PUBLIC HEARINGS 2022 Proposed Comprehensive Budget Mayor Kelly opened the public hearing at 6:48 p.m. Commissioner Madigan stated this is the continuation of the second public hearing. This public hearing will be closed after a successful vote of the budget. Changes will be detailed during her agenda. No one spoke. Mayor Kelly concluded the public hearing at 6:50 p.m. and kept it open. Maple Dell/Marion Ave. PUD Zoning Amendment Mayor Kelly opened the public hearing at 6:50 p.m. Page 3 of 15 City Council Meeting 11/16/2021 Vince DeLeonardis, city attorney, stated this has been brought forward by Stewart’s. The land use boards reviewed and responded with advisory hearing. Commissioner Franck advised there will not be a vote on the PUD but a discussion and vote for coordination of SEQRA review. Vince DeLeonardis stated his office received a protest petition and they are in the process of reviewing that. Chuck Marshall of Stewart’s Shops & Libby Coreno, their attorney, presented. They are proposing a planned unit development along Maple Dell and Marion Avenue. They sent a letter in September of the final proposal. They propose a maximum height of 25 feet. The zoning does allow the convenience store and the gas on Maple Dell. The traffic count exceeds 12,000 cars on Marion Ave. It was determined it was good to include a deeded buffer. (copy of slides attached) Deb of 11 Marion Avenue stated no matter what is done, commercial intensive is being put into residential. That will increase traffic, safety hazards, and noise pollution. Stewart’s doesn’t need to have two more businesses in Saratoga Springs. John Iacapone of Saratoga Springs stated there are numerous other neighbors in the audience who prefer not to speak. The proposal includes the installation of a car wash. The location of the proposed car was is in the conservation/greenbelt district. The Zoning Ordinance calls out the protection of resources. This proposal converts residential lots to commercial. The neighbors don’t want this and feels it sets a bad precedent. This not consistent with the Comprehensive Plan. Tracy Mills of Maple Dell stated this is a benefit to Stewart’s but no benefit to the neighbors. Stewart’s has always been like a weed, you give them an inch and they take a yard. The neighbors want to preserve the little single family residential that remains. They want to maintain the northern entrance to Saratoga Springs as residential. Luanna Griffith Brandon of Saratoga Springs stated it is a beautiful proposal as it takes the old and blends it with the neighborhood. This will also open up more jobs in that area. Christina Cicardi of 662 Grand Avenue stated that corner is an eyesore right now. The proposal will make the area better and brings value to that area. She supports it. Angela Kaufmann of Saratoga encouraged the people who are not comfortable talking on this topic to speak up. Diana Armstrong of 28 Marion Avenue stated they don’t realize the traffic from Maple Avenue School and the noise from the car wash drives them crazy. Renee Iacapone of 4 Avenue A stated it has been a year since this has started. This is so stressful for them. They are going to keep coming after us. Even if this voted down, they will come after them with another proposal. She asked the Council to take a vote on this and to vote NO. Please vote before you are out of office and vote it down. Darlene McGraw of Halfmoon stated there are rules and you have to stick with those. Mike Davis of Saratoga Springs stated the people that the Council should listen to the ones who live there. He and his wife are against the PUD. Heather Carrigan of Saratoga Springs stated she is in favor of the move for Stewart’s. They take care of their neighbors and their property. She takes this route frequently and finds this will be positive. Lanyel Brandon of Saratoga Springs stated she is in favor of the proposal. Stewart’s does their due diligence when they look to make this type of change. Page 4 of 15 City Council Meeting 11/16/2021 Gary Shall of Saratoga Springs stated this is an enhancement compared to the current situation. It will enhance road safety and the level of traffic on Maple Dell. Mayor Kelly concluded the public hearing at 7:33 p.m. and kept it open. New Chapter 37 of the City Code – Community Police Board Mayor Kelly opened the public hearing at 7:33 p.m. Commissioner Dalton stated this is now called the Civilian Review Board. They have taken the feedback from the public and provided a revised ordinance. Julia of 815 North Broadway (Skidmore College) showed a video of the July 14th protest. There were seven protestors arrested. She is trying to put a spotlight on the egregious actions taken by SSPD during that protest. CRB is an obstruction of the truth, no subpoena power, and vaguely calls for background checks. Adam Walker of Albany stated he was the star of the video just sown. You can’t change the rules. The problem with CPR is they should see it for how shallow it is. You still haven’t consulted the people you need to consult on this. They will have to continue the conversation on their terms. Commissioner Dalton stated this draft is not her words. She is holding this to get more feedback and make more changes. She has been watching how the subpoena power will play out in Albany and it appears there will be a legal objection to it. Adam Walker stated he is being told it is not in the cards and can’t be done. Angela Kaufman of Saratoga stated the subpoena power would lead to a lawsuit yet the AG is already here investigating. Someone who is potentially a subject to police harassment or arrest, they should be represented on the board. Dominic of Skidmore College stated he grew up 40 min north of here in Chestertown. The endless campaign of division by the SSPD has to end. The Civilian review Board lacks subpoena power. He asked the City work to make amends. Commissioner Dalton stated the appointees have to have a majority vote of the City Council to be on the CRB. Andrew Beaty of 21 Michael Drive stated he does not feel safe watching that video. Darlene McGraw of Halfmoon stated she thought Saratoga Springs was supposed to be Health, History, and Horses and be unique. She moved here from Albany because she didn’t feel safe but then was threatened with arrest for writing on the sidewalk with chalk. Alex Patterson of Clifton Park shot the video shown. He has watched SSPD harass his friends and abuse his friends. This is about the long history of white supremacy in this City. The City Council will do anything to avoid having a Civilian Review Board that will hold police accountable. Speaker started the CRB lacks subpoena power, independent investigatory power, and funding. The mayor is being given too much discretionary power. Molly Dunn of downtown Saratoga Springs asked why they are talking about the CRB in their last month of office. Why is there a 90-day limit to complaints? She read the Civil Rights Act of 1964. We are violating Civil Rights in Saratoga Springs in 2021. Page 5 of 15 City Council Meeting 11/16/2021 Thomas Dragonette of Saratoga Springs stated the language in the CRB is vague. How can they be sure the politicians and police are not putting barriers in place to stop the CRB from carrying out meaningful oversight? Nedra Hickenbottom asked the Council where they are getting the pool of people to make up the CRB? Commissioner Dalton stated the application would be on line for anyone who would want to apply. Chandler Hickenbottom asked how are they going to come to a decision of who is going to be on the CRB when they don’t get anything done during meetings. Commissioner Dalton stated over the past 2 years, there have only been a handful of occasions where things haven’t passed. Jona of Skidmore College stated the CRB is important. It is a problem when the promise of investigation of the Darryl Mount case is part of a campaign – a political issue. He urged the Council to vote against the CRB in its current form and give it more time. Alexis Brown of Saratoga Springs stated a problem with the CRB is lack of subpoena power. She has an issue with background checks and would like to get a definition of age requirements. Mayor Kelly closed the public hearing at 8:22 p.m. Commissioner Madigan stated this may take into the next administration to be sorted out. It does have its own budget and is not at the oversight of the mayor. Commissioner Franck stated this Council put together a Task Force. That Task Force came up with their plan and the Council voted to take four or five things out of their plan. The CRB will be overturned by the next City Council if we don’t take the CRB as presented by the Task Force. As a City Council, they are safer to follow the recommendations of the people on the Task Force. The City also has an Ethics Board that has subpoena power against anyone including employees, police, and elected officials. Commissioner Dalton stated unless we adopt the collaborative proposal word for word you (Commissioner Franck) will not vote for it. Commissioner Franck stated that is correct. The baseline should be what the Task Force put together. Commissioner Scirocco stated he is hearing no one is happy with this plan or proposal. The new Council has ideas where the CRB should go. He would be more comfortable with the new Council to look at it and put the CRB in place. He wouldn’t support it as he feels the new City Council should weigh in on it. Mayor Kelly closed this public hearing at 8:38 p.m. Weibel Avenue PUD Amendment Mayor Kelly opened the public hearing at 8:38 p.m. Vince DeLeonardis advised there is not a lot of movement on this issue. He is waiting to hear if they are going to amend the PUD. No one spoke. Mayor Kelly concluded the public hearing at 8:39 p.m. and kept it open. Page 6 of 15 City Council Meeting 11/16/2021 CALL TO ORDER Mayor Kelly called the meeting to order at 8:39 p.m. PUBLIC COMMENT Mayor Kelly said the public comment period is limited to a total of 15 minutes and individuals are limited to two minutes. Mayor Kelly opened the public comment period at 8:40 p.m. Andrew Beatty of Saratoga Springs stated with the Attorney General investigating activity in Saratoga Springs, it would be appropriate that the City make sure Mr. Figuereo gets his property back. Darlene McGraw of Halfmoon stated she has spoken with many municipalities and has been told, it is $50,000 for insurance for taxi companies. You are making Saratoga Taxi pay $300,000 for insurance in order to operate. They have gone out of business. Erin Leary of Saratoga Springs stated she was re-routed on her way home on July 14th but had no problem with that. What was a concern was the excessive police presence. Police in riot gear scare her kids. The aggressors were white conservative men. Angela Kaufman of Saratoga stated they want people on the CRB to have a pulse but that means they are going to have a bias. Maybe you don’t want someone showing up with the ACAB shirt. That’s fine, that can be left it at home. Strive for wide range of experience. Speaker asked how ‘Meg’ (Mayor Kelly) is going to appoint anyone when she refers to BLM and black people as cockroaches. Learn how to act when you are in public. You have left a stain on Saratoga and they are going to remember the things that were said. Sone of Skidmore College said he is shaky because of the power that the Council holds. He read a journal entry he wrote on September 7th. Alena of Skidmore College said that a couple months ago she witnessed a small protest in favor of Back the Blue. They were standing on the sidewalk with signs. Why can they protest and not get shut down? Why are the BLM protests getting shut down? This town is over policed and there is systemic racism. Can you all agree you are ignoring the voices of your own people? Mary Holquist of Macarthur Drive stated she is here to follow up on the concerns brought up at the last meeting regarding walkers of the Caroline Street School and lack of sidewalks. Zoe of Skidmore College stated every day that goes by without what they are demanding be an action is another day of you allowing what happened to Darryl Mount to happen again. Susan Horst of 11 Macarthur Drive stated the photo she shared helps conceptualize the danger Caroline Street School walkers are in. There is no cross-walker. They benefit from a reliable cross-walker and multiple crosswalks. Olivia O’Malley of Macarthur drive stated the TIPS program application is on Commissioner Madigan’s agenda and encouraged the Council to vote in favor of this. Their crossing guard has been very unreliable for the past 2 weeks – either arriving late or not getting out of his car. Nora Brennan of Saratoga Springs stated this room is laid out for COVID protocol but there were 30 people crammed into a narrow hall. Page 7 of 15 City Council Meeting 11/16/2021 Hanna Hurley of Saratoga Springs the CRB proposal has no democratic process. There is less regard for a bar that is open until 4 a.m. on Halloween than there is for a BLM protest. Justify where the police budget is going. Tracy Kroski of Halfmoon stated she hopes the AG investigates everything that has happened. She hopes they look into the Darryl Mount case and what the SSPD is desperate to hide. She hopes they look into why an officer was allowed to quietly retire after he was arrested for stalking his wife and ex-wife while on duty. She hopes they look into why SSPD follow Saratoga Black Lives Matter organizers, the July 30, 2020 event, the June 28, 2021 statement made by Assistant Chief Catone and why he wasn’t reprimanded; and July 6, 2021 when SSPD blocked the entrance to a public City Council meeting. It’s amazing the allowances given to white people. She hopes they look at the video of July 14, 2021 where the police pointed to certain activists and then ambushed them. Speaker stated it is hard to believe the City take allegations seriously when there is unjust arrests of BLM activists. There is an unfair double standard as to who is getting arrested. People should be able to voice their opinions at the public comment period without fear of retaliation. Katie of Skidmore College stated she has witnessed the horrible injustices in the town. She learned from black student activists that Saratoga and Skidmore profits from diversity. She asked the Council to vote no on the CRB, as it is inadequate to serve the people. Sara of Skidmore College stated she has empathy for the people here. People don’t feel safe in this town and at Skidmore. If you want to save the reputation of Saratoga Springs, you are going to have start listening to the demands of black activists. Nedra Hickenbottom stated all they are asking for is empathy. She has children that are grown but they are hers. She worries about them every time they leave the house. They are fighting for their rights. They are asking for empathy and for the Council to think about it. Some of them work harder the rest because of their skin color. Lexis Figuereo stated they have been here for 17 months and not one time did you break a rule for him. They are going to keep coming at them. They are going to get the people they want elected. None of you has ever had a conversation with them and that’s all they ever wanted. We were arrested for speaking our minds and standing in the streets. The AG’s Office is going to be looking at videos and you have edited the videos. You took out a lot of our public comments as if we were never even there. Adam Walker of Albany stated take money from police budget to fund the CRB. He is going to reach out to each member of the Council to sit down for a quick interview. They are going to teach you how mediation is done. Samira Sangare stated people’s unwillingness to attempt to understand where they are coming from shows how much self-awareness they lack and soul searching they need to do. People’s behavior towards others is a reflection of themselves. If you are loud, black, and angry, you are looked at as a threat. The SSPD’s response to the AG was they were going to justify how they treated them. Julia of Skidmore College stated it is clear from the tension in the room there are years of police brutality in this town. The person who is defending Saratoga Springs in the Darryl Mount case defended Troy in a case where an unarmed black man was shot. Justice has not been served and there will be many more Council meetings like this if nothing changes. Alexus Brown of Saratoga Springs stated she gave a presentation to Skidmore College students last weekend about what has taken place in this City over the past 16 months. You all are racist. You know what you are doing is wrong and no one has anything to say. Mayor Kelly closed the public comment period at 9:45 p.m. Page 8 of 15 City Council Meeting 11/16/2021 PRESENTATION(S) Pop Warner Cheerleaders – Proclamation Commissioner Madigan stated the Pop Warner Cheerleaders where here but had to leave since it is a school night. Commissioner Madigan read the following resolution into the record: A PROCLAMATION OF THE CITY OF SARATOGA SPRINGS, NEW YORK WHEREAS, cheerleading is a sport that demands dramatic talent, split-second timing, strength, balance, coordination and boundless energy. It teaches the values of teamwork, trust, dedication and responsibility. Cheerleaders love competition just the same as any other athletes, and they work just as hard to be the best at what they do; and WHEREAS, recently a team of Saratoga Springs Pop Warner Pee Wee Cheerleaders, age 9-12, took first place in the 2021 Capital District Cheer Competition and advanced to the Regionals Competition. At the Regionals, their outstanding routines won them first place again, gaining them the title of Eastern Region Champions. Now, for the first time in our city’s history, a team of Saratoga Pop Warner Cheerleaders will compete in the Nationals at Universal Studios in Florida. We are all extremely proud of our hometown team, and we will be doing plenty of our own cheering when they take the stage in Florida, NOW, THEREFORE, members of the of Saratoga Springs City Council are pleased to join with fellow Saratogians in congratulating our Pop Warner Pee Wee Cheerleaders on their amazing victory as 2021 Eastern Region Champions, and in extending to them, their families, friends and instructors, our very best wishes for continued success in National competition. We hereby proclaim today, November 16, 2021 as SARATOGA SPRINGS POP WARNER PEE WEE CHEERLEADERS DAY Update: SiFi Phase 1 Commissioner Madigan introduced Bob Knight of SiFi. Bob Knight stated the Phase 1 test was completed on November 8th. They are awaiting confirmation from the City on the test. The test was done along State Street. Stage 1 design is going to start in a couple weeks. It will take about 3 – 4 weeks to complete. They video tape the streets before and after construction. Julia of SiFi advised they have been doing community and stakeholder engagements. The community is very knowledgeable about the advancement of technology but they were happy to answer any questions asked. They will be signing people up in the spring after the Phase 1 test has been proven successful. They have a follow up meeting with the Chamber. Mr. Knight advised they are going to start designing the fiber cabinets and submitting designs to DPW in upcoming weeks. They are going to start putting out public information but need to know whom they should send it to for review prior to sending it out. Ayes – All Discussion and Vote: Saratoga Springs Housing Authority (21-476) Mayor Kelly recommended the appointment of Janet Altamari to the Saratoga Springs Housing Authority. The term will run from 12/17/21 – 3/31/24. Mayor Kelly moved and Commissioner Madigan seconded to approve the appointment of Janet Altamari to the Saratoga Springs Housing Authority. Ayes – All Discussion: Unified Development Ordinance Mayor Kelly stated it has come to her attention that some commissioners are not ready to vote on the UDO without consideration of additional issues. Issues include four amendments submitted to the Council by Sustainable Saratoga. Commissioner Madigan submitted an amendment to the Council last Friday regarding the definition of a clubhouse that would be allowed in the country overlay area of the RR district. A workshop date of Tuesday Nov 23rd at 6 p.m. was proposed. An invitation will be extended to members of Sustainable Saratoga. Mayor Kelly moved and Commissioner Dalton seconded to add item to agenda. (21-477) Ayes - All Discussion and Vote: Appointment to the Civil Service Commission (21-478) Mayor Kelly moved and Commissioner Madigan seconded to approve the appointment of Joanna Schneider Zangrando to the Civil Service Commission. Ayes – All ACCOUNTS DEPARTMENT Set Public Hearing: Proposed Local Law No. 3 of 2021 – Amend Special District No. 1 of 2002 (Interlaken SAD) Commissioner Franck set a public hearing for Tuesday, December 7, 2021 at 6:55 p.m. Page 10 of 15 City Council Meeting 11/16/2021 Commissioner Franck moved and Commissioner Madigan seconded to add an item to the agenda for discussion and vote: coordinating SEQRA review and determination of lead agency relating to PUD of Stewart’s. (21-479) Ayes – All Discussion and Vote: Coordinating SEQRA Review and Determination of Lead Agency (21-480) Vince explained the Council can seek lead agency or defer to one of the other involved agencies. The last PUD before the Council, the Council did seek lead agency. City Planning Board, DRC, and NYSDOT are the other entities that can be listed as lead agency. The Council is not approving or denying the PUD, they are just starting the SEQRA analysis. Commissioner Franck moved and Commissioner Madigan seconded for the City Council to be lead agent for SEQRA review of the Maple Dell/Marion Avenue PUD amendment. Ayes - All FINANCE DEPARTMENT Discussion and Vote: 2022 Budget (21-481) Commissioner Madigan advised the 2022 proposed budget is ready for vote. Changes to the operating fund budget totals $168,000 bringing the total proposed 2022 budget to $54.2 million. There was a re- allocation of funds from the sewer budget to the general operating budget in the amount of a $118,000 increase. She included the addition of a grants coordinator, which is a net increase of about $100,000. There is a decrease of $20,000 in the first allocation of RISE; $12,000 increase for a code enforcement vehicle, and Civil Service software maintenance fee increase of $5,700. There is no tax increase. The proposed inside tax district rate is $6.4306 and the outside tax district proposed rate is $6.3727. Commissioner Madigan moved and Commissioner Dalton seconded to approve the 2022 proposed amended budget as described this evening and included with the agenda as the 2022 adopted budget for the City of Saratoga Springs. SUPERVISORS Matt Veitch 2022 Saratoga County Budget Update and Public Hearing Supervisor Veitch reported a workshop was held November 10th. There is a slight tax decrease being proposed. The public hearing will be held November 30, 2021 at 4:45 P.M. Saratoga County Bike Routes Supervisor Veitch reported the bike route maps have been approved by the County. Tara Gaston Saratoga County Website Supervisor Gaston reported they will be working on this to bring it up to date. 2022 Saratoga County Budget Supervisor Gaston reported she tried to amend the budget to provide more funding for non-profits but it did not pass. Public Forum Supervisor Gaston pulled this item.
