JOHN CARROL UNIVERSITY – 20201 FAIRMOUNT BOULEVARD: A Public Hearing was held on the request of John Carroll University (JCU), 20201 Fairmount Boulevard, to the City Planning Commission for a conditional use permit to establish off-campus student housing (OCSH). Proposed legislation, Chapter 1245, establishes an OCSH as a conditional use in the MF Multi-Family Residential zoning district. An OCSH overlay zone is proposed at the Fairmount Circle South apartment building at 20201 Fairmount Boulevard, and a conditional use permit is required to establish the use. A conditional use permit requires City Planning Commission and City Council review. The request is reviewed under the proposed Chapter 1245 of the zoning ordinances, and Section 1263.25 Conditional Use Permit Standards for OCSH.A Public Hearing was held on the request of Mr. Gruber swore in speakers at the meeting. Mr. Feinstein showed pictures of both sites. He stated this is a request for a conditional use permit (CUP) to establish an OCSH use at both 20201 and 20600 Fairmount Boulevard. The applicant proposes an OCSH use in these two apartment buildings per the proposed legislation in Chapter 1245 of the zoning code amendments which establish an OCSH overlay zoning district at these two properties. A CUP review is required under proposed Chapter 1245 OCSH overlay zoning district. The City Planning Commission recommended approval of those zoning code amendments at its April meeting. The OCSH overlay district is now set for a Public Hearing and third reading on May 28, 2024. There were many issues raised during consideration of that legislation from both CPC members and the public that have been included in the proposed legislation. These conditional use permit requests both require Council confirmation. Chapter 1245 OCSH of the proposed zoning ordinance amendments has been introduced to Council. Staff recommends approval of the conditional use permit with the following conditions: 1) Adoption of Chapter 1245 OCSH; 2) Each bedroom is occupied by 1 student. And an additional condition for 20201 Fairmount Boulevard; Submission of a detailed landscape plan of the evergreen buffer with location, species, and installation heights of the shrubs. Jeremiah Swetel, John Carroll University, presented information regarding requesting a conditional use permit for both properties. Fairmount Gardens does not have parking spaces for each bedroom. Other on or off-campus spaces will be assigned. Fairmount Circle South has a number of spaces to equal 1 parking space per bedroom. Parking enforcement will be handled with dialogue with JCU Police and Shaker Heights Police to help with enforcement if necessary. JCU will work with the City to work to develop a Memorandum of Understanding with the Police Department. Other enforcement of this building is processed through on-site staff and the management team at Coral Company. Bike parking is available in the garages, with enough room for 10 bikes at each location. He showed the site plan and explained access and walking routes. The dumpsters are enclosed, with each dumpster brought out for pick up. Fairmount Gardens has a 6-foot tall fence as a buffer, but Fairmount Circle needs additional landscaping toward the adjacent house on Fairmount Boulevard in order to meet code. Mr. Russell asked about parking. Will students apply for on-site spaces and alternate on-campus permits through JCU? Mr. Swetel said yes, parking permits are a separate process from leasing. Board of Zoning Appeals & City Planning Commission 05/07/2024 Minutes Page 5797 Mayor Weiss said Fairmount Circle South has one parking space per bedroom but Fairmount Gardens does not. Mr. Swetel said Fairmount Gardens has a deficit of 18 parking spaces. They have historically housed lots of students at this building and parking has not been a problem. Mr. Malone asked if the university has reached out to the neighbors. Mr. Feinstein said the city did send public hearing notices to an extended list of nearby residents. Mr. Malone asked if there would be a review of the conditional use permit in a year. Ms. Braverman said yes, they could do a 1-year review by City staff. At any time the City Planning Commission can review any violations of a conditional use permit and may revoke a permit after a public meeting. Mr. Malone said he would like to add the condition of a 1 year staff review of the conditional use permit as a condition of any approval. Mr. Boyle asked the estimated number of beds needed. Per the school’s Master Plan, can they project the number of beds needed including when these two buildings are converted to 100 percent students? Mr. Swetel said on campus they have 1,500 beds for freshmen and sophomores. The Fairmount Circle North and South and Fairmount Gardens are 150 beds. Additional apartments and houses the school owns will also be used depending on enrollment. Research shows that residing in school-owned housing for freshmen and sophomores leads to a retention of 85% of sponsored students. Mayor Weiss asked about additional JCU owned off-campus housing. Other than these. Mr. Swetel said there are 52 bedrooms in duplex homes and another 70 beds in other apartment buildings. Lisa Brown Cornelius, Dean of Students, said student staff will live on-site, plus a supervisor with professional staff will manage and collaborate with the management group for site conditions. Tony Coyne, JCU Legal Counsel, asked about monitoring issues in a review after a year. What does that mean? Ms. Braverman said that review could be on any conditions of the conditional use permit, other City ordinances, and inspection reports. She confirmed that staff would complete that review. Mayor Weiss inquired about controlling on-site parking. Mr. Swetel said 1 car parking space per bedroom is provided at Fairmount Circle South. Fairmount Gardens does not have enough parking for each bedroom, so other JCU parking will be required for additional cars over that number. Board of Zoning Appeals & City Planning Commission 05/07/2024 Minutes Page 5798 Ms. Cornelius said Fairmount Gardens parking permits are different so they will probably limit parking to one per unit. Then other vehicles will need on-campus or off-campus permits. Mr. Russell asked the general student to vehicle ratio. Mr. Swetel said freshmen and sophomores must get permits to park cars. On-campus parking is tight. It could be 1 to 1 but he is unsure if off-campus housing will be different. Mayor Weiss opened the Public Hearing. Mr. Feinstein summarized the public comment that had been submitted. Bill Powell, 20200 North Park Boulevard, asked about the process to review in one year. Would the public be allowed to have input in that process? He suggested public input regarding parking. He said that the city and JCU should enter into an agreement to agree that tax exempt status will not be changed to exempt. Mr. Gruber said a number of residents, including Mr. Powell, are concerned with on-street parking. That is not a direct zoning issue. It is a Police Department issue. There is no evidence that on-street parking has been an issue. There will now be a limit for the number of cars. There is no reason to believe there will be more cars. The Police Department deals with parking issues all over the city on an ongoing basis. If a problem arises, the Police Department and City will address the issues. Residents regularly let the City know if there are issues. Mayor Weiss asked about the review process. Ms. Braverman said normal review is completed by staff. Other City departments including the Police Department are consulted during the review. If violations are found and the City Planning Commission meets to discuss them, they could also take public input. Mr. Russell asked if they have ever held a public meeting for a review. Ms. Braverman said no. Mr. Feinstein said any review would include a review of public comments and concerns reported to all relevant city departments. Mayor Weiss asked about tax status progress. Mr. Gruber said there has been no further development regarding tax status of the properties with the university. John Carroll University has stated the properties will remain taxable, as they are now. Mayor Weiss said compliance with good neighbor guidelines is an important part of the OCSH. Will those guidelines be incorporated with the leases? Mr. Swetel said yes, it will be and all students will get an orientation. Board of Zoning Appeals & City Planning Commission 05/07/2024 Minutes Page 5799 Mr. Malone said JCU has made straightforward remarks and submitted written input that they do not intend to change tax status of the properties. He is relatively confident with those assurances made by the university. It was moved by Mr. Boyle and seconded by Mr. Russell to approve the request based on the findings of fact and conclusions of law as set forth in the Action Sheet with the following conditions: 1. Adoption of Chapter 1245 OCSH by City Council. 2. Each bedroom shall be rented to only one student as proposed by the applicant. 3. A detailed landscape plan including species, location and installation size for the evergreen hedge proposed in the western side yard is submitted for staff review. 4. Staff review after one (1) year for compliance with the conditional use permit, conditions and City code requirements. PETER’S LUTHERAN CHURCH – 18000 VAN AKEN BOULEVARD: A Public Hearing was held on the request of Heather Vallier, St. Peter’s Lutheran Church, 18000 Van Aken Boulevard, to the Board of Zoning Appeals for a parking variance to add a new primary school use on the site. The applicant proposes to establish a primary school on the church property. The property has 30 on-site spaces in the parking lot in addition to 9 adjacent on-street parking spaces for a total of 39 available parking spaces. There are an additional 18 shared parking spaces on adjacent city-owned land. The church requires 67 parking spaces and the new school requires 10 additional spaces for a total of 77 required parking spaces. Mr. Feinstein showed pictures of the site. He stated this is a request for a parking variance in order to establish a primary school at the church. The applicant proposes a primary school to occupy existing classrooms in the church. The property has 30 on-site spaces in their parking lot with 9 additional on- street spaces on Glencairn Road for a total of 39 total parking spaces. Code requires 62 parking spaces for the church and 10 for the proposed primary school for a total of 77 parking spaces. There are an additional 18 spaces on adjacent city-owned land on the western edge of the parking lot. The primary school is a permitted use. Staff supports the request with the condition of parking lot striping defining the pick-up and drop-off route. Jeff Zunicky, representing the church said the classrooms were intended for educational uses since being built for a school in 1963. They currently use the rooms for Bible study classes and have done over many years. They have operated in this building since 1938 with educational uses and never had a problem with parking. They have allowed another church to share space and it has not created a problem. The church sold that line of parking to the City in the 1970’s and maintains the lot. Operational times do not overlap between the church and school. Most of school parking is existing teachers and staff. They agree to stripe the lot and hope for 40 students this coming school year. They can certainly accommodate 10 cars stacked for pick-up and drop-off. The Pastor has started discussions with the Police Department regarding crosswalks and speed limits. Mr. Gruber asked about a play area. Will they be using the nearby park or the parking lot? Mr. Zunicky said he imagines use of the park and also their own property for outdoor play. Mr. Malone asked about the city-owned parking spaces. Mr. Feinstein said it is shared parking with a handful of neighborhood cars using the spaces. Mr. Zunicky agreed that some cars from the neighborhood park there. Three or four spaces are used each day and a few more in the evening. Mayor Weiss opened the Public Hearing. There were no comments received regarding this application. Mayor Weiss said factors to consider include the shared parking. Board of Zoning Appeals & City Planning Commission 05/07/2024 Minutes Page 5801 Mr. Malone asked about Sunday overflow parking. Mr. Zunicky said some parishioners choose to park on the street near the entrance, but there is always available on-street parking remaining. Mr. Gruber asked about funerals during school hours. Mr. Zunicky said that might include 30 to 40 spaces for a funeral nowadays. It is less than it used to be due to lower attendance. They will endeavor to avoid a conflict. It was moved by Mr. Russell and seconded by Mr. Boyle to approve the request based on the findings of fact and conclusions of law as set forth in the Action Sheet with the condition that additional parking lot striping is added to direct pick-up/drop-off lines in the parking lot and a plan is submitted for staff review. CRUMPTON RESIDENCE – 3396 AVALON ROAD: A Public Hearing was held on the request of Anthony Crumpton, 3396 Avalon Road, to the Board of Zoning Appeals for a variance to the side yard fence location regulations. The applicant proposes to install a 6-foot tall wood picket fence in the side yard. The fence is 11 feet 8 inches from the applicant’s house near the rear, but only 5 feet 3 inches from the house at the front. Code requires 10 feet on both sides of the property line in order to locate a fence in the side yard. The fence is located approximately 13 feet from the neighbor’s house across their driveway. The fence extends along the side property line from the rear corner of the lot to the front corner of the house with a gate across a walkway Mr. Feinstein showed pictures of the site. He stated this is a request for a variance to the side yard fence location regulations. The applicant proposes a 6-foot tall wood fence in the Avalon Road side yard. The fence is proposed 11 feet 8 inches from the applicant’s house at the corner, but only 5 feet 3 inches at the front corner. Code requires a 10-foot wide side yard on both sides in order for a fence to be in a side yard. The fence would be approximately 13 inches from the neighbor’s house across their driveway. Staff supports the request. Mr. Crumpton said he has owned the property for 1 ½ years. Lots of foot and animal traffic comes through the side yard. The proposed fence will help eliminate traffic trespass. Mayor Weiss noted this is an unusually shaped and situated property. Board of Zoning Appeals & City Planning Commission 05/07/2024 Minutes Page 5802 Mr. Crumpton said he owns both parcels. He lives in one side and rents the other side. His property on the Avalon Road side does not have 10 feet of land to his property line near the front corner. It is an odd-shaped property. Mayor Weiss asked where the fence would be located. Mr. Crumpton described the fence location and said it is right up to the neighboring chain link fence. Mr. Russell said he is glad it is proposed set back from front wall of the house. He now understands the issue of trespass and supports the request. Mr. Malone asked if the fence has been discussed with the neighbor. Mr. Gruber said the fence is proposed to prevent neighbor issues. Mayor Weiss opened the Public Hearing. No comments were received in regard to this application. It was moved by Mr. Russell and seconded by Mr. Malone to approve the request based on the findings of fact and conclusions of law as set forth in the Action Sheet. STOIBER/MCCAFFREY RESIDENCE – 3734 LINDHOLM ROAD: A Public Hearing was held on the request of Anna Stoiber and Ian McCaffrey, 3734 Lindholm Road, to the Board of Zoning Appeals for a variance to the fence location and height regulations on a corner lot. The applicant proposes to install a 4-foot tall open picket fence on this corner lot at Lindholm Road and Scottsdale Boulevard. The fence is proposed to be located 3.5 feet off the Scottsdale Boulevard sidewalk. Code requires that fences located in corner side yards not extend in front of the setback line of the primary building on the adjacent lot. The adjacent commercial building fronting on Lee Road is set back 16.5 feet from Scottsdale Boulevard. The fence is proposed to enclose a portion of the corner side and rear yard between the house and the garage. Existing boxwood shrubs, additional boxwood shrubs, and a mix of native plants are proposed to soften the fence view from the street. Mr. Feinstein showed pictures of the site. He stated this is a request for a variance for fence height and location on a corner lot. The applicant proposes a 4-foot tall open picket fence 3 feet 6 inches off the Scottsdale Boulevard sidewalk at the corner with Lindholm. Code requires a fence to be no closer to the street than the adjacent building on a corner lot. The adjacent commercial building facing Lee Road is 16 feet off of Scottsdale Boulevard. The applicant proposes existing and new boxwood shrubs plus native plantings to soften the view of the fence to the street. The fence is proposed to contain the applicant’s child and dog. Staff supports the request. Board of Zoning Appeals & City Planning Commission 05/07/2024 Minutes Page 5803 Ms. Stoiber said this is a unique lot on the corner. They want to keep the dog and the child in the yard and keep others out. The fence will connect in the rear to the other neighbor’s fence. They want to enclose a small part of their rear yard. There is a convenience store across the street with lots of traffic on Scottsdale Boulevard and Lee Road. Mr. Malone said the fence location makes sense. It is closer to the sidewalk than a usual corner fence, but it is located to take advantage of the existing landscaping. He added that this is a busy area at the corner with Lee Road. Mayor Weiss asked how far the fence extends out from the house. Mr. Feinstein said 6 feet out from the house. Mr. Russell said he assumes the hedge was original to when the house was built. Mr. Feinstein said yes it is original landscaping. Mayor Weiss opened the Public Hearing. No comments were received in regard to this application. It was moved by Mr. Boyle and seconded by Mr. Russell to approve the request based on the findings of fact and conclusions of law as set forth in the Action Sheet. MURPHY RESIDENCE – 22100 MCCAULEY ROAD: A Public Hearing was held on the request of David Ellison, architect, representing, Cynthia Murphy, 22100 McCauley Road, to the Board of Zoning Appeals for variances to the garage regulations in order to construct a new detached, one car garage in the rear yard. The applicant proposes the additional garage while maintaining the existing attached garage which faces the rear yard. The new detached garage is proposed behind the existing garage with the garage doors facing the street. Code allows only one garage structure on the property. Code also requires an attached garage that does not face the street on this street block where the majority of garages are attached with garage doors facing the side or rear. Mr. Feinstein showed pictures of the site. He stated this is a request for variances to the garage regulations for number, type and orientation of the garage doors. The applicant proposes to build a detached garage in the rear yard, while maintaining the existing garage. Code allows only one garage structure. Code also requires an attached garage that does not face the street where the majority of garages on the block are attached and face the side or rear. The Architectural Board of Review approved the garage and house addition design at yesterday’s meeting with conditions about the addition windows. Staff supports the request. Board of Zoning Appeals & City Planning Commission 05/07/2024 Minutes Page 5804 David Ellison, architect, said he is representing Cindy and Brian Murphy in order to renovate this house in order to move next to their daughter. He tried several addition design schemes and this scheme preserves more of the back yard with less pavement. The existing garage is very narrow and difficult. A Model A car or a Mini Cooper would fit. This design preserves the existing attached garage and then locates the second enclosed garage space behind the house so you do not see the door. The also rearranged the existing garage interior and overhead door. Mayor Weiss asked about the connection between the house addition and driveway. This is only a one car garage? Mr. Ellison said they are now proposing a gate only to connect to the one car garage. Ms. Braverman said there is precedent to grant a second freestanding garage. Mayor Weiss opened the Public Hearing. No comments were received in regard to this application. Mr. Russell said subject to staff report he supports the proposal. CUYAHOGA COUNTY LAND BANK – 3634 LUDGATE ROAD: A Public Hearing was held on the request of Jennifer Vasquez-Norman, Cuyahoga County Land Bank, 3634 Ludgate Road, to the Board of Zoning Appeals and City Planning Commission for site plan review and variances for a new single-family house. The applicant proposes to construct a new three bedroom house on this vacant lot, with a two-car detached garage located at the rear of the lot. The house will have an open floor plan with a front porch and basement. The property is 38 feet by 130 feet and 4,940 square feet, which does not meet code requirements for lot width or minimum size in the SF-3 Single-Family Residential zoning district. Code requires a lot be 40 feet wide and a minimum of 5,600 square feet in size. All location and setback requirements of the house are code conforming. Site plan review is required for all new houses. Mr. Feinstein showed pictures of the site. He stated this is a request for site plan review and variances to the lot size for a new single-family house. The applicant proposes two new houses on city-owned lots on Ludgate Road. The homes are a bungalow design with three bedrooms and a front porch. The lots are 38 feet wide and 4,490 square feet in size. Code requires a 40-foot wide lot that is 5,600 square feet in the SF-3 Single Family Residential zoning district. The new house meets all location and setback regulations. The Architectural Board of Review approved the design at their March 18, 2024 meeting with comments Board of Zoning Appeals & City Planning Commission 05/07/2024 Minutes Page 5805 about the front dormer roof line and a bathroom window. Staff supports both new house locations and variances. Jennifer Vasquez-Norman, Cuyahoga County Land Bank, said this is their second attempt to get houses built on these lots. They request variances for the lot size. A landscape plan has been submitted. This is a prototype design for the street. The upstairs bedrooms have a nice consistent height with the shed roof dormer design. They did notify the immediate neighbors and send a design to them. Mr. Feinstein said new homes were approved in 2021 on these lots. Those homes were not built. Mr. Boyle said these lot sizes were already approved. Mr. Feinstein said all the lots on this block of Ludgate Road are the same size. Ms. Braverman said these new homes need site plan review. The variance for lot size is not different than was approved before. Mayor Weiss opened the Public Hearing. No comments were received in regard to this application. HAMMONS RESIDENCE – 3695 AVALON ROAD: A Public Hearing was held on the request of the City of the Shaker Heights, representing Barrett Hammons, 3695 Avalon Road, to the City Planning Commission for subdivision of land in order to join a city-owned vacant lot with the property on which the Hammons home is located. The house parcel at 3695 Avalon (735-29-088) is proposed to be combined with the vacant adjacent lot at 3699 Avalon (735-29-087). Mr. Hammons proposes to integrate the vacant lot into his yard. This combined lot meets code requirements in the SF-3 Single Family Residential zoning district. Subdivision of land requires City Planning Commission approval. Mr. Feinstein showed pictures of the site. He stated this is a request for subdivision of land to combine a vacant lot with the applicant’s house. The city-owned lot was approved by City Council to be sold to Mr. Hammons next door and combined with their property as extra yard area. The combined lots meet code requirements in the SF-3 Single Family Residential zoning district. Staff supports this request. Mr. Hammons said he is looking forward to developing the lot with landscaping to use for his son and dogs. Mayor Weiss opened the Public Hearing. No comments were received in regard to this application. Mr. Boyle said he supports joining the two lots. It was moved by Mr. Boyle and seconded by Mr. Russell to approve the request based on the findings of fact and conclusions of law as set forth in the Action Sheet with the condition that a final plat is submitted to the City and filed with the county.
