A communication was received from Tom DeVaney requesting permission to consume, but not sell wine, liquor and beer at the Old Courthouse Museum, 200 West Sixth Street, on Saturday, May 21, 2011, from 5:30 p.m. to 12:00 a.m. for a wedding reception. 2. A communication was received from South Dakota Association for the Education of Young Children/South Dakota Head Start Association stating their intent to sell raffle tickets from April 14, 2011 to April 16, 2011, for an outdoor classroom learning kit (valued at $500.00). Tickets will be $1.00 for one or $3.00 for five. Proceeds are to be used to support each association. 3. A communication was received from Augustana College Deaf Awareness stating their intent to sell raffle tickets April 8-9, 2011, for gift cards from local businesses (highest value of a card is $10.00). Tickets will be $1.00 each or free with a donation of 3 canned goods. All proceeds will be donated to Children's Inn. 4. A communication was received from Presentation Sisters stating their intent to conduct a 50/50 Cinco De Mayo raffle on April 30, 2011. Tickets will be $5.00 for one or $10.00 for three. Half of proceeds will be awarded to one winner and the other half is to be used for Caminando Juntos (Presentation Sisters ministry with Latino populations in Sioux Falls, SD). APPLICATIONS The following abatements were recommended for approval by the Director of Equalization and the State's Attorney's Office for Minnehaha County; and the City Attorney for Sioux Falls: 5. Megan and Betty Melloon, 6301 W. Misty Glen Pl., for 2010 property taxes in the amount of $257.48. A fire occurred on May 25, 2010 and the property owners are requesting an abatement for the days structure was gone. ANNEXATION 2011-02-01 57TH STREET AND SD HIGHWAY 11, HARMODON PARK A RESOLUTION INCLUDING CERTAIN CONTIGUOUS TERRITORY WITHIN THE CORPORATE LIMITS OF THE CITY OF SIOUX FALLS, SOUTH DAKOTA. WHEREAS, there has been presented to the City Council of the City of Sioux Falls and filed with the City Clerk, a Petition in writing signed by the owners and otherwise in compliance with the provisions of SDCL Chapter 9-4, requesting that the territory hereinafter described be included within the municipality; WHEREAS, there has been an analysis completed in regard to the territory hereinafter described and it has been found that: 1. The property has been properly described and is contiguous to the current city limits. 2. The proposed land uses and densities are generally consistent with the Shape Sioux Falls 2035 Comprehensive Plan. 3. There is adequate provision for municipal utilities and access to the major street network. NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF SIOUX FALLS, SD: That the following described properties be and the same hereby are included within the corporate limits of the city of Sioux Falls, Minnehaha County, and the boundary of the city is hereby extended to include such territory. Dean’s Tract 1 in SE 1/4 SE 1/4 of Section 36, T101N, R49W; and Tract 1 Kilness Addition in the E 1/2 SE 1/4 of Section 36, T101N, R49W; and Lot H-1 of Harris Tract 1 Pt. SW 1/4 of Section 31, T101N, R48W, all in Minnehaha County, South Dakota; and adjacent 57th Street right-of-way. And that the City Clerk shall cause to be filed with the Register of Deeds, Minnehaha County, South Dakota, a duly certified transcript of this resolution. 34. A RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO A MASTER ENERGY PROCESSING SERVICES PURCHASE AGREEMENT BETWEEN THE CITY OF SIOUX FALLS AND POET BIOMASS, LLC, A SOUTH DAKOTA LIMITED LIABILITY COMPANY. BE IT RESOLVED BY THE CITY OF SIOUX FALLS, SD: That the document attached to and part of this resolution entitled “Master Energy Processing Services Purchase Agreement” between the City and POET Biomass, LLC, is hereby approved. That the Mayor is authorized to sign such agreement after it is ratified and executed by POET Biomass. 35. A RESOLUTION CHANGING TWO STREET ASSESSMENTS. A motion was made by Council Member Kenny Anderson Jr. and seconded by Council Member Michelle Erpenbach to adopt said Resolution for Item 35. BE IT FURTHER RESOLVED: That the Director of Finance is hereby authorized to show said action on the respective record and to notify the Lincoln County treasurer of said action. 36. A RESOLUTION CANCELING INTEREST AND PENALTY ON AN INSTALLMENT OF STREET ASSESSMENT. A motion was made by Council Member Michelle Erpenbach and seconded by Council Member Sue Aguilar to adopt said Resolution for Item 36. BE IT RESOLVED BY THE CITY OF SIOUX FALLS, SD: That the interest and penalty for the 2011 installment of the street assessment for the N 400' Tract 1 Knewel’s Addition in the W1/2 NW1/4 of Section 7-T101N- R49W, Minnehaha County, SD, for Project No. G-05309 be canceled. BE IT FURTHER RESOLVED: That the Director of Finance is hereby authorized to show said action on the respective record and to notify the Minnehaha County treasurer of said action. REPORT OF MARCH 26, 2011, INSURANCE REIMBURSEMENT FOR TOTALED PICKUP (PARKS & RECREATION). 38. REPORT OF MARCH 28, 2011, NOTICE OF TRANSFERS OF APPROPRIATIONS WITHIN MAJOR ORGANIZATIONAL UNITS. NEW BUSINESS/ITEMS ADDED AFTER DEADLINE Mayor Huether excused himself from the meeting and the vote on Item 39. Council Chair Jamison chaired the meeting for Item 39. 39. A RESOLUTION APPOINTING THE NEW COUNCIL MEMBER FROM THE NORTHWEST DISTRICT. A motion was made by Council Member Sue Aguilar and seconded by Council Member Erpenbach to nominate Dean Karsky, Mark Millage, Marlin Thompson and James Ysbrand for the Northwest District position. The following votes were taken: 1st Vote Karsky: Entenman, Jamison, Rolfing, Brown, 4. Millage: Erpenbach, Aguilar, 2. Thompson: No votes. A RESOLUTION APPOINTING THE NEW COUNCIL MEMBER FROM THE NORTHWEST DISTRICT. BE IT RESOLVED BY THE CITY OF SIOUX FALLS, SD: That it appoints Dean Karsky as the Council Member from the Northwest District in the City of Sioux Falls. Such Council Member shall serve until the next regularly scheduled election in April 2012. Pursuant to SDCL 9-19-13, this resolution is declared to be for the support of the municipal government. It shall therefore become effective upon first publication. Mayor Huether returned to chair the remainder of the meeting. 40. Swearing in Ceremony performed by Honorable Larry E. Long, Second Judicial Circuit Court Judge Council Member Karsky joined the meeting at this time.
