Council Meeting – September 7, 2023 Mayor H. Troy Ethington called the council meeting to order at 6:30 p.m. with the following council members present: Tom Hardesty, Pam Carter, Sally Pollett Zaring, Mike Zoeller and Frank Page. City Employees Present: Jennifer Herrell and Carla Wainscott. City Attorney: Steven Gregory All present pledged allegiance to the flag Minutes – Public Hearing and Regular Called Meeting of August 17, 2023 Councilmember Carter moved to approve the minutes of the public hearing and regular called meeting of August 17, 2023, as read by the council members prior to the meeting. Seconded by Councilmember Smitha. All voted “aye” and the motion carried. Re-Appointment, Mayor Ethington and Appointment, Mayor Ethington Mayor H. Troy Ethington requests the re-appointment of Ed Yocum to the Code Enforcement Board for a 3-year term to expire on September 17, 2026. Mayor H. Troy Ethington requests the appointment of Mannie Stone to the Parks and Recreation Board filling out the unexpired term of Mitchel Tinsley to expire on December 31, 2024. Councilmember Zaring moved to approve the appointments. Seconded by Councilmember Hardesty. All voted “aye” and the motion carried. Ordinance/An Ordinance Annexing Real Property to the City of Shelbyville and Adopting a Zone Change – 1st Reading, Steven Gregory Steven Gregory, City Attorney, read in summary an ordinance annexing real property to the City of Shelbyville and adopting a zone change. This property consists of 432.579 acres located in Shelby County, Kentucky and owned by four (4) separate business entities, 1. Big Four Star Properties, LLC, 2. Langley Land Company, LLC, 3. WMC Lane LLC, and 4. TDA Properties, Inc. The business owners have asked in written consent to be annexed into the city limits of Shelbyville in accordance with KRS 100.209. This is approval for Mayor Ethington to request the properties to be annexed from Triple S Planning and Zoning. Councilmember Zoeller moved to approve the ordinance. Seconded by Councilmember Page. Ordinance No. 2023-10-05/An Ordinance Enacting Text Amendments to Articles II, VI and XI of the City of Shelbyville Zoning Regulations Relating to Signage, 1st Reading, Steven Gregory Steve Gregory, City Attorney, read in summary an ordinance enacting text amendments to Articles II, VI and XI of the City of Shelbyville zoning regulations relating to signage. Councilmember Page moved to approve the ordinance. Seconded by Councilmember Carter. Municipal Order No. 2023-09-07/An Order Declaring Personal Property Owned by the City of Shelbyville to be Surplus Property and Authorizing the Sale or Trade of said Property, Steven Gregory Steve Gregory, City Attorney, read an order declaring personal property owned by the City of Shelbyville to be surplus property and authorizing the sale or trade of said property. The surplus property is a 2012 Ford Focus which is part of the administration fleet. Councilmember Zoeller moved to approve the municipal order. Seconded by Councilmember Hardesty. All voted “aye” and the order carried. Ordinance No. 2023-09-07/An Ordinance Levying Ad Valorem Property Taxes for the Calendar Year 2023, 2nd Reading, Steven Gregory Steven Gregory, City Attorney, read an ordinance levying Ad Valorem Property Taxes for the Calendar Year 2023. Councilmember Page moved to approve the ordinance. Seconded by Councilmember Smitha. Upon Roll Call: Councilmember Hardesty, Councilmember Smitha, Councilmember Carter, Councilmember Zaring, Councilmember Zoeller and Councilmember Page. All voted “aye” and the motion carried. Ordinance No. 2023-09-07(A) /An Ordinance Adopting the City of Shelbyville, Kentucky, Budget Amendment for the Fiscal Year July 1, 2022, through June 30, 2023, 2nd Reading, Steven Gregory Steven Gregory, City Attorney, read in summary an ordinance adopting the City of Shelbyville, Kentucky, budget amendment for the Fiscal Year July 1, 2022, through June 30, 2023. Councilmember Carter moved to approve the motion. Seconded by Councilmember Zaring. Upon Roll Call: Councilmember Hardesty, Councilmember Smitha, Councilmember Carter, Councilmember Zaring, Councilmember Zoeller and Councilmember Page. All voted “aye” and the motion carried. Ordinance No. 2023-09-07(B)/An Ordinance Amending Chapter 41, Article III, of the City of Shelbyville Code of Ordinances Relating to Sidewalks, 2nd Reading, Steven Gregory Steven Gregory, City Attorney, read in summary an ordinance amending Chapter 41, Article III of the City of Shelbyville Code of Ordinances relating to sidewalks. Councilmember Carter moved to approve the ordinance. Seconded by Councilmember Smitha. Upon Roll Call: Councilmember Hardesty, Councilmember Smitha, Councilmember Carter, Councilmember Zaring, Councilmember Zoeller and Councilmember Page. All voted “aye” and the motion carried. Ordinances No. 2023-09-07 (C-QQ)/ Ordinances of the City of Shelbyville Amending the Position Descriptions of City Employees, 2nd Readings, Steven Gregory Steven Gregory, City Attorney, read in summary ordinances of the City of Shelbyville amending the position descriptions of city employees. There are 41 ordinances which are being presented. The departments are Administration, Code Enforcement, Police Department, Fire Department, Public Works, and Weissinger Hills Golf Course. Public Comments No public comments. City Attorney’s Report Steven Gregory reported that the city received a copy of the cable franchise agreement from Spectrum (Charter) and Mr. Gregory made some revisions. It has been resubmitted and will be bringing it to Council in the future. It is a non-exclusive agreement. City Administrator’s Report Fred Rogers – No report. City Clerk’s Report Carla Wainscott – No report. Department Reports Jennifer Herrell, City Engineer, stated the Household Hazardous Waste Event will take place on Saturday, October 7, 2023. Mrs. Herrell will have a Stormwater Booth at Shelby Showfest on September 23, 2023, sponsored by Shelby County Chamber of Commerce. The Stormwater program will sponsor a bounce house. The Public Works Department has been repairing drainage along with outside contractors. Darlene Snow, Shelby Main Street, reported that there is a community wide survey of economic vitality for the downtown area of Shelbyville and will run through September 2023. Matt Mattingly, Shelbyville/Shelby County Parks, spoke about the Trailer Treat with Froggy which takes place on Saturday, October 28, 2023, from 5:00 p.m. - 6:30 p.m. Mayor’s Report Mayor Ethington informed that the Painted Stone Settlers Re-enactment will take place on September 8th and September 9th, 2023, at Red Orchard Park. A ribbon cutting at Sluggers Roofing on September 13, 2023, at 11:30 a.m. The Jeep Invasion will take place September 16, 2023, at 2:00 p.m., along with the John Prime concert to follow on 6th Street. On September 22, 2023, Larry Rogers Caldwell Bankers will be hosting the midday mixer from 11:30 a.m. to 1:00 p.m. On September 23, 2023, Shelby Showfest at the fairgrounds will be a family fall festival from 9:00 a.m. to 2:00 p.m. On September 27, 2023, groundbreaking on the new Traditional Bank location at 10:00 a.m. On September 28, 2023, the employee banquet will be held at the Shelbyville Conference Center. Council’s Report Councilmember Hardesty asked to keep the 2 Louisville Metro Police Officers who were shot in your prayers. Councilmember Carter shared that Habitat 4 Humanity will be serving lunch for our veterans and first responders on Monday, September 11, 2023, at the Veterans Village from 11:00 a.m. to 12:30 p.m. Councilmember Page advised that Traditional Bank will be having Customer Appreciation Day on Friday, September 8, 2023. Councilmember Zaring expressed gratitude for having a school resource officer at the schools. A motion was made to adjourn the regular-called council meeting at 7:15 p.m. by Councilmember Page.
