1. Call To Order
Council Members Present: Janet Brekke, Christine M. Erickson, Rick Kiley, Greg
Neitzert, Marshall Selberg, Curt Soehl, Theresa Stehly
Council Members Absent: Pat Starr
Council Chair Marshall Selberg called the meeting to order at 4 p.m.
2. City Council Open Discussion
Council Member Theresa Stehly spoke about a recent police ride along.
Council Member Curt Soehl said that due to flooding of the flag football field, the
Sioux Falls School District allowed the games to be held at Howard Wood Field.
Council Member Christine M. Erickson spoke about a new POW/MIA flag in the
Chambers.
Council Member Janet Brekke said the Bee Ordinance was removed from the
agenda and will be placed on a future agenda, after she receives an updatedt draft
of the ordinance.
Selberg applauded everyone for pitching in and helping with the aftermath of the
tornadoes.
3. Presentations
A. Pre-Annexation Plan - Bindert Addition by Sam Trebilcock, Senior Planner
Presentation: Approximately 10 minutes followed by discussion
Sam Trebilcock, Senior Planner, spoke about a Pre-Annexation Plan, which he
described as a different way of transitioning landowners from outside to inside the
city limits. The presentation focused on one property in the Bindert Subdivision.
Trebilcock explained the the purpose of the plan was to: inform citizens within the
City's growth area of future annexation considerations; to have citizens provide
input on future annexation considerations; to allow the City to gain better
understanding of future utility and land use needs within future growth areas; to
develop a plan for eventual annexation; and to allow citizens to transition City
utilities.
Trebilcock explained the difference between a Pre-Annexation Plan and a Pre-
Annexation Agreement. The differences are: the plan is non-binding; a plan is
informational and only references existing ordinances and policies; an agreement
will provide definite timeframes or triggers for future annexation; an agreement will
provide the citizen(s) with specific assurances of city performance or non-
performance; and preannexation plan is more realistic for most situations.
The area of focus for the pre-annexation plan was Tract 4A of Bindert Subdivision.
The landowner wants to connect to the City sewer. Trebilcock explained the rest of
the plan details, which included requirements focusing on water service, sewer
service, zoning, annual fees, streets, storm water retention, sidewalk, and platting
fees.
Discussion followed regarding: boundaries of the subdivsion; sewer service to the
area; plan vs. agreement; paying for services; cost recovery; annexed area; water
source and service; sidewalks; ADA compliance; ensuring things are explained that
this is a plan; and unpaved roads in the City.
4. Public Comment
There was none.
5. Executive Session
A. Consulting with legal counsel or reviewing communications from legal counsel
about proposed or pending litigation or contractual matters pursuant to SDCL 1-25-
2(3)
A motion was made by Council Member Kiley and seconded by Council Member
Soehl to enter Executive Session at 4:22 p.m.
Roll call vote to enter Executive Session. 7 Yes: Brekke, Erickson, Kiley, Neitzert,
Selberg, Soehl, Stehly; 0 No: (None). Motion Passed.
A motion was made by Council Member Kiley and seconded by Council Member
Soehl to exit Executive Session at 5:59 p.m.
Voice vote to exit Executive Session. 7 Yes: Brekke, Erickson, Kiley, Neitzert,
Selberg, Soehl, Stehly; 0 No: (None). Motion Passed.
6. Adjournment
Council Chair Marshall Selberg adjourned the the meeting at 5:59 p.m.
