A communication was received from Wayne and JoAnn Albers, requesting permission to consume, but not sell, liquor, wine and/or malt beverages at the Siouxland Heritage Museum, 6th and Main Street, on Saturday, August 20, 2011, from 7:00 p.m. to 11:15 p.m. for the purpose of a wedding dance and reception. APPLICATIONS The following abatements were recommended for approval by the Director of Equalization and the State's Attorney's Office for Minnehaha County; and the City Attorney for Sioux Falls: 2. Julie Ideker, 3212 S. Jefferson Avenue, for 2010 property taxes in the amount of $814.89. Monies requested are the difference between the elderly freeze and the non elderly freeze. 3. PUBLIC INPUT Jim Schmidt spoke regarding Clint and Tara Siemonsma. Schmidt gave special recognition for them coming to the Pettigrew Housing Resource Center to request assistance in building a house. The assistance was not for him, but rather for his neighbors, Gary and Darlene Nipp, whose home was destroyed by fire. Tim Stanga spoke regarding citizens who are on a limited budget/income and the raising of rates. UNFINISHED BUSINESS 8. Special One-Day Liquor License for Washington Pavilion Management Inc., Washington Pavilion of Arts & Science, 301 South Main Avenue, for the Turnabout Performance on April 17, 2011, and authorize publication of notice on  04-01-11 to set the hearing date. WHEREAS, a petition of the owners of Lots 11–14 Block 2 Airport Addition;  Lots 1–4 Block 3 Airport Addition to the City of Sioux Falls, Minnehaha County, South Dakota has been filed with the City Clerk, asking that the aforesaid be vacated. Pursuant to SDCL, notice of hearing has duly been given, and said notice was properly published; and WHEREAS, the hearing was held on April 11, 2011, and the petition has been duly examined and investigated by the City Council of the City of Sioux Falls. Testimony in support of said petition has been heard, and no opposition thereto was voiced. Said property, as shown upon the plats attached to and made a part of said petition, has been used as a street or alley and no longer serves a useful public purpose. Section 2. The owners of the above-described lots and parcels of land have been notified to repair the sidewalk at their own cost in front of and abutting upon said lots and parcels of land in accordance with the provisions of the Ordinances of the City of Sioux Falls, and specifications therefore as filed in the Office of the City Engineer. Because the sidewalks were not repaired by the owners or occupants of said lots or parcels of land within the time specified, the City of Sioux Falls will cause the same to be repaired and the cost thereof assessed upon the abutting lots or parcels of land. The cost and expense of the above-listed improvements shall be levied by special assessment upon the above-described property in accordance with SDCL Chapter 9-43. Section 3. Notice. The City may waive or reduce special assessments levied against owner-occupied single-family dwellings where the head of the household is 65 years of age or older, or is disabled or where the annual household income is less than $10,000. In order to qualify and be eligible for the waiving or reduction of such special assessments, you must make application on forms provided at the City of Sioux Falls Community Development, Carnegie Town Hall, 235 W. 10th St., or call 367-7125, prior to the date of the ‘Final Levy of the Assessment Roll’ before the Sioux Falls City Council. Failure to make proper written application prior to this date will disqualify you from being eligible for waiving or reduction of the special assessment. Section 4. The assessment may be paid in five equal annual installments. If not paid within 30 days after the assessment roll has been filed in the City Accounting Office, the assessment or any installment shall be collected with interest in accordance with the procedure provided by SDCL 9-43-31 through 9-43-41. Interest on such assessment or installment will be charged and collected in accordance with the law. The rate to be charged will be set by the City Council in the year of assessment. Section 5. The estimated cost of said sidewalk is as follows: Remove/Replace 4" Sidewalk Per Square Foot $6.00 Remove/Replace 6" Sidewalk Per Square Foot $7.00 Tree Root Removal Per Each Location $100.00 Engineering Fee 20% Section 6. A copy of the resolution will be recorded at the Register of Deeds Office, Lincoln County, SD, as a notice to all potential or actual future landowners, of present or future assessment payments on said property. 17. A RESOLUTION AMENDING THE 2011–2015 CAPITAL PROGRAM. A RESOLUTION AMENDING THE 2011–2015 CAPITAL PROGRAM. BE IT RESOLVED BY THE CITY OF SIOUX FALLS, SD. That the 2011–2015 Capital Program be amended as follows: Public Works—Sanitary Landfill Amend the Other Capital Expenditures Program by adding a waste grinder in 2011. The estimated cost is $565,000 and will not require an increase in appropriations as it will be funded by landfill user fees. Amend the Other Capital Expenditures Program by adding a front-end loader bucket in 2011. The estimated cost is $15,000 and will not require an increase in appropriations as it will be funded by landfill user fees. Amend the Other Capital Expenditures Program by adding a sandbag machine in 2011. The estimated cost is $24,800 and will not require an increase in appropriations as it will be funded by landfill user fees. Public Works—Fleet Amend the Other Capital Expenditures Program by adding a TechCrete machine in 2011. The estimated cost is $50,000 and will not require an increase in appropriations as it will be funded by user fees within the Fleet Revolving Fund. Public Works—Water Reclamation Amend the Capital Improvements Program by adding a new project, Sioux River South Interceptor Improvements, in 2011. The estimated cost is $2,000,000 for design/inspection and $12,000,000 for construction, totaling $14,000,000. This project will not require an increase in appropriations and will be funded by State Revolving Loan Funds. Public Works—Storm Drainage Amend Capital Improvements Project No. 214072, Non-Point Source Bank Stabilization, by increasing funding in 2011. The estimated cost is $100,000 for design/inspection, $50,000 for geotechnical testing, and $562,000 for construction, totaling $712,000. This project will require an increase in appropriations and will be funded by State Revolving Loan Funds. 18. A RESOLUTION APPROVING THE SIOUX FALLS CONVENTION AND VISITORS BUREAU BUSINESS IMPROVEMENT DISTRICT’S BUDGET. WHEREAS, pursuant to Resolution 86-10, the City of Sioux Falls adopted a resolution of intent to establish the Sioux Falls Convention and Visitors Bureau Business Improvement District; and WHEREAS, in accordance with SDCL Chapter Ch. 9-55 of the South Dakota Codified Laws, the CVB Business Improvement District has imposed an occupational tax of two dollars ($2.00) per night per rented room for all lodging rooms within the CVB Business Improvement District to market and promote the visitor industry in the city of Sioux Falls and increase the room night sales of lodging facilities within the CVB Business Improvement District; WHEREAS, the CVB Business Improvement District Board of Directors has developed an annual budget which is subject to City Council approval. NOW, THEREFORE, BE IT RESOLVED: That the budget dated January–September 2011, which is attached hereto and made a part of this Resolution, is hereby approved.
