CALL TO ORDER
Mayor Yepsen called the meeting to order at 1:21 p.m.

Mayor Yepsen said the public comment period is limited to a total of 15 minutes and individuals are
limited to two minutes each according to the rules approved in February of 2004 by the City
Council.
Mayor Yepsen opened the public comment period at 1:22 p.m.
Bonnie Sellers of 73 Fifth Avenue requested a lot of garbage cans be put on Broadway for tonight’s events.
Commissioner Scirocco advised they have it covered.
Mayor Yepsen closed the public comment period at 1:23 p.m.

budget amendments (increases) which were distributed with the agenda.

PUBLIC WORKS DEPARTMENT
Discussion and Vote: Authorization for the Mayor to Sign Agreement with Fitzgerald, Morris, Baker, Firth,
PC (14-508)
Commissioner Scirocco advised this contract is for legal services related to the City’s municipal water
system and to include services already provided.
Commissioner Scirocco moved and Commissioner Mathiesen seconded to authorize the mayor to
sign an agreement with Fitzgerald, Morris, Baker, Firth, PC for the provision of municipal water
legal services for an amount not to exceed $15,000.
Funding is in line F3638314 / 54720.
Mayor Yepsen asked what the relation this contract has to the landfill as the landfill is mentioned in the
contract.
Commissioner Madigan advised that piece of the contract should be removed. This does not relate to the
landfill.
Mayor Yepsen asked what exactly are the legal services needed related to water.
Commissioner Scirocco advised this is for water connection fees.
Stephani Voigt, assistant purchasing agent, stated she asked this contract to be done to comply with the
purchasing policy and to confirm it will be paid for out of DPW’s budget.

Mayor Yepsen confirmed that the motions stands with the understanding that the piece regarding the
landfill will be removed from the contract.

EXECUTIVE SESSION
Mayor Yepsen moved and Commissioner Mathiesen seconded to adjourn to executive session
regarding potential litigation at 1:36 p.m.

The Council returned at 1:53 p.m.
Mayor Yepsen announced nothing resolved in executive session to report to the public.
ADJOURNMENT
There being no further business, Mayor Yepsen adjourned the meeting at 1:54 p.m.
