Unsafe Structures or Unsafe Equipment. In cases where the Building Inspector or a Code Enforcement Officer determines that a building, structure, equipment or a portion thereof is unsafe due to a violation or violations of the Uniform Fire Code (“Uniform Code”), Fire Code of New York State (“FCNYS”), the Property Maintenance Code of New York State (“PMCNYS”), any other State law, or the Schenectady City Code, the Building Inspector or Code Enforcement Officer may, as the case necessitates, condemn part of or all of said building, structure and/or equipment to protect the life, health, property or safety of the public or the occupants of the structure, require that such building, structure and/or equipment be vacated, and, in the event of condemnation, shall provide notice of such condemnation as described hereinbelow. (1) The notice of condemnation shall: a. Be in writing; FT b. Be dated and signed by the Building Inspector or Code Enforcement Officer; c. Specify the condition or activity that serves as the basis for the notice of condemnation and violates the Uniform Code, FCNYS, PMCNYS, or RA Schenectady City Code; d. Specify the provision or provisions of the Uniform Code, FCNYS, PMCNYS, or Schenectady City Code which is/are violated by the specified condition or activity and serves as the basis for the notice of condemnation; e. Specify the period of time which the Building Inspector or Code Enforcement D Officer deems to be reasonably necessary for achieving compliance; f. Direct that compliance be achieved within the specified period of time; and g. State that an action or proceeding to compel compliance may be instituted if compliance is not achieved within the specified period of time. (2) The Building Inspector or Code Enforcement Officer shall cause the notice of condemnation, or a copy thereof, to be served on the owner of the affected property personally or by first-class mail. The Building Inspector or Code Enforcement Officer shall be permitted, but not required, to cause the notice of condemnation, or a copy thereof, to be served on any builder, architect, tenant, contractor, subcontractor, construction superintendent, or their agents, or any other person taking part or assisting in work being performed at the affected property personally or by first-class  mail; provided, however, that failure to serve any person mentioned in this sentence shall not affect the efficacy of the notice of condemnation. (3) Posting of notices of condemnation. Whenever the Building Inspector or Code Enforcement Officer makes a determination pursuant to the provisions of this article, as may be prescribed by law, or the Schenectady City Code that a structure and/or equipment is unsafe, unfit for occupancy or must be vacated (the “determination”), the Building Inspector or Code Enforcement Officer shall place a notice or placard on such structure and/or equipment stating that the structure and/or equipment is unsafe, unfit for occupancy or must be vacated (the “notice”), and that notice shall: i. Identify with specificity each immediate hazard to life or health that is the basis for the determination or the posting of the notice; ii. Identify the date on which the notice was posted on the structure (the “posting date”); iii. FT Identify all conditions that must be repaired, remedied or corrected, the date by which each condition must be repaired, remedied or corrected, and each and every penalty for failure to repair, remedy or correct each condition; iv. RA State that any owner, tenant or occupant of the structure may challenge the determination by requesting a hearing before the Mayor’s Designee (the “hearing”), so long as the hearing is requested no later than 3:00 p.m. on the third day after the notice is posted and dated if served in person on the Schenectady City Clerk; or 4:00 p.m. on the third day after the notice is posted and dated if served by facsimile or email on the Schenectady City Clerk; state that the written request for the hearing may be delivered by hand, D facsimile or email to the Schenectady City Clerk; identify the address, facsimile number and email address for service of such request; and shall state that a request for hearing shall identify the address, telephone number(s) and email address, if any, of the person requesting the hearing and the reasons or grounds for the appeal. In addition to posting the notice on the structure, the Code Enforcement Officer shall provide the notice to all tenants or occupants of the structure by either affixing the notice to the door of each unit in the structure in which any tenant or occupant may reside or placing the notice under the door of each such unit; make an attempt to hand-deliver a copy of the notice to any person who is present in or at the structure at the time of posting; and mail the notice to the owner(s) of the structure on the same business day as the notice is posted at the address listed on the tax roll for the City of Schenectady. (4) Mandated procedures upon posting of a notice. (i) The hearing will be held at the Schenectady City Hall, 105 Jay Street, Schenectady, New York, within five business days of the City Clerk’s receipt of the request for the hearing, unless adjourned for good cause or the person requesting the hearing and the Mayor’s Designee agree otherwise. Persons requesting the hearing shall be notified of the date and time of the hearing at least 24 hours in advance of the hearing date by a notice sent to the person requesting the hearing at the address provided by said person pursuant to Subsection C-1(3)(iv) above. (ii) If the Building Inspector or Code Enforcement Officers explains the circumstances requiring posting at the hearing, he/she shall provide any person requesting the hearing with all available documentation or information concerning the determination. The person requesting the hearing will be afforded an adequate opportunity to present statements and other (iii) FT evidence regarding the need for the posting and to suggest alternatives. Persons attending the hearing may be represented by counsel. No determination that the structure is unsafe, unfit for occupancy or must be vacated will be confirmed unless the Mayor’s Designee determines that it has RA been demonstrated that the determination is necessary to protect owners, tenants or occupants from an immediate threat to health or safety. Absent confirmation by the Mayor’s Designee who is present for the duration of the hearing, the determination shall be vacated. Upon a confirmation of the determination, the Mayor’s Designee shall also issue written findings and conclusions confirming, modifying, or otherwise setting forth all conditions that must be repaired, remedied or corrected, and the date by which each D condition must be repaired, remedied or corrected, which findings and conclusions shall be mailed to the owner of the structure at the address provided to the City taxing authority and to the person requesting the hearing at the address provided in the request for a hearing. (iv) Neither the City of Schenectady nor any of its Building Inspector or Code Enforcement Officers shall order or direct the removal of any personal property from a structure to which a notice has been posted unless the Building Inspector or Code Enforcement Officer makes a determination that such personal property constitutes a hazard to any owner, tenant or occupant of the structure. The City is not responsible for any property remaining in the structure. (v) Notwithstanding the provisions of this Subsection C-1, all occupants, tenants, landlords or their agents shall comply with any and all federal and State laws  and local municipal laws or regulations, including but not limited to the Uniform Code and the Schenectady City Code. (vi) The procedures set forth in this Chapter, shall apply to any action of the Code Enforcement Officer under §137-3 of the Code of the City of Schenectady requiring a structure to be vacated as being unsafe or unfit for occupancy, pursuant to §138-30. FT RA D  CITY COUNCIL SCHENECTADY, NEW YORK LOCAL LAW NO.: _______________ Councilmember offered the following: A Local Law Amending Section C6-18 of the Charter of the City of Schenectady WHEREAS, on December 27, 2021, a public hearing was held regarding amending Section C6-18 of the Charter of the City of Schenectady related to the extension of time for payment of delinquent liens for homeowner/occupants: NOW, THEREFORE, FT BE IT ENACTED by the Council of the City of Schenectady, in regular meeting convened, Section C6-18 of the Charter of the City of Schenectady shall be amended to include RA the italicized language and delete any struck language below, as follows: §C6-18 Extension of time for payment of tax delinquent liens for homeowners/occupants The owners of one-family or two-family solely rResidential buildings property, as defined in New York State Real Property Tax Law Section 1111, upon submission of proof that said properties were owner-occupied for the entire time of the tax delinquency, shall not be foreclosed until the expiration of 33 months 3 years from the date the City levied the tax liens D thereon. Corporation Counsel  CITY COUNCIL SCHENECTADY, NEW YORK RESOLUTION NO.: ______________ Councilmember Carl Williams offered the following: A Resolution Authorizing the City to Enter into a Contract with the U.S. Bureau of Justice Assistance (BJA) FY21 Body-Worn Camera Police and Implementation Program to Support Law Enforcement Agencies WHEREAS, the City Council wishes to enter into a contract with the U.S. Bureau of Justice Assistance (BJA) for securing funds under the Body-worn Camera Police and FT Implementation Program to Support Law Enforcement Agencies; and WHEREAS, pursuant to this grant the City shall receive $155,200.00 from BJA to purchase body-worn cameras and related equipment to be assigned to members of the Police Department: RA NOW, THEREFORE BE IT, RESOLVED, that the City Council hereby authorizes a contract to be signed between the U.S. Bureau of Justice Assistance and the City of Schenectady for the purposes of securing grant funding from the Body-worn Camera Police and Implementation Program to be allocated as above described, the terms of such contract to be set by the Corporation Counsel; and it is further D RESOLVED, that the Commissioner of Finance and Administration is directed to receive and allocate the funding as directed in the grant Budget Detail Worksheet. Corporation Counsel  CITY COUNCIL SCHENECTADY, NEW YORK RESOLUTION NO.: _______________ Councilmember offered the following: A Resolution Directing the Assessor of the City of Schenectady to Grant Exemptions Governor Hochul’s Executive Order 11.1 WHEREAS, on December 18, 2020, then Governor Cuomo signed an executive order declaring that individual municipalities had the opportunity to extend, by local option, certain FT exemptions granted in 2020 to the 2021 assessment roll due to COVID-19; and WHEREAS, a week later, the former governor signed the COVID-19 Emergency Eviction and Foreclosure Prevention Act of 2020 (Chapter 381 of the Laws of 2020), of which Part D removed the local option thereby mandating that assessment units extend those same RA exemptions to the 2021 assessment roll. The mandate expired on May 1, 2021, the date of printing of the printing of the tentative assessment roll; and WHEREAS, on December 26, 2021, by Executive Order 11.1, Governor Hochul modified the state of emergency in New York to address two sections of the Real Property Tax Law (“RPTL”), that is §459-c (persons with disabilities and limited incomes) and §467 (persons sixty-five years of age or over); DWHEREAS, specifically, subsections 7, 7-a, and 8 of RPTL §459-c, as well as subsections 5, 5-a, 5-b, 5-c, and 6 of RPTL §467 require, in relevant part, that: (i) applications for an exemption must be made annually, (ii) applications should be filed on or before the fifteenth day of March, and (iii) the assessor shall mail application forms to all persons who were granted an exemption on the latest completed assessment roll (2021), together with a notice that such application must be filed on or before the taxable status date; and WHEREAS, pursuant to the Executive Order, these provisions may be suspended, subject to the adoption of a resolution by the governing body of an assessing unit; and WHEREAS, the City Council seeks to direct the Assessor of the City of Schenectady to grant exemptions pursuant to such sections of the Real Property Tax Law on the 2022 assessment roll to all property owners who received that exemption on the 2021 assessment roll, thereby dispensing with the requirement for the assessor to mail renewal applications to such persons, and to authorize the Assessor of the City of Schenectady to, in her discretion, establish procedures by which she may require a renewal application to be filed when she has reason to be live that an owner who qualified for the exemption on the 2021 assessment roll may have since changed his or her primary residence, added another owner to the deed, transferred the property to a new, or died: NOW, THEREFORE BE IT, RESOLVED, that the City Council directs the Assessor of the City of Schenectady to grant exemptions pursuant to such sections of the Real Property Tax Law on the 2022 assessment roll to all property owners who received that exemption on the 2021 assessment roll, thereby dispensing with the requirement for the Assessor to mail renewal applications to such persons; and be it further RESOLVED, that the City Council authorizes the Assessor of the City of Schenectady to, in her discretion, establish procedures by which she may require a renewal application to be filed when she has reason to be live that an owner who qualified for the exemption on the 2021 assessment roll may have since changed his or her primary residence, added another owner to the deed, transferred the property to a new, or died. Kelly, Jr. for his Recent Graduation from the FBI National Academy FT WHEREAS, On December 16, 2021, Lieutenant Thomas J. Kelly, Jr., of the City of Schenectady Police Department, achieved the distinguished honor of graduating from the FBI’s National Academy (FBINA) as part of their 280th Session. Lieutenant Kelly completed the rigorous academy, where command level officers are nominated due to their demonstrated leadership qualities, thusly joining the ranks of other Schenectady Police Department FBINA RA graduates, namely Police Chief Eric S. Clifford (Session 274), Assistant Chief Michael J. Seber (Session 197), Assistant Chief (ret.) Jack Falvo Jr. (Session 219), and Lieutenant James Sanders (Session 278); and WHEREAS, following his nomination to the program by Chief Clifford, in the FBINA, Lieutenant Kelly completed graduate level courses pertaining to the psychology of leadership, advanced investigative strategies, officer wellness, media, and crisis negotiations. The program D included demanding fitness challenges, including the “Yellow Brick Road,” which involves a 6.1- mile run over a rugged trail built by the Unites States Marine Corps that included scaling walls, cliffs, and other obstacles. Lt. Kelly also had the honor of being selected by his FBINA peers as a Section Representative; and WHEREAS, Lt. Kelly attended several speaking events featuring activists from the LGBTQ community, the mental health field, and more. He attended several museums including the National Museum of African American History and Culture, the United States Holocaust Memorial Museum, and the National Museum of the American Indian. Lt. Kelly himself described his time at the FBINA as “a reinvigorating experience, a reminder of the original oath of office that we take as law enforcement officers and the importance of instilling it in new officers as they continue to work through their careers. He looks forward to bringing the experience and these new attributes back to the Schenectady Police Department”; and WHEREAS, in the words of the Chief Clifford, “The FBI National Academy is the premier executive level training for law enforcement. Lt. Kelly was one of my top choices because he previously led my office of professional standards, and he has a strong desire to promote higher. Completing the training and joining the global network of law enforcement leader’s shows the dedication Lt. Kelly has towards improving the leadership and operations at the Schenectady Police Department. Corporation Counsel D RA FT D RA FT D RA FT D RA FT D RA FT D RA FT D RA FT  CITY COUNCIL SCHENECTADY, NEW YORK RESOLUTION NO.: _______________ Councilmember offered the following: A Resolution Authorizing an Agreement for “Liquid Sodium Bisulfate 2022” for the Wastewater Treatment Plant WHEREAS, the City of Schenectady has issued a bid for “Liquid Sodium Bisulfate - 2022” for restocking its inventory of this chemical. This chemical is used in the treatment of City wastewater; and FT WHEREAS, a low bid was received on December 29, 2021, from Holland Company, Inc. in the amount of $66,000.00. Funds for the purchase of the Liquid Sodium Bisulfate will be charged to the 2022 Operating Budget Code G8130 – 409: RA NOW, THEREFORE BE IT, RESOLVED, that this Council, acting as a Board of Contract and Supply under section C5-9 of the City Charter, authorizes the Mayor to enter into an agreement Holland Company, Inc. of Adams, MA in the amount of $66,000.00 for the purchase of Liquid Sodium Bisulfate, the terms of which are to be set by the Corporation Counsel; and be it further D RESOLVED, that the Commissioner of Finance is authorized to charge the cost, in the amount of $66,000.00, to the 2022 Operating Budget Code G8130-409. Corporation Counsel D RA FT D RA FT D RA FT D RA FT D RA FT D RA FT D RA FT  CITY COUNCIL SCHENECTADY, NEW YORK RESOLUTION NO.: _______________ Councilmember offered the following: A Resolution Authorizing an Agreement with E-Lot Electronics Recycling, Inc. for the 2022 Electronic Waste Recycling Bid WHEREAS, the previous contract to provide services to remove electronic waste collected from city residents has expired and a new solicitation was issued; and FT WHEREAS, one bid was received from E-Lot Electronics Recycling, Inc. for a cost of $644.50 per ton and a $100 Pallet/Container Charge per pick-up; and WHEREAS, the estimated total for this contract on an annual basis is $77,280.00 for RA recycling plus the fees per pick-up: NOW, THEREFORE BE IT, RESOLVED, that this Council, authorizes the Mayor to enter into an agreement with E- Lot Electronics Recycling, Inc. for the sum of $644.50 per ton of electronic waste removed and a charge $100 per pallet or container per pick-up, the terms of which shall be set forth by the D Corporation Counsel. .
