Background Information:
From 2011 until 2013, an affidavit of tax exemption was not Itled on behalf of
the Church. Because of this, there are outstanding liens on the property
subjecting it to foreclosure. According to the Pastor, Priscilla Terry, the
Church has consistently operated as such and should not have lost its tax
exemption.
Evaluation!Analysis:
Because of legislation passed in the NYS Assembly, properties that lost tax
exempt status because of an administrative oversight where the paperwork
was not Itled, we are able to reinstate that exemption pursuant to Council
approval.
Recommendation:
Restore the tax exempt status for Out The Box Family Worship Tabernacle
for the years that it lost its exemption.

The City of Schenectady hereby grants Revocable Permit No. 601 to lemma Market for a Sign that is
approximately 48/1 tall and 5' wide and hangs over the City right-of-way, with a minimum clearance of 8' on
the front of the building at 789 Albany Street, Schenectady, NY.
a) The Sign is approximately 48/1 tall and 5' wide and hangs over the City right-of-way, with a
minimum clearance of 8' on the front of the building at 789 Albany Street, Schenectady, NY.
b) Jemma Market shall hold the City, its employees or agents harmless for any damage to the Sign
resulting from their acts in performing of their duties.
c) So long as the Sign remains in the City right-of-way, Jemma Market shall carry, at THEIR expense
public liability insurance in an amount not less than $1,000,000/$1,000,000 for personal liability
and not less than $1,000,000 for property damage in one accident and $2,000,000 in the
aggregate. The liability policy must the name City of Schenectady as additionally insured to be
saved harmless for personal liability and property damage and is subject to the approval of the
Corporation Counsel of the City of Schenectady.
d) The City Engineer of the City of Schenectady reserves the power to revoke the permission
granted and to require the removal of the Sign except in case of a dangerous condition which
shall be corrected immediately upon notification.
e) Jemma Market complies with all rules, regulations and building permits relating to the erection
and maintenance of the Sign.
f) Jemma Market agrees to defend, indemnify and hold harmless the City of Schenectady, their
officers, agents and employees from any and against any and all claims, suits, liens, judgments,
damages, losses and expenses including reasonable legal fees and costs arising in whole or in
part and in any manner from acts, omissions, breach or default of Jemma Market, or their agent,
related to their performance related to this revocable permit.

Background Information:
The removal of select trees, stumps and brush was determined to be the first step in the
implementation of the City's master plan for the improvements to the golf course. This
contract will continue to address the tree removal needs in an effort to increase air flow and
sunlight to tees, greens and fairways. The ideal time to perform such work is the winter as it
reduces the chances of damage to the course by tree removal equipment.
Evaluation/Analysis:
The Engineering Department solicited and received bids for the "Golf Course Tree Removal"
and a low responsible bid was received on December 16, 2015 from Wickes Arborists in the
amount total of $133,865.00 for the Base Bid and Alternate. Funds for the work are to be
charged to Capital Budget Code 14617093-201.
Recommendation:
Award the Bid and Contract for the "Golf Course Tree Removal" to Wickes Arborists Service in
the Amount of $133,865.00 for the Base Bid and Alternate, to be charged to 14617093-201

advising the Committee plans to request that the City reimburses it tor a
portion of expenses incurred to maintain the Rose Garden ('Garden') during 2015. Any
reimbursement would be for an amount less than or equal to the 2015 revenue generated by the
Garden. Last year the City reimbursed the Committee $1,700, an amount equal to the revenue
received by the City in 2014.
