PUBLIC HEARINGS Amend Chapter 225 Section 225-81 Parking Prohibited Mayor Kelly opened the public hearing at 6:55 p.m. Commissioner Dalton stated this is to prohibit parking on both sides of Adams Road from Cady Hill Blvd. to Marsel Drive. No one spoke. Mayor Kelly closed the public hearing at 6:56 p.m. Saratoga Springs Community Development Citizens’ Advisory Committee for the 2021 Annual Block Grant Action Plan Mayor Kelly opened the public hearing at 6:56 p.m. Mayor Kelly advised the recommendations are on the City website. No one spoke. Mayor Kelly concluded the public hearing at 6:57 p.m. and kept it open. CALL TO ORDER Mayor Kelly called the meeting to order at 6:59 p.m. PUBLIC COMMENT Mayor Kelly said the public comment period is limited to a total of 15 minutes and individuals are limited to two minutes. Mayor Kelly opened the public comment period at 7:00 p.m. Ciara Meyer of Saratoga Springs stated she is here to show support for recycling in the downtown area. She hopes there will be funding in the 2022 budget for recycling bins. She emphasized this is a one-time cost. Jade Helal of Saratoga Springs stated she is here to advocate for recycling bins. She lived in Germany before moving to Saratoga Springs and was surprised to see there was no recycling being done here. Maddie Cook of Saratoga Springs stated she is voicing her support for recycling in the downtown area. They would like to see 28 recycling bins in the downtown. John Iacoponi of Saratoga Springs stated they are daily users of the Spring Run Trail. He has noticed there has been degradation on that trail more recently and asked if there is money in the budget to fix some of the fences and drainage. Lucia Cucinella of Saratoga Springs stated she is here to show support of 28 recycling bins in the downtown. Mayor Kelly closed the public comment period at 7:09 p.m. Commissioner Madigan stated recycling can be both a general expense item or a capital budget item. Commissioner Dalton gave kudos to the Saratoga Springs High School students who spoke up about the recycling. Page 5 of 14 City Council Meeting 4/20/2021 Mayor Kelly stated the Spring Run Trail and the recycle bins will take money and we don’t have money. We have to set priorities. Commissioner Scirocco commended the students on their recycling initiative and concern for the environment. He had met with them but it comes down to budget. The 28 recycle bins will cost close to $30,000. Commissioner Franck stated he sees solar recycling bins in Maine. He also suggested reaching out to hardware stores to assist with the trail cleanup. PRESENTATION Unified Development Ordinance (UDO) – Final Draft Release (presentation attached) Mayor Kelly advised the final draft of the UDO is on the City’s website. Camiros is here to share the major changes to the final draft and they will be holding public meetings on the following dates: April 21, 2021 at 2 p.m. (public meeting), April 22, 2021 at 9:30 a.m. (public meeting) and 6 p.m. (land use board meeting). Vince DeLeonardis, city attorney, advised of the history of the development of the UDO up to this point. Camiros will summarize the changes from draft 2 to draft 3. Arista Strungys of Camiros advised this is the April 2021 draft – 3 of the UDO. This document is a redlined document. The goals of the update is to implement the comprehensive plan. The use structure has been updated with the biggest change being the use matrix. They clarified use standards, prohibit expansion of carriage houses/barn dwellings once use has been allowed, requiring parks and playgrounds when not a special use to have a site plan review, required medium rooming houses require site plan review, and updated solar and wind provisions. Districts UR1 – UR4 have been converted back to their original standards. Chris Jennette of Camiros advised draft map 2 coincides with draft 3 of the UDO. This contains label corrections and minor changes. All suburban residential districts have been converted into one suburban residential district. The Committee will present its recommendations on August 17th for adoption. Announcement: Geyser Road Trail Opening Day – Thursday, April 22 nd – Earth Day Mayor Kelly announced this Thursday, April 22nd at 11 a.m. will be a ribbon cutting ceremony of the Geyser Road Trail. Discussion and Vote: Approval to Pay a Portion of Invoice #3880 Nelcorp Electrical Contracting Corp. (21- 133) Mayor Kelly advised the Recreation Department is requesting payment of 50% of the invoice and the other 50% will be paid by the school district. Mayor Kelly moved and Commissioner Madigan seconded to approve the portion to pay invoice #3880 to Nelcorp Electrical Contracting. Ayes – All Discussion and Vote: Authorization for Mayor to Sign the 2021 State of New York Department of Health Renewal Application for a Permit to Operate Camp Saradac (21-134) Mayor Kelly advised this is an annual contract. Mayor Kelly moved and Commissioner Dalton seconded to authorize the mayor to sign the 2021 State of New York Department of Health renewal application for a permit to operate Camp Saradac. Ayes – All Discussion and vote: Authorization for the Mayor to Sign the contract with All American Arena Products for Vernon Arena Dasher Boards (21-135) Mayor Kelly moved and Commissioner Dalton seconded to authorize the mayor to sign the contract with All American Arena Products for the Vernon Arena dasher boards. Ayes – All Discussion and Vote: SEQR for Missing Links Project Mayor Kelly advised the City Council is lead agency for this project. The City is now progressing with SEQRA Part II and III short forms. (completed forms attached) Mayor Kelly moved and Commissioner Dalton seconded that the SEQRA negative declaration since the project will not result in any large and important impacts and therefore is one that will not have a significant adverse impact on the environment. The City received a $10,000 grant for the rebate program. Mayor Kelly moved and Commissioner Dalton seconded to approve mayor to sign DEC01- T00972GG-3350000 contract for EV vehicle reimbursement. ACCOUNTS DEPARTMENT Discussion and Vote: Zoning Amendment Request, Merit for Review and Referral for Advisory Opinions – YMCA PUD (21-137) Commissioner Franck moved and Commissioner Madigan seconded that the zoning text amendment proposed by the Saratoga Regional YMCA has merit for review and will be forwarded to the City and County Planning Boards for an advisory opinion. Ayes - All Announcement: Grievance Day is Tuesday, May 25, 2021 Commissioner Franck advised grievance day will be held on Tuesday, May 25, 2021. A drop box will be placed in the hallway for people to leave their completed grievance packets for review by the Board of Assessment Review. FINANCE DEPARTMENT Update: City Finances Commissioner Madigan advised we should have first quarter sales tax numbers in the next 6-8 weeks. There is a tax anticipation note due in full in June and another one due in full in December. We still have in process the sale of real property. VLT was fully restored in the state 2021-2022 budget. The $7.7 million dollars from the federal government does not have how it is going to be disbursed right now. Discussion: SiFi Networks Fiber City Wide Infrastructure Progress Commissioner Madigan stated this will bring fiber to homes and businesses. She advised we are at a stage where we need to approve the standard details. Micro trenching is the way companies are laying fiber throughout the country. SiFi now operates in 11 cities and continues to move forward every day. She introduced Scott Bradshaw of SiFi Networks. Scott Bradshaw of SiFi provided a high-level history of when SiFi first presented to the City to today. The engineering standards are a set of techniques. This is where they are today with Saratoga Springs. They are looking at about 240 million feet of construction in Saratoga Springs. What they need now is authorization from the City’s Engineering Department. They provided a New York State stamped engineering document. Page 8 of 14 City Council Meeting 4/20/2021 Commissioner Scirocco stated DPW has spent many hours working with SiFi on this project. He is supportive of this project but has some concerns with micro trenching. He provided a memo of concerns to the Council today. He is concerned about the long-term impact on City streets. Scott Bradshaw stated in regard to construction, they have all known about this for a period of time. They trench on both sides of the street. Discussion: Temporary Hiring Freeze Commissioner Madigan stated they have not been consistent with hires during the hiring freeze. The hospitalization lines are in danger of operating in the red. She asked the Council to take a pause on hiring and replacement hires until they can get more information. She would like to revise this agenda item to ask the Council to take a vote to pause on hiring until June 15th. Commissioner Madigan moved and Commissioner Franck seconded to approve the revision of item #3 on her agenda to include vote as follows: Discussion and Vote: Temporary Hiring Pause. Mayor Kelly advised she is voting ‘no’ because she didn’t know it was a discussion and vote – she is not prepared. Commissioner Franck stated he doesn’t feel waiting 6 weeks is a big ask as long as there is a sunset date. Mayor Kelly stated she doesn’t know if this includes part time. Commissioner Franck stated he believes it is on all hires. Mayor Kelly stated then the Recreation Department can’t hire. She is not prepared to discuss and can’t vote for it. Commissioner Madigan stated she is pulling the item. If the Council wants to keep spending like there are not problems go ahead. Commissioner Scirocco stated he understood she would be meeting with all departments to understand what their needs are and he hasn’t met with her yet. Commissioner Madigan stated she doesn’t know why he hasn’t set up the meeting; they have met with all the other departments. PUBLIC WORKS DEPARTMENT Announcement: Update on Tree Commissioner Scirocco stated old pictures of Broadway will show it was once lined with elm trees. When the trees were lost to disease, it changed the look of Broadway forever. The large elm at the corner of North Broadway and VanDam Street has been hit by disease. They tried to treat the tree but there is no sign of healthy tissue. The tree will have to be removed for safety reasons and to protect the other trees. Discussion and Vote: Approval to Reimburse Employee #2675 in the Amount of $230.00 (21-140) Commissioner Scirocco advised this is for the arborist certification renewal. Commissioner Scirocco moved and Commissioner Franck seconded to reimburse employee #2675 in the amount of $230 for the arborist certification renewal. Principles of forestry, conservation, and environmental responsibility are an important part of our nation’s heritage, and WHEREAS, the preservation of trees and forests is an issue of great concern to all of us. We in Saratoga Springs can be especially proud of the majestic Elm trees that graced our city streets in great numbers during the 19th and early 20th centuries. Today, the City’s Department of Public Works maintains a partnership with Sustainable Saratoga’s Tree Toga planting program. They pay $3,000 per month rental. Commissioner Dalton moved and Commissioner Scirocco seconded to authorize the mayor to sign a contract with Empire Ambulance. Ayes – All Discussion and Vote: Accept Donations for the SSPD K9 Unit (21-151) Commissioner Dalton advised the Police Department who have received many donations for K-9s in the amount of $27,400. Commissioner Dalton moved and Commissioner Franck seconded to accept the K-9 donations and they be placed in the K-9 donation line. Donations are from Christina Mastrianni Morris, Michael Billock and Patricia McGovern, Eric and Carrie Cushing, Crescent Hill Partners, Matthew Jones, Cliff and Claudia VanWagner, Suzanna Allerdice, Boghosian Brothers, Wesley Healthcare Center, 519 Broadway, stores of the Dake Family, and the Adirondack Trust Company, and the Business for Good Foundation. The total amount of the donations are $27,400. Ayes – All Set Public Hearing: Amend Chapter 225, Section 225-81 of the City Code, Schedule XVI – Parking Prohibited at All Times – Crescent Street Commissioner Dalton set a public hearing for Tuesday, May 4, 2021 at 6:55 p.m. SUPERVISORS Matt Veitch County DPW Geyser Road Paving Project Supervisor Veitch reported Geyser Road will be paved starting this week with resurfacing starting later this month with completion by end of May. STOP DWI 2021 Amounts Supervisor Veitch reported the County accepted additional funding for the STOP DWI program. Deer Hunting PILOT Program Supervisor Veitch reported the County will be taking part in New York State’s new deer hunting PILOT program. There is a public hearing set for May 18, 2021 at 3 p.m. This is to expand youth hunting to 12 and 13 year olds. Tara Gaston COVID-19 Update Supervisor Gaston reported our positivity rate is coming down and the vaccination rate is excellent in the county. Public Health Expansion Page 13 of 14 City Council Meeting 4/20/2021 Supervisor Gaston reported the County is expanding the Public Health Department to a full service department of health. They will take on things like restaurant and camp inspections. The City has the option to opt out of the County’s Health Department. Saratoga County Women in Government Leadership Program Supervisor Gaston reported the Women in Government Leadership Program was announced today. The application process will be live on Monday. We are the first county in New York State to do this.
