Mayor Kim called the meeting to order at 7:00 p.m.
PUBLIC COMMENT
Mayor Kim advised there are rules to public comment. People have two minutes to use or lose it.
He asked all to be kind as we all are part of the same community. He also asked the speakers to
be factual. The Council members may respond if they choose.
Mayor Kim opened the public comment period at 7:01 p.m.
Gisela Huber of Saratoga Springs stated a raised ranch across the street has been turned into a VRBO
and they have had up to 14 people staying there at any given time. This situation is terrible and a big
problem. She would like to know if anything will be done about this.
Mayor Kim stated what they spoke about was speaking to the city attorney or code enforcement to verify
if any rules/laws have been broken.
Commissioner Moran advised there is a short-term rental workshop this Thursday from 6 – 8 p.m.at the
City Center.

PRESENTATION
RISE – Community Outreach Court

Sybil Newell, executive director of RISE stated she provided an update last year on the Community
Outreach Court. This program is going well.
Victoria, court coordinator of RISE advised Judge Vero is the judge for the Outreach Court. Victoria read
a statement Judge Vero as follows:
Dear Mayor Kim and Members of the Saratoga Springs City Council,
I provide the following statement in connection with tonight’s presentation from RISE Housing and Support Services about
the Community Outreach Court. As a full time judge, I may only appear before an executive or legislative body under
limited circumstances and I believe this is the most appropriate way to share my thoughts within that applicable rules. I
appreciate the opportunity to provide insight into the impetus for and creation of the program.
When I took office, I was dismayed by the number of individuals suffering from homelessness, charged with offenses, who
failed to appear in City court when redirected and re-offended shortly after being convicted. It was evident this revolving
door approach to court proceedings was ineffective because the underlying issues causing individuals in this population to
offend, such as mental illness, substance abuse, lack of access to affordable housing, and employment were going

unaddressed. The revolving door approach was negatively impacting the community, congesting the court docket, and no
way serving the affected population. A new approach was developed to address the special needs of the homeless
population and the Community Outreach Court was formed in the fall of 2020.
With this program, any individual charged with a non-violent offense who lacks a stable residence almost immediately
connected with the RISE court coordinator after arraignment who connects the person with the social services they need.
The court coordinator facilitates communication regarding service referrals and other matters through the pendency of the
case and often for one-year post conviction. The RISE court coordinators Jenna Espey and Vitoria Fefarro consistently
exceed every expectation and/are incredibly dedicated and passionate about the cause. They provide transportation to
and from court, treatment appointments, and physiological evaluations. They work with individuals while they are
incarcerated setting them up for success with treatment and housing plans for when they are released from jail. The work
they do seems endless and it would be impossible to list all they do in connection with the program.
You will see from the data in the upcoming presentation the Community Outreach Court has proven to benefit the
community and improve the lives of the participants. This success simply would not be possible without RISE and the
work of the court coordinators. The data RISE will present demonstrates the extraordinary success of the Outreach
Court. I am humbled by the impact the program has had and grateful for the opportunity to be part of it.

Honorable Francine Vero
Sybil, stated since October 2020, 60 individuals have participated in the Community outreach courts. Of
all the participants, 77% have appeared at all their court dates. Participants have either completed their
ACOD (Adjournment in Contemplation of Dismissal) by remaining arrest free for six months, entered into
a rehabilitation facility, or went to jail. The court coordinators made 182 service referrals for primary care,
housing, rehabilitation, etc. with 132 of those referrals being accepted into the agency they were referred
to.
Victoria explained ACOD means Adjournment in Contemplation of Dismissal. An individual will appear a
couple times to show they wish to be part of the program and then put on ACOD with a six-month or one-
year hold. The length of the hold will be dependent upon the severity of the charges and if they have
been on ACOD in the past. The court is updated regarding the appointments attended or not attended
and any overall progress made.
Commissioner Montagnino added that at the completion of a successful ACOD, the charges are
dismissed.
DPW – Urban Forestry Management Plan
Commissioner Golub introduce Steve Lashomb from the Department of Public Works.
Alex Hancock of PlanIt Geo presented. Mike Martini attended the presentation with Alex.
Alex stated they have worked with City staff and Sustainable Saratoga and set goals based upon the
inventory data completed last year. Benefits of urban forests include clean air and protection of wildlife
and threats such as population growth, construction conflicts and program resources. They completed a
full analysis of the tree diversity, number of trees, percent of trees by species, and importance value in
the City of Saratoga Springs. They identified which trees are critical for removal with 144 needing
removal; street pruning required; and plantings of new trees. The Emerald Ash Borer is present and
requires a separate part of the plan to be addressed. Steve Lashomb is working in the capacity of
multiple positions when he should be focusing on one position and should have additional staff. Next
steps for implementation is adoption of the plan.
Mayor Kim asked what the difference is between an invasive and non-native species.
Alex advised an invasive species in an area has established it will become a dominant species in the
event there is space for that species to reproduce. A tree can be non-native and not dominate a
geographic area.

Commissioner Moran asked what the current staffing number now.
Steve stated there are three. The number of staff varies at all times.
Commissioner Moran asked Steve what he needs to properly do this job absent of staff.
Steve stated things have run more efficiently since the completion of the inventory. Documentation is
also very important. This software helps them to know what needs to be done.
Commissioner Golub stated there are reactive to calls due to not having the budget for a team to make
them proactive.
Steve stated the next round of grant money is first quarter of 2023. He will apply for a planting grant.
Mayor Kim stated the Delta Consulting Group is looking for grants for building and economic
development. The City could task them to look at grants for this.
Steve stated he has been asked to co-chair the Region 5 RELEAF Committee. This Committee supports
and motivates other municipalities to create programs like ours.

County Budget Update

Supervisor Veitch reported a special budget meeting workshop was held on November 9, 2022. There
was little change to the budget and remains at a $378.3 million dollar budget with a 5% property tax
reduction. The vote is scheduled for December 14, 2022.
Tara Gaston
Public Health Update
Supervisor Gaston reported stated the 7-day rolling positivity rate has decreased significantly. The
variant seen right now are part of Omicron. The RSV positivity rate is increasing and now being seen in
older children and adults and positive flu tests have increased 200% in the past week.
Saratoga County Budget
Supervisor Gaston reported historically they have not seen a lot of people attend budget hearings. Most
of the opioid funds received by the county is going toward veterans and incarcerated people. In order to
stay below the tax cap the County must lower property taxes.
NACO Appointment
Supervisor Gaston reported she is one of the County officials appointed for advancing racial equity. They
will be meeting across the country on how to improve equity.

Discussion and Vote: Capital District Transportation Committee Unified Planning Work Program Grant
(22-473)
Mayor Kim moved and Commissioner Sanghvi seconded to approve the Capital District
Transportation Committee Unified Planning Work Program Grant application.
Mayor Kim advised matching funds are in the amount of $15,000, which will be in-kind services.
Commissioner Sanghvi asked if it intended to re-route truck traffic.
Mayor Kim stated it will look at a variety of mitigations. It may also include ticketing trucks through the
Department of Public Safety. In the past, a few commissioners have looked at bypasses. If the City fully
and completely takes over Broadway, the City can regulate things.

Discussion and Vote: Authorization to Accept the Saratoga County Trails Grant Program (22-516)
Mayor Kim moved and Commissioner Moran seconded to accept the Saratoga County Trails Grant
Program in the amount of $10,000.
Mayor Kim stated this is to create parallel parking along the Blodgett property. The City will match the
grant amount.

Set Public Hearing: Enhancing Union Avenue
Mayor Kim set a public hearing for Tuesday, December 6, 2022. The City is looking to install a bike lane
on Union Avenue from East Avenue to Congress Park.
Announcement: Non-Profit Grant Program
Mayor Kim announced the previous City Council approved a non-profit grant program. There are three
eligibility categories – human services housing and workforce development; environmental sustainability
and resiliency; and arts, culture, and history. The City is looking for applications from non-profits that
address those issues. The application period begins tomorrow (11/16/2022) and ends 12/31/2022.

Discussion and Vote: 30 Day SLA Waiver Authorization (22-517)
Commissioner Moran advised that the City Clerk’s Office receives a 30-day advance notice that a
restaurant is going to apply for their liquor license through the New York State Liquor Authority. Many of
the licensees have the foresight to request the municipality issue a waiver of the 30-day notice. If the
municipality is amenable to the waiver, the municipality’s Legal Department will issue a formal letter
advising of such. It has been common practice to operate this way in the City. Commissioner Moran
stated with the new administration, I am looking for Council to approve our Legal Department to continue
this practice. The issuance of the waiver will also expedite the issuance of a liquor license; otherwise, the
establishment could wait up to 9 months for their liquor license.
Commissioner Moran moved and Commissioner Golub seconded that the Council authorize the
City Attorney to review and approve requests for waivers of the 30-day advance notice
requirement to municipalities, established by Section 110-b of the Alcoholic Beverage Control
Law, for on-premise license applications.
Commissioner Montagnino stated he would be happy to offer a friendly amendment to include the city
attorney must obtain sign-off from each department before issuing the letter.
Commissioner Moran stated his concern is expediency.
Commissioner Sanghvi stated if the City attorney is the point person, he can provide context for the
commissioners to approve as quickly as possible.
Commissioner Moran suggested if no response within three days, the City attorney moves forward.
Mayor Kim stated he feels the City attorney should go around to the Council for approval so it doesn’t get
lost.
Commissioner Moran revised his motion to read:

Victorian Street Walk Weekend – begins Thursday, December 1 – Sunday, December 4. Festivities
include the tree lighting on December 1st at 6 p.m.; Caroling on Friday, December 2nd from 5 – 8 p.m.;
Music on Saturday, December 3rd from 5 – 8 p.m.; and Music on Sunday, December 4th from noon – 3
p.m.
Saratoga New Year’s Fest – December 31st and January 1st.
Announcement: Business Milestones
Commissioner Moran recognized DeJonge Jewelers for 40 years of business.
Announcement: Election Update
Commissioner Moran announced there are at least four inspectors at each of the 25 districts in the City.
He drew special attention to Joy King who leads the efforts from the Board of Elections and Matt Hogan
who was the sole maintenance person on the machines this year. Out of 18,000 voters, 12,000 showed.
Commissioner Moran stated the need for more poll workers.
Announcement: Special Recognition
Commissioner Moran announced there has been quite a bit of loss within his peer group. He extended
condolences to the Stevens family, the Coroza family, the Lair family, and the Brimhall family.
FINANCE DEPARTMENT
Update: City Finances
Commissioner Sanghvi stated year to date sales tax is $12,866,087.68, which is a 15% increase from
2021.
The amended budget has been forwarded to all Council members. Allegations have been made that she
has not been transparent with the budget, which is not true. The budget has been on the City website
since before she presented the comprehensive budget. They believe the amended budget is the best
budget for our City.
Update: Third Quarter Financial Report
Commissioner Sanghvi stated the report is on the City’s website. The report ended September 30, 2022.
The report is prepared on a cash basis and no adjustment has been made for receivables or payables.
Commissioner Sanghvi read the following into the record:
REVENUES:
General Fund
Revenues Property taxes in the General Fund are recognized as revenue for the full amount levied at
the time the tax roll is posted to the general ledger and an adjustment made at year-end to defer to
future years the amount not collected. The Finance Office has reviewed the payments made as of
09/30/22 and 87% has been collected or $14,824,510.48. Last year at this time, 87% was collected.
Property taxes can be paid in four installments with the first installment due March 1. However, the City
offers a discount of 2.25% if the full year is paid on or before March 1. This accounts for the greater
than 75% collection rate after the third due date has passed.
As of 09/30/22, many of the City’s larger revenue items are received on a lag, months after they have
been earned.

VLT aid was received on June 17th in the amount of $2,325,592 for 2022. The City’s revised budget
for 2022 is $2,325,592.
Sales Tax figures include distributions for January through July. August and September collections
will be distributed in October and November, respectfully. The amount received as of 09/30/22 was
$9,110,252.30. This was an increase of 11% from 09/30/21. It is expected the City will exceed the 2022
revised budget of $14,900,000
Hotel Occupancy Tax is paid to the City from the County on a quarterly basis. The first quarterly
payment for 2022 was received on April 15th. The second was received on July 15th. As of 09/30/2022,
the City received $201,300.89. Collections are rebounding from 2021 and have about doubled in 2022
when compared to the first two installments of 2021. The 2022 revised budget is $425,000 and the City
expects to exceed it.
County surplus distribution is paid on a quarterly basis and two payments have been received. These
amounts are expected to meet the budget.
NYRA Admissions Tax is paid annually after the racing season has closed.
The bulk of Franchise Tax is paid annually, in the last quarter of the year.
State Aid Revenue sharing is distributed in two installments, September and December, with the
largest share received in December. The September payment was received on 09/15/2022 in the
amount of $227,128. The City expects to meet the revised budget of $1,649,701.
Mortgage Tax is paid semiannually in May and November. Mortgage tax receipts increased
approximately 12% when compared to 09/30/21. As of 09/30/22, $1,135,241.98 was received and as of
09/30/21, $1,017,454.63 was received.
Taking into consideration the property tax revenue recognition issues, approximately 69% of revenues
were received as of 09/30/22. This is a decrease from 2021 at September 30 when 77% of revenues
were received. This decrease is partly a timing issue of when grant revenues are received.
Water and Sewer Revenues
The second quarter water and sewer bills for 2022 were mailed in July for an August 15th due date.
Therefore, only two quarters of revenue have been booked as of 09/30/22. Approximately 40% of water
revenues have been recorded. This is consistent with 2021.
Capital Revenues
The City closed on a General Obligation Bond on June 23, 2022 to finance various 2022 capital
projects for $17,137,299.
EXPENSES:
General Fund Expenses
Finance Office – Discount on Taxes is a final figure.
All – Liability insurance has been paid in full for the year. Additional expenses would be for claims or
additional coverage. Final retirement payments will be made on 12/15/22. Also, most departments’ total
expenses are running at about 62% to 68% of revised budget used except for DPW, which is at 53%.

Since the Community Development Block Grants are awarded on a different schedule than the City’s
fiscal year, no budget is established.
Discussion and Vote: Water and Sewer Fund Recommendations
Commissioner Sanghvi advised recommendations were shared with the Council at the beginning of the
meeting. The water assigned fund balance as of December 31, 2021 was $359,815 and falls below the
minimum of 10% of the fund balance policy. Beginning with the 2023 budget year condominiums and
townhomes will pay the basic service charge, emergency fee, and capital improvement fee. This change
adds 640 properties paying into this.
Commissioner Sanghvi advised the assigned sewer fund balance as of December 31, 2021 was $0 and
falls below the minimum of 10% of the fund balance policy. This is the second year it has fallen below the
minimum requirement.
Commissioner Sanghvi recommended the following actions:
Return $243,971 to the sewer fund balance that was transferred in 2021 to pay for capital
projects.
Condominiums and townhomes will pay the basic service charge, emergency fee, and capital
improvement fee.
Commissioner Sanghvi moved and Commissioner Golub seconded to accept the water and sewer
fund recommendations.
Commissioner Montagnino asked if this is something that should have a public hearing. This is the first
time he is seeing this document as they just received it at the beginning of the meeting. There is a
significant increase in the water rates for high end users.
Commissioner Sanghvi advised this does not increase the water rate for anyone. This is a
recommendation for Department of Public Works to look at these options.
Mayor Kim stated he doesn’t believe a public hearing is required as this is an internal document.
Tony Izzo stated this is different from the process of setting water and sewer rates.
Commissioner Golub stated he doesn’t know that this requires a vote.
Tony Izzo stated it appears these are options to consider so no vote is appropriate at this point.
Discussion and Vote: Approve Use of Insurance Reserve Resolution #5 (22-518)
Commissioner Sanghvi advised this is for damage to a vehicle from storm damage.
Commissioner Sanghvi moved and Commissioner Montagnino seconded to approve the use of
insurance reserve resolution #5, which seeks to use insurance reserve monies in the amount of
$12,862.87 for insurance deductible expense claim number A2F2065.
