MINUTES Tuesday, June 4, 2013 Informational Meeting 4:00 PM at Carnegie Town Hall Sioux Falls City Council 235 West Tenth Street Members Present: Kenny Anderson Jr., James Entenman, Michelle Erpenbach, Greg Jamison, Dean Karsky, Kermit L. Staggers, Sue Aguilar Members Absent: Rex Rolfing, Mike T. Huether Staff Present: Lorie Hogstad, CMC, City Clerk; Jim David, Legislative/Operations Manager; David Bixler, Budget Analyst; and Rich Oksol, Lead Internal Auditor 1. Call To Order Council Chair James Entenman called the meeting to order at 4:00 p.m. 2. Land Use Committee A. Report on meeting held Tuesday, May 21, 2013 Councilor Dean Karsky gave this report as a member of the Land Use Committee. The barking dog ordinance was discussed and this committee will not be making any changes to this enforceable ordinance. Deer feeding and feeding of other wildlife was discussed. The South Dakota Game Fish & Parks Department will be giving a presentation on this topic in either July or August. The arterial street expansion program was part of this meeting. Chad Huwe, Public Works/City Engineer, discussed the process and presented a project list. Councilor Kenny Anderson Jr. stated the formula for the arterial street program will be further discussed. 3. City Council Open Discussion Councilor Greg Jamison spoke on the deer feeding topic discussed under the Land Use Committee Report. He added that an ordinance was previously adopted allowing an archery season for deer on the east side of Sioux Falls. He suggested this be incorporated into the GF&P presentation as far as the effectiveness of this program. Jamison added that the Audit Committee will be meeting on Thursday, June 6th at 4 p.m. in the Council Chambers. Anderson Jr. spoke with some members of the Mayor's Diversity Council this morning and was made aware of a new multi-lingual magazine called LaVoz Global/Global Voice printed in English, Spanish and Swahili, all incorporated within one magazine. Councilor Kermit L. Staggers had concerns regarding City Contracts. The Sioux Empire Farmer's Market that was held in the Kohl's parking lot on South Louise Avenue has now moved to Yankton Trail Park. This agreement with the Farmer's Market was approved by the Parks Board and the Mayor signed this contract. Staggers is concerned about contracts approved by a non-elective body. He said there should be standards for when the City Council should be involved in contract discussions. Staggers continues to hear from citizens regarding the issue of FEMA funds in relation to the April 9, 2013, ice storm, asking if the decision to accept FEMA funds will be an administrative issue or if it will be discussed by the Council. Entenman responded that he will get some answers to these questions on Friday when Council Leadership meets with the Mayor. The final numbers should be determined by the end of June and an update will be provided at that time including the process that will be followed by the City. Further discussion was held on this topic. Jamison added that this is similar to applying for a grant in that you are operating under the premise that you will accept the grant. However, it is possible to introduce a resolution that states that the FEMA money should not be accepted. Entenman reminded the Council members to submit their committee requests to him by the end of this week. He would like to complete the process this weekend and will announce the committee assignments at the June 11th Informational Meeting. Anderson Jr. asked Mark Cotter, Director of Public Works, to update the public on Operation Timber Strike. Cotter stated the team is in the punch list stage which is the terminology used when a project is substantially complete and a walk-through is done to identify any remaining items to be completed. The debris pickup should be wrapped up this week. The grinding operation is going well at the Madison site north of the Fairgrounds, which is the largest site, and the contractor is in the process of hauling out the mulch to the staging yard. They will move to the Lyons site next which will take a week, followed by the Street Department site which will take approximately five weeks. The tree branch drop off sites at both 69th and Cliff and the Street Division are still open seven days a week for citizens to drop off their own branches. The Landfill is also open for this process six days a week. Entenman noted that there will not be a Fiscal Committee Meeting after the Informational Meeting. The Council will be back for the 7:00 p.m. City Council  Meeting. 4. Presentations A. Proposed Wastewater Rates and Charges Ordinance Revisions from the Recommendations in the Sioux Falls Comprehensive Wastewater Regionalization Study by Mark Cotter, Director of Public Works; Trent Lubbers, Utility Operations Administrator; Mark Perry, Wastewater Superintendent Trent Lubbers began the presentation and touched upon the key concepts: The City of Sioux Falls will retain ownership of the system, will have the financial and governance framework in place to discuss future requests for connection, and that regionalization is an economy-to-scale effort for the smaller communities as the capital costs and regional costs of operating the system will be the same for each community. Lubbers also discussed the regionalization process overall, reviewed the progress to-date through May 2013, and the implementation of South Dakota Codified Law changes. Mark Perry reviewed the details of the proposed ordinance which will come before the Council on June 11th for the first reading and June 18th for the second reading. Perry discussed the determination of rates, the system development charge, and the implementation schedule. Lubbers and Perry responded to questions from the City Council members.
