Councilmember offered the following: A Resolution Supporting Metroplex’s Application for the RESTORE NY Grant WHEREAS, the New York State Legislature in the 2023 state budget created the "Restore New York's Communities Initiative" grant program (“Restore NY”); and WHEREAS, such program provides state monies to municipalities with financial assistance for the revitalization of commercial and residential properties and further encourages community development through the elimination and redevelopment of blighted structures; and D WHEREAS, the City of Schenectady is in support of the submission of a funding application RA requesting $3 million in Restore NY funding for the proposed Wedgeway/ Kresge Renovation Project, which involves renovation and reconstruction of the historic Wedgeway and Kresge buildings and construction of a five-story addition in the adjacent vacant lot (the “Project”); and WHEREAS, since matching funds are being provided by the private developer involved in the FT project, the proposed combination of private and public financing is appropriate for the Project; and WHEREAS, as required by the Restore NY program, the property was selected through a property assessment process to identify parcels and projects, for which site control is secured to support the City’s revitalization efforts and is consistent with the City’s 2020-2024 Comprehensive Plan; and WHEREAS, a properly noticed and advertised public hearing was held and all comments and testimony submitted have been duly considered by this Council; and WHEREAS, it is hereby determined to be in the best interest of the City of Schenectady to apply for funds from the Restore NY program for rehabilitation, reconstruction and demolition projects to eliminate blight and spur economic development in our downtown area; and WHEREAS, the City Council does hereby support the findings of facts as completed by Metroplex Development Authority: 1. The proposed Project is consistent with the City’s 2020-2024 Comprehensive Plan; 2. The proposed financing is appropriate for the Project; 3. The Project facilitates effective and efficient use of existing and future public resources to promote both economic development and preservation of community resources; and 4. The Project develops and enhances infrastructure and other facilities in a manner that will attract, create, and sustain employment opportunities: 3  NOW, THEREFORE BE IT, RESOLVED, that the City Council hereby authorizes the Mayor to take all actions and execute all documents necessary to apply for available Restore NY Communities Initiative grant funding in an amount not to exceed $3 million; and be it further RESOLVED, that the Chairman and/or his designee is authorized to take all actions and execute all documents necessary to effectuate the foregoing resolution. Councilmember offered the following: A Resolution Approving an Amendment to Extend by One Year to an Agreement to Reimburse Schenectady County for Work Performed on Behalf of the City of Schenectady Police Department WHEREAS, on January 25, 2021, the Schenectady City Council passed a resolution authorizing a three-year agreement (2021-2023) to reimburse Schenectady County for work performed on behalf of the City of Schenectady Police Department; and WHEREAS, specifically a County employee in the position of Confidential Target Criminal (CTC) D Investigator has provided a service to the City in the use of the Schenectady County Public Surveillance Camera System; and RA WHEREAS, under the current three-year agreement, the City is required to reimburse the County for the work performed on behalf of the City of Schenectady Police Department by the (CTC) Investigator by paying a fixed sum of Twenty-One Thousand Dollars ($21,000.00) annually; and FT WHEREAS, the County has requested that the agreement be extended one additional year; and WHEREAS, it is in the best interest of the City to extend the term of the agreement: NOW, THEREFORE BE IT, RESOLVED, that the City Council, Acting as a Board of Contract and Supply under Section C5-9 of the City Charter approves amending agreement with the County of Schenectady as described in the recitals hereto; and AND BE IT FURTHER RESOLVED, that the Mayor is authorized to enter into such written amendment with the County of Schenectady for the continued provision of services by the CTC Investigator, such amendment to be on terms and conditions deemed acceptable by the Corporation Counsel, and to execute any documents necessary to effectuate this resolution. Councilmember offered the following: A Resolution Authorizing the Mayor or His Designee to Enter a Memorandum of Understanding with CDTA for the Bikesharing Program Cycle! WHEREAS, CDTA has been operating CDPHP Cycle!, the Capital Region’s bike-share program, for five seasons; and WHEREAS, CDTA and the City of Schenectady believe creating bicycle-friendly, transit-oriented D environments will improve the health and quality of life within communities, while also improving their economic vitality. Both entities understand the connection between bicycle sharing (bikeshare) systems and reduced traffic congestion, easier access to local businesses, and increased appeal to new community members RA to avoid purchasing new cars and reducing wear and tear of city infrastructure; and WHEREAS, CDTA, in partnership with the City of Saratoga Springs, the City of Troy, the City of Albany, and the City of Schenectady, previously received funding from the Congestion Mitigation and Air Quality (“CMAQ”) grant to begin operating CDPHP Cycle! which required matching funds from each FT municipality, and WHEREAS, CDTA has contracted with Mobility Cloud (“MC”) to operate the bike-share system and continues to work with them and the City of Schenectady, to operate this new transportation option: NOW THEREFORE BE IT, RESOLVED, that the Schenectady City Council authorizes the Mayor or his Designee to enter a Memorandum of Understanding with CDTA for the Bikesharing Program Cycle!; and AND BE IT FURTHER RESOLVED that the City will reimburse CDTA for a portion of total operating costs totaling the amount of $25,000 per year for the years of 2022, 2023, and 2024 by March 1 of the following year or the beginning of the next operating year of the bikeshare program, whichever comes latest, subject to City Council appropriation; and AND BE IT FURTHER RESOLVED that the City agrees to partake in all siting, planning, and operations discussions with CDTA and its vendor, MC, regarding the bikeshare program and its operation. Councilmember offered the following: A Resolution Authorizing the Mayor to Enter into a Revocable License Agreement with 501 State Street Assoc LLC for Use of the City’s Right- of-Way in the Sidewalk Area at 501 State Street WHEREAS, 501 State Street Assoc LLC has been rehabilitating the building on the corner of State Street at both Clinton Street and Barrett Street, as identified as SBL 39.72-4-14; and D WHEREAS, 501 State Street Assoc LLC seeks a long-term license from the City to erect and maintain a patio to be located in the City’s right-of-way: RA WHEREAS, the revocable license agreement will provide the use of approximately 1,060 square feet of the right-of-way to construct a patio in partnership with Metroplex Development Authority; and FT NOW THEREFORE BE IT, RESOLVED, that the City Council authorizes the Mayor or his designee to enter into an agreement with 501 State Street Assoc LLC, granting a revocable license for the erection and maintenance of a patio; and be it further RESOLVED, that the revocable license agreement shall provide a 50-year term with the ability of license renewal and a requirement that the licensee restore the area for which the license was granted to the condition the area had been at the time of the agreement’s execution, unless otherwise agreed and any other terms deemed necessary by the Corporation Counsel.
