PUBLIC HEARINGS Unified Development Ordinance (Final) Mayor Kelly opened the public hearing at 6:46 p.m. Keith Kaplan, chair of the Zoning Board of Appeals stated they are in support of the UDO. It is appropriate at this time to align with the Comprehensive Plan. There are no radical changes being made. Tami Ehinger, chair of the Design Review Commission, stated they look forward to the vote and implementation of the UDO. Diana Goodwin, co-chair of Sustainable Saratoga, stated there are many good things in the UDO. They have two suggestions – remove the new uses in the greenbelt and strengthen the rural design standards (go back to the old ones and make them mandatory). Page 4 of 15 City Council Meeting 10/5/2021 Mayor Kelly concluded the public hearing at 6:51 p.m. and kept it open. Zoning Amendment Weibel Avenue PUD Mayor Kelly opened the public hearing at 6:51 p.m. Vince DeLeonardis, city attorney, advised this amendment is to extend the expiration date for the area identified as Zone B until July 1, 2024 and seeks to amend the use schedule. The County Planning Board found in favor of the extension of the date for Zone B but expressed concern over the additional uses. The City Planning Board provided a favorable opinion on the extension date and an unfavorable opinion on the additional uses. No one spoke. Mayor Kelly concluded the public hearing at 6:55 p.m. and kept it open. CALL TO ORDER Mayor Kelly called the meeting to order at 7:00 p.m. PUBLIC COMMENT Mayor Kelly said the public comment period is limited to a total of 15 minutes and individuals are limited to two minutes. Mayor Kelly opened the public comment period at 7:01 p.m. Melanie Trimble of the New York Civil Liberties Union addressed the arrests made of BLM activists in the past weeks. They believe the protestors were engaged in actions protected by the first amendment. The actions at worst may have been violations rather than an arrestable offense. The arrests were made in a way that were calculated and in a way to cause fear and intimidation. They will continue to watch and so will the Attorney General’s Office. Jasmine of Albany County stated she has never felt comfortable here. It is crazy that people don’t see this. This is Saratoga, built off horseracing and cocaine. Sometimes the white supremacy glows so much here it’s blinding. Brianna of Albany stated if given the opportunity she would paint a true picture of her loved ones – Chandler Hickenbottom and Elz Figuereo. She is tired of watching her brother and sister being tackled. Nora Brennan of Saratoga Springs thanked the Council for moving the meeting to the Music Hall. Systemic racism is not a unique problem to this City. It’s a problem we should be facing. She asked the Council to be open so they can start addressing the problem. Andrew of Saratoga Springs stated he was born and raised here. He did four years in a state penitentiary for trumped up charges for drugs, while whites get probation. Not all of Saratoga is racists. He is for all lives matters. We need to work together as we are one race – human race. Natalia of Saratoga stated she would like to see the focus on systemic racism rather than individual racism. She has been noticing people in our community using the phrase BIPOC (Black Indigenous People of Color). People are not a monolith. Page 5 of 15 City Council Meeting 10/5/2021 Chandler Hickenbottom of Ballston Spa stated it has been one month since her niece and nephew were traumatized. Those children will never look at the police as someone to protect them. Your police had me in a cell for four hours for a violation and her brother was held in a cell for eight hours for a violation. She finds it a slap in the face to Darryl’s family that you are mentioning his case tonight and there was not talks in the media and no one reached out to his family about what you are going to be talking about tonight. Adam Walker of Albany stated he feels by moving to this bigger room and talking about Darryl Mount is their way of seeing this as mediation – no. Tonight is not going to qualify as any type of mediation. Think carefully about what you say about Darryl Mount. Mediation can only continue when all the charges are dropped. Dan Morano of Milton stated fix the Darryl Mount thing. Chel Miller of Cohoes stated she spends her days advocating for survivors. What you are hearing from these people is trauma. Molly Dunn of Wilton stated the mayor should recuse herself from a vote as the aunt of the president of the PBA. Elz Figuereo of Saratoga Springs stated what they have had to deal with so far is insane. No one has never been harmed at one of their rallies for 16 months. You say we’re not peaceful. You are angry because we have so much support. The only reason the City Council meetings have anyone in the room is because of them. They care about their community. Samira Sangare of Clifton Park stated she got into court this morning to support her friend. It is obvious SSPD has a vendetta against BLM. Remember the AG is watching. Alexus Brown of Saratoga Springs it has been 14 weeks since the June press conference when Robin Dalton and John Catone used their positions to attack the defund the police movement. The SSPD is a racist organization. On more than one occasion, they have denied access to meetings based upon the fact they support racial equality. Anthony Brown Davis of Albany stated he has been harassed by SSPD. He has been charged with disorderly contact twice. Saratoga Springs is racist. He said he doesn’t know if they want the energy to be like energy in Albany when George Floyd died. You believe your little pretty a** town can’t get touched but I’ll you know you keep f***in with the Black Lives Matters Movement we are not going to take it/stand for it. Mayor Kelly closed the public comment period at 7:30 p.m. PRESENTATION 2022 Comprehensive Budget – City of Saratoga Springs Commissioner Madigan officially submitted the proposed 2022 Comprehensive Budget to the Council and the public. The 2022 revenue projections at this time are $54M, about $7.8M more than amounts available at the time that we adopted the 2021 budget. The 2021 budget has since been revised upwards in the amount of about $3.5M, bringing the change between 2022 and 2021 to about $4.3M. The revised 2021 changes were largely based on the improvement in revenue collection and full restoration of VLT and State Aid. This year we also have the benefit of the second installment of the Federal American Rescue Act. Once again, there will be no tax increase. The 2022 Comprehensive Budget reflects one resounding theme from department budget requests - increased staffing. It is important to bear in mind that this staffing includes numerous replacements and replenishments that were cut or delayed due to the pandemic. It is more important to understand that these changes are responsive to public demands for additional services in Building, Planning, Police and Fire Page 6 of 15 City Council Meeting 10/5/2021 departments. Information Technology is increased due to necessity; long-term employee retirements, increased cyber security needs, and almost complete reliance of City government on the performance of the IT department render this one of the most essential City services that we support. Departments originally requested a total of forty-eight full-time and two part time employees. Including wages and benefits, this would be cost almost $5M, plus additional expenses for equipment, training, uniforms, vehicles, supplies and service contracts that new employees produce. While 2021 revenues continue to improve and 2022 projections are very strong, an increase of these proportions is more than we can reasonably support in a single year. Based on discussions with each department, a strong plan has been compiled to sufficiently address the staffing needs in 2022, with an eye to the future as well. The Mayor’s Department will receive 2 assistant building inspectors - 1 full time new hire and 1 replacement; and 2 administrative aids - 1 full-time 1/2 year and 1 part-time 1/2 year. The Finance Department will receive a full time director of info technology (new hire - start date late '21); a fulltime assistant director of info technology (new hire - start date late '21); a full time computer support technician (new hire to replace former employee (start date late '21); and a full time finance coordinator for IT assistant (replaces 2 former employees - start date late '21). The Department of Public Works will receive a full time junior city engineer (new hire); a full time city assistant engineer (new hire starting mid-year 2022); and four labors for trail maintenance to reinstate the ‘Trails’ sub-department. The Department of Public Safety will receive three police officers (new hires); one full time dispatcher (new hire); one full time Police Department cleaner (new hire); on part-time on street parking PEO (new hire); four firefighters; a full time senior clerk for the Fire Department (new hire); and one full time code enforcement technician (new hire). The Accounts Department will receive a full time data collections clerk (new hire) and a full time fixed asset & inventory coordinator (new hire). The Recreation Department will receive a full time assistant administrative director (new hire). Commissioner Madigan also included a new non-profit – RISE Healthy Housing and Support Systems in the 2022 budget. The services that RISE provides not only supports our most vulnerable populations, but also provides Public safety and economic benefits to the City, its citizens, visitors and businesses. She is also crafting an assignment to fund the recommendations adopted by the City Council in response to the Police Reform Task Force to assist in the funding of a Civilian Review Board and various other associated costs. To further the affordable housing priorities, this would provide $165,000 of CDBG funding to support the rehabilitation of existing substandard housing, creating six new units of affordable housing at 43 Allen Drive. Mayor Kelly moved and Commissioner Scirocco seconded to authorize the mayor to sign the NYSDOT highway work permit – completion of work for Geyser Road Trail. This public hearing is to consider the Sewer District’s proposed sewer rates for the year 2022. FINANCE DEPARTMENT Submission: 2022 Comprehensive Budget; 2022 Budget Workshop Schedule Commissioner Madigan advised the proposed 2022 Comprehensive Budget is on the City’s webpage. A memo with suggested dates and times will be circulated soon for the budget workshops. Discussion and Vote: Resolutions to Replenish Reserves and Assignment (21-420) Commissioner Madigan advised the resolutions have been revised to specify an amount. Retirement reserve is $500,000, insurance assignment is $150,000, payment of bonded indebtedness is $500,000, and the IT assignment is $125,000. Commissioner Madigan moved and Commissioner Dalton seconded to approve the resolutions to replenish reserves and assignments as included and uploaded with the agenda. The Commissioner of Finance is hereby authorized to invest from time to time, the monies of this fund pursuant to General Municipal Law and shall then credit to the fund any earned interest. No expenditure shall be made from this reserve fund except upon authorization of the City Council pursuant to section 6-r of the General Municipal Law. This Reserve has proven to be a critical element of the City’s budget process and financial wellbeing. The City’s best interests are service by having sufficient funds in this reserve to cover budget needs. As of 08/25/21, the current balance in this reserve is $260,583.59. I recommend that $500,000 from the general fund unassigned fund balance be added to the Retirement Reserve Fund. This Reserve has proven to be a critical element of the City’s budget process and financial wellbeing. The City’s best interests are service by having sufficient funds in this reserve to cover budget needs. As of 08/25/21, the current balance in this reserve is $ 13,595.32. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA SPRINGS, NY TO REPLENISH THE ASSIGNMENT FOR IT INITIATIVES AND ONE-TIME PROJECTS ESTABLISHED ON DECEMBER 15, 2015 Be it resolved, by the City Council of the City of Saratoga Springs NY, as follows: On 12/15/15 the City Council adopted a resolution creating an Assignment for IT Initiatives and One-time Projects, pursuant to the following declarations: This City must invest in its Information Technology capacities and I intend to ensure that we are as technologically prepared and competitive as possible in 2016 and beyond. Virtually every daily operation, project and plan involves IT - laptops in police vehicles, security cameras on Caroline St., body cameras on police officers, parking ticket laser guns, Tasers, e-911, Nixel notification systems, payroll time and attendance software, financial management systems, GPS for real property assessments, tablets for building code enforcers, City Council meeting agenda software, Web-casts, cash registers, credit card operations, scanners, printers, desktops, projectors, e-mail, information archives, internet for all City buildings, and the people’s portal to all City government – the City website. The City must be also be ready to participate in City-wide high-quality broadband. This is vital to our business economy as well as the health, safety and public welfare of our citizens and visitors. High-speed internet access has become necessary rather than optional infrastructure. It is a universal and essential resource that we depend on already, and I intend to see that the City is positioned to develop effective broadband Internet and next generation networking. This has City-wide implications and community-wide benefits that I am committed to bringing to Saratoga Springs. On 05/19/20 this assignment was released to cover budget and cash flow implications in response to the 2020-2021 pandemic economy. The Assignment itself remains intact albeit unfunded. Ayes - All Set Public Hearing: An Ordinance to Create a New Chapter 37 of the City Code Page 13 of 15 City Council Meeting 10/5/2021 Mayor Kelly stated she is looking to understand the lack of transparency on this. The general public would never know what this is for the way it is listed on the agenda. She is not sure this reflects what the task force is looking for. This is empty legislation and the ordinance is very vague. Commissioner Dalton stated they agreed to this in principle in March 2021 and in June 2021, Mayor Kelly appointed two people to figure out what kind of civilian review board would work best for our City. This was talked about extensively at the last City Council meeting. Mayor Kelly stated they heard about two cities and they gained less than one hour of knowledge. Commissioner Dalton set a public hearing for Tuesday, October 19, 2021 at 6:25 p.m. Announcement: Mount Case Timeline John Aspland, City’s attorney on this case, provided a timeline of events relating to the Darryl Mount case. The document he referred to during his presentation has been posted to the City’s website. SUPERVISORS Matt Veitch 2022 Saratoga County Capital Plan Supervisor Veitch reported they completely revised and re-wrote the process for the Capital Plan. This year they held a public meeting and discussed each capital item. Department heads needed to justify and explain their requests. Legislative & Research Committee Update Supervisor Veitch reported the Committee had on their agenda last week for discussion the resolution from the City regarding the early closing times of bars. The item was referred to the County attorney for additional review. Commissioner Dalton asked if this is moving forward without the support of our supervisors. Supervisor Veitch stated it does move forward as that is the process. There is no affect whether they support it or not. Mayor Kelly stated it does affect it. As our City supervisor, it is a shame that you are not advocating for this. Tara Gaston Public Health Update Supervisor Gaston stated the County stays stable at around 3% positivity. The hospitalization numbers continue to go up and down but there have been a couple of weeks with no fatalities. They are seeing more testing. Office of Cannabis Management Supervisor Gaston reported today was the first meeting of the Office of Cannabis Management.
