Page 4 of 14 City Council Meeting 4/16/19 CALL TO ORDER Mayor Kelly called the meeting to order at 7:00 p.m. PUBLIC COMMENT Mayor Kelly said the public comment period is limited to a total of 15 minutes and individuals are limited to two minutes. Mayor Kelly opened the public comment period at 7:01 p.m. No one spoke. Mayor Kelly closed the public comment period at 7:02 p.m. PRESENTATIONS City Sustainability Progress Commissioner Madigan and Tina Carton, sustainability coordinator, presented. Commissioner Madigan reviewed the various sustainability projects the City has been working on including the solar park; Energize NY PACE Finance for green projects; EV charging stations on City owned parking lots; and traffic lights have been upgraded to LEDs. Tina Carton stated the City has an award winning walkable downtown. The City adopted the Saratoga Greenbelt Trail in 2014; adopted the Complete Streets Plan in 2016; and has been supporting CDTA’s Bike Share. The City also applied for funding through the Transportation Improvement Program for an additional 3.4 miles of sidewalks throughout the City. The City should hear about this funding by the end of June. Tina also reviewed the various projects the City has been recognized for such as being designated as a clean energy community; being awarded the Sole Smart Solar Community designation; Arbor Day Tree City Foundation recognition; and designated as a Bronze Walk-Friendly Community. Commissioner Madigan advised the first sustainability fair was held at Skidmore last weekend. The City had a table there. A City-wide effort is going on to look into changing all street lights to energy efficient LEDs. Tina Carton introduced the hub that has been created on the City’s website. The page contains information on the CDPHP Cycle; complete streets; Climate Smart Task Force; Energize NY PACE Financing; EV charging stations; municipal energy benchmarking; Open Space Committee; Greenbelt Trail; and the Spa Solar Park. She also reviewed the projects the various committees and boards are working on. Pitney Meadows Community Farm – Update Barbara Glaser presented an update on Pitney Meadows Community Farm. The land has been totally paid off in 2018. Joyce Carroll advised the community gardens are up to over 100 beds with 7 community groups gardening with them. Barbara advised they have had hundreds of volunteers working on various projects at Pitney Meadows. The fields have been restored and will be expanding this year. Last year they grew over 400 lbs. of food for Franklin Community Center and this year they will have fields dedicated for that use. They will also be Page 5 of 14 City Council Meeting 4/16/19 growing food this year for Saratoga High School. Starting this year, they will be doing informal concerts in the garden in conjunction with Café Lena. Many community events have been held so far with many more to happen. Peter Goutos advised they were charged with making recreation happen at Pitney Meadows. The farms will be part of the Greenbelt Trail. Authorization to Pay Invoice Without a Purchase Order to Goldberger and Kremer, Labor Counsel Ayes – All MAYOR’S DEPARTMENT Presentation: Wesley Community Presentation Dave Carr of the LA Group advised Wesley made an application to amend their existing PUD. They are requesting lead agency status be taken care of and the project be passed on to the City and County Planning Boards for advisory opinions. Brian Nealon of Wesley Community advised Wesley currently provides a wide array of services. They have 700 seniors living on the campus, 600+ employees, and operate with an annual $45 million dollar budget. They are looking at the services that they need to be providing as times change. The initiative is to provide more housing and homecare within that; and caring for more memory care individuals. The application represents the changes and the first time in 20 years of adding brick and mortar. They have prided themselves on having good relationships with their neighbors and plan to communicate with them as they move forward through this project. Cliff Van Wagner, pharmacy director at Wesley, provided details on the project. They propose enclosing the four corners of the Springs Building and go up 4 floors and have 30% more private rooms. They are looking to add 100 apartments; 70 for low to moderate income seniors and 30 supportive units. They have a building to demolish - rebuild a two-story office building and increase the size of their maintenance building. In the application, they provided a traffic engineer report and the SEQRA long form. Hospice is in their PUD but is not owned by Wesley. Mayor Kelly moved and Commissioner Madigan seconded to add an item to the mayor’s agenda determining merit for review and to send to the City and County Planning Boards for an Advisory Opinion. Ayes – All Proclamation: Arbor Day Proclamation Mayor Kelly read the following proclamation into the record: A PROCLAMATION OF THE CITY OF SARATOGA SPRINGS, NEW YORK WHEREASE, for more than a century, Arbor Day celebrations have been held in communities across the United States. Principles of forestry, conservation, and environmental responsibility are important part of our American Heritage, and WHEREAS, Saratoga Springs is one of more than 3,400 Tree City USAs, with a combined population of 140 million, and WHEREAS, in 2013, the Saratoga Springs City Council unanimously adopted its first-ever Urban & Community Forest Master Plan, which committed the City to “preserving and expanding the urban forest”, and WHEREAS, Sustainable Saratoga’s Urban Forestry Project has partnered closely with the City on trees issued since 2012, beginning with the inventory of 5600 street and park trees. This inventory was donated to the City to provide the data upon which the Urban & Community Forest Master Plan was based; and WHEREAS, this May, the City’s DPW will plant trees, many in the commercial core of the City, a priority of the Urban & Community Forest Master Plan; and WHEREAS, on April 27, 2019, Sustainable Saratoga’s volunteers will plant 30 large maturing trees throughout the City as part of its semi-annual Tree Toga planting effort, which will bring a total number of Tree Toga trees planted since 2014 to 255. NOW THEREFORE, I, MEG KELLY, Mayor of the City of Saratoga Springs, am pleased to join with my colleagues on the City Council, with the dedicated people of Sustainable Saratoga’s Urban Forestry Project and all their Tree Toga volunteers, and with my fellow Saratogians, in proclaiming April 26, 2019 as ARBOR DAY. The grant was awarded at the 3/19/19 City Council meeting. The amount is $20,000 with $15,000 in grant funds and $5,000 in matching funds made up of in-kind services. Mayor Kelly moved and Commissioner Madigan seconded to authorize the mayor to sign the MOU with the Capital District Transportation Committee for the Municipal Smart City Street Light Conversion & Evolving Technology Guide Project as included with agenda. Ayes – All Discussion and Vote: Authorization for Mayor to Sign the Second Amended and Restated Declaration of Covenants and Restrictions of Stephen Ethier 166-168 Jefferson Street (19-157) Vince DeLeonardis advised the City entered into a settlement agreement about a year ago with the owner of 287 Jefferson Street. That parcel was subject to workforce housing restrictions. We commenced action when it became know that a unit there was sold at market rate and the owner paid a fine and a replacement unit was to be built at 166-168 Jefferson. The complex at 166-168 Jefferson is 10 units which will now have 5 workforce housing units as a result of the settlement agreement. This amendment is to incorporate that change as well as bank foreclosure and resale. Mayor Kelly moved and Commissioner Madigan seconded to authorize the mayor to sign the second amended and restated declaration of covenants and restrictions of Stephen Ethier 166-168 Jefferson Street as included with this agenda. Ayes –All Discussion and Vote: Authorization for Mayor to Sign Stipulation of Settlement and Discontinuance of the Matter City of Saratoga v. Robin Courtney et al. (19-158) Vince DeLeonardis stated this is regarding eminent domain matter at 100 Geyser Road. This is a missing piece of sidewalk to connect our Safe Routes to School Program. This will bring this matter to conclusion and a discontinuation of the matter. Mayor Kelly moved and Commissioner Martin seconded to authorize the mayor to sign a stipulation of settlement and discontinuance of the matter City of Saratoga vs. Robin Courtney et al. Ayes – All Page 9 of 14 City Council Meeting 4/16/19 Discussion and Vote: Authorization to Refund Building Permit Fee for Square Footage: U.S. Navy Field House (19-159) Mayor Kelly advised the U.S. Navy’s operations in Saratoga County has a $5 million per year impact on the economy. A refund of $2,995 in fees is being requested. Mayor Kelly moved and Commissioner Franck seconded to approve a $2,695 refund to the U.S. Navy for square footage portion of the building permit fees for their field house as described with this agenda. He met with Commissioner Scirocco and Mike Sharp to make this work. There will be 5 or 6 groups using the rink. This agreement will be retroactive to January 1, 2019 and will run through December 31, 2019. Commissioner Scirocco moved and Commissioner Martin seconded to authorize the mayor to sign the intermunicipal recycling agreement between the County of Saratoga and the City of Saratoga Springs for the management of single stream recyclables collection. The substantial completion time would be extended to April 16, 2019 with final completion time being extended to June 4, 2019. Commissioner Scirocco moved and Commissioner Madigan seconded to authorize the mayor to sign change order #1B with Trinity Construction for time extension only for flocculation tank project. Ayes – All Discussion and Vote: Authorization for Council Approval to Amend DPW Part-Time Laborer Hourly Wage (19-170) Commissioner Scirocco advised he is looking to increase the hourly wage to $ 13 per hour. Commissioner Scirocco moved and Commissioner Franck seconded to approve to amend the Department of Public Works part time labor hourly wage to $13 per hour. Ayes – All Discussion and Vote: Authorization for Mayor to Sign Change Order #3 with Aktor Corporation for City Hall Selective Demolition & Asbestos Abatement (19-171) Commissioner Scirocco advised this change order is for additional demolition and abatement in City Hall in the amount of $11,072. They voted to hire a full time veterinarian and coordinator for the animal shelter. The chairman has deemed this year the year of the senior. There will be a senior celebration on June 26th at Congress Park. Geyser Road Trail Supervisor Veitch thanked the council for getting the trail over the finish line. Tara Gaston Veterans Committee Supervisor Gaston reported there was no deceased veteran ceremony this month. Next month they will be honoring a Saratoga Springs deceased veteran - Tracy Millis. Board Report Supervisor Gaston reported Hudson Valley Community College has expressed interest in working with our community on the development of a maker space. The Public Health Department is working on anti-tics. Information on tics and tic kits can be obtained from the Health Department. Saratoga County Planning Board Supervisor Gaston reported meeting at 4 p.m. Thursday at the County Planning Office.
