Informational Meeting 4:00 PM at Carnegie Town Hall

Members Present: Kenny Anderson Jr., Michelle Erpenbach, Greg Jamison, Dean Karsky,
Rex Rolfing, and Kermit L. Staggers
Members Absent: Sue Aguilar, James Entenman, and Mike T. Huether
1. Call To Order
City Council Vice Chair Dean Karsky called the meeting to order at 4:00 p.m.
2. Staff Report
A. Jim David, Legislative/Operations Manager
Jim David, Legislative/Operations Manager, provided updates on proposals and Senate
bills.
3. City Council Open Discussion
Council Member Kermit Staggers and City Attorney David Pfeifle discussed the
following topics pertaining to a petition submitted last week in the City Clerk's
Office: the U.S. Supreme Court case Rust V. Sullivan (1991) regarding government
speech; and the U.S. Supreme Court case Pleasant Grove City, Utah V. Summum (2009).
Discussion followed.
Council Member Greg Jamison spoke about Item 8 on tonight’s City Council Agenda,
regarding proposed revisions to the TIF ordinance. Council Member Michelle
Erpenbach stated she would be making a motion on this item tonight to move the 2nd
Reading to March 4, 2014; this would enable Council Member Jim Entenman to be
present for the vote.
Council Member Kenny Anderson Jr. spoke about a proposed land purchase in the
eastern part of downtown Sioux Falls which involved the Catholic Church. Erpenbach
stated there would be a neighborhood meeting next week requesting input from the
neighbors about the building's proposed use.
4. Presentations
A. Code Enforcement Annual Update by Kevin Smith, Assistant Director of Planning
and Building Services
Kevin Smith, Assistant Director of Planning and Building Services, proved an annual
update on Code Enforcement. He reviewed a PowerPoint Presentation that covered the
following 2013 data: Statistics, Citations Collection, Improved Citizen Access to
Information, Rental Registration Verification, Neighborhood Clean Up and
Beautification, Strengthening Neighborhoods, Working Together, Consolidation of Code
Enforcement Functions, and the 2014 Code Enforcement Goal. Discussion followed.
5. Executive Session
A. Proposed Executive Session to consult with legal counsel about proposed or
pending litigation or contractual matters pursuant to SDCL 1-25-2(3).
A motion was made by Council Member Rex Rolfing and seconded by Council Member
Michelle Erpenbach to go into Executive Session at 4:54 p.m. to consult with legal
counsel about proposed or pending litigation or contractual matters pursuant to SDCL 1-
25-2(3).
Vote to approve: Roll Call: Yeses, Kenny Anderson Jr., Michelle Erpenbach, Greg
Jamison, Dean Karsky, Rex Rolfing, and Kermit L. Staggers, 6. Noes, 0.
Motion Passed.
A motion was made by Council Member Michelle Erpenbach and seconded by Council
Member Rex Rolfing to go out of Executive Session at 5:48 p.m.
Council Chair Dean Karsky called for a voice vote. All members voted yes.
Motion Passed.
6. Adjournment
Council Vice Chair Dean Karsky adjourned the meeting at 5:48 p.m.
