Metropolitan Planning Commission (File No. 12-001930-ZA) requesting approval to amend 8-3002 and 8-3025 (a) and (b) to Refer to Animal Control Ordinance the definition section to include a definition for “agriculture general” which clarifies that it applies to commercial activities, add a definition for “agriculture restricted” which applies to the commercial raising of crops without the commercial raising of animals, add a definition for “personal agriculture” which specifically refers to the Animal Control Ordinance for the keeping of animals, and expand the definition of “home occupation;” and replace the use “raising of commercial and noncommercial livestock and poultry” with “agriculture general” in the index and use tables for the C&R and B&I districts; replace the uses “growing of crops, gardens” with “agriculture restricted” and “raising of non-commercial poultry” with “agriculture personal” and allow in all zoning districts, of the City Zoning Ordinance. Melissa Johnson (Mellow Mushroom) Petitioner/Agent, (File No. 15-004789- ZA) requesting to rezone 11 West Liberty Street from an RIP-D (Medium Density Residential) zoning classification to an RIP-B-1 (Medium Density Residential) zoning classification. The petitioner seeks a change of zoning district to allow its restaurant to serve liquor in addition to beer and wine, which Mellow Mushroom is already licensed to serve. The larger parcel and building in which the restaurant is located already contain uses that are permitted to serve liquor (The Public restaurant and the Knights of Columbus event space). The north side of Liberty Street between Whitaker Street and Bull Street is zoned to allow restaurants that serve liquor, which SoHo South Café at 12 West Liberty Street does. The subject property is located within a “to-go cup” zone, which allows alcoholic beverages, including liquor, to be consumed in the public rights of way in accordance with the requirements of the City of Savannah Alcoholic Beverage Ordinance.  -3- Permitted uses within the current RIP-D District and proposed RIP-B-1 District are similar, though there are some differences. If approved, hospitals, some care homes and funeral homes would no longer be permitted, while restaurants that serve alcohol, Laundromats, and grocery stores would be allowed. If approved, Mellow Mushroom would not be allowed to serve alcoholic beverages without a full-service meal, which is the current requirement. MPC unanimously approved the requested rezoning from an RIP-D (Medium Density Residential) zoning classification to an RIP-B-1 (Medium Density Residential) zoning classification. Recommend approval. 11. Metropolitan Planning Commission, (File No. 15-004243-ZA) requesting to amend to Article B (Zoning Districts), Section 8-3030 (n)(6)(Savannah Historic District Ordinance) of the City of Savannah Zoning Ordinance. The use of fiber cement material as a replacement for historic wood is not consistent with the Historic District Ordinance or the Secretary of the Interior’s Standards for Rehabilitation. To allow the wholesale replacement of historic wood with fiber cement on all historic buildings could jeopardize the historic integrity of the National Historic Landmark District and would damage the historic authenticity of the District. Recommend continuing hearing to November 12, 2015. 12. Eric Riley, Petitioner and Solomon A. Amusan, J.D., Agent (File No. 15- 004814-ZA) requesting to amend Section 8-3129 (14) (b) and (15) (c) Commercial Use Standards; Vehicle Repair of the zoning ordinance to allow some minor vehicle repair to occur outside a building in Mid City. The findings of staff lead to the conclusion that the proposed amendment is contrary to planning best practices and maintaining the integrity of neighborhoods within Mid City. It has been the policy of the City of Savannah to ensure the protection of neighborhoods and to abate the impacts associated with outdoor vehicle repair by requiring those repairs to occur within a building. This condition is consistent across the zoning districts where the use is allowed and in staff’s opinion should remain. The Planning Commission recommends denial of the petitioner’s request to amend Section 8-3129 of the zoning ordinance to allow some minor vehicle repair to occur outside a building in Mid City. Recommend denial.  -4- ORDINANCES Second Readings 13. Amendments to the City of Savannah Animal Control Ordinance (Sections 9- 5000 - 5061). An ordinance to allow, with restrictions, certain types of animals within the City of Savannah, including chickens, bees, horses, pigs and other livestock. The City of Savannah, Metropolitan Planning Commission, Savannah Chatham Metropolitan Police Department Animal Control, and other stakeholders participated in a task force under the direction of Dr. Blake Caldwell to create the draft revisions to both the City and County ordinances. The revisions establish consistency to allow property owners to utilize their properties for sustainable urban agriculture while ensuring that they do not impose on their neighbors. (Continued from the meeting October 1, 2015). 14. Proposed Amendment to the City of Savannah Temporary Curfew Ordinance (Section 9-1024). An ordinance to temporarily amend the City of Savannah’s curfew ordinance and create Youth Support Centers designed to safely detain and assess minors until they can be safely returned to their parents or other responsible authority. MISCELLANEOUS 15. Appointments to Boards, Commissions & Authorities. BIDS, CONTRACTS AND AGREEMENTS 16. Easement to Georgia Power Corporation. Georgia Power Company (“GPC”) is requesting an easement across City-owned real property located at 10610 Middleground Road that’s along the east side of Middleground Road just north of Quail Forest Drive. The parcel is part of a large former waste-water treatment site, and other parcels have been assembled with this parcel to facilitate future parks and recreation uses. GPC is seeking an easement of 528 square feet along the road frontage and access to this parcel to install overhead transmission lines. The easement is part of a proposed GPC 115k/V Transmission Line upgrade project extending from the New Dutchtown Substation to the Lewis Drive Substation. There will not be any poles or guy wires within the easement area, and the easement is solely to provide a buffer to these high voltage power lines. The City retains the underlying fee value of the property, including the right to install, modify, maintain, and operate its utilities in the easement area, as well as the right to grant easement rights to other utilities (i.e., cable, gas, telecom, fiber optics, etc.) as long as such additional uses do not injure or interfere with the use of the easement by GPC.  -5- The requested easement has been reviewed by Real Property Services, the Bureau of Public Works and Water Resources, the Bureau of Leisure Services, and the Assistant City Attorney. GPC offered the City $1,100.00 for the easement. The City retained a well- qualified state certified general real estate appraiser who concluded a market value of $1,439.00. GPC has agreed to offer the City the appraised value of $1,439.00. Recommend authorizing the City Manager to enter into an agreement with Georgia Power Company for the easement across City-owned real property for development of a high voltage transmission project. (A map is attached.) Recommend approval. 17. Autodialers – Annual Contract – Event No. 3201. Recommend approval to award an annual contract for autodialers to EH Solutions in the amount of $51,620.00. Autodialers are telephone-based automatic monitoring systems. The contract will provide Conveyance and Distribution Department with autodialer monitoring and alarm notification systems in various wastewater pumping stations in the event of emergencies. Recommend approval to procure construction services from Johnson-Laux in the amount of $1,229,203.28. These services will be used for the streetscape improvements along Waters Avenue from 37th Street to Anderson Street. The work includes brick paver sidewalks, stamped concrete crosswalks, ADA compliance ramps, fixtures, landscaping, and ornamental lighting.  -6- This project originally received two bids that both exceeded the engineer’s estimate. As a result, the State of Georgia’s job order contractor is being recommended to perform this project. The State of Georgia’s job order contract is considered a convenience contract that is available for use by all State, City, and County public entities. The purpose of this contract is to provide multi-traded general construction services to accomplish small to medium sized projects for repair, alteration, modernization, rehabilitation, and minor new construction to infrastructure, buildings, structures, or other real property. The State of Georgia used a competitive bidding procedure to select Johnson-Laux Construction to serve as the sole provider of these services for this region. Johnson-Laux’s pricing is $89,401.72 lower than the lowest bid received for this project. The project included an overall MWBE goal of 17%, with the breakdown of 11% MBE and 6% WBE. Based on the proposed schedule of M/WBE participation submitted by Johnson-Laux, the overall M/WBE participation will be 18.9%, with 11.52% MBE being performed by Groundworks Contracting and 7.38% WBE being performed by Atlantic Star. (B)Indicates local, non-minority owned company. *Indicates value engineered amount. Recommend approval. 19. President Street Wastewater Plant Solids Handling – Emergency Sole Source – Event No. 3712. Notification of an emergency sole source procurement of construction services from Southern Champion in the amount of $337,400.00. These services are necessary to install a sludge line for the President Street Wastewater Plant solids handling. This sludge line will be retained to also serve as the long range back-up for loading dewatered sludge in the event that primary sludge handling facilities must be taken out of service.  -7- This is an emergency sole source procurement because the use of the incinerators at the plant must be discontinued by March 2016 in order to be in compliance with the Federal Air Emissions regulations. In order to discontinue the incinerators, it will be necessary to haul generated solids while the final handling facilities are being designed and constructed. Therefore, the sludge line is necessary for staff to be able to safely load the bio-solids that are produced in the interim. Failure to have an adequate discharge line to load trucks will mean the incinerators cannot be taken off- line on the required date, thus placing the plant in violation of the Federal Air Emissions regulations effective in March of 2016. A violation of these regulations would subject the City to potential fines. This vendor was selected because it was the only contractor with the necessary expertise that could begin work immediately and complete it by the deadline. E.P. Southern Champion Construction (Garden City, GA) (D)$337,400.00 Funds are available in the 2015 Budget, Capital Improvements Fund/ Capital Improvement Projects/Other Costs/Treatment Plant Capital Maintenance (Account No. 311-9207-52842-SW0810). Pre-Employment Psychological Assessment and Testing for Savannah- Chatham Metropolitan Police Department – Annual Contract – Event No. 3365. Recommend approval to award an annual contract for pre-employment psychological assessments of law enforcement candidates to Stephen J. Sampson, PhD in the amount of $300.00 per candidate and in an amount not to exceed $40,000.00. The services are needed to screen law enforcement applicants. The method used for this procurement was the Request for Proposal. Proposals were received and evaluated on the basis of qualifications, methodology, fees, references, and local preference. The recommended proposer is willing to perform the psychological testing at a City of Savannah site which will improve the efficiency of the administration. Recommend approval to procure construction services from Collins Construction in the amount of $1,480,000.00. The services will be used for the new Savannah Fire Training Facility located on Agonic Road. The project will consist of a new fire training classroom facility and will include offices, restrooms, locker room and showers, vehicle operation simulator room, and other ancillary spaces. Associated site work on two acres includes limited paving, bioswales, detention ponds, and landscaping. Seven contractors were pre-qualified to bid on this project. Of those seven, three submitted bids. Two were deemed to be in compliance with the MWBE goals set forth in this project and were opened and evaluated. The project includes an overall MWBE goal of 15%, with the breakdown of 9% MBE and 6% WBE. Based on the proposed schedule of MWBE participation submitted by the low bidder, the overall MWBE participation will be 38%, with 9% MBE being performed by Economy Masonry in the amount of 3% and MCN in the amount of 6%. The WBE participation submitted by the low bidder is 29%, with 27.5% being performed by Collins Construction and 1.5% being performed by Bridges Wood Products. The parts will be used as stock items in the President Street Plant warehouse. The criteria for this RFP included experience and qualifications, methodology of providing debris management services, references, responsiveness, and fees.
