Councilmember offered the following: RESOLVED, that the City Council will conduct a public hearing in relation to: A MORATORIUM ON SMOKE AND VAPE SHOPS, AND SIMILAR USES, IN THE CITY OF SCHENECTADY FOR PURPOSES OF DEVELOPING MODIFICATIONS TO THE ZONING ORDINANCE REGARDING SUCH USES Said Public hearing shall be held on Monday, August 14, 2023, at 7:00 p.m. at Council Chambers, Room 209, Schenectady City Hall, 105 Jay Street, Schenectady, New York – for the purpose of a moratorium on smoke and vape shops, and similar uses, in the City of Schenectady for purposes of developing modifications to the zoning ordinance regarding such uses; and D be it further RESOLVED, that the City Clerk shall have the following notice published in the appropriate RA manner: NOTICE OF PUBLIC HEARING FT A MORATORIUM ON SMOKE AND VAPE SHOPS, AND SIMILAR USES, IN THE CITY OF SCHENECTADY FOR PURPOSES OF DEVELOPING MODIFICATIONS TO THE ZONING ORDINANCE REGARDING SUCH USES On Monday, August 14, 2023, at 7:00 p.m., the Schenectady City Council shall conduct a public hearing in relation to the above-referenced matter. Said public hearing shall be held in Council Chambers, Room 209, Schenectady City Hall, 105 Jay Street, Schenectady, New York – for the purpose of receiving public comment relative to the above-referenced matter; and be it further RESOLVED, that copies of materials related to the proposed moratorium on smoke and vape shops, and similar uses, in the City of Schenectady for purposes of developing modifications to the zoning ordinance regarding such uses be made available at the City Clerk’s Office and the City of Schenectady website at www.cityofschenectady.com for public inspection beginning no later than August 9, 2023, and be it further RESOLVED, that all interested parties may also be heard by submitting written comments to the City Clerk via www.cityofschenectady.com/158/City-Council, by email at smykoo@schenectadyny.gov, or mail at City Clerk, 105 Jay St., Schenectady, NY 12305, by 12:00 p.m. on August 11, 2023. 2 Approved as to form this 24th day of July, 2023. __________________________ Andrew B. Councilmember offered the following: A Resolution Authorizing the Abandonment of A Portion of Larch Street WHEREAS, it is in the best interest of the City of Schenectady to abandon a portion of Larch Street which is a dead end running between 633 and 651 Lansing Street; and WHEREAS, a public hearing with regard to the proposed abandonment was held on April 24, 2023 without comment; and D WHEREAS, there is no municipal use for the property: RA NOW, THEREFORE BE IT, RESOLVED, that the City Council authorizes the Mayor to authorize such actions as to abandon the portion of Larch Street between 633 and 651 Lansing Street; and be it further FT RESOLVED, that the process of abandonment, and any other documentation required, be set by the Corporation Counsel. Councilmember offered the following: A Resolution Authorizing an Amendment to the Collective Bargaining Agreement (2021-2025) between the City of Schenectady and AFSCME Council 66 Local 1037A WHEREAS, the City Council previously authorized a collective bargaining agreement between the City of Schenectady and AFSCME Council 66 Local 1037A (“1037”) for the period January 1, 2021 through December 31, 2025 (2021-2025 CBA); and WHEREAS, the City of Schenectady and 1037 desire to define the requirements in Article 39 of D the 2021-2025 CBA and agree to resolve issues concerning temporary employees working over nine consecutive months and usage of seasonal employees; and RA WHEREAS, the City of Schenectady and 1037 desire to make amendments to clarify certain terms, make compensation adjustments, and other related modifications, in addition to modifications regarding certain requirements and compensation for employees with commercial divers licenses; and FT WHEREAS, the proposed amendments to the 2021-2025 CBA were memorialized in a Memorandum of Agreement, a copy of which is attached to this resolution and incorporated herein; and WHEREAS, the Memorandum of Agreement has been reviewed by the City Council; and WHEREAS, 1037 has ratified the Memorandum of Agreement: NOW, THEREFORE BE IT, RESOLVED, that the City Council approves the amendment to the 2021-2025 CBA, as memorialized in the attached Memorandum of Agreement, which is incorporated herein, effective August 1, 2023. Councilmember offered the following: A Resolution Amending Resolution No.: 2023-136 Regarding an Endorsement of the Schenectady Inner City Ministry’s Application to the New York State Department of Environmental Conservation for the “Southern Pine Community Recovery Program” Grant WHEREAS, the City Council previously approved Resolution No.: 2023-136 endorsing the Schenectady Inner City Ministry’s application to the New York State Department of Environmental Conservation for a project grant under the Southern Pine Beetle Community Recovery Program to be located at the Fehr Ave. Farm, at the corner of Fehr Avenue and Central Park Road, a site within the D territorial jurisdiction of the Council of the City of Schenectady; and RA WHEREAS, the City Council desires to amend Resolution No.: 2023-136 to reflect the grant number of the Schenectady Inner City Ministry’s application: NOW, THEREFORE BE IT, FT RESOLVED, that Resolution No.: 2023-136 is amended to resolve that the City Council of the City of Schenectady hereby approves and endorses the application of Schenectady Inner City Ministry for a grant under the Environmental Justice Community Impact Grant Program For Communities Exposed to Multiple Environmental Harms and Risks in New York State DEC01-EJCIG-2023-00009 for a project known as “Schenectady Community Compost Project” and located within the City of Schenectady.
