A Regular Meeting of the Board of Trustees of the Village of Scarsdale was held in
Rutherford Hall in Village Hall on Tuesday, September 9, 2014 at 8:00 P.M.
Present were Mayor Steves, Trustees Lee, Martin, Pekarek, Samwick, and Stern. Also
present were Village Manager Gatta, Deputy Village Manager Pappalardo, Village Attorney
Esannason, Deputy Village Attorney D’Andrea, Village Treasurer McClure, and Assistants to the
Village Manager Scelza and Schnabel.

The minutes of the Board of Trustees Regular Meeting of August 26, 2014 were
approved on a motion entered by Trustee Martin, seconded by Trustee Pekarek, and carried
unanimously.

Bills & Payroll
Trustee Pekarek reported that she had audited the Abstract of Claims dated September 9,
2014 in the amount of $681,556.61 which includes $7,073.72 in Library Claims previously audited
by a Trustee of the Library Board which were found to be in order and she moved that such
payment be ratified.
Upon motion duly made by Trustee Pekarek and seconded by Trustee Martin, the following
resolution was adopted unanimously:
RESOLVED, that the Abstract of Claims dated September 9, 2014 in the amount of
$681,556.61 is hereby approved.
Trustee Pekarek further reported that she had examined the payment of bills made in
advance of a Board of Trustees audit totaling $75,232.63 which were found to be in order and she
moved that such payment be ratified.
Upon motion duly made by Trustee Pekarek and seconded by Trustee Lee, the following
resolution was adopted unanimously:

RESOLVED, that payment of claims made in advance of a Board of Trustees audit

Mayors Comments
Mayor Steves noted that at recent past meetings he had announced the loss of two
employees who had moved up and secured positions in other municipalities. He welcomed Chris
Scelza to the staff as an Assistant to the Village Manager. The general public will get to know
him quickly as a staff member in the Village Manager’s office and he is sure that Mr. Scelza will
maintain the quality of staff in the Manager’s office that everyone has enjoyed in the past.
Mayor Steves announced proudly that Jason Marra, Superintendent of Parks and
Recreation, has been named an extern (one of four) to the Academy of Parks and Recreation
Administrators. This is an excellent externship where they will pay for him to go to the
conference and they will mentor him and be given the opportunity to work and learn with people
with long tenures. On behalf of the Board, Mayor Steves extended his congratulations to Mr.
Marra for that opportunity.
On Sunday, September 28th, there will be a celebration of the 40th Anniversary of “Bike
Sunday” on the Bronx River Parkway. Mayor Steves encouraged the bikers in the community to
join the County in this celebration at the Westchester County Center. There will be flyers around
the community and information on the usual public outlets regarding the details for this event.
Prior to this meeting, the Board met with the Village’s auditors, who presented the audit
for the last fiscal year, FY2013-2014. The Village received, as usual, an unqualified opinion. The
Board and management took its time going through the comments and the financial statements
as it should. By tomorrow, a copy of the financial statement will be up on the home page of the
Village’s website.
Mayor Steves noted that Thursday is September 11th and urged everyone, in their way, to
stop and reflect on what that day meant to this Country, what lessons can be taken from that, and
what responsibilities we have as citizens that were underscored by that day.

Manager’s Comments
Village Manager Gatta stated that the Village was informed today by the City of White
Plains that Saxon Woods Road from the White Plains line to Mamaroneck Road in White Plains
will be closed off to all traffic. The only traffic that will be allowed will be those that have a
residence or a business there. White Plains is undertaking major reconstruction of the road,
curbing, drainage, and new gas lines. The road will be closed beginning September 15th.

Public Comments
Elion Amidor, Teresa Group Resources, noted that he currently has a project at 10
Ogden Road and that Mr. Robert Harrison is constantly bothering the Village employees about
this project. He stated that he spoke to Mr. Harrison and informed him that if he had any
problems concerning the construction that he should contact him directly. The Village
employees are basically Mr. Harrison’s venting venue. None of the Village employees are happy
with him. Mr. Amidor stated that when he asked Mr. Harrison to stop harassing the Village
employees, Mr. Harrison said they are getting paid for that. He told Mr. Harrison that they are
not getting paid to be harassed. They are getting paid to do their job and do their inspection.
Mr. Amidor stated that Mr. Harrison attended the Board of Architectural Review (BAR)
meeting regarding the project’s drainage. This is not the BAR’s issue. The BAR has no
jurisdiction over drainage. As a taxpayer, Mr. Amidor stated that it is not right that Mr. Harrison
is constantly using the Village resources and tying up employees’ time. It is not right that one
person is going to keep the Building and Engineering Departments tied up and not think about
the 6,000 families that we have in Scarsdale.
Mayor Steves stated that the Building Department does a good job in sorting out what it
feels is material and what is not material. He noted that the Board does not want to get into any
issues between individuals, but Mr. Amidor’s point is heard.
Robert Harrison, 65 Fox Meadow Road, stated that since Mr. Amidor raised his
comments, he presented photos of 10 Ogden Road where the presence of mud is obvious
because the erosion control fence is not doing its job and is falling down. The muddy water from
that construction site goes onto 73 Fox Meadow Road, forming a muddy swimming pool over
the Village’s sanitary sewer line which runs right under this property. Sewage water then backs
up into his basement. Mr. Harrison stated that it is incumbent on the contractor if his erosion
control fence comes down due to tree cutting to fix the fence. He said he didn’t know why Mr.
Amidor was so upset. He stated that he knows that if you get a building permit, you are
supposed to keep up with the regulations in place in the Village Code which includes keeping the
erosion control fencing properly maintained. He also noted that Mr. Amidor has had his
equipment at the site at 7:30 a.m., which is before the time of 8:00 a.m. allowed in the Code.
Mayor Steves interjected, stating that this is not the forum to debate respective views
between Mr. Harrison and Mr. Amidor. The Village Staff made the professional decisions when
they went out to inspect the subject site. It is inappropriate to focus on a particular project at this
meeting; there are other venues. The Board is not going to debate and is not going to draw any
conclusions from the testimony given by either party as to the appropriateness of the activity on
that site. That will be left to the professional staff.
Mr. Harrison gave his congratulations to Jason Marra, Superintendent of Parks and
Recreation for being named extern to the Academy of Parks and Recreation Administrators. He

added that there was a Sports Jamboree on Saturday noted in the Inquirer which is a new activity
that Jason and his staff organized.
Another issue in his neighborhood is a blind curve at the corner of Ogden and Fox
Meadow Roads. Cars come around the blind curve and there are people walking on the road and
several driveways including his own that back out onto Fox Meadow Road near this curve.
Mayor Steves noted that Mr. Harrison has already brought this to the attention of the
Village.
Mr. Harrison stated that he did, but that nothing has been done yet although he knows
that the Village staff is looking into it. The low level evergreen bushes that are interfering with
the line of sight at the curve need to be removed because they are a public safety hazard for
everyone.
Mr. Harrison noted that the Board had a very detailed Finance Committee meeting earlier
this evening and that there are a number of issues that the Board will be addressing. He hope
that the Board will keep the community informed on the issues that relate to the tax cap. He
thanked the Board for all the time they have put into that.
Mayor Steves noted that he attended the sports Jamboree on Saturday and stated that it
was a job well done. He had the opportunity to thank everyone involved in all of the sports
programs.
With respect to the Budget, Mayor Steves stated that the Board did have a public Finance
Committee meeting which had been announced to begin preliminary discussion on the FY2015-
2016 Budget – broad, philosophical discussions with respect to the cap. And as always, he noted
that the Finance Committee meetings are public meetings. The public is always encouraged to
attend; the Board is always looking for input on the Budget, both specific and general. The
Board will always advise the public as to where and when they are going to meet and what the
general discussion will be about.
Mayor Steves noted again that he was not trying to be arbitrary in trying to cut off
conversation earlier; he just wants to keep this forum appropriate. The Board understands that
there are issues and the parties that need to be aware of those issues are aware of them and will
carry out their professional responsibilities.
As there were no further comments, Mayor Steves closed the public comments portion
of the meeting.

Upon motion entered by Trustee Martin, and seconded by Trustee Lee, the following
resolution regarding Fiscal Year 2013-2014 Closeout Balancing Budget Transfers was adopted by the
vote indicated below:
WHEREAS: Pursuant to the provisions of Section 5-520 of the New York State Village
Law, the Board of Trustees, by resolution, may transfer funds from
existing and unexpended balances; from a contingent account; from
available cash surplus or unanticipated revenues within a fund; or by
borrowing; and
WHEREAS: at the end of the Village Fiscal Year 2013-2014, it is necessary to make
balancing modifications to and from various accounts of already existing
appropriations in the budget based on actual results of operations, and
WHEREAS: the final 2013-2014 audit has been completed and in all cases, there are
sufficient unexpended balances in various accounts, excess revenues or
fund balances available to cover the transfers, now therefore be it
RESOLVED: that pursuant to Village Law 5-520, the Board of Trustees hereby
authorizes and directs the proper Village officers to modify the 2013-2014
Budget by making the following transfers:

Land Use Committee
Upon motion entered by Trustee Lee, and seconded by Trustee Pekarek, the following
resolution regarding the Extension of Building Permit #141635 for a Residence at 30 Lincoln Road
was adopted by a unanimous vote:
WHEREAS, Building Permit #141635 for exterior alternations and dormer additions at
30 Lincoln Rd., identified on the Village Tax Map as Section 18, Block 02,
Lot 299, expired on June 27, 2014; and
WHEREAS, the owner of the property at 30 Lincoln Rd. has been unable to complete
the construction within the two (2) year period under said building permit
and has requested an extension; and
WHEREAS, the Building Inspector reviewed the application, visited the site, and based
upon the outstanding items left to complete, estimates that the remainder
of the work will take approximately eight (8) months to complete from
the June 27, 2014 expiration date or until February 27, 2015; and
WHEREAS, the Village has incurred additional costs to inspect the home and process
this request for a building permit extension; and

WHEREAS, §132-25 of the Village Code permits the Village Board to extend such
building permits; now therefore be it
RESOLVED, that Building Permit #141635 for exterior alternations and dormer
additions at 30 Lincoln Rd., be extended for eight (8) months from the
current expiration date of June 27, 2014 or until February 27, 2015; and
be it further
RESOLVED, that pursuant to the FY 2014-15 Village-Wide Fees and Charges Schedule,
the owner shall pay to the Village of Scarsdale an additional fee of $425.00
based upon the original Building Permit Fee and the length of this
extension and to compensate for the additional services required to
complete this application.

Municipal Services Committee
Trustee Stern stated that according to Section 272-3 of the Village Code, the Board of
Trustees must determine the number of taxicabs to be licensed each year by the Village. Village
Clerk Conkling has done a study and the demographics of the taxicab licenses that makes sense for
the Village. The Village currently has 25 taxicab licenses authorized with 23 issued this current year.
Based on demographic studies and Metro North train usage, the growth of the population in
Scarsdale, it has been deemed that the 25 taxicab licenses is an adequate number to issue in
Scarsdale.
Trustee Stern stated that the Board will hold a Public Hearing on Tuesday, September 23,
2014 at 8:00 P.M. in Rutherford Hall in Village Hall regarding the number of taxicabs to be
licensed in the Village in 2015 pursuant to Section 272-3 of the Village Code, so moved by
Trustee Samwick and carried by a unanimous vote.

Upon motion entered by Trustee Stern, and seconded by Trustee Lee, the following
resolution regarding an Intermunicipal Agreement with New York City Water Board for Water
Demand Management Planning Assistance was adopted by the vote indicated below:
WHEREAS, the Village of Scarsdale’s water supply is received from the New York City
Water Supply System and delivered through the Kensico-Bronx 48”
pipeline, New York City Catskill Aqueduct and under certain conditions
the Delaware Aqueduct; and
WHEREAS, the New York City Department of Environmental Protection (DEP),
through funding provided by the New York City Water Board, has
initiated a large-scale Water Demand Management Program in New York
Village Board of Trustees 09 -09-2014 P a g e | 278
City and certain “upstate” customers with the goal of reducing overall
water system consumption by 5% by the year 2020; and
WHEREAS, as part of this effort the New York City Water Board has contracted with
a water demand management consulting firm, Water Demand
Management, LLC (Water DM) of Boulder, Colorado, to develop water
demand management plans for New York City customers as well as their
ten largest consuming “upstate” customers in order to identify achievable
water conservation measures to reach the 5% water reduction goal; and
WHEREAS, the Village of Scarsdale is one of New York City’s ten largest “upstate”
customers and the DEP has offered the assistance of Water DM in
developing a Water Demand Management Plan at no expense to the
Village, said plan to include: a water system profile and characterization
including the establishment of baseline usage data; water conservation
goals; proposal and evaluation of water conservation measures and an
implementation plan; and
WHEREAS, the New York City Water Board will assume all costs associated with this
work provided the Village collaborates and works in good faith with
Water DM to complete the Water Demand Management Plan, said
arrangement memorialized through an intermunicipal agreement (IMA)
with the New York City Water Board; and
WHEREAS, upon completion of the Water Demand Management Plan, the Village
will unilaterally decide whether or not to move forward with the
systematic implementation of the plan measures and if implementation is
pursued, the New York City Water Board has offered a funding option
through a separate IMA with funding for the Village of Scarsdale
currently earmarked at $650,000; now therefore be it
RESOLVED, that the Village Manager is herein authorized to execute an agreement
with the New York City Water Board in substantially the same form as
attached hereto, to receive assistance from the Water Board and the New
York City Department of Environmental Protection, for the preparation
of a Water Demand Management Plan through the use of their
professional consultant; and be it further
RESOLVED, that the Village Manager is hereby authorized to undertake any and all
administrative acts as may be required under said agreement.

Recreation Committee
Upon motion entered by Trustee Samwick, and seconded by Trustee Pekarek, the following
resolution regarding Supply Field Building Use for Scarsdale Teen Center Halloween Event was
adopted by the vote indicated below:
WHEREAS, the Scarsdale Teen Center, a non-profit organization whose mission is to
provide teens with fun, safe and substance-free activities, is planning their
fourth annual Halloween “Zombie Asylum” Haunted House event and
has requested the use of the Supply Field Building at 244 Heathcote Road
in order to continue offering regular teen programming at the Teen
Center at 862 Scarsdale Avenue; and
WHEREAS, the haunted house event would be held on the second floor of the Supply
Field building on nine Friday, Saturday and Sunday evenings from
October 10, 2014 to November 1, 2014; and
WHEREAS, the Village would allow access to the second floor storage area of the
Supply Field Building in conjunction with the event from August 20, 2014
to November 14, 2014 in order for the Teen Center volunteers and the
event vendor, Fright Room Productions, to erect and disassemble the
haunted house and props; and
WHEREAS, upon discussion with the Teen Center Executive Director regarding
Village staff concerns about the potential adverse neighborhood impacts
relative to noise, light spillage and potential disorderly conduct as well as
pedestrian/vehicular conflicts, no ancillary entertainment activities, or
music will be permitted around the perimeter of the building with the
exception of a photo area and food table approved by the Village; and
WHEREAS, the Scarsdale Teen Center will provide proper lighting and staff to
safeguard the parking area at the Supply Field Building on all event dates;
and
WHEREAS, Village Recreation Department supervisory staff and Village Volunteer
Firefighters or, in their absence career Fire Department staff will be onsite
during the event hours to oversee the operation, safeguard the building
and represent the Village, and

WHEREAS, the Teen Center has requested that the Recreation and Fire Department
expenses related to the event be absorbed by the Village and, upon
referral by the Village Board at their August 12, 2014 meeting, the Land
Use Committee of the Village Board met on August 26, 2014 and
recommended favorably on the request, provided that the Teen Center
make a strong effort to have volunteers from the Scarsdale Volunteer Fire
Department cover the fire watch for the nine day period; now therefore
be it
RESOLVED, that the Village Board of Trustees herein approves the use of the Supply
Field Building at 244 Heathcote Road, by the Scarsdale Teen Center in
conjunction with their annual Halloween “Zombie Asylum” Haunted
House event during the period of August 20, 2014 through November 15,
2014, during the hours specified in the event schedule and as needed for
the preparation and disassembling of the haunted house and props; and
be it further
RESOLVED, that the Scarsdale Teen Center must provide proper lighting and staff to
safeguard the Supply Field parking area during event dates and make an
extraordinary effort to have volunteers from the Scarsdale Volunteer Fire
Department cover the fire watch for the nine day period so as to limit the
costs for the Village by making the facility available; and be it further
RESOLVED, that the Scarsdale Teen Center and Fright Room Productions will
indemnify and hold harmless the Village of Scarsdale in all actions, claims,
judgments, costs or expenses arising from the haunted house event; and
be it further
RESOLVED, that the Scarsdale Teen Center shall provide the Village with a certificate
of liability insurance naming the Village as an additional insured, at limits
approved by the Village Attorney.

Upon motion entered by Trustee Samwick, and seconded by Trustee Lee, the following
resolution regarding Acceptance of a Gift – Basketball Hoops for Municipal Pool Complex was
adopted by a unanimous vote:

WHEREAS, pursuant to Policy #106: “Gifts to the Village of Scarsdale” of the Village of
Scarsdale Administrative Policies & Procedures Manual, acceptance of all
gifts valued at $500 or greater must be approved by the Village Board of
Trustees; and
WHEREAS, at the August 12, 2014 meeting the Village Board granted permission to
Bootleg Productions Inc., 15 Washington Avenue, Suite 3365 Brooklyn,
New York 11205, to use the Scarsdale Municipal Pool Complex,
specifically the diving pool, upper parking lot and leaf transfer parking lot,
for the purpose of filming a scene for the television show “Boardwalk
Empire”; and
WHEREAS, Bootleg Productions Inc., used the Municipal Pool Complex diving pool
for two days beginning at 7:30 AM on August 26, 2014 and concluding at
4:00 PM on August 27, 2014, for setup and filming which resulted in the
diving pool being closed to pool members for a total of 12 operating
hours; and
WHEREAS, for use of the Municipal Pool Complex, Bootleg Productions Inc. paid the
Village $20,000 and reimbursed the Village an additional $796.67 for
overtime staff costs related to their use of the facility; and
WHEREAS, as an act of appreciation of the Village’s granting them use of the
Municipal Pool Complex and for the Village staff’s cooperation during
filming, Bootleg Productions Inc. is desirous of donating an additional
$3,000 to the Village for the purchase of two new replacement fiberglass
basketball hoops at the Municipal Pool Complex; and
WHEREAS, the new fiberglass basketball hoops would be purchased by the Village
through the Pool Enterprise Fund ER-2000-POOL-POOL-400 and the
Village would be responsible for the removal of the old basketball hoops
and the installation of the new fiberglass basketball hoops; now therefore
be it
RESOLVED, that the Village Board of Trustees herein accepts a gift of $3,000 from
Bootleg Productions, Inc. for the purchase of two fiberglass basketball
hoops to be installed at the Municipal Pool Complex; and be it further
RESOLVED, that the Board of Trustees hereby extends its thanks and appreciation to
Bootleg Productions Inc., 15 Washington Avenue, Suite 3365 Brooklyn,
New York 11205, and Boardwalk Empire for this generous gift to the
community.

Upon motion entered by Trustee Samwick, and seconded by Trustee Martin, the following
resolution regarding Acceptance of a Gift – Counter Top and Sink for the Weinberg Nature Center
was adopted by a unanimous vote:
WHEREAS, pursuant to Policy #106: “Gifts to the Village of Scarsdale” of the Village of
Scarsdale Administrative Policies & Procedures Manual, acceptance of all
gifts valued at $500 or greater must be approved by the Village Board of
Trustees; and
WHEREAS, during the winter and spring of 2014, the Village completed renovations
of the meeting room and kitchen area at the Weinberg Nature Center
which included a replacement tile floor, painting, lighting fixtures,
refinishing of kitchen cabinets and construction of a dividing wall in the
main entrance area; and
WHEREAS, renovation work at the Weinberg Nature Center was performed in-house
by the Department of Public Works Facilities Maintenance Division and
funds for construction material were used from the Weinberg Nature
Center FY 2013-14 General Maintenance Fund A-7020-NATUR
MAINT-400; and
WHEREAS, to assist the Village in completing the renovation at the Weinberg Nature
Center, the Friends of the Weinberg Nature Center wish to donate a
granite kitchen counter top and sink to be installed in the recently
renovated kitchen; and
WHEREAS, the cost to purchase and install the proposed counter top and sink by an
outside contractor is estimated at $2,662.77; now therefore be it
RESOLVED, that the Board of Trustees hereby accepts the Friends of the Weinberg
Nature Center’s gift of the purchase and installation of a granite counter
top and sink at the Weinberg Nature Center to complete the recent
renovations to the kitchen; and be it further
RESOLVED, that the Village Board of Trustees hereby extends its thanks and
appreciation to the Friends of the Weinberg Nature Center for this
generous gift to the community.

Other Committee Reports
Trustee Stern stated that he was very happy to report that the Sustainability Committee
attended an all-day program entitled “Solarize Westchester”. He, Trustee Pekarek, Deputy
Superintendent of Public Works Justin Datino, and CAC member Ron Schulof attended the
Village Board of Trustees 09 -09-2014 P a g e | 283
meeting. He explained that the basic idea is to encourage solar power on commercial, residential
and school buildings. The goal of New York State is that in Westchester County we should put
down 2.5 gigawatts of solar power on all of these types of buildings. The conference explored all
the different types of incentives. The two incentives that are available to residents are a rebate
that covers about 1/3 or more of the installation and a federal tax credit in addition to that. The
other initiative that the State is undertaking is to solarize all of the schools, public and possibly
private schools. These are very strong programs that the State wants to implement. He added
that the Village of Scarsdale has one of the most friendly approval processes in the State with
regard to the installation of solar panels. He also noted that the Village is looking into putting
solar energy panels on Firehouse #1 during renovations there.

Written Communications
Village Treasurer McClure reported on behalf of Village Clerk Conkling that two (2)
written communications have been received since the last meeting:
Letters from Lillian Killian, One Forest Lane, and Frederick and Linda Ball, 55
Tunstall Road, expressing their concerns and suggestions in regard to the proposed
termination of municipal leaf removal.

Mayor Steves noted that both of the communications received dealt with the resolution
that has been sent to the Municipal Services Committee with respect to a proposal for a mulching
program in the Village. He stated that he would like to emphasize that the Board’s strategy is
that they have brought their best thinking together into that proposal at the time to get in front
of the community a specific course of action that had implications to generate community
feedback. Letters are appreciated, the Board asks the community to pay attention to the proposal
and to communicate to the staff or the Trustees your thoughts on mulching. The Board wants to
do what they do in the most informed way and to consider as much as possible each of the needs
and concerns of the Village. There will be public meetings on the topic; we are reaching out to
the gardeners who will have a big part to play in this. We will also have an educational
component as well. This is not a done deal; we want to move this issue along and encourage
community input.
