MINUTES City Council Meeting Tuesday, June 10, 2025, at 6:00 PM Carnegie Town Hall, 235 West 10th St., Sioux Falls, South Dakota 57104 CALL TO ORDER 1. MEETING ROLL CALL Present: Council Member Richard L. Thomason, Council Member David Barranco, Council Member Miranda Basye, Council Member Sarah Cole, Council Member Rich Merkouris, Council Member Jennifer Sigette, Mayor Paul TenHaken Absent: Council Member Ryan Spellerberg, Council Member Curt Soehl 2. INVOCATION • Pastor Kirk Flaa, Abiding Savior Free Lutheran Church 3. PLEDGE OF ALLEGIANCE CONSENT AGENDA 4. APPROVAL OF THE CONSENT AGENDA A motion was made by Council Member Merkouris and seconded by Council Member Barranco to approve the Consent Agenda. Roll call vote to approve. 6 Yes: Thomason, Barranco, Basye, Cole, Merkouris, Sigette; 0 No: (None). Motion Passed. 5. APPROVAL OF MINUTES • Informational Meeting of Tuesday, June 3, 2025 • City Council Meeting of Tuesday, June 3, 2025 COMMUNICATIONS 6. Approval of contracts/agreements over $100K on the memorandum dated June 6, 2025. 7. Notice of Contracts/Agreements under $100K and Change Orders over $100K through May 31, 2025. 8. Approval of surplus property disposition on the memorandum dated May 28, 2025. 9. Approval of a request pursuant to SDCL 35-1-5.5 from Danyel Geier to consume, but not sell, alcoholic beverages at the Mary Jo Wegner Arboretum, 1900 S. Perry Pl., on July 5, 2025. 10. Approval of a request pursuant to SDCL 35-1-5.5 from Elizabeth Atack to consume, but not sell, alcoholic beverages at the Mary Jo Wegner Arboretum and East Sioux Falls Historic Site, 1900 S. Perry Pl., on September 13, 2025. REGULAR AGENDA 11. APPROVAL OF THE REGULAR AGENDA A motion was made by Council Member Sigette and seconded by Council Member Cole to approve the Regular Agenda. Roll call vote to approve. 6 Yes: Thomason, Barranco, Basye, Cole, Merkouris, Sigette; 0 No: (None). Motion Passed. INTRODUCTION AND ADOPTION OF ORDINANCES ORDINANCE FIRST READINGS 12. 1st Reading: AN ORDINANCE OF THE CITY OF SIOUX FALLS, SD, AUTHORIZING THE MAYOR TO ENTER INTO A FIRST AMENDED AND RESTATED CONDITIONAL GIFTING AND NAMING AGREEMENT FOR A FUTURE CASH GIFT FOR THE EXPANSION OF THE LEVITT SHELL SIOUX FALLS LOCATED IN FALLS PARK. Sponsor: Mayor A motion was made by Council Member Cole and seconded by Council Member Sigette to set a date of 2nd Reading for Tuesday, June 17, 2025 for Item 12. Roll call vote to set a date of 2nd Reading. 5 Yes: Barranco, Basye, Cole, Merkouris, Sigette; 0 No: (None). Motion Passed. Thomason was excused from the meeting and the vote on this item pursuant to City Ordinance 30.017. 13. 1st Reading: AN ORDINANCE OF THE CITY OF SIOUX FALLS, SD, PROVIDING SUPPLEMENTAL APPROPRIATIONS. Sponsor: Mayor A motion was made by Council Member Merkouris and seconded by Council Member Cole to set a date of 2nd Reading for Tuesday, June 17, 2025 for Item 13. Roll call vote to set a date of 2nd Reading. 5 Yes: Barranco, Basye, Cole, Merkouris, Sigette; 0 No: (None). Motion Passed. Thomason was excused from the meeting and the vote on this item pursuant to City Ordinance 30.017. HEARINGS AND RESOLUTIONS 14. A RESOLUTION ADVISING AND GIVING CONSENT TO THE APPOINTMENT OF MEMBERS TO CERTAIN CITIZEN BOARDS. Sponsor: Mayor A motion was made by Council Member Barranco and seconded by Council Member Sigette to adopt Resolution No. 38-25. Roll call vote to adopt. 6 Yes: Thomason, Barranco, Basye, Cole, Merkouris, Sigette; 0 No: (None). Motion Passed. RESOLUTION NO. 38-25 A RESOLUTION ADVISING AND GIVING CONSENT TO THE APPOINTMENT OF MEMBERS TO CERTAIN CITIZEN BOARDS. BE IT RESOLVED BY THE CITY OF SIOUX FALLS, SD: That it gives its advice and consent to the following Mayoral appointments: Name Board Term Joseph Turbak Building Board of Appeals Appointed for a term from July 2025 to July 2027 (replacing Wes Enberg). Justin Smith Parks and Recreation Board Reappointed for a term from August 2025 to August 2030. Date adopted: 06/10/25 . Paul TenHaken, Mayor ATTEST: Jermery J. Washington, City Clerk REPORT OF OFFICERS/BOARDS/COMMITTEES/TRANSFERS OF UNENCUMBERED APPROPRIATION BALANCES AMONG PROGRAMS WITHIN A DEPARTMENT OR ORGANIZATIONAL UNIT AS PROVIDED IN THE SIOUX FALLS CITY CHARTER SECTION 5.07(d) 15. NOTICE OF TRANSFER OF APPROPRIATIONS ON THE MEMORANDUM DATED: May 31, 2025. NEW BUSINESS There was none. GENERAL PUBLIC INPUT The following topics were discussed: the city's infrastructure; accepting and declining donations from T. Denny Sanford; the fencing project at the Bishop Dudley Hospitality House; helping the unhoused; repurposing of the old Joe Foss alternative school building; having the same fitness equipment for the Westside Recreation Center and the Frank Olson Recreation Center; and the difference between stores selling marijuana legally versus illegally in the city. ADJOURNMENT A motion was made by Council Member Barranco and seconded by Council Member Sigette to adjourn at 6:41 p.m. Roll call vote to adjourn. 6 Yes: Thomason, Barranco, Basye, Cole, Merkouris, Sigette; 0 No: (None). Recommendation: Set a date of 2nd Reading for Tuesday, June 17, 2025. Sponsor: Mayor Background & Objective: This supplemental appropriations is to fund the build out of the Levitt from a private donor. HEARINGS AND RESOLUTIONS 14. A RESOLUTION ADVISING AND GIVING CONSENT TO THE APPOINTMENT OF MEMBERS TO CERTAIN CITIZEN BOARDS.
