PUBLIC HEARINGS New City Code Chapter #205 – Street Performances Mayor Yepsen opened the public hearing at 6:55 p.m. Mayor Yepsen stated this was presented a couple weeks ago. Many people expressed strong feelings of how to make the arrangements work downtown. There was input from downtown businesses and artists. She thanked everyone for all the input. This version is improved but may not be finished. A meeting was held last week to gather input. Page 4 of 15 City Council Meeting 4/21/15 Tony Izzo, assistant city attorney, stated this ordinance has been changed a number of times. The current version should not have any reference to licensing. It is a regulation only ordinance. Points that are still up for discussion are distance between performers, the decibels, and times of performances. Roger Borgen of Railroad Place stated he is here to express the concerns of another magician (Steve Brundige) who couldn’t be here tonight. They are concerned about the distance between performers is too much. The time stated seems to be a noise issue and not a performance issue. Section M seems to be the main issue regarding traffic issues. That may be the solution to the space. Mary Carr of Saratoga Springs stated her son was a busker and used that to pay his way through college. They are not doing anything illegal. If it is not broke don’t fix it. They add to the beauty and charm to this City. Linda Letendre of Greenfield Avenue stated she is happy to see the licensing taken out. Building a sense of community could go a long way. Why not move some of the people to other streets to draw attention there? John Carrusone stated the Saratogian misreported the 10 foot rule. They have it reversed. Darlene McGraw of Saratoga Springs stated as long as they are staying out of trouble and keeping quiet, that’s what we want. Joy King of 6 Marion Avenue stated she enjoys hearing all the sounds during the summer. She doesn’t want too many restrictions on street performers. She sees it as a positive thing and keeps some citizens out of trouble. People could be spaced out on side streets. It is a unique treasure to Saratoga. Peter Copoletti of Saratoga Springs stated he lives on Broadway. They do support the buskers but they are asking the Council to reconsider the time; they need to share the space. He also asked that the 80 decibel level be kept. Mayor Yepsen end the public hearing at 7:16 p.m. and left it open. . CALL TO ORDER Mayor Yepsen called the meeting to order at 7:16 p.m. PUBLIC COMENT Mayor Yepsen said the public comment period is limited to a total of 15 minutes and individuals are limited to two minutes each according to the rules approved in February of 2004 by the City Council. Mayor Yepsen opened the public comment period at 7:17 p.m. Phil Diamond of 55 Railroad Place stated he is the chair of Concerned Citizens for Homeless Veteran’s read a letter into the record (attached). They donated $350 to reimburse VetHelp for the cost of the rental of the Music Hall for their fundraiser. Cliff Ammon of Saratoga Springs stated he is a veteran. He would hope his City Council would show compassion to people who are in dire straits (particularly veterans) unlike the County who showed no compassion to the seniors who were thrown out of the nursing home. Page 5 of 15 City Council Meeting 4/21/15 Darlene McGraw of Saratoga Springs thanked the Council for making it so they don’t have to give their specific address during public comment period. She asked the Council not to bicker tonight; she doesn’t want to listen to it. She asked for a moment of silence for crime victims. Marcie Taylor of 49 Doten Avenue stated there has been talk about Commissioner Mathiesen’s ability to bring civility back to Council meetings. When she heard that, she didn’t understand it was the lack of the public’s civility. With the new ‘civility rule’, the Council can rebut what is said during public comment with no time limit. The new rules don’t enhance civility and gives the Council the last word. She suggested they review the webcasts for the past year to see how they act rather than how the public acts. Mary Carr of Saratoga Springs stated she doesn’t find any of this funny that the Council is looking at them like they are stupid. We need a city that works. Mayor Yepsen closed the public comment period at 7:28 p.m. Commissioner Mathiesen stated the rules of conduct have been in place since 2004. They have a right to respond to comments made to the City Council. He brought up the rules of conduct to make sure everyone’s rights are protected. He also stated everyone here has respect for veterans and would personally be happy to make a contribution to cover that cost. If policies are changed now for one group it opens the door for other groups. There is a limitation and there are costs involved to the City and the tax payers. Commissioner Madigan stated this is not about any one specific non-profit. The event had already taken places; we don’t typically offer a waiver of fees after the event has taken place. Commissioner Scirocco stated he met with the veterans and they signed a contract with full expectation to pay. It was after the fact that they asked for the fee to be waived. He takes the comment as an insult that he doesn’t care about veterans. Mayor Yepsen advised she was invited to participate in a press conference yesterday. The pledge she signed with the White House and VetHelp; they have identified 21 homeless veterans in Saratoga Springs. They have found permanent homes for 18 of them. VetHelp comes in every Tuesday for free to help veterans. She will add the donation to her agenda. (15-111) Ayes – All Mayor Yepsen moved and Commissioner Franck seconded to accept the donation of a centennial plaque valued in the amount of $32 which is being provided to the Council by Roger Goldsmith of Crafters Gallery. (15-112) Ayes – All Mayor Yepsen moved and Commissioner Franck seconded to add an item to her agenda to accept the generous donation of $350 from Mr. Diamond to help defer the costs the City has charged VetHelp. (15-113) Ayes – All Mayor Yepsen moved and Commissioner Madigan seconded to accept $350 from the Concerned Citizens to help defer the costs of the VetHelp fundraiser in the Music Hall. (15-114) Ayes - All Presentation: City Center Authority Annual Report Mark Baker, president of the City Center Authority, reported most of the community involvement centered around the 30th anniversary of the City Center. They presented a historic review of the City Center and hospitality within Saratoga. They had over 157 events in 2014 compared to 148 in 2013. The building was occupied 314.5 days; 86% occupancy. Over $29 million dollars was generated in sales; $2 million in sales tax. This eliminates almost $600 off each property tax payer. They continue to book multiple events for multiple years out. They had a $1.5 million dollar budget and the catering revenue was $158,542. Commissioner Scirocco thanked Mark and his staff for the job they do. They help make the City the destination we are. There would be a void without them. Commissioner Mathiesen stated the City Center has been a great host to the Dental Society. He wished them well. Commissioner Madigan stated the City Center is one of the economic drivers of this city. She congratulated the City Center on their record year. Commissioner Franck stated thanked the City Center for all they do. Mayor Yepsen stated she gets to here the updates monthly as an ex-officio of the board. She thanked Mr. Baker for being here to share the information. Announcement: Human Resources Administrator Mayor Yepsen announced Kate Amello will be joining the City as the human resource administrator. This position has been difficult to fill and feel they have found the right person for the job. Kate brings a significant amount of experience to this position. She worked in human resources at Boston Medical Center, Catholic Dioceses in Albany, and Prime Care Physicians. Her start date is Monday, May 11th. Page 7 of 15 City Council Meeting 4/21/15 Mayor Yepsen thanked Pinnacle, specifically Carl Gonzales and Derrick Holmes for their assistance during this transition. Discussion and Vote: 2015 Community Development Block Grant Allocations (15-115) Mayor Yepsen advised she will be asking the Council to approve the Committee recommendations Rich Ferguson presented at the March 3rd meeting. Rich Ferguson advised of the following recommendations for the 2015 Community Development Block Grant:  Shelters of Saratoga for $20,000  Wellspring – Emergency Shelter Counselor for $7,500  Catholic Charities – Saratoga Mentoring Program for $7,500  Legal Aid Society Homelessness Prevention Project for $7,500  Saratoga Springs Recreation Department – Camp Saradac Scholarship for $2,500  Saratoga Affordable Housing Group – Rehabilitation Allen Drive Apartments for $74,209  Habitat for Humanity – Affordable Housing Construction for $50,000  Mother Susan Anderson Emergency Shelter – Rehabilitation Project for $35,000  Department of Public Works – Senior Center Drainage Project for $30,000  Saratoga Hospital – Community Health Care Handicap Accessibility for $15,000  Department of Public Works – Infrastructure Improvements for $15,000  Rebuilding Together Saratoga County - Housing Rehabilitation for $10,000  Community Development Program Administration for $68,486 Brad Birge advised applications are released to the public each year and then the advisory committee reviews the requests. This is their recommendation. Mayor Yepsen moved and Commissioner Franck seconded to approve the recommendations of the Community Development Citizen Advisory Committee for the 2015 CDBG funding as listed in the April 17, 2015 memorandum from the administrator of planning and economic development to the City Council. Ayes - All Discussion and Vote: Authorization for Mayor to Sign Lease Assignment for Lena Lane (15-116) Mike Toohey, attorney for the new owners, stated there is a stipulation in the lease agreement that if one of the properties was sold, the new party could continue with this lease with approval from the City Council. The 7 Horse Pub has been sold and the new owner is going to continue running it as a restaurant and pub. Mayor Yepsen moved and Commissioner Scirocco seconded to authorize the mayor to sign a lease assignment for Lena Lane. Ayes - All Discussion and Vote: Authorization for Mayor to Sign Contract with NYSERDA for Solarize Saratoga (15- 117) Mayor Yepsen advised the City has been awarded a $5,000 grant to begin the Solarize Saratoga Program. This program will be headed up by the Climate Smart Community Task Force. Raina Coldwell, former chair of the task force, stated they will send out their request to installers this week. There will be a public meeting on May 5th for all interested citizens and business owners. If a resident chooses the vendor selected by the task force the resident will receive a discount. The vendor will be from a vetted list provided by NYSERDA. Page 8 of 15 City Council Meeting 4/21/15 Commissioner Madigan asked if this would interfere with anything our land use boards do. Raina advised people will still need to comply with all regulations of the City. Commissioner Madigan asked if there are any legal implications. Raina advised there is a hold harmless clause in the contract with the vendor. Mayor Yepsen moved and Commissioner Madigan seconded to authorize the mayor to sign a contract with NYSERDA for Solarize Saratoga Program in the amount of $5,000 as distributed with the agenda. Ayes – All Discussion and Vote: Accept Donation from Putnam Market for April 7th Centennial Celebration (15-118) Mayor Yepsen advised Putnam Market supplied snacks for the centennial celebration. Mayor Yepsen moved and Commissioner Madigan seconded to approve the donation of in-kind services from Putnam Market in the amount of $161.42 which was provided at the centennial event on April 7, 2015. Ayes – All Discussion and Vote: Accept Donations for Summer Concert Series (15-119) Mayor Yepsen advised one donation is from the Stewart’s Shops in the amount of $500 and the other is from the Adirondack Trust in the amount of $500. Mayor Yepsen moved and Commissioner Franck seconded to accept these donations in support of the City’s summer concert series; one from Stewart’s Shops in the amount of $500 and the other from the Adirondack Trust Company in the amount of $500. Ayes – All Discussion and Vote: Authorization for the Mayor to Sign the 2015 State of New York Department of Health Renewal Application for a Permit to Operate Camp Saradac (15-120) John Hirliman, administrative director of the Recreation Department, advised this is a renewal application to operate Camp Saradac. Mayor Yepsen moved and Commissioner Franck seconded to authorize the mayor to sign the 2015 NYS DOH renewal application for permit to operate Camp Saradac. Ayes – All Discussion and Vote: Approval of the 2015 Camp Safety Plan (15-121) John Hirliman advised this is under annual review. This allows the risk and safety director to make any changes recommended after submission to the New York State Department of Health. Mayor Yepsen moved and Commissioner Franck seconded to approve the 2015 Camp Safety Plan. Ayes – All Page 9 of 15 City Council Meeting 4/21/15 Discussion and Vote: 2015 Camp Saradac Trip and Program Approvals (15-122) John Hirliman advised a list was supplied of their trips and programs. Mayor Yepsen moved and Commissioner Mathiesen seconded to approve the 2015 Camp Saradac trip and program approvals. Ayes – All Discussion and Vote: Accept Donations for the Recreation Department (15-123) John Hirliman stated the Saratoga County Children’s Committee donated $4,000, and George and Martha Parker donated $1,000. Mayor Yepsen moved and Commissioner Franck seconded to approve and accept the two donations as stated for the Recreation Department. Ayes - All Discussion and Vote: Authorization for the Mayor to Sign the 2015 Tri-City Contract for Camp Saradac (15-124) John Hirliman advised the Tri-City Valley Cats is requesting an agreement. Mayor Yepsen moved and Commissioner Scirocco seconded to authorize the mayor to sign the 2015 Tri-City contract for Camp Saradac. Ayes – All Discussion and Vote: Authorization for the Mayor to Sign the Great Escape 2015 Contract for Camp Saradac (15-125) John Hirliman advised the Great Escape is requesting an agreement and requires a $500 deposit. Mayor Yepsen moved and Commissioner Franck seconded to authorize the mayor to sign the Great Escape 2015 contract for Camp Saradac. Ayes – All Discussion and Vote: Authorization for the Mayor to Sign an Agreement with the Saratoga Casino and Raceway (15-126) John Hirliman stated this is an annual renewal to utilize their fields for the soccer program. We will provide them with a certificate of insurance. Mayor Yepsen moved and Commissioner Scirocco seconded to authorize the mayor to sign an agreement with Saratoga Casino and Raceway. Ayes – All Discussion and Vote: Authorization for the Mayor to Sign Agreement with Saratoga Pop Warner Football (15-127) John Hirliman advised this is a co-sponsorship of a flag football program. Ayes – All Discussion and Vote: NYS Office of Children and Family Services Funding Application 2015 (15-128) John Hirliman advised they are looking to submit to the NYS Office of Children and Family Services funding application. They work with the County Youth Bureau to obtain funding. Mayor Yepsen moved and Commissioner Franck seconded to authorize the Recreation Department to submit an application to the NYS Office of Children and Family Services funding application for 2015. Ayes – All Announcement: Saratoga Springs Recreation Department Programs & Registration John Hirliman announced all recreation programs can be found on line. Registration is open for Camp Saradac through May 17th. ACCOUNTS DEPARTMENT Discussion and Vote: Employee Request for 134 Hours from Sick Bank (15-129) Commissioner Franck advised there is an employee who is in need of 134 Sick Bank Hours. The CSEA City Hall unit has approved the use of these hours from the Sick Bank. Commissioner Franck moved and Commissioner Scirocco seconded to request 134 hours from the sick bank to be used in no shorter than two hour increments as currently stated in the union contract. Ayes - All Announcement: Grievance Class – May 7th Commissioner Franck announced they will be holding a grievance class again this year on Thursday, May 7, 2015 at 6:30 p.m. in the City Council Room. City residents are invited to attend to learn how to correctly fill out the application to grieve their assessments and understand the process. Grievance Day is Tuesday – May 26th. Award of Bid: Professional Conservation Services Spirit of Life to Daedalus, Inc. (15-130) Commissioner Franck moved and Commissioner Scirocco seconded to award the bid for Professional Conservation Services Spirit of Life to Daedalus Inc. for $36,500. Funding is line H3036952 / 52000 / 1039. Ayes - All FINANCE DEPARTMENT Page 11 of 15 City Council Meeting 4/21/15 Discussion and Vote: Determination of SEQRA for Proposed Zoning Text Amendment – Tourist Related Business District (15-131) Commissioner Madigan advised the County Planning Board opinion has been received. She went through the SEQRA long form (attached). She is recommending a text amendment to the tourist related business district. Commissioner Madigan moved and Commissioner Mathiesen seconded for a negative SEQRA declaration since the project will not result in any large and important impacts; therefore is one that will not have a significant adverse impact on the environment. Ayes – All Discussion and Vote: Proposed Zoning Text Amendment – Tourist Related Business District (15-132) Commissioner Madigan stated this is the vote on the actual amendment to the ordinance. Commissioner Madigan moved and Commissioner Mathiesen seconded to approve the revision of the Tourist Related Business Zoning District as presented in the July 15, 2014 City Planning Board advisory opinion with one modification – animal clinics – shall be removed from the new list of uses that are not permitted in the part of the TRBD within the gateway design district 1A and 1B. TRBD shall be left as is with respect to animal clinics. Ayes – All Discussion and Vote: Agreement with CivicPlus for Website and Social Media Design and Upgrade (15- 133) Commissioner Madigan advised the bid was awarded at the last City Council meeting. The agreement is in the amount of $48,000 and funding is in line A3021694 / 54720. There will be an annual maintenance fee of $8,715. Commissioner Madigan moved and Commissioner Mathiesen seconded to approve the mayor’s required signature on the agreement with CivicPlus for website and social media design upgrade as distributed with the agenda with exhibits correctly titled. Ayes – All Discussion and Vote: Bond Resolution for Open Space Bond Act Funds (15-134) Commissioner Madigan advised bond resolutions are deemed repealed after 10 years. This bond resolution allows the commissioner of finance to bond up to $1,450,000 and covers amount remaining under the first referendum. Commissioner Madigan moved and Commissioner Mathiesen seconded to approve the 2015 bond resolution that was distributed with the agenda. Roll Call: Commissioner Franck – Aye Commissioner Madigan – Aye Commissioner Scirocco – Aye Commissioner Mathiesen – Aye Mayor Yepsen - Aye Discussion: New York State Budget Page 12 of 15 City Council Meeting 4/21/15 Commissioner Madigan stated we had an increase in VLT aid by $498,000. The wording for the use of the funding makes it difficult for us to rely on the funding and we have been relying on it. We may want to consider one time pieces of equipment or a one-time project. She recommended they do not appropriate the additional amount directly into the general operating budget. The property tax rebate will be sent to our resident. If we meet the qualifications outlined by the state for shared services and stay under the tax cap; our taxpayers will again receive a rebate. Discussion: North American Meetings Industry Day Commissioner Madigan advised she welcomed the North American Meetings Industry Day last week at the City Center. PUBLIC WORKS DEPARTMENT Discussion and Vote: Authorization for the Mayor to Sign Agreement with Daedalus, Inc. – Spirit of Life (15-135) Commissioner Scirocco stated this is the last of the 3 phase restoration. Daedalus will perform a examination of the statue and follow up conservation. Commissioner Scirocco moved and Commissioner Mathiesen seconded to authorize the mayor to sign an agreement with Daedalus, Inc. for the restoration and conservation of the Spirit of Life sculpture in the amount of $36,500. Funding is in line: H3036952 / 52000 / 1039. Maloy, Inc. It requires a 40 day contract change order. Commissioner Scirocco moved and Commissioner Mathiesen seconded to authorize the mayor to sign a time extension change order for the completion of this project with James H. Maloy, Inc. Ayes – All Announcement: Sale of Compost Commissioner Scirocco announced compost will be for sale at the Weibel Avenue location. The cost is $20 per yard; delivery within the City limits requires a minimum of 7 yards for $154; delivery within a 10 mile radius outside the City limits requires a minimum of 7 years for $182. Announcement: Shared Services with the Town of Greenfield Commissioner Scirocco announced the City and the Town of Greenfield have an inter-municipal agreement. They have helped the City on many occasions with hauling our equipment for service; we have borrowed their small paver; and they have hauled and delivered salt and sand to us. They have asked for the City to loan them a street sweeper with an operator for 2 days. Page 13 of 15 City Council Meeting 4/21/15 PUBLIC SAFETY DEPARTMENT Discussion and Vote: Public Safety Employee to Use CSEA City Hall Unit Sick Bank (15-137) Commissioner Mathiesen moved and Commissioner Madigan seconded to approve the use of the CSEA City Hall sick bank for a public safety employee. Ayes – All Announcement: Arrest of Suspect in Ben & Jerry’s Burglary Commissioner Mathiesen advised on April 16, 2015 the Police Department arrested a suspect in the Ben & Jerry’s burglary. He thanked the public for their assistance and tips that helped them identify the suspect which led to the arrest. Discussion and Vote: Accept Donation from Bonacio Construction to Build and Donate Two K9 Kennels (15-138) Commissioner Mathiesen advised Bonacio Construction has offered to build and donate the labor and materials for two K9 kennels. Commissioner Mathiesen moved and Commissioner Madigan seconded to accept the donation from Bonacio Construction in the amount of $8,000. Ayes - All Announcement: The Empty Chair Project Commissioner Mathiesen announced this is a program among law enforcement agencies. It includes traffic safety issues, underage drinking, and impaired driving. SUPERVISORS Matthew Veitch Saratoga County Prosperity Partnership Supervisor Veitch reported Marti Vaneges was hired as the president of the Saratoga County Prosperity Partnership and will start May 6th. Criminal Justice Advisory Committee Supervisor Veitch reported they meet quarterly to discuss progress in the criminal justice arena. They received an update on pre-trial services status, community work order program, and the probation and correctional alternatives. June Legislative Gazette Supervisor Veitch reported Saratoga County has been offered the feature in the June issue of the Legislative Gazette. Deceased Veteran’s Honors Supervisor Veitch reported they honored Thomas Jordanis from Waterford who served in Vietnam. National Meetings Industry Day Page 14 of 15 City Council Meeting 4/21/15 Supervisor Veitch reported this was covered previously by Commissioner Madigan. Tour of Saratoga County Supervisor Veitch reported he visited with the Town of Clifton Park this month. The next visit is the Town of Greenfield. Peter Martin Social Programs Supervisor Martin reported balancing incentive program issued grant to Saratoga County for non- institutional based long term service and support. The grant amount is $37,200. The month of May is Older Americans Month in the County. Public Health Supervisor Martin reported they entered into 2 inter-municipal agreements. The state has mad funds available for a mobile mental health crisis team as long as the funds are used among multiple counties. County Financial Report Supervisor Martin reported the County administrator released a financial report that will be available on the County website. The first quarter report is that the County is on target. Victim’s Vigil Supervisor Martin reported he provided a welcoming address for this event. They heard from some victims.
