SAFETY DEPARTMENT Nothing at this time. SUPERVISORS Nothing at this time. EXECUTIVE SESSION Mayor Yepsen moved and Commissioner Mathiesen seconded to adjourn to executive session regarding potential litigation at 1:36 p.m. Ayes - All The Council returned at 1:53 p.m. Mayor Yepsen announced nothing resolved in executive session to report to the public.
