MINUTES OF THE REGULAR MEETING OF THE BOARD OF DIRECTORS OF THE CITY OF SILOAM SPRINGS, BENTON COUNTY, ARKANSAS, HELD MAY 21, 2024 The City of Siloam Springs, Arkansas, met in regular session at the City of Siloam Springs Administration Building on May 21, 2024. The meeting was called to order by Vice Mayor David Allen. Roll Call: Hunt, Blair, Wiles, Rissler, Carroll, Smiley, Allen— present. City Representatives Present: Allan Gilbert, City Administrator; Jene' Fain, Assistant City Clerk; Joel Kurtz, City Attorney; Scott Miller, Police Chief; Kris Paxton, Community Development Director; Ben Rhoads, Senior City Planner; Kevin Moore, City Engineer; Dustin Kindell, Interim Fire Chief. Director Blair led the opening prayer. Vice Mayor Allen led the Pledge of Allegiance. Allen asked if there were any comments from the audience regarding an item not on the City' s agenda. The vice mayor asked if there were any comments on an item on the Consent Agenda. Consent Agenda A. Workshop Minutes— Annexation/ May 7, 2024 B. Regular Meeting Minutes/ May 7, 2024 C. Purchase/ Sanitation Division/ 2024 Caterpillar Excavator/ Riggs Cat/$ 111, 365. 27 D. Oklahoma Secretary and Environment Department / Siloam Springs Water Resource Company Property/ Proposed Land Sale/$ 713, 655. 00 A motion to approve the consent agenda as presented was made by Smiley and seconded by Wiles. Motion passed unanimously. Allen requested Item D be removed from the consent agenda for discussion. Allen stated he had not had the opportunity to review the contract provided the week before and questioned why GRDA would be signing the contract and not the State of Oklahoma. Ken McQueen with the Oklahoma Office of Energy and Environment stated that the state cannot hold title to property. He stated that GRDA can hold a title and that is why they have been chosen on their behalf. Allen stated he wanted to make sure the contract states that GRDA cannot sell the property at a later date. A motion to table Item D on the consent agenda to June 4, 2024, as presented was made by Allen and seconded by Rissler. Motion passed with a 4- 3 vote, with Allen, Rissler, Wiles and Blair voting - yes, Smiley, Hunt and Carroll voting- no. Board of Directors Meeting Minutes Page 12 May 21, 2024 Item E: Ordinance 24- 12/ 2nd Reading/ Amending Section 102- 21 of the City Municipal Code/ Rezoning from A- 1 to P- D/ 3500 Block of E. Kenwood St. Kevin Moore briefed the item. A motion was made by Smiley and seconded by Carroll, to place Ordinance 24- 12 on its second reading, suspending the rules and reading title only. Motion passed unanimously. An ordinance entitled: AN ORDINANCE AMENDING SECTION 102- 21 OF THE SILOAM SPRINGS MUNICIPAL CODE ( CITY ZONING MAP); REZONING ( FROM A- 1 TO P- D) PROPERTY LOCATED AT THE 3500 BLOCK OF EAST KENWOOD STREET; was read on its second reading. Item F: Ordinance 24- 13 / 2nd Reading Amending Section 102- 21 of the City Municipal Code/ Rezoning from A- 1 to R- 2/ 3500 Block of E. Kenwood St. Kevin Moore briefed the item. A motion was made by Hunt and seconded by Carroll, to place Ordinance 24- 13 on its second reading, suspending the rules and reading title only. Motion passed unanimously. An ordinance entitled: AN ORDINANCE AMENDING SECTION 102- 21 OF THE SILOAM SPRINGS MUNICIPAL CODE ( CITY ZONING MAP); REZONING ( FROM A- 1 TO R-2) PROPERTY LOCATED AT THE 3500 BLOCK OF EAST KENWOOD STREET; was read on its second reading. Item G: Ordinance 24- 14/ 1st Reading/ Vacation of Right- of-Way/ 500 Block of South College Street. Kevin Moore briefed the item. Rissler stated she would abstain from the vote in that she and her husband own said property. A motion was made by Smiley and seconded by Hunt, to place Ordinance 24- 14 on its first reading, suspending the rules and reading title only. Motion passed unanimously, with Rissler abstaining. An ordinance entitled: AN ORDINANCE VACATING AND ABANDONING RIGHT- OF- WAY AT THE 500 BLOCK OF SOUTH COLLEGE STREET; was read on its first reading. Item H: Ordinance 24- 15 / 1st Reading/ Amended Section 2- 144 of the City Municipal Code/ Establishing Duties and Responsibilities of the Siloam Springs Assistant City Clerk. Allen Gilbert briefed the item. Rissler requested that the matter be read on its 1st 2" d and 3' reading based on emergency. A motion was made by Smiley and seconded by Rissler, to place Ordinance 24- 14 on its first, second and third reading, suspending the rules and reading title only. Motion passed unanimously. Board of Directors Meeting Minutes Page 3 May 21, 2024 An ordinance entitled: AN ORDINANCE VACATING AND ABANDONING RIGHT- OF- WAY AT THE 500 BLOCK OF SOUTH COLLEGE STREET; was read on its first, second and third reading. A motion to adopt Ordinance 24- 15 was made by Smiley and seconded by Blair. Motion passed 7- 0. A motion to instate the emergency clause was made by Rissler and seconded by Smiley. Motion passed 7- 0. Item I: Resolution 25- 24/ 2024 Annexation Ordinance Authorization. Ben Rhoads briefed the item. A motion was made by Hunt and seconded by Smiley to approve Resolution 25- 24. Motion passed 7- 0. Item H: Administrator' s Report. Allan Gilbert reported on the items attached hereto. Gilbert asked Chief Miller to give an update on the daughter of Officer Burnett. She is still in extreme condition after many surgeries and Officer Burnett and his wife have been at her side nonstop for the past several weeks. There has been an account set up at Grand Savings Bank in the name of Beau and Amanda Burnett Fund for anyone who wishes to help the financial burden of this family. He asked that you please keep them and their daughter in your prayers. Directors Reports- Hunt— She wants to thank Parks and Rec Department for the pickleball courts. They have been full each time she passes. She is looking forward to the first 4th Friday of the season. She wants to congratulate Jason Davis and snatiation with the increase in recycling. She congratulated Dustin Kindell for his promotion to interim fire chief. She thanked Jeff Farmer for coming and speaking regarding annexation and thanks everyone who gets involved and participates. Wiles— He wants to thank all city departments for their hard work and wants to let them know it is appreciated. Blair— She wants to congratulate Jordan Jackson on his promotion to interim deputy fire chief. She also wants to remind everyone of our charitable organizations which are in need. The Adult Development Center is having financial hardship and any donations would be appreciated. Also, Gensis House is in need of diapers in sizes 5 and 6. The animal shelter also would appreciate any toys, food or necessities. Rissler— She has had questions where the tennis courts will be now and what hours they will be open. She wants to clarify that when she says " yes" to annexation it is so that everyone has a chance to vote at the ballot. She states that she does not oppose tabling an item because life gets Board of Directors Meeting Minutes Page 14 May 21, 2024 busy. She questioned updates to the Master Street Plan. The CPKC steam locomotive came through town and it was amazing to see. She is still getting complaints about Bright Speed. Allen — He expressed sadness and sends his prayers for Officer Burnett and his family. Grady Nichols is a great musician for our first 4th Friday and is a native of our city. His vote for annexation was to allow the ordinance to come before the board for a vote. He congratulates Jordan Jackson. He hopes the Adult Development Center can find the necessary funding to remain in our community. He would like to see more money spent on streets. Carroll— He thanks GRDA and the State of Oklahoma for showing up tonight. He feels there is a need for annexation. He hopes the city and those affected can come together for growth. He is looking forward to the first 4th Friday and to witness Grady Nichols play. Smiley— She sends prayers to Officer Burnett and his daughter. Please remember those who have before us. The first 4th Friday event of the season is this Friday, May 24th. Grady Nichols will be performing at 6pm and the Full House Band begin at 7: 30pm. Look forward to over fifty vendors and food trucks, bounce houses and yard games. 2. The pool opening ceremony will be this Saturday at 1: 00pm. 3. New this year from Parks& Recreation is Tuesday night pickleball 6: 00pm to 9: 00pm at Bob Henry through the month of September. There will be children' s pickleball camps June 18d'— 21 st. See our website for registration information. 4. A reminder that this coming Monday, May 27th, is Memorial Day. City offices will be closed to allow staff time to honor those whose lives have been lost in our nation' s wars. Please note that Monday night yoga class on that day is canceled. 5.
