Village Board of Trustees 12/28/2017 546 THREE THOUSAND TWO HUNDRED NINETY-SIXTH SPECIAL MEETING Trustees’ Room Village Hall December 28, 2017 A Special Meeting of the Board of Trustees of the Village of Scarsdale was held in the Trustees’ Room in Village Hall on Thursday, December 28, 2017 at 9:30 A.M. Present were Mayor Hochvert, Trustees Finger, and Pekarek; and Trustees Ross, Samwick, and Veron (via teleconference). Also present were Village Manager Pappalardo, Village Attorney Esannason, Deputy Village Attorney Garrison, and Village Treasurer McClure. ******** A motion was entered by Trustee Finger, seconded by Trustee Pekarek and approved unanimously to enter into Executive Session to get advice from Counsel regarding Governor Cuomo’s Executive Order allowing prepayment of 2018 property taxes. ******** Upon motion entered by Trustee Finger, seconded by Trustee Pekarek and approved unanimously, the Board adjourned out of Executive Session at 10:41 A.M. ******** Resolution Upon motion entered by Trustee Finger, and seconded by Trustee Pekarek, the following resolution regarding an Interim Levy and Warrant for FY 2018/2019 Village Property Taxes was approved by the vote indicated below: WHEREAS, on December 22, 2017, President Donald J. Trump signed into law the Tax Cuts and Jobs Act (hereinafter the “Act”); and WHEREAS, the Act caps the annual allowable deduction for State and local income, sales and real property taxes at $10,000, adversely impacting many Village of Scarsdale homeowners financially whose current deductions are significantly higher; and Village Board of Trustees 12/28/2017 547 WHEREAS, in an attempt to limit these financial impacts, the Village administration completed a thorough investigation relative to opportunities for Village homeowners to prepay their 2018 taxes by December 31, 2017 to potentially realize the property tax deduction benefits largely eliminated through the Act; and WHEREAS, despite these efforts, which included detailed discussions with our New York State legislative team and various legal and tax experts, the Village was unable to implement a 2018 property tax prepayment plan, with the primary impediment being the New York State statutory requirements associated with preparing, noticing, meeting and adopting a budget and levy prior to the issuance of tax warrants; and WHEREAS, on December 22, 2017, after the close of business, Governor Andrew M. Cuomo, issued Executive Order No. 172, attached hereto, which suspended certain provisions of the New York State Real Property Tax Law and Westchester County Tax Law, and authorized local governments to either adopt their budget or issue their respective tax warrants for the purpose of collecting taxes no later than 11:59 pm on December 28, 2017, with the purpose and intent of allowing for the pre-payment of real property taxes on or before December 31, 2017; and WHEREAS, the Executive Order also authorizes the collection and acceptance of partial payments of real property taxes; now therefor be it RESOLVED, that pursuant to Governor Andrew M. Cuomo’s Executive Order No. 172, attached hereto and made a part hereof, the Town/Village of Scarsdale adopts an interim levy which shall be assessed against the taxable property in the Village of Scarsdale plus a 2% contingency for a sum of $40,083,432, as contained on the last completed single Village/Town assessment roll, said sum together with the other revenues estimated, shall be applied to the purposes set forth and described in the attached Tax Warrant; and be it further RESOLVED, that pursuant to the aforementioned Executive Order, the Village Treasurer, at this time, is hereby authorized and directed to collect and deposit, in whole or in part, the interim levy amount stated herein; and be it further RESOLVED, that the Village/Town Board, at a later date, in accordance with the adoption and development of the FY 18/19 Budget will modify and reconcile the interim levy and warrant assessment against those property owners that have pre-paid all or a portion of their 2018 real property taxes. Village Board of Trustees 12/28/2017 548 AYES NAYS ABSENT Trustee Finger None Trustee Callaghan Trustee Pekarek Trustee Ross Trustee Samwick Trustee Veron Mayor Hochvert ******** There being no further business to come before the Board, the meeting was adjourned at 10:51 A.M.
