WHEREAS, the City of Sioux Falls, SD, no longer needs a 24' public access easement and
sanitary sewer easement across the above-described real property, as shown on Exhibit A.
Signed approvals from all public and private utilities are on file with the office of the City
Engineer;
WHEREAS, the 24' public access easement and sanitary sewer easement was established by plat
and filed in Book 78 of Plats on page 38 in the office of the Register of Deeds for Minnehaha
County, SD, on March 4, 2016, and was reaffirmed by plat and filed in Book 78 of plats on
page 178 in the Register of Deeds for Minnehaha County, SD, on August 25, 2016;

WHEREAS, the permanent public recreation trail easement was established by plat and filed in
Book 75 of Plats on page 184 in the office of the Register of Deeds for Minnehaha County, SD,
on June 14, 2013;

OF SIOUX FALLS, MINNEHAHA COUNTY, SD.
WHEREAS, the City of Sioux Falls, SD, no longer needs part of the existing utility easement
area across the above-described real property, as shown on Exhibit A. Signed approvals from all
public and private utilities are on file with the office of the City Engineer.
WHEREAS, the existing utility easement was established by plat of Lots 1-11, Block 1, Twin
Knolls Estates Addition to the City of Sioux Falls, Minnehaha County, SD, with the Minnehaha
County Register of Deeds in Plat Book 53, Page 198 on October 16, 1991. The easement is
subsequently shown on the Plats of Lot 4A, Block 1 (Plat Book 54, Page 294 on August 8, 1992)
and Lot 4B, Block 1 (Plat Book 60, Page 261) in the office of the Register of Deeds for
Minnehaha County, SD, on November 4, 1998.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF SIOUX FALLS, SD:
That it approves the release of part of an existing utility easement, as shown on attached Exhibit
A, and affecting the real property described as Lot 4B, Block 1, Twin Knolls Estates Addition to
the City of Sioux Falls, Minnehaha County, SD, and that the City Clerk shall cause to be
recorded with the Register of Deeds, Minnehaha County, SD, a duly certified transcript of this
resolution.
