RESOLUTION NO. 70-22 A RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO AMENDMENT TWO TO GOLF FACILITIES MANAGEMENT AGREEMENT BETWEEN THE CITY OF SIOUX FALLS AND LANDSCAPES GOLF MANAGEMENT, LLC. WHEREAS, Landscapes Golf Management Company, LLC and the City of Sioux Falls, SD, are parties to a Golf Facilities Management Agreement dated January 19, 2018, as amended, and filed as City Agreement No. 17-0102 (the "Agreement"); and WHEREAS, the parties desire to enter into Amendment Two to incorporate the liquor license under the Agreement; NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF SIOUX FALLS, SD: Section 1. The document attached hereto and made a part of this resolution entitled "Amendment Two to Golf Facilities Management Agreement between the City of Sioux Falls and LMC" is hereby approved. Section 2. The Mayor is authorized to sign the Amendment Two to Agreement after it is ratified and executed by LMC. Section 3. The City shall publish the resolution, without attachment, after its passage. RESOLUTION NO. 71-22 A RESOLUTION DETERMINING IT ADVISABLE AND TO THE BEST INTEREST OF THE PUBLIC TO GRATUITOUSLY CONVEY WITHOUT PAYMENT CERTAIN REAL PROPERTY OWNED BY THE CITY. WHEREAS, pursuant to SDCL Chapter 6-5, any political subdivision may convey and transfer any real property that is owned by which it is not held for public use or that is about to be abandoned for public purposes to a nonprofit corporation for public, charitable, or humanitarian purposes and accommodation without offering the property for sale and without requiring the nonprofit corporation to pay for the property; WHEREAS, the City owns the real property with the legal description of: The North 200' of the South 500' of the East 200' of Tract 1 of County Auditor’s Subdivision of the SW1/4 of Section 17-T101N-R49W of the 5th P.M., Minnehaha County, South Dakota, except Lot H-1 contained therein. NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF SIOUX FALLS, SD: That the real property legally described as: The North 200' of the South 500' of the East 200' of Tract 1 of County Auditor’s Subdivision of the SW1/4 of Section 17-T101N- R49W of the 5th P.M., Minnehaha County, South Dakota, except Lot H-1 contained therein is not held for public use or is about to be abandoned for public purposes; It is further resolved that it is deemed advisable and to the best interest of the public to gratuitously convey without payment all or a portion of the above-described real property to the South Eastern Development Foundation, a South Dakota nonprofit corporation or another qualified South Dakota nonprofit corporation, subject to the condition that the real property be used for public, charitable, or humanitarian purposes and accommodation; It is further resolved that the City is hereby directed to convey and transfer all or a portion of the described herein real property to the South Eastern Development Foundation, consistent with the provisions of SDCL Chapters 6-5 and 6-13 and pursuant to Section 2.12(7) of the City Charter and approved Gift Agreement. RESOLUTION NO. 72-22 A RESOLUTION OF NECESSITY AUTHORIZING THE COMMENCEMENT OF CONDEMNATION PROCEEDINGS FOR ACQUISITION OF REAL PROPERTY LOCATED IN SIOUX FALLS, SD, FOR PUBLIC USE. WHEREAS, the City of Sioux Falls (the “City”) is authorized and proposes to undertake and carry out for public use a roadway construction project to construct South Veterans Parkway in southern Sioux Falls as the final segment of a limited- access corridor connecting Interstate 29 and Interstate 90. The project preserves the function and performance of the area’s future road system, and includes additional reconstruction of minor and principal arterial roadways perpendicular to the South Veterans Parkway corridor; and WHEREAS, in connection with the Project, it is necessary to acquire right-of-way from the landowners and parcels listed below; and WHEREAS, a portion of the construction of the Project will require the acquisition of additional land for right-of-way and construction, which may include control of access, borrow pits, cutslopes, fillslopes, impoundments, and channel changes, either by purchase or condemnation; and WHEREAS, the Project is scheduled for construction in 2023; and WHEREAS, in connection with such acquisition, the City has obtained or will obtain independent real estate appraisals to determine fair market value, which appraisals have been or will be reviewed by an independent real estate appraiser; and WHEREAS, purchase offers at fair market value based on the appraisals and waive valuations have been made by the City of Sioux Falls for the right-of-way; and WHEREAS, the City of Sioux Falls has been unable to acquire, by voluntary purchase or agreement, the rights-of-way and temporary easements described below that are necessary for the construction of the Project; and WHEREAS, it is deemed necessary and in the best interest of the City of Sioux Falls that the acquisition of the Project right-of-way proceed expeditiously; and WHEREAS, SDCL § 9-27-1 authorizes a municipality to acquire real property by condemnation for any purpose authorized by law when approved by a two-thirds majority vote; NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF SIOUX FALLS, SD: Section 1. That it is necessary to acquire the following right-of-way and temporary easements by condemnation in accordance with the provisions of SDCL Ch. 21- 35 and Ch. 31-19, which may include filing Declarations of Taking pursuant to SDCL § 31-19-23: Landowner: Sharon Deeb (Parcel 19-1) Property: The Southeast Quarter (SE¼), except Tract 1 of Tronson’s 2nd Addition in the Southeast Quarter (SE¼) and except that portion of the Southeast Quarter (SE¼) lying west of Tract 1 of Tronson’s 2nd Addition in the Southeast Quarter (SE¼), all in Section 21, Township 100 North, Range 50 West of the 5th P.M. in Lincoln County, South Dakota, according to the recorded plat thereof.
