FT Be It Enacted by the City Council of the City of Schenectady as Follows: Section 1. Purpose: To create Article V, Prohibition of Eviction Without Good Cause, to Chapter 210 of the Schenectady City, Rental Property, and add Section 210-20, Protections Established. Section 2. Legislative Findings and Intent: Increased real estate prices are leading to the displacement of tenants who cannot afford increasing rents. The purpose of this law is to protect tenants from exorbitant rent increases that could result in homelessness. RA Section 3. Article V, Prohibition of Eviction Without Good Cause. Section 210-20. Protections Established. A. There is hereby established, pursuant to and in accordance with the provisions of Section 213 of Article 6-A of the Real Property Law of the State of New York, a Prohibition of Eviction without Good Cause in the City of Schenectady. B. Pursuant to Section 213-2(a) of Article 6-A of the Real Property Law of the State of New York, the D City of Schenectady provides that any unit on or within a housing accommodation shall be exempt from the provisions of this Article if it has a monthly rate above three hundred forty-five percent of fair market rent as published by the United States Department of Housing and Urban Development and as shall be published for the County of Schenectady by the New York State Division of Housing and Community Renewal. C. Pursuant to Section 213-2(b) of Article 6-A of the Real Property Law of the State of New York, the City of Schenectady, for purposes of this Article, defines “small landlord” to mean a landlord of not more than one (1) unit anywhere in the State of New York. Section 4. Councilmember offered the following: The Schenectady City Council, in regular meeting, does ordains as follows: An Ordinance to Amend Article VII, Trucks, Section 248-85 of the Schenectady City Code to Exclude Trucks, Tractors and Tractor Trailer Combinations Over Eight Tons on Kings Road from Albany Street to the City Line. FT Section 1. Purpose: For traffic and pedestrian safety and for the proper maintenance of the roadbed, it is necessary to exclude trucks, tractors and tractor trailer combinations on Kings Road from Albany Street to the City Line. RA Section 2. The Table of Exclusion of Trucks, Tractors and Tractor Trailer Combinations contained in Section 248-85 of the Schenectady City Code is amended to add the following Street: Trucks, Tractors and Tractor Trailer Combinations over eight (8) tons are excluded on Kings Road from Albany Street to the City Line Section 3. This Ordinance shall take effect August 18, 2025. Councilmember offered the following: A Resolution Authorizing the Department of Finance to Make Budget Amendments to the 2025 Budget. WHEREAS, the City Council previously adopted the 2025 budget; and FT WHEREAS, the City Council’s City Development and Planning Committee has approved an amendment to the golf budget regarding the reallocation of funds from the Golf Course’s Type Capital Reserves to select Golf Course Operating Fund codes; and WHEREAS, the Finance Department will transfer $36,000.00 from the E908780 Golf Course Reserves to: CR7180-200 Equipment; CR7180-460 Repairs in order to make unanticipated repairs and improvements to the Clubhouse and golf course facilities for the following items and projects: Albany Fire Protection for its repairs to the sprinkler system- RA $23,143.00; Pond Aeration- $6,268.97 and a Convection Oven- $ 5,798.40; and NOW, THEREFORE BE IT, RESOLVED, the City Council hereby authorizes the Department of Finance to make the budget amendment as described hereinabove to the 2025 Operating and Capital Budgets. Corporation Counsel 8  City of Schenectady, New York RESOLUTION No.: Councilmember offered the following: A Resolution Authorizing a 2025 Budget Reallocation Related to an Agreement between City of Schenectady and CSEA WHEREAS, the City Council previously authorized in Resolution 2025-77 a Collective FT Bargaining Agreement with the City CSEA Local 1000 AFSCME, AFL CIO Unit # 8501 that contained compensation increases for 2025 that the City did not appropriate in the 2025 Budget; and WHEREAS, in accordance with Governmental Accounting Standards, the 2025 payments must be disclosed and charged to the 2025 fiscal year; and WHEREAS, the 2025 payments are being disbursed, pursuant to the CSEA Collective Bargaining Agreement. In accordance with Governmental Accounting Standards the attached RA budget re-appropriation is approved and incorporated by reference into this Resolution; and NOW, THEREFORE BE IT, RESOLVED, that the City Council hereby authorizes this reallocation of the 2025 Budget as provided in the attachment hereto and made a part hereof. The City did not appropriate the settlement amount of this Agreement in the 2025 Budget; and WHEREAS, in accordance with Governmental Accounting Standards, the 2025 payments must be disclosed and charged to the 2025 fiscal year; and WHEREAS, the 2025 payments are being disbursed, pursuant to the IOUE Local 158- RA District 106 Collective Bargaining Agreement. Councilmember offered the following: FT A Resolution Authorizing the Mayor to Enter an Agreement for the City Hall Parking Lot (27 Broadway) License. WHEREAS, since 2008, Schenectady Metroplex Development Authority (Metroplex), through its administrator LAZ Parking, has managed the shared parking lot known as the City Hall Parking Lot. The lot includes the City-owned parcel at 27 Broadway as well as Metroplex owned and licensed parcels at 415 Liberty St, 423 Liberty St, 14 Yates St and 16 Yates St. The lot provides daytime parking for City Hall staff as well as parking for general downtown visitors and workers; and RA WHEREAS, A license agreement was last approved in 2013, which continued the shared use agreement and Metroplex’s provision of daily maintenance, landscaping and plowing services at no cost to the City; and WHEREAS, Metroplex is proposing to renew the license agreement which will extend the agreement and allow Metroplex to provide funding to the City for the recently completed paving improvements to the Metroplex-owned and licensed portion of the lot; and NOW, THEREFORE BE IT D RESOLVED, that the City Council authorizes the Mayor or his designee to execute the license, the final terms of which to be determined by Corporation Counsel. FT WHEREAS, it is in the best interest of the City of Schenectady to sell parcel numbered SBL # 49.31-1-34.1; and WHEREAS, there is no municipal use for the property: NOW, THEREFORE BE IT, RESOLVED, the City Council authorizes the Mayor to enter into a contract to transfer RA the title of parcel numbered SBL # 49.31-1-34.1 to DAVE AND SON PLUMBING AND HEATING and/or assign for the sum of THIRTY ONE THOUSAND AND 00/100 ($31,000.00); and be it further RESOLVED, the terms of the contract for sale to an Investor Buyer shall contain a clause requiring that purchaser pay $500 at closing for building, electrical, plumbing and other applicable permits, that construction of a home on the property begin within thirty days of the purchase, and that total rehabilitation of the property, requiring compliance with the State Building Code and securing appropriate building permits with necessary inspections be completed within six months of purchase, as well as any other terms deemed necessary by the Corporation Counsel. Councilmember offered the following: A Resolution Authorizing the Redemption and Withdrawal of FT 2110 Lenox Road from Foreclosure. WHEREAS, a Notice of Foreclosure was filed in New York State Supreme Court, Schenectady County, having index no. 2024-1194; and WHEREAS, 2110 Lenox Road (SBL# 39.36-3-1) (“the property,” herein) was included on the list of delinquent properties in said foreclosure action; and WHEREAS, the current owner is trying to sell the property and wishes to pay all RA outstanding taxes, interest, invoices, and other charges including a $1,000 administrative charge (collectively, the “funds for redemption”) at closing to redeem the property. The settlement also includes releases of any claims against the City of Schenectady by the parties involved; and NOW, THEREFORE BE IT, RESOLVED, that the City Council authorizes the Office of Corporation Counsel to withdraw the property from the foreclosure action so long as the funds for redemption are received at the closing for the sale of the property by August 15, 2025. WHEREAS, the owner of property located at 450 Duane Avenue has instituted a certiorari action to review the assessment upon the property (Index No.: 1583-2024); and WHEREAS, the City Corporation Counsel has negotiated a settlement of the action and having apprised the City Council of the same, and the Claims Committee having approved the settlement as follows RA Address S/B/L Years Assessment at Issue Settlement Assessment 450 Duane Avenue 49.58-2-13 2024-2027 $3,600,000 $2,300,000 WHEREAS, there will be no refunds associated with overpayment of property taxes as a result of this settlement on account of the original assessed value in excess of the amount of such taxes and assessments based upon the reduced assessed values as herein; and NOW, THEREFORE, BE IT RESOLVED, the settlement proposed by the Corporation Counsel is hereby approved and the relevant personnel of the City are hereby authorized to make and execute such documents as may be necessary and acceptable by the City’s Office of Corporation Counsel to give such effect to such settlement in accordance with the above. Pleasant Bakery Inc. and Joseph Riitano filed a claim (2021-060) with the City of Schenectady; and WHEREAS, the Office of the Corporation Counsel has recommended that it would be in the best interest of the City to settle this matter; and WHEREAS, the settlement proposal was accepted by the City Claims Committee: RANOW, THEREFORE BE IT, RESOLVED, that the Office of the Corporation Counsel is authorized to enter into a settlement to settle the claim for $35,000.00, the terms of which shall be set by the Corporation Counsel.
