The Invocation was given by Prophetess Hazel Scott, Resurrection Pentecostal Temple followed by the Pledge of Allegiance to the Flag. PRESENT: Mayor Edna Jackson, Presiding Mayor Pro-Tem Van Johnson, II Alderman Tony Thomas, Chairman of Council Alderman Mary Osborne, Vice-Chairman of Council Aldermen John Hall, Mary Ellen Sprague, Estella Shabazz, Carol Bell, Tom Bordeaux City Manager Stephanie Cutter City Attorney W. Brooks Stillwell Assistant City Attorney William Shearouse Upon motion of Alderman Johnson, seconded by Alderman Shabazz, unanimous approval was given for the Mayor Pro-Tem to sign an affidavit and resolution on Litigation for an Executive Session held today where no votes were taken. (SEE RESOLUTIONS) MINUTES Upon motion of Alderman Osborne, seconded by Alderman Johnson, and unanimously carried the summary/final minutes for the Emergency Meeting of October 23, 2015. Upon motion of Alderman Osborne, seconded by Alderman Johnson, and unanimously carried the summary/final minutes for the City Manager’s briefing of October 29, 2015. Upon motion of Alderman Osborne, seconded by Alderman Shabazz, and unanimously carried the summary/final minutes for the City Council meeting of October 29, 2015. APPEARANCES Alderman Johnson read a Proclamation declaring November 14, 2015 as “National Type I Diabetes Awareness Day.” Christian Cruz, Director of Live Oak Public Libraries and Kristy Devine, Marketing and Development Coordinator appeared to invite Council and the community to the 12th annual Savannah Children’s Book Festival, which will take place November 14 in Forsyth Park from 10 a.m. until 4 p.m. Mr. Cruz stated the festival continues to be a great partnership with the City of Savannah. He outlined a few of the events that will take place during the festival. 1  OFFICIAL PROCEEDINGS OF SAVANNAH CITY COUNCIL MEETING November 12, 2015 Bob Rosenwald appeared to discuss the documentary entitled “Rosenwald” about the life of Julius Rosenwald, who rose to become President of Sears Roebuck a century ago and dedicated his life to philanthropy. The movie premiers in Savannah on November 20 at the Eisenhower Theaters, the creator will be at the theater on November 21. Alderman Bell encouraged individuals throughout the community that work with youth groups to go see the movie as a way to show them history. Sgt. John Cain appeared to be recognized for their support during the 2015 Rock & Roll Marathon. Chief Lumpkin stated Sgt. Cain represents one of the Savannah Chatham Metropolitan Police Department’s finest, his heartwarming act of kindness has gone viral and has been viewed by many to include people oversees. Sgt. Cain stated he is proud to represent the law enforcement community by being present today. A plaque was presented to Sgt. Cain from the Savannah City Council. Mayor Jackson also recognized Billy Rawlings, Team Captain, Teresa Warren, Critical Care Manager, Jimmy Hatrick, Risk Manager, Cheryl Rawlings, Imaging Manager and Betty Jackson, Nurse St. Joseph/Candler Medical Personnel who assisted with racers who may have passed out or needed other forms of medical attention. Marty Johnston, Deputy Assistant to the City Manager also thanked St. Joseph/Candler Medical Personnel for their assistance during the race stating this year’s race was faced with extreme temperatures which made the event more difficult than previous years. In addition, she thanked the SCMPD officers, Sanitation, Traffic Engineering and all volunteers that assisted with the race. Mayor Jackson thanked Marty Johnston and the SCMPD officers who assisted with the race on behalf of Savannah City Council. LEGISLATIVE REPORTS ALCOHOLIC BEVERAGE LICENSE HEARINGS As advertised, the following alcoholic license petitions were heard. No one appeared in objection to the issuance of these licenses. Scott C. Kier for Savannah Taphouse, LLC t/a Savannah Taphouse, requesting liquor, beer and wine (drink) license with Sunday sales at 125 East Broughton Street, which is located between Abercorn Street and Drayton Street in District 2. The applicant plans to operate as a full-service restaurant. (New ownership/management) Recommend approval. Alderman Bordeaux asked Mr. Kier if he understood having an alcohol license is a privilege and not a right and comes with certain rules and regulations that he must abide by; if he doesn’t abide by those rules and regulations the license can be revoked; if he promised to comply with those rules and regulations. Mr. Kier responded yes to all questions. Hearing closed upon motion of Alderman Hall, seconded by Alderman Osborne, and unanimously carried. Approved upon motion of Alderman Hall, seconded by Alderman Thomas, and unanimously carried per the City Manager’s recommendation. Cherri K. Stamey for Wal-Mart East, LP t/a Walmart #4530, requesting beer (package) and wine (package with tasting) license at 10530 Abercorn Street, which is located between Wilshire Boulevard and Magnolia Avenue in District 6. The applicant plans to operate as a retail grocery store. (New location/ownership) Recommend approval. Alderman Thomas asked Ms. Stamey if she understood having an alcohol license is a privilege and not a right and comes with certain rules and regulations that she must abide by; if she doesn’t abide by those rules and regulations the license can be revoked; if she promised to comply with those rules and regulations. Ms. Stamey responded yes to all questions. Mayor Jackson asked if the establishment isn’t opening until January 2016, will they have to apply for a new license at the beginning of the year. Judee Jones, Revenue Department appeared stating they will have to renew in 2016, and they are aware the license will expire December 31 but wanted to move forward without delay. PUBLIC HEARINGS 2016 Housing and Community Development Plan One-Year Action Plan. This is the second public hearing to receive comments concerning the City’s 2016 Housing and Community Development One-Year Action Plan for the allocation of Community Development Block Grant (CDBG), HOME, and Emergency Solutions Grant (ESG) funds. The plan is based on HUD program requirements, Council priorities, public input and stated objectives as identified in the City’s 2013-2017 Housing and Community Development Plan. Recommend approval. Ivan Cohen appeared stating he is interested in the quality and affordable housing aspects which he hopes is included in the plan. Approved upon motion of Alderman Bell, seconded by Alderman Osborne, and unanimously carried per the City Manager’s recommendation. ZONING HEARINGS Metropolitan Planning Commission, (File No. 15-004243-ZA), requesting to amend to Article B (Zoning Districts), Section 8-3030 (n)(6)(Savannah Historic District Ordinance) of the City of Savannah Zoning Ordinance. The use of fiber cement material as a replacement for historic wood is not consistent with the Historic District Ordinance or the Secretary of the Interior’s Standards for Rehabilitation. To allow the wholesale replacement of historic wood with fiber cement on all historic buildings could jeopardize the historic integrity of the National Historic Landmark District and would damage the historic authenticity of the District. (Continued from the meeting of October 29, 2015). Recommend denial of rezoning request. Marcus Lotson, Metropolitan Planning Commission appeared to briefly describe the petitioner’s request. 3  OFFICIAL PROCEEDINGS OF SAVANNAH CITY COUNCIL MEETING November 12, 2015 Alderman Thomas asked how the Historic Savannah Foundation acquired this type of easement or is it legislated. Attorney Stillwell stated the HSF purchased many properties over the years to save them through their revolving fund. Rich Siouf, Petitioner came forward thoroughly describing his request. Mr. Lotson stated this particular property has an existing residential building in the carriage house what has been filed is a text amendment to the Historic District Ordinance. Based on the petitioner’s application anything done will apply to all buildings within the Historic District. Alderman Osborne stated the integrity of the Landmark District would be tampered by changing this regulation and although she understands Mr. Siouf’s concerns of having to constantly repair buildings when people buy into the Landmark District they know in advance because they know what they have to maintain and keep up. She asked if the owner(s) decide not to obey the regulations will they be taking the property off the historic roll. Mr. Lotson replied there is a zoning enforcement process the owner would have to go through. There are hundreds of buildings made primarily of wood and have been maintained over the years and are in excellent condition but do require maintenance. Daniel Carey, HSF stated the comments made by Attorney Stillwell were true, in addition people of their own free will and accord have donated easements to the HSF to monitor them. He stated the property being referenced today was donated to HSF. Hearing closed upon motion of Alderman Johnson, seconded by Alderman Hall, and unanimously carried. Ordinances Second Readings Ordinance read for the first time in Council October 29, 2015, read a second time, November 12, 2015 placed upon its passage, adopted and approved upon a motion by Alderman Thomas, seconded by Alderman Sprague and unanimously carried per the City Manager’s recommendation. Metropolitan Planning Commission (File No. 12-001930-ZA). An ordinance to amend 8-3002 and 8-3025 (a) and (b) to Refer to Animal Control Ordinance the definition section to include a definition for “agriculture general” which clarifies that it applies to commercial activities, add a definition for “agriculture restricted” which applies to the commercial raising of crops without the commercial raising of animals, add a definition for “personal agriculture” which specifically refers to the Animal Control Ordinance for the keeping of animals, and expand the definition of “home occupation;” and replace the use “raising of commercial and noncommercial livestock and poultry” with “agriculture general” in the index and use tables for the C&R and B&I districts; replace the uses “growing of crops, gardens” with “agriculture restricted” and “raising of non-commercial poultry” with “agriculture personal” and allow in all zoning districts, of the City Zoning Ordinance. 4  OFFICIAL PROCEEDINGS OF SAVANNAH CITY COUNCIL MEETING November 12, 2015 AN ORDINANCE To Be Entitled AN ORDINANCE TO AMEND PART 8, CHAPTER 3, ZONING TO ESTABLISH AGRICULTURE RESTRICTED, AGRICULTURE GENERAL AND AGRICULTURE PERSONAL USES IN CERTAIN ZONING DISTRICTS AND TO ESTABLISH DEFINITIONS FOR SAID USES; TO AMEND THE HOME OCCUPATION DEFINTION; TO REPEAL ALL OTHER ORDINANCES IN CONFLICT HEREWITH AND FOR OTHER PURPOSES. (Generally), Sec. 8-3002 Definitions; Establish Definitions for Agriculture General, Agriculture Personal and Agriculture Restricted; and to Amend the Definition of Home Occupation. Agriculture General. Commercial agriculture activities of all types, livestock and poultry farms, dairy farms, fisheries, activities including sawmills, the raising and harvesting of crops and uses of a similar nature. This does not include personal agriculture. More than 30 poultry, 10 pigs, or 10 other livestock shall constitute commercial agriculture activity. Agriculture Personal. Agricultural activities intended for personal use such as gardening, beekeeping, the keeping of chickens, and uses of a similar nature. Personal agriculture activities involving animals are subject to additional restrictions in the City of Savannah Animal Control Ordinance. Agriculture Restricted. Commercial agriculture activities limited to the raising and harvesting of crops and uses of a similar nature, but not including the keeping of animals for commercial purposes. Home Occupation. An occupation carried on within a home or from a home only by family members residing in the home, using only such equipment as is customarily found in the home, involving no display of articles or products, and, except as otherwise provided, having no on- premises signage identifying the occupation and having no on-site storage of equipment, or materials used to deliver products or provide services off-site and having no on-site assembly or storage of vehicles other than the customary household vehicles. Arranging to provide or deliver products or services off-site which are produced on-site or off-site and involve no on-site employees other than those living in the home, and involve no assembling or storage of materials or equipment on the premises. However, this definition shall also include the following activities: (1) Boarding not more than two nontransient guests; (2) A family day care home; or (3) A beauty parlor operating in a room separate from but attached to a dwelling unit and using equipment other than that customarily found in a home, occupying not more than 500 square feet of floor area, and employing no more than two people, both of whom shall reside in the dwelling to which the beauty parlor is attached. The plan is based on HUD program requirements, Council priorities, public input and stated objectives as identified in the City’s 2013-2017 Housing and Community Development Plan. Recommend approval. Approved upon motion of Alderman Thomas, seconded by Alderman Johnson, and unanimously carried per the City Manager’s recommendation. RESOLUTION WHEREAS, the City of Savannah, Georgia expects to receive a total of $3,841,005 from the United States Department of Housing and Urban Development in the form of Community Development Block Grant, Emergency Solutions Grant, and HOME Investment Partnerships funds for the fiscal year 2016; and WHEREAS, it is a condition for receipt of such funding that the City submit to the United States Department of Housing and Urban Development a comprehensive multi-year Housing and Community Development Plan, including a one-year action plan for the fiscal year 2016, and WHEREAS, the City has developed a 2013-2017 Housing and Community Development Plan which includes a 2016 One-Year Action Plan that have been published and made available online for public comment for a period of 30 days, and two public hearings have been held on May 5, 2015 and November 12, 2015, to discuss and receive comments on the plan; and WHEREAS, the City of Savannah seeks to support agencies that can successfully provide services to assist low-to-moderate income persons and carry out projects to improve housing, economic development and other eligible activities; NOW, THEREFORE, BE IT RESOLVED that the Mayor and Aldermen of the City of Savannah authorize Stephanie Cutter, City Manager, to submit to the United States Department of Housing and Urban Development the City’s 2013-2017 Consolidated Housing and Community Development Plan and the One-Year Action Plan for 2016 and to enter into grant agreements with the subrecipients named therein. ADOPTED and APPROVED: NOVEMBER 12, 2015. 2015-2016 CORPORATION FOR NATIONAL AND COMMUNITY SERVICE GRANT APPLICATION. Approved upon motion of Alderman Johnson, seconded by Alderman Thomas, and unanimously carried per the City Manager’s recommendation. 11  OFFICIAL PROCEEDINGS OF SAVANNAH CITY COUNCIL MEETING November 12, 2015 RESOLUTION WHEREAS the City of Savannah is an eligible applicant under the rules of the Corporation for National and Community Services’ 2015 – 2016 Notice of Funding Availability; and WHEREAS the City of Savannah is desirous of submitting an application to the Corporation for National and Community Services for three AmeriCorp VISTA members to support the expansion of the Savannah Youth Ambassador Program; and WHEREAS the program is designed to enhance the social, personal and civic engagement skills of youth that will impact priority neighborhoods below the poverty line with concrete projects addressing community health, environmental quality, and community vitality. NOW, THEREFORE, BE IT RESOLVED that the Mayor and Aldermen of the City of Savannah, Georgia, hereby authorize Stephanie S. The Initiative’s goal is to increase recycling rates in buildings by 30% over three months in five high profile buildings across diverse departments, including City Hall, Gamble Building, Water Distribution, Development Services and Broughton Municipal Building, and then expand program to all City facilities. The DOT bus stop would be relocated to the south and the tour stand installed on the north. Tourism Management and Ambassadorship, Traffic Engineering, Mobility and Parking Services and Chatham Area Transit reviewed and support the installation of a tour stand at this location. The Tourism Advisory Committee (TAC) also recommends approval. Recommend approval. Ms. Williams, a retired maintenance worker, sustained a series of orthopedic injuries during her City employment; most significantly in a serious motor vehicle collision in 2010. Her workers’ compensation claim was settled at mediation, contingent upon the approval of Council, for $175,000 in addition to a Medicare Set-Aside of $208,000. The City’s contribution will be $120,000, the balance of its self-insured retention. Safety National, the City’s excess carrier, will pay the balance. Recommend approval. TRAFFIC ENGINEERING REPORTS Reduction in Speed Limit on Berkley Place, Thackery Place, E. 66th Street, and Goebel Avenue. Recommend reducing the speed limit on Berkley Place and Thackery Place between Montgomery and Bull Street, and on E. 66th Street between Bull Street and Waters Avenue from 30 MPH to 25 MPH. Neighborhood residents have complained that these streets are used to circumvent signals and bypass congestion resulting in excessive speeding. Results of speed studies confirm residents’ complaints. Also recommend reducing the speed limit on Goebel Avenue between E. President and E. Gwinnett Streets from 35 MPH to 30 MPH. This portion of Goebel Avenue is residential and serves as a collector street. In order for the speed limit to be enforced, the Berkley Place, Thackery Place, E. 66th Street, and Goebel Avenue speed limit changes must be added to the radar permit through the Georgia Department of Transportation. Recommend that the speed limit on Berkley Place, Thackery Place, and the segment of E. 66th Street between Bull Street and Waters Avenue be reduced from 30 MPH to 25 MPH, that the speed limit on Goebel Avenue between E. President and E. Gwinnett Streets be reduced from 35 MPH to 30 MPH, and that a resolution to amend the radar permit be submitted to the Georgia Department of Transportation. Recommend approval. Coastal Workforce Development Board PY2015 Youth Service Provider Contract Awards. Coastal Workforce Development Board request approval of the PY2015 Workforce Innovation and Opportunity Act (WIOA) Youth Services Provider contracts in the amount of $655,778 and authorization for the City Manager to execute these contracts. On June 25, 2015, Council approved receipt of the Coastal Region’s PY2015 WIOA Youth Services grant allocation of $1,755,014. On October 22, 2015, Coastal Workforce Development Board’s Executive Committee approved awards to two individual service providers: Paxen (a program of Eckerd) and Savannah Impact Program. The funds will be used to administer WIOA youth program services from July 1, 2015 through June 30, 2016 to low-income youth between ages 14 to 24. Services will include work experience, occupational skills training, alternative secondary school services, tutoring and supportive services to Camden, Chatham, Glynn and McIntosh Counties. Recommend approval . Workforce Innovation and Opportunity Act (WIOA) Contract Modifications. Coastal Workforce Services is seeking approval to modify contracts approved by City Council for Workforce Innovation and Opportunity Act (WIOA) Adult and Dislocated Worker Service Providers. Affected providers include Ross Innovative and Employment Solutions Corporation (Ross-IES), Georgia Department of Labor (GDOL) - District 5 East, and William Kennemore, CPA, LLC. Ross Innovative and Employment Solutions Corporation (Ross-IES) The first contract allows Ross-IES to provide Business Services Support & Compliance, Career & Case Management, One-Stop Operator and Resource Room Services to newly enrolled WIOA participants throughout the ten-county region. The contract period is June 1, 2015 – June 30, 2016. There are no revisions or material changes to the contract’s scope of work. The Resource Room Services contract budget will decrease by $20,000 and both the Business Services Support & Compliance and Career & Case Management Services allocations will increase by $10,000, respectively. The modifications will cover the cost for equipment and other supplies needed to provide adequate services to the WIOA participants. The second contract allows Ross-IES to provide One-Stop Operator Services to newly enrolled WIOA participants throughout the ten-county region. The contract period is June 1, 2015 – June 30, 2016. The level of services and the contract scope of work will not change. The requested funds will be used for One-Stop/Job Centers building leases and other operational costs throughout the ten-county region. The cost was not budgeted in the initial contract and the increase is due to the loss of building space previously provided by the Georgia Department of Labor. Recommend approval of Contract Modification No. 1 to Senior Citizens, Inc. in the increased amount of $112,670.35. The purpose of this contract is to provide meals for the City of Savannah (Title III) Meals Program. The contract modification is due to an increase in the number of the senior citizens using the program. Based on the year-todate usage of the contract, the average monthly cost is $38,163.57. The services will be used by the Leisure Services Bureau to install synthetic turf at the Daffin Park Optimist Bowl and the field at Scarborough Park (supports soccer, football, and lacrosse programs). This SPLOST 6 project will save thousands of gallons of water as there is no need for irrigation. It will also eliminate the use of chemicals currently used for fertilization and insect control, thereby eliminating runoff into our rivers and streams. The method used for this procurement was the Request for Proposal, which evaluates criteria in addition to cost. The criteria evaluated as part of this RFP were the manufacturer experience, proposed schedule, project approach and organization, local and MWBE participation, and fees. Design-Build Services – SCMPD Central Police Precinct – Event No. 3617. Recommend approval to procure design-build services from Gilbane Building Company in the amount of $445,020.00. The services will be used for the design and pre-construction of Phase I of the Savannah-Chatham Metropolitan Police Department Central Precinct. The building will be 16,000 square feet, with the design phase scheduled to begin in December 2015. The guaranteed maximum price will be provided by the end of May 2016, with construction scheduled to begin mid-July 2016. It is expected that construction will be completed in April 2017. Four contractors were pre-qualified for this project. Of those, three submitted proposals. A mandatory pre-proposal meeting was held and all pre-qualified vendors attended. The project includes an overall MWBE goal of 4%, with the breakdown of 2% MBE and 2% WBE. Based on the proposed schedule of MWBE participation submitted by the recommended proposer, the overall MWBE participation will be 18%, with 11% MBE being performed by Coastline Consulting Services in the amount of 6% and Sustainable Design Consultants in the amount of 5%. The WBE participation submitted by the recommended proposer is 7%, with 6% being performed by Clemmons Engineers and 1% being performed by Mandel Design, LLC. Alderman Johnson stated he is pleased staff is moving forward with the design and build phase of the new Central police precinct. He stated this is a win, win for several reasons as there is a city owned piece of property in the middle of one of the most densely populated areas in the City. Medicare Advantage Plan – Annual Contract Renewal – Event No. 3707. Changes to governmental accounting standards require recognizing the cost of postemployment benefits over the working career of an employee. In order to reduce this liability while maintaining retiree medical benefits, the best solution is a group sponsored fully insured Medicare Advantage Plan. Based upon 100% enrollment, the estimated annual cost for the approximately 695 covered retirees and spouses equals $1,781,103.00 of which the City will pay on average 52% of the premium. This premium is reflective of an increase of approximately 3% from the prior year. The reason this is a sole source is because our current benefits provider, USI, did a market assessment and determined that this is the most cost effective plan. S.S. Humana, Inc. Design, Build, and Install Eleven (11) Digital Display Kiosks, City of Savannah Event No. 3474, $211,361.02 – Savannah/Hilton Head International Airport. The Savannah Airport Commission request approval of a contract with ECO Construction & Maintenance Management, LLC in the amount of $211,361.02 to Design, Build, and Install Eleven (11) Digital Display Kiosks. The new Kiosks are part of a continuing effort to upgrade and enhance the airport’s ability to communicate information to passengers in a first-class manner. The existing Kiosks are 20 years old and have become outdated. The new Kiosks will be installed in the center of the concourse between gates 4 through 10, and will be capable of displaying: High resolution marketing advertisements, community events, and other passenger related information. The project will consist of the installation of 33 fifty-five inch High Definition monitors configured into 11 three-sided Kiosks, 11 video player units, a video controller unit, and a Content Management Software Suite. The project was submitted as a request for proposal (RFP) through City of Savannah Event No. 3474. The Evaluation Committee selected the ECO Construction & Maintenance Management, LLC proposal as the best value meeting the needs of the Commission. Recommend approval. Alderman Osborne stated as a member of the CAT Board they provide service from the airport into the downtown hotels and have asked them to add that aspect to the kiosk so visitors won’t think they have to take a cab into the downtown area. The following announcements were made: Ms. Robinson announced tomorrow is the last day for Open Enrollment if employees want to make any changes to their Health Benefits. 24  OFFICIAL PROCEEDINGS OF SAVANNAH CITY COUNCIL MEETING November 12, 2015 Mayor Jackson congratulated Alderman Johnson for winning a second term on the National Board for NLC at the meeting in Nashville. Alderman Hall was awarded the Silver Certificate of Achievement. Alderman Johnson received his Magnum Cum Laude Diamond Certificate for Training. Alderman Shabazz was elected as the Regional Board Member for the State of Georgia for NBC Leo. Alderman Hall asked that Mayor Jackson’s office communicate more with Council for parades as he was unhappy that he was not notified of the arrangements for the Veteran’s Day Parade. Mayor Jackson stated she took full responsibility for that as it slipped her mind. Mayor Jackson announced the 2016 Budget Retreat will be held November 18-20, 2015 at the New Ebenezer Retreat Center. Alderman Bell recognized the passing of Mr. Robert McAlister, community activist and former Budget Director with the City of Savannah whose funeral will be Saturday. Mayor Jackson recognized the passing of Alderman Shabazz’s sister whose funeral will be Saturday. The next Council meeting will be held Tuesday, November 24, 2015 due to the Thanksgiving Holiday. Alderman Shabazz announced there will be a Victory Drive Corridor Study Phase 2 meeting this afternoon from 5:30 p.m. until 7:00 p.m. at Alfred Ely Beach High School.
