PUBLIC HEARINGS Amend Chapter 225 Section 225-81 Parking Prohibited on Crescent Street Mayor Kelly opened the public hearing at 7:11 p.m. Commissioner Dalton stated this to amend the City Code to put up no parking signs on the south side of Crescent Street from South Broadway to Joshua Street. Darlene McGraw of Saratoga Springs stated there should not be parking in this area. It would be safer if there was no parking in that area. Mayor Kelly closed the public hearing at 7:13 p.m. CALL TO ORDER Mayor Kelly called the meeting to order at 7:13 p.m. Page 4 of 14 City Council Meeting 5/4/2021 PUBLIC COMMENT Mayor Kelly said the public comment period is limited to a total of 15 minutes and individuals are limited to two minutes. Mayor Kelly opened the public comment period at 7:14 p.m. Sam Brewer of Saratoga Springs stated there has been some federal funds allocated to Saratoga Springs in the amount of $7.7 million dollars. It is quite less than Glens Falls. He asked the Council to contact Senator Schumer and Senator Gillibrand’s offices to see if we can get more. Laura Rappaport, co-chair of Sustainable Saratoga, stated they are asking for a postponement on the merit vote of the UDO. The UDO is a dense document that is hard to read and understand. The community has been too consumed by the pandemic to participate in the process. They hope they will give people a real chance to understand this planning document and have a well-reviewed solid plan in place. Stefon Stilwell of Ballston Spa stated he is handicapped and does not find areas of Saratoga Springs to have accessibility for those that are handicapped. He asked for an assessment of accessibility be done for improvement. Darlene McGraw of Saratoga Springs stated it is paving time. She asked why DPW vehicles are outside of the City. John Iacoponi of Saratoga Springs stated he agrees with what Ms. Rappaport stated regarding the UDO. He believes there are many little details that require a better explanation. He agrees with a delay in the review. Matt Jones of Saratoga Springs stated he is here to support the resolution of moving the UDO forward for advisory opinion from the City and Planning Boards. Mayor Kelly closed the public comment period at 7:27 p.m. Vince DeLeonardis, city attorney, advised the City has been going through an inventory of all the City sidewalks and identifying those sidewalks that require improvements. Commissioner Scirocco stated when paving, they are required to make the intersections ADA compliant. PRESENTATION CHA – Fire and EMS Station 3 Commissioner Dalton introduced CHA to present. Tony Stellato of CHA presented. They would like to initiate the SEQRA process tonight and discuss the engagement of the land use boards. The building is 15,500 square feet, which is just about centered on the parcel. It is a one-story building with the bulk of the parking in the rear of the building. Alan of CHA showed the layout of the building and the location of the apparatus bays, bunks, dayroom, etc. The exterior of the building is green. Commissioner Scirocco asked what the setback is from the road. Alan advised approximately 100 feet from the road. Approve Warrant – 2021 21MAY1 $258,021.23 Ayes – All MAYOR’S DEPARTMENT Discussion: Cannabis Legislation Vince DeLeonardis, city attorney, advised the usage of marijuana is now legal. The law established two new state agencies to administer programs, publish rules, issue licenses, and investigate and enforce infractions. Cities, towns, and villages have the right to opt out of allowing dispensaries and/or onsite consumption establishments. A local law would have to be adopted on or before December 31, 2021 to opt out. Then the issue would be voted on by the community and if passed, would take effect 45 days after. There will be a 4% tax imposed upon cannabis of which 3% will come to the City. Discussion and Vote: Approval for Mayor to Sign Occupational Medicine Services Agreement with Saratoga Hospital (21-152) Mayor Kelly stated the hospital will provide service on a fee for service arrangement. Mayor Kelly moved and Commissioner Madigan seconded to authorize the mayor to sign occupational medicine services agreement with Saratoga Hospital. Ayes – All Discussion and Vote: Approval for the Mayor to Sign a Memorandum of Agreement (MOA) Between the City of Saratoga Springs and Saratoga Springs PBA (21-153) Mayor Kelly moved and Commissioner Dalton seconded to authorize the mayor to sign a memorandum of understanding between the City of Saratoga Springs and the Police Benevolent Association. Vince DeLeonardis, city attorney, advised this has been discussed during prior executive sessions. This incorporates a change from an 8 hour to a 12-hour shift. Officers working a 12-hour shift will be divided into 4 separate shifts that run from 7 a.m. – 7 p.m.; 11 a.m. – 11 p.m.; 7 p.m. – 7 a.m.; and 11 p.m. – 11 a.m. Page 6 of 14 City Council Meeting 5/4/2021 Officers will work 36 hours in one week and 48 hours in the next week; for a total of 84 hours over a two- week period. The additional 4 hours will not be paid out as overtime. This is scheduled to go into effect May 22nd. The MOU was ratified by a majority of the PBA’s members last week. The increased costs are expected to be minimized if not entirely eliminated by anticipated savings to overtime lines. Commissioner Madigan stated the MOA runs from 5/22/2021 to 12/31/2025. Over that period of time, the projected cost is $869,000. The total projected increase for this year is $109,205 more than if the PBA remained under their current contract. In 2022, the increase in cost over their current contract is $184,425 (for 12 months plus salary increases); in 2021, the increase in cost is $188,000; for 2021, the increase in cost is $192,000; and for 2025, the increase in cost is $195,000. These projections don’t include overtime savings. The thinking is they will be able to decrease the budgeting of overtime, which is offset by the 12- hour shifts. The MOA currently affects a total of 49 patrol and sergeants. Ayes – All Discussion and Vote: Resolution Authorizing the Sale of Certain Real Property (21-154) The resolution is as follows: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA SPRINGS AUTHORIZING THE SALE OF CERTAIN REAL PROPERTY WHEREAS, the City of Saratoga Springs is the owner in fee of certain parcels of land situated on the southwest corner of Caroline and Henry Streets, in the City of Saratoga Springs and bearing Tax Map ID #s165.60-1-35 & 165.60-1-36; and WHEREAS, the City acquired lawful title to the parcels by warranty deed, dated March 8, 1982 and has, for many years, utilized the property for surface parking, sufficient to accommodate approximately Nineteen (19) vehicles; and WHEREAS, in or about November 2020, the City Center Authority completed the development and construction of a public parking facility on property owned by the City of Saratoga Springs, obviating the need to locate parking at the above described parcels and rendering them no longer useful, suitable or necessary for municipal purposes; and WHEREAS, in an effort to mitigate the serious financial impacts caused by the Covid-19 Pandemic, the City Council has deemed it necessary and appropriate to identify real property owned by the City of Saratoga Springs which no longer serves a municipal purpose and to offer such property for sale through a competitive bidding process; and WHEREAS, the above described parcels were recently appraised and determined to have a fair market value of approximately Five Hundred Thousand Dollars ($500,000); and WHEREAS, the sale of real property owned by the City of Saratoga Springs is lawfully permitted pursuant to Section 8.4 of the City Charter, NOW THEREFORE, BE IT RESOLVED, that the City Council finds that the identified parcels (Tax Map ID #s 165.60-1-35 & 165.60-1- 36) no longer serve a municipal purpose and hereby approves the sale of such parcels through a competitive bidding process, with minimum acceptable bids being not less than Five Hundred Thousand Dollars ($500,000); and BE IT FURTHER RESOLVED, that the City Attorney shall coordinate with appropriate City staff and prepare all necessary documentation required to solicit bids for such property, which shall be subject to City Council approval. Mayor Kelly moved and Commissioner Scirocco seconded to authorize the resolution for the sale of City owned property situated on the southwest corner of Caroline and Henry Street in the City of Saratoga Springs and bearing tax map ID#: 165.60-1-35 and 165-60-1-36. Vince DeLeonardis stated the City has owned this parcel since 1982. The lot accommodates up to 19 vehicles and no longer serves a purpose for the City. The parcel was appraised at $500,000 and the minimum bid will be set at that amount. Ayes – All Discussion and Vote: Determination of Merit for Review for Unified Development Ordinance (UDO) (21- 155) Mayor Kelly moved and Commissioner Madigan seconded that the Unified Development Ordinance has merit for review that is referred to the City Planning Board, the County Planning Board, and the Design Review Commission for advisory opinions. Page 7 of 14 City Council Meeting 5/4/2021 Vince DeLeonardis, city attorney, advised correspondence was received from Sustainable Saratoga along with template e-mails from the community. These e-mails indicate the UDO is not consistent with the Comprehensive Plan and the City Council should not approve it. Tonight’s item is to find if it has sufficient merit for review, not to approve the UDO. Commissioner Dalton explained her reasons for why she will not be able to support the UDO going to the land use boards for review. Commissioner Franck asked if the Council has a specific time in which they have to vote on the UDO after receiving the advisory opinions from the various boards. Vince DeLeonardis advised the Council can take their time to review the advisory opinions and vote. Commissioner Madigan stated she received the e-mails and understands the concerns. This is standard procedure at this time. We may want to ask the land use boards to help define the level of use. Commissioner Scirocco stated the right thing to do at this point is to give it to the land use boards and get some recommendations. Mayor Kelly stated she personally had an e-mail sent to her stating she is destroying the greenbelt. She and this Council have protected the greenbelt in every way possible. Ayes – 4 Nays – 1 (Commissioner Dalton) Discussion and Vote: Approval to Adopt Citizen Advisory Committee Recommendations 2021 CDBG Funding (21-156) Mayor Kelly moved and Commissioner Franck seconded to approve the adoption of the Citizen Advisory Committee recommendations for the 2021 CDBG funding. Ayes – All Discussion and Vote: Approval to Reimburse Employee #2175 in the Amount of $224.85 (21-157) Mayor Kelly advised this reimbursement is for tiles purchased to protect the floor in the game room. Mayor Kelly moved and Commissioner Franck seconded to approve the reimbursement to employee #2175 in the amount of $224.85 for the purchase of tiles to protect the floor in the Recreation Center game room. Ayes – All Discussion and Vote: Approve the Updated Return to Recreation Operational Plan (21-158) Mayor Kelly advised the plan has been updated in accordance with the CDC and the State of New York guidelines. Mayor Kelly moved and Commissioner Madigan seconded to approve the updated return to recreation Operational Plan in accordance with the CDC and the New York State guidelines. Ayes – All Discussion and Vote: Appointment to Downtown Special Assessment District (21-159) Mayor Kelly advised Ashley Gardner’s appointment will run from 5/4/2021 - 7/31/2023. Ayes – All Announcement: First Public Information Meeting – Missing Sidewalk Links Project Mayor Kelly announced the first public informational meeting regarding the missing sidewalk links project is scheduled for May 18, 2021. Announcement: Development and Construction Report Deputy Mayor Lisa Shields advised the public and Council of information she has been tracking regarding planning and building activity and services provided. She also introduced a new feature on their website. (A copy of the slides are attached.) Ayes - All FINANCE DEPARTMENT Discussion: 2020 Preliminary Financial Report Commissioner Madigan advised the 2020 preliminary report provides a summary of the annual financial report and a summary of the City’s financial position at year-end 2020. The report will be on the City’s website. The Finance Department is preparing the 2020 financial statements. A copy of the report is attached to the minutes. Update: City Finances Commissioner Madigan advised there no new information on the stimulus funds. She has met with each department and plans to bring 2021 budget amendments to the City Council by mid-June. Discussion and Vote: Beacon/Saratoga Workforce Housing PILOT Resolution and Agreement (21-163) Commissioner Madigan advised this would favor a housing project for 56 low-income housing units. The City agrees to a PILOT payment for 32 years. The resolution is as follows: RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA SPRINGS AUTHORIZING THE EXECUTION OF A PAYMENT IN-LIEU OF TAX (“PILOT”) AGREEMENT BY AND AMONG THE CITY OF SARATOGA SPRINGS, EXCELSIOR PARK HOUSING DEVELOPMENT FUND COMPANY, INC. AND THE BEACON AT EXCELSIOR PARK LLC WHEREAS, the City of Saratoga Springs (the “City”) desires to encourage a sufficient supply of adequate, safe and sanitary dwelling accommodations properly planned for persons with low income; and WHEREAS, Excelsior Park Housing Development Fund Company, Inc., a to-be-formed Article XI New York private housing finance law corporation and a New York not-for-profit corporation (the “HDFC”), and The Beacon at Excelsior Park LLC, a to-be-formed New York limited liability company (the “Company”), have identified approximately 1.51 acres of certain real property located at Excelsior Avenue, being a portion of the parcel designated as Tax Map No. 166.00-1-23, in the City of Saratoga Springs, County of Saratoga, Page 10 of 14 City Council Meeting 5/4/2021 State of New York (the “Land”), for the purpose of construction on the Land of a housing project for persons of low income, said project to consist of: (i) the acquisition of the Land; (ii) the construction of approximately fifty-six (56) units of housing for persons of low income and related improvements, comprised of six (6) units for tenants with household incomes at or below thirty percent (30%) of the Area Median Income for Albany-Schenectady-Troy, NY Metropolitan Statistical Area (“AMI”), thirteen (13) units for tenants with household incomes at or below fifty percent (50%) AMI, twenty-one (21) units for tenants with household incomes at or below sixty percent (60%) AMI and sixteen (16) units for tenants with household incomes at or below ninety percent (90%) AMI, together with approximately five thousand one hundred seventy one square feet (5,171 sq. ft.) of ground floor commercial space intended for occupancy by one or more not-for-profit corporations and used in furtherance of charitable purposes designed to address resident needs, surface parking and other ancillary improvements (the “Improvements”); and (iii) the acquisition and installation therein and thereon of certain machinery, equipment, furniture, fixtures and other tangible personal property (the “Equipment”, and collectively with the Land and the Improvements, the “Project”); and WHEREAS, the Company and the HDFC will be formed for the purpose of providing residential rental accommodations for families and persons of low-income; and WHEREAS, the HDFC will acquire fee title to the Land, as nominee for the Company, and will convey its equitable and beneficial interests in the Land to the Company in furtherance of the development of the Project; and WHEREAS, the HDFC’s and the Company’s plan for the use of the Land constitutes a “housing project” as that term is defined in the Private Housing Finance Law of the State of New York (“PHFL”); and WHEREAS, the HDFC is a “housing development fund company” as the term is defined in Section 572 of the PHFL and Section 577 of the PHFL authorizes the City Council to exempt the Project from real property taxes; and WHEREAS, the Company and the HDFC will be willing to enter into a PILOT Agreement whereby they will make annual payments in lieu of taxes to the City as set forth in the PILOT Agreement presented to the City Council for approval; NOW THEREFORE, BE IT RESOLVED that the City Council hereby exempts the Project from real property taxes to the extent authorized by Section 577 of the PHFL and approves the proposed PILOT Agreement by and among the City, the Company and the HDFC, in substantially the form presented at this meeting, providing for annual payments as set forth in such agreement; and it is FURTHER RESOLVED, that the Mayor of Saratoga Springs is hereby authorized to execute and deliver the foregoing PILOT Agreement on behalf of the City; and it is FURTHER RESOLVED, that this resolution shall take effect immediately. Commissioner Madigan moved and Mayor Kelly seconded to approve the Beacon/Saratoga Workforce Housing PILOT Resolution and agreement as included with the agenda. Ayes – All Discussion and Vote: Authorization for Mayor to Sign a Memorandum of Understanding (MOU) Re: Grant to the City of Saratoga Springs from the New York State Economic Development Corporation (ESD) to be Administered by the New York State Technology Enterprise Corporation (NYSTEC) for a PILOT Program Re: the Construction and Implementation of LED Streetlights Incorporating Public WiFi and Video Analytics (21-164) Commissioner Madigan advised a grant was received to establish a PILOT program for the conversion to LED lighting and installation of technical equipment. This saves funds and incorporates public WiFi and video analytics. The grant will be used to fund a one-year PILOT project. Commissioner Madigan moved and Commissioner Franck seconded to authorize the mayor to sign a memorandum of understanding (MOU) regarding the grant to the City of Saratoga Springs from the Empire State Development (ESD) to be administered by the New York State Technology Enterprise Corporation (NYSTEC) for a PILOT program regarding construction and implementation of LED streetlights incorporating public WiFi and video analytics as included with the agenda. Ayes – All Discussion and Vote: Approval to Pay Invoice 3000291 in the Amount of $1,000 to Bolton St. John for Government Services (21-165) Commissioner Madigan advised a three-month extension was approved at the March 29, 2021 Council meeting. Tony Stellato stated the City Council will be the lead agency for SEQRA. They are prepared to forward to the boards and meet with them. Once all of that is completed, then funding has to be addressed and permits to build have to be obtained from the Office of General Services. Construction could start in 2022. The high bid is $2.8 million dollars. The Committee is going to recommend accepting that bid. Tara Gaston COVID-19 Update Supervisor Gaston reported the County numbers are looking better. The rolling positivity rate for 7 days is 1.5% and there are 11 hospitalizations.
