MINUTES Tuesday, July 15, 2014 Informational Meeting 4:00 PM at Carnegie Town Hall Sioux Falls City Council 235 West Tenth Street Members Present: Kenny Anderson Jr., Christine M. Erickson, Michelle Erpenbach, Greg Jamison, Dean Karsky, Rick Kiley, Rex Rolfing, Kermit L. Staggers Members Absent: Mike T. Huether Staff Present: Denise D. Tucker, CMC, Assistant City Clerk; Lorie Hogstad, CMC, City Clerk; David Bixler, Budget Analyst; and Jim David, Legislative/Operations Manager 1. Call To Order City Council Chair Dean Karsky called the meeting to order at 4:00 p.m. 2. Public Services Committee A. Report on meeting held on Tuesday, July 8, 2014 City Council Member Christine M. Erickson said commercial pedal cars were discussed at the Public Services Committee Meeting. 3. City Council Open Discussion Karsky said there will be a Council Working Session tomorrow, focusing primarily on the Capital Budget. City Council Member Greg Jamison expressed his concern about flashing red lights. He said there have been several accidents, resulting in some fatalities. Jamison stated maybe more education is needed; or this should be reevaluated. Discussion followed. This item will be discussed at a future Informational Meeting. City Council Member Rex Rolfing said he received a number of calls regarding Item 4 on the proposed Legislative Priorities list. It states, "The Sioux Falls City Council supports legislation extending owner-occupied status to income-based rental housing for property tax purposes." Rolfing said he received calls from a lot of landlords, who thought this courtesy should be extended. Discussion followed. It was decided that the item would be amended at tonight's City Council Meeting. Karsky said lately there has been some discussion regarding damage caused by the  Police Department, during the pursuit of a suspect; and compensating property owners. City Attorney David Pfeifle provided an explanation on what the City can and cannot do in these situations. Discussion followed. 4. Presentations A. OVS License Extension for WideOpenWest by Sue Quanbeck Etten, Director of Central Services; and Adrian Herbst, Esq., Baller Herbst Law Group P.C. (City Council action on July 15, 2014) Sue Quanbeck Etten, Director of Central Services, explained that there is a resolution on tonight's agenda to extend the Open Video Service license to WOW! (WideOpenWest), for another five years. The license allows WOW! to extend cable services into the city. A compliance review was held prior to recommending that the license be extended. Quanbeck Etten introduced presenter, Adrian Herbst, Esq., Baller Herbst Law Group P.C. Some items covered in Herbst's PowerPoint presentation, included: a brief ownership background; basis for requesting an extension; explanation of what is an OVS System; requirements for OVS as distinguished from cable services; Cable Act requirements applicable to OVS operators the same as cable providers; FCC enforcement; rights of localities to impose requirements on an OVS provider; the process used to evaluate license compliance; and compliance for obligations for system upgrades and customer services. Discussion followed. B. Presentation of Sioux Falls Tomorrow 2014 by Mike Cooper, Director of Planning and Building Services; and Andy Patterson, Sioux Falls Area Community Foundation Mike Cooper, Director of Planning and Building Services, began his presentation by introducing his co-presenters, Mary Tidwell, Chair of the Sioux Falls Tomorrow 2014 Steering Committee, and Andy Patterson, with the Sioux Falls Area Community Foundation. Cooper said they were going to provide an overview of the process and the outcome. This is the third time, previously in 1994 and 2004, that this process has been done. A review of the 2004 report was done, which focused on goals and accomplishments. The City of Sioux Falls contributed $5,000.00 to the Sioux Falls Tomorrow project. Tidwell expressed thanks for the City's financial support of the project. She gave a brief background on the project and process. Tidwell read the Vision Statement from the study. She called the report, the "people's vision" for the City of Sioux Falls. Patterson highlighted a few items: how to obtain a copy of the report; survey results; Vision Statement; request of citizens to keeping the City moving forward; celebrate diversity; and confront challenges of growth. He also spoke of goals in  the following key focus areas: Economic Vitality, Education, Local Government Services, Quality of Life, Social Services, and the Sioux Falls Cultural Plan. Patterson mentioned plans that some organizations have based off of the Sioux Falls Tomorrow document. Discussion followed. 5.
