Council Meeting – August 17, 2023 Mayor H. Troy Ethington called the council meeting to order at 6:30 p.m. with the following council members present: Tom Hardesty, Pam Carter, Sally Pollett Zaring, Mike Zoeller and Frank Page. City Employees Present: Jennifer Herrell, Chief Rob Rothenburger, Chief Bruce Gentry, Candice Selph, Fred Rogers, and Carla Wainscott. City Attorney: Steven Gregory All present pledged allegiance to the flag Minutes – Special Called Meeting of July 27, 2023 Councilmember Carter moved to approve the minutes of the special-called meeting of July 27, 2023, as read by the council members prior to the meeting. Seconded by Councilmember Zaring. All voted “aye” and the motion carried. Resolution No. 2023-08-17/A Resolution Authorizing the Mayor of Shelbyville and the Chief of The Shelbyville Police Department to Enter into a Memorandum of Understanding with the Shelby County School District for the Provision of School Resource Officer Services in Shelby County Public Schools During the 2023-2024 School Year, Steven Gregory Steven Gregory, City Attorney, read in summary a resolution authorizing the Mayor of Shelbyville and the Chief of the Shelbyville Police Department to enter into a memorandum of understanding with the Shelby County School District for the provision of School Resource Officer services in Shelby County Public Schools during the 2023-2024 school year. Councilmember Zaring moved to approve the resolution. Seconded by Councilmember Carter. All voted “aye” and the resolution was carried. Resolution No. 2023-08-17(A)/A Resolution Authorizing the City of Shelbyville to Enter into a Franchise Agreement with Openfire Kentucky Company, LLC DBA Accelecom, Granting a Ten (10) Year, Non-Exclusive Franchise for a Telecommunications System Within the City Limits of Shelbyville, Kentucky, Steven Gregory Steven Gregory, City Attorney, read in summary a resolution authorizing the City of Shelbyville to enter into a franchise agreement with Openfire Kentucky Company, LLC DBA Accelecom, granting a ten (10) year, non-exclusive franchise for a telecommunications system within the city limits of Shelbyville, Kentucky. Appointment, Mayor Ethington Jason Whisman to the Tax Appeals Board for a 3-year term to expire August 31, 2026. Councilmember Hardesty moved to approve the appointment. Seconded by Councilmember Zoeller. All voted “aye” and the motion carried. Ordinance/An Ordinance Levying Ad Valorem Property Taxes for the Calendar Year 2023-1st Reading, Steven Gregory Steven Gregory, City Attorney, read an ordinance levying Ad Valorem Property Taxes for the 2023 calendar year. Councilmember Page moved to approve the ordinance. Seconded by Councilmember Smitha. Ordinance A /An Ordinance Adopting the City of Shelbyville, Kentucky, Budget Amendment for the Fiscal Year July 1, 2022, through June 30, 2023-1st Reading, Steven Gregory Steven Gregory, City Attorney, read in summary an ordinance adopting the City of Shelbyville, Kentucky, budget amendment for the Fiscal Year July 1, 2022, through June 30, 2023. Councilmember Page moved to approve the motion. Seconded by Councilmember Carter. Ordinance B/ An Ordinance Amending Chapter 41, Article III, of the City of Shelbyville Code of Ordinances Relating to Sidewalks, 1st Reading, Steven Gregory Steven Gregory, City Attorney, read in summary an ordinance amending Chapter 41, Article III of the City of Shelbyville Code of Ordinances relating to sidewalks. There is language added to the amending of the ordinance, which is in Section A, 1-9 where the work may be paid fully by the City; Section B where there will be a 50/50 split; Section C are the projects which must be fully funded by the property owners and Sections D-H which apply to any other policies that are incorporated into the ordinance. Councilmember Zoeller moved to approve the ordinance. Seconded by Councilmember Hardesty. Ordinances (C-QQ)/ Ordinances of the City of Shelbyville Amending the Position Descriptions of City Employees, 1st Readings, Steven Gregory Steven Gregory, City Attorney, read in summary ordinances of the City of Shelbyville amending the position descriptions of city employees. There are 41 ordinances which are being presented. The departments are Administration, Police Department, Fire Department, Public Works, and Weissinger Hills Golf Course. We are going to read this in summary as a group and if there are any questions on one of them, then we will read that alone. Councilmember Zaring moved to approve the ordinances. Seconded by Councilmember Carter. Public Comments No public comments. City Attorney’s Report, Steven Gregory No report. City Administrator’s Report, Fred Rogers No report. City Clerk’s Report, Carla Wainscott No report. Department Reports Jennifer Herrell, City Engineer, reported the Household Hazardous Waste Event will take place on Saturday, October 27, 2023. Mrs. Herrell is working on the reimbursement process from KYTC regarding Burks Branch Road Bridge rehabilitation. The lake Shelby bath house documents and building plans have been created/executed. The department is still accepting applications for a Maintenance Tech II. Candice Selph, Human Resources, reiterated the desire for applications for Public Works and the Police Department. Chief Rob Rothenburger, Shelbyville Fire Department, reported that the department has been out doing fire inspections. Installation scheduled for August 24 and 25, 2023, for the ladder truck. The ARPA funding for the HVAC has been completed. Chief Bruce Gentry, Shelbyville Police Department, stated that the 2 new police officers will be released to be on their own in the middle of September 2023. Mason Warren - ShelbyKy Tourism, reported that the City of Shelbyville, City of Simpsonville, and Shelby County will be partnering together for the fee to Granicus which documents and tracks down the rental property. Mayor’s Report Mayor Ethington advised the council that the financial reports are in their packets. There is an application on-line for anyone who would like to be appointed to the Parks and Recreation Board. On September 19 – 22, 2023, KLC will hold their annual conference in Lexington. The Art Spark festival will be held on September 1-4, 2023, at the fairgrounds. August 23, 2023, Morning Mixer at Stargazer. On September 5, 2023, Midday Mixer at Karem Dental. Council Reports Councilmember Hardesty advised that on Sunday, August 20, 2023, a Celebration of Life will be held for Mark Stucker, who worked for Weissinger Hills Golf Course. Councilmember Carter advised of the Labor Day Festivities being held at the fairgrounds. Mrs. Carter also shared that Habitat 4 Humanity will be helping serve lunch on Friday, September 8, 2023, at the Veterans Village at 11:30 a.m. A motion was made to adjourn the regular-called council meeting at 7:25 p.m. by Councilmember Zaring.
