Be It Enacted by the City Council of the City of Schenectady as Follows: T Section 1. Purpose: To create Article V, Prohibition of Eviction Without Good Cause, to Chapter 210 of the Schenectady City, Rental Property, and add Section 210-20, Protections Established. AF Section 2. Legislative Findings and Intent: Increased real estate prices are leading to the displacement of tenants who cannot afford increasing rents. The purpose of this law is to protect tenants from exorbitant rent increases that could result in homelessness. Section 3. Article V, Prohibition of Eviction Without Good Cause. Section 210-20. Protections Established. R A. There is hereby established, pursuant to and in accordance with the provisions of Section 213 of Article 6-A of the Real Property Law of the State of New York, a Prohibition of Eviction without Good D Cause in the City of Schenectady. B. Pursuant to Section 213-2(a) of Article 6-A of the Real Property Law of the State of New York, the City of Schenectady provides that any unit on or within a housing accommodation shall be exempt from the provisions of this Article if it has a monthly rate above three hundred forty-five percent of fair market rent as published by the United States Department of Housing and Urban Development and as shall be published for the County of Schenectady by the New York State Division of Housing and Community Renewal. C. Pursuant to Section 213-2(b) of Article 6-A of the Real Property Law of the State of New York, the City of Schenectady, for purposes of this Article, defines “small landlord” to mean a landlord of not more than one (1) unit anywhere in the State of New York. Section 4. WHEREAS, the City of Schenectady is required under Title 24 Code of Federal Regulations Part 91 to submit to the U.S. Department of Housing and Urban Development (HUD) an Annual Action Plan, which carries out the City’s Consolidated Plan and which provides a concise summary of the actions and activities that it will pursue for its use of Community Development Block Grant (CDBG), T HOME Investment Partnerships (HOME) and the Emergency Solutions Grant (ESG); and WHEREAS, the City of Schenectady, per a HUD Award letter dated May 14, 2025, will receive the following funding allocations from HUD for 2025-2026: CDBG: $2,050,241.00; HOME: AF $1,187096.39; and ESG: $184,656.00; and NOW THEREFORE BE IT, RESOLVED, the City Council accepts the 2025-2026 HUD allocations and that the Mayor or his designee is authorized to execute all necessary contracts for acceptance of the HUD allocations in R conformance with all executive orders and applicable laws. WHEREAS, per the legislative request made by Assemblyman Angelo Santabarbara, the New York State Department of Criminal Justice Services (DCJS) and U.S. Department of Justice (DOJ) have awarded the Schenectady Police Department an Edward Byrne Memorial Justice Assistance Grant (JAG) in the amount of $15,000.00; and T WHEREAS, the Schenectady Police Department will use the Grant to purchase license plate readers to support the Department’s technology needs; and AF WHEREAS, the acceptance of the JAG Grant does not require any matching funds from the City of Schenectady; and NOW, THEREFORE BE IT, RESOLVED, that the Mayor is hereby authorized to execute any and all agreements necessary to effectuate the acceptance of $15,000.00 in Grant Funding from the DCJS and the DOJ. WHEREAS, the Schenectady Police Department has received grant funding under the Gun Involved Violence Elimination (GIVE) Partnership for State Fiscal Year 2025/26 from the New York State Department of Criminal Justice Services (DCJS); and T WHEREAS, the GIVE Grant Application is a partnership between the Schenectady Police Department, the Schenectady District Attorney’s Office, the Schenectady County Sheriff’s Office, and the Schenectady County Probation Department; and AF WHEREAS, the GIVE Grant amount for the City of Schenectady Police Department is $452,133,00 and the Grant requires no matching funds from the City of Schenectady; and NOW, THEREFORE BE IT RESOLVED, that the Mayor is hereby authorized to execute any and all agreements necessary to effectuate the acceptance of $ 452,133.00 from DCJS in GIVE Grant funding. Councilmember offered the following: A Resolution Authorizing a Waiver of Apprenticeship Requirements for the Central Park Tennis Court Improvements Contract. WHEREAS, the Purchasing Policy adopted by the City Council states, “Public works construction contracts exceeding $500,000.00 may only be awarded to contractors and subcontractors that have an approved apprenticeship program and further complements the City T of Schenectady Minority and Women-Owned Business Utilization goals[]”; and WHEREAS, the Central Park Tennis Courts need improvements to correct the disrepair AF that has left many of the courts unusable for teaching and competitive events; and WHEREAS, the Engineering Department is ready to issue a solicitation for bids for “Central Park tennis courts improvement.” However, the City’s apprenticeship program requirements may impede receiving competitive bids from qualified contractors: R NOW THEREFORE BE IT, RESOLVED, that the Schenectady City Council authorizes a waiver of the apprenticeship requirements of the adopted Purchasing Policy for the “Central Park tennis courts D improvement” project which is to be bid by the Department of Engineering. Councilmember offered the following: A Resolution Authorizing an Agreement with the Schenectady City School District for Storage and Use of a Drone and Antenna. WHEREAS, the Schenectady City School District (the “District”) owns the school building known as Central Park Middle School located at 421 Elm Street Schenectady New York 12304 (hereinafter the "CPMS"); and, T WHEREAS, the District maintains CPMS as an operational school; and WHEREAS, the City purchased a first responder drone to be used as part of its law enforcement AF efforts in the City including viewing areas of the City on a periodic, as needed basis; and, WHEREAS, the City purchased a communications antenna to be used as part of its law enforcement efforts in the City including enhancing communications throughout the City; and WHEREAS, the City identified the CPMS as a geographic high point in Central Park region of the City; and R WHEREAS, the City has requested permission from the District to utilize a portion of the roof of the CPMS as a storage, landing and takeoff point for the drone and antenna, and the Board of the D District approved; NOW, THEREFORE BE IT, RESOLVED, that the Mayor is authorized to enter into a license agreement with the District for storage and use of a drone and antenna, the terms of which shall be set by the Corporation Counsel. WHEREAS, a Project for the Broadway Mill & Fill Fourth Street to Weaver Street, City of Schenectady, Schenectady County, P.I.N. 1760.42 (the Project") is eligible for funding under Title 23 U.S. Code, as amended, that calls for the apportionment of the costs such program to be borne at the ratio of 80% Federal funds and 20% non-federal funds; and WHEREAS, the City of Schenectady desires to advance the Project by making a commitment of 100% of the non-federal share of the costs of the Design and Construction/CI phases of the project, NOW, THEREFORE, the City Council, duly convened does hereby T RESOLVE, that the City Council hereby approves the above-subject project; and it is further AF RESOLVED, that the City Council hereby authorizes the City of Schenectady to pay in the first instance 100% of the federal and non-federal share of the cost of Design and Construction/CI work for the Project or portions thereof; and it is further RESOLVED, that the sum of $1,918,920.00 is hereby appropriated from Capital Code IC517083-201 and made available to cover the cost of participation in the above phase of the Project; and it is further R RESOLVED, that in the event the full federal and non-federal share costs of the project exceed the amount appropriated above, the City of Schenectady shall convene as soon as possible to appropriate said excess amount immediately upon the notification by the NYS Department of Transportation thereof; and it is further D RESOLVED, that the Mayor of the City of the Schenectady be and is hereby authorized to execute all necessary Agreements, certifications or reimbursement requests for Federal Aid and/or Marchiselli Aid on behalf of the City of Schenectady with the New York State Department of Transportation in connection with the advancement or approval of the Project and providing for the administration of the Project and the municipality's first instance funding of project costs and permanent funding of the local share of federal-aid and state-aid eligible Project costs and all Project costs within appropriations therefore that are not so eligible; and it is further RESOLVED, that a certified copy of this resolution be filed with the New York State Commissioner of Transportation by attaching it to any necessary Agreement in connection with the Project; and it is further RESOLVED, this Resolution shall take effect immediately. Councilmember offered the following: A Resolution Authorizing an Agreement with the Capital District YMCA for 2026 HUD Continuum of Care WHEREAS, the City of Schenectady and Development of Broadway, LLC, also known as the Capital District YMCA, have agreed to work together to provide permanent housing in connection with supportive services to homeless people with disabilities and their families; and T WHEREAS, U.S. Department of Housing and Urban Development has provided $201,722.00 for 2026 Continuum of Care funding to provide permanent housing in connection with supportive services; and AF WHEREAS, the funding will be used for providing 20 bed units in monthly and administrative costs and now: NOW, THEREFORE BE IT, RESOLVED, that the City Council authorizes the Mayor or his designee to enter into an R agreement with Development of Broadway, LLC d/b/a Capital District YMCA for $201,722.00 for the provision of 20 bed units and administrative costs associated with the program.
