The developer will pay the City the full assessed value of the land which totals $138,300. The option period is for two years so that the developer can complete their plans and file applications with the State to obtain housing tax credits. DePaul was founded in 1958 in Rochester, New York. The company has built new housing developments in New York, North Carolina, and South Carolina. In Schenectady, DePaul successfully developed the $13 million Joseph L. Allen apartments on Albany Street. DePaul plans to construct two new buildings facing Crane Street with parking and greenspace at the rear of the site. This proposed development builds off the enhancements identified in the City’s recently completed Craig‐Main Connection plan. The developer will be seeking State tax credits so that high quality affordable housing can be built on Crane Street with many of the units built specifically with the needs of seniors in mind. There will be other units where supportive housing is provided in cooperation with the Schenectady Community Action Program (SCAP). The proposed development builds on extensive work already underway in Mont Pleasant including over 44 demolitions by the City and Land Bank, the new $13 million Boy and Girls Club, the new Mont Pleasant Library and Literacy branch, Better Community Neighborhoods Inc.’s New York State Main Street program that is working with local business owners to improve their facades, the enhanced and recently opened Orchard Park, new Habitat for Humanity homes, planned streetscape improvements funded by Schenectady Foundation’s Thriving Neighborhoods program and lastly, the recently announced Crane/Main intersection improvement funded by Assemblyman Santabarbara to improve walkability for the community right in front of the proposed project. The six parcels to be purchased from the City include two sites that were cleared by the Land Bank, so we are building on this previous investment. Only one parcel has a building on it, 933 Pleasant Street, the former Hungarian Hall, which is vacant. DePaul would pay all asbestos abatement/demolition costs. The developer has already secured all the other parcels needed to complete the development site. DePaul is committed to enhancing ongoing community improvement efforts in Mont Pleasant. Background Information: The 2020-2024 consolidated plan prioritized housing needs and the creation of affordable rental opportunities for the City of Schenectady with a priority given the NRSA. On July 6th 2021 the City of Schenectady initiated a 30 day public comment period for the reallocation of HOME funds from the conversion of vacant city owned properties to the Elmer Gardens project. On July 26th, 2021, the City of Schenectady held a public hearing on the project. To date the City has received a total five comments on the project three were in support of the project, one requesting the funds be reallocated to projects which support homeownership and one requesting the funding be utilized for rental projects which support all residence not just seniors. BCNI’s tax credit application is due to the State of New York on August 24, 2021 Evaluation/Analysis: It is necessary to implement of the goals from the 2020-2024 Consolidated Plan in the NRSA and to prioritize the creation of affordable rental units in the City of Schenectady. Reallocating funding to the Elmer Gardens project will assist with this goal. These funds are important to demonstrate local support and assist in providing BCNI a competitive advantage for New York State Low Income Housing Tax Credits. For example, currently, a person found guilty of criminal possession of a firearm, a class E felony, faces up to four years in prison. In the Capital Region, including the City of Schenectady, there seems to have been an uptick in incidents involving shots fired and, unfortunately, incidents where people have been struck by gunfire, injuring and killing them. The bottom line is that there are too many illegal firearms on our streets. We need the New York State Legislature and Governor Cuomo to make changes to the Penal Law to mandate a minimum 10-year sentence for people convicted of criminal possession of a weapon and/or firearm felonies. This change will curtail the illegal possession of firearms and ensure that those convicted of these offenses will get more than a short sentence if found guilty. Evaluation/Analysis: This legislative request seeks support for a resolution to be sent to New York State. It does not have any budgetary implications. Recommendation: The Committee vote to recommend the full Council pass a Resolution requesting that the New York State Legislature and Governor Cuomo amend the Penal Law as provided hereinabove.
