PUBLIC HEARINGS
Local Law #1 of 2020 – Community Choice Aggregation Program
Mayor Kelly opened the public hearing at 6:56 p.m.
Commissioner Madigan advised this is the first public hearing for Local Law #1 of 2020. Materials can be
found under agenda item #1 on the Finance agenda. Residents can obtain better rates on their electric bills
and avoid spikes in their electric prices. If our community joins, the resident still has the option to opt out. A
meeting will be held at the library in the Sussman Room on January 14, 2020 from 6:30 p.m. - 7:30 p.m.
The public hearing will be left open tonight and will be closed at the next meeting when a vote will be taken.
Tina Carton, sustainability coordinator and City resident stated she is excited about this program. She
provided a little history of the program and stated there are 13 municipalities that have signed on. She looks
forward to the advantages that the CCA will bring to her and her family as a resident. The City’s action can
hopefully spark local job creation.

Laura Faulk, a member of Sustainable Saratoga read a statement (see attachment) into the record. She
stated we are running out of time to avert a climate catastrophe. They thanked the City for their declaration
of support for the Paris Climate Accord and its participation in the Climate Smart Cities Program. Adopting
a local law to authorize Community Choice Aggregation will continue the City’s commitment to climate
change mitigation because it offers the chance for residents to move to a renewable energy supply.
Louise Galk of Hathorne Street stated her family already has renewable energy they purchased through
another organization. They will continue to do that until there is another option in the City.
Sam Brewer of Saratoga Springs urged the Council to support a municipal aggregation of electric supply as
long as the rate that can be negotiated is less than the average of what National Grid charged people for
the last couple of years.
Mayor Kelly closed the public hearing at 7:00 p.m.

Mayor Kelly called the meeting to order at 7:06 p.m.
PUBLIC COMMENT
Mayor Kelly said the public comment period is limited to a total of 15 minutes and individuals are
limited to two minutes.
Mayor Kelly opened the public comment period at 7:07 p.m.
Sam Brewer of Saratoga Springs congratulated the Council on their elections. He encouraged the Council
to be aggressive about human trafficking. He also suggested the City increasing their insurance for legal.
Mayor Kelly closed the public comment period at 7:09 p.m.

Mayor Kelly announced the State of the City Address will be held on January 28, 2020 at the City Center at
7 p.m.

Announcement: UDO Draft Text Released for Public Review
Mayor Kelly announced the draft UDO is available for public review on the City’s webpage. Comments can
be submitted directly to the planning staff right from the UDO page. Next steps include Camaros reviewing
and discussing the draft at the January 21, 2020 Council meeting; two public workshops will be held; the
next final draft will be released after February 7, 2020; advisory opinions will be requested; a public hearing;
SEQRA analysis; and finally the Council vote.
Appointment: Saratoga Race Course Advisory Board
Mayor Kelly advised she gets to appoint 5 members to the Saratoga Race Course Advisory Board.
Her appointments are all re-appointments and are as follows: Cindy Hollowood, Skip Carlson, Michele
Funicello, John Carusone, and Bill Willmont.
Discussion and Vote: Accept Donation for Room at Empire State College (20-001)
Mayor Kelly advised Empire State College would like to donate a room to be used for the two UDO public
workshops. The amount of the donation is $
Mayor Kelly moved and Commissioner Madigan seconded to accept the donation for the room at
the Empire State College as included with this agenda.

Discussion and Vote: Accept 2015 Saratoga County Trails Grant – Saratoga Greenbelt, Crescent Avenue
(20-002)
Mayor Kelly advised in 2015, Saratoga County granted the City $12,500. The administrative process of
accepting the grant is being completed. There is a match of $16,125 match in funds or in-kind services.
Mayor Kelly moved and Commissioner Madigan seconded to accept the 2015 Saratoga County
Trails Grant – Saratoga Greenbelt, Crescent Avenue as described with this agenda.

Discussion and Vote: Authorization for Mayor to Sign Agreement with County for 2015 Saratoga County
Trails Grant (20-003)
Mayor Kelly moved and Commissioner Madigan seconded to authorize the mayor to sign agreement
with the County for the 2015 Saratoga County Trails Grant as included with this agenda.

Discussion and Vote: Authorization for Mayor to Sign Contract with the City Center for the State of the City
Address (20-004)
Mayor Kelly moved and Commissioner Scirocco seconded to authorize the mayor to sign a contract
with the City Center for the State of the City Address as included with this agenda.

Public Hearing Materials: Local Law #1 of 2020 Adopting a Community Choice Aggregation Program
Commissioner Madigan advised the information and materials for the public hearing can be found attached
to this item and on the web.
Discussion and Vote: Use of Reserve Resolution – Payment of Bonded Indebtedness (20-005)
Commissioner Madigan advised $400,000 was included in the 2020 debt service fund budget for the
reserve of payment of bonded indebtedness to pay debt on outstanding bonds. The balance of bonded
indebtedness after this withdrawal will be $407,617.87.
Commissioner Madigan moved and Commissioner Scirocco seconded to approve use of reserve
resolution – payment of bonded indebtedness as included with the agenda.

Discussion and Vote: Use of Reserve Resolution – Retirement Reserve (20-006)
Commissioner Madigan advised the 2020 general fund budget included revenue for the retirement system
reserve in the amount of $600,000 to defray increased employer contributions due to growing payroll costs.
There will remain $255,531.14 after this withdrawal.
Commissioner Madigan moved and Commissioner Dalton seconded to approve the use of reserve
resolution – retirement reserve as included with the agenda.

Commissioner Madigan moved and Commissioner Scirocco seconded to approve the budget
transfer – payroll as included with the agenda.

PUBLIC WORKS DEPARTMENT
Discussion and Vote: Approval to Pay Invoice #Sara-02712 to Aktor Corporation in the Amount of
$36,094.00 for Asbestos Abatement in City Hall (20-008)
Commissioner Scirocco advised this invoice is for the removal of asbestos from the Music Hall and the
Police Department.
Commissioner Scirocco moved and Commissioner Dalton seconded to approve to pay invoice #
02712 to Aktor Corporation in the amount of $36,094 for asbestos abatement in City Call.

Discussion and Vote: Approval to Pay Invoice #26562 to AllPro Restoration & Reconstruction in the
Amount of $1,883.60 for Water Damage Remediation in City Hall (20-009)
Commissioner Scirocco advised this invoice is for remediation of water damage in the basement of City
Hall.

#26562 to AllPro Restoration & Reconstruction in the amount of $1,883.60 for water damage
remediation in City Hall.

Padlock and Key for Katrina Trask Gate (20-010)
Commissioner Scirocco advised the reimbursement paperwork was not completed with the required 30
days.
Commissioner Scirocco moved and Commissioner Madigan seconded to approve to reimburse
employee #1038 in the amount of $75 for the purchase of a padlock and key for the Katrina Trask
Gate.

PUBLIC SAFETY DEPARTMENT
Announcement: Inauguration Comments and Thank You
Commissioner Dalton thanked the people in Public Safety Department. She is proud of the men and
women in the department and astounded by how great they are. She thanked Commissioner Martin,
Commissioner Wirth, and Commissioner Mathiesen in helping her prepare for this position.

2020 Board of Supervisors Organizational Meeting
Supervisor Gaston reported Preston Allen form the Town of Day has been elected as the Chairman. She
has been re-appointed to the Legislative & Research Committee, Real Property Tax Committee, and
Gaming Committee.
Public Forum
Supervisor Gaston reported the first public forum will be January 26, 2020 from noon – 2 p.m. at the
Saratoga Springs Library in the Sussman Room. The forum will be focused on infrastructure and
development.
