A RESOLUTION AUTHORIZING THE CITY OF SIOUX FALLS TO SET ASIDE TWO ON-SALE LIQUOR LICENSES FROM THE ON-SALE LICENSE LOTTERY FOR USE AT THE CITY’S GOLF COURSES. RESOLUTION NO. 44-22 A RESOLUTION AUTHORIZING THE CITY OF SIOUX FALLS TO SET ASIDE TWO ON- SALE LIQUOR LICENSES FROM THE ON-SALE LICENSE LOTTERY FOR USE AT THE CITY’S GOLF COURSES. WHEREAS, the City of Sioux Falls, SD, pursuant to SDCL 35-4-106, may make application for issuance of on-sale liquor license at municipal golf courses; and WHEREAS, the City of Sioux Falls, SD, has three municipal golf courses currently operating; and WHEREAS, the City of Sioux Falls, SD, pursuant to Section 111.014.2 of the Code of Ordinances of the City of Sioux Falls, SD, may, by resolution, set aside up to two on-sale liquor licenses from the on-sale liquor license lottery provided for in Sections 111.015.1 through 111.015.2 for use at municipal golf courses; NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF SIOUX FALLS, SD: That two (2) on-sale liquor licenses currently available to be issued pursuant to SDCL 35-4-11 and otherwise subject to the on-sale liquor license lottery provided for in the Code of Ordinances of the City of Sioux Falls, SD, Sections 111.015.1 through 111.015.2 be set aside for later use by the City at municipal golf courses. WHEREAS, there has been presented to the City Council of the City of Sioux Falls and filed with the City Clerk, a Petition in writing signed by the owners and otherwise in compliance with the provisions of SDCL Chapter 9-4, requesting that the territory hereinafter described be included within the municipality; WHEREAS, there has been an analysis completed in regard to the territory hereinafter described and it has been found that: 1. The property has been properly described and is contiguous to the current city limits. 2. The proposed land uses and densities are generally consistent with the Shape Sioux Falls 2040 Comprehensive Plan. 3. There is access to the major street network along W. 15th St. 4. Sanitary sewer will need to be extended from the abutting properties. 5. WHEREAS, the City of Sioux Falls, SD, no longer needs part of the permanent utility easement area across the above-described real property, as shown on Exhibit A.
