MINUTES Informational Meeting Tuesday, November 5, 2019 at 4:00 PM Carnegie Town Hall, 235 West 10th St., Sioux Falls, SD 57104 1. Call To Order Council Members Present: Janet Brekke, Christine M. Erickson, Rick Kiley, Greg Neitzert, Marshall Selberg, Curt Soehl, Pat Starr, Theresa Stehly Council Members Absent: None Council Chair Marshall Selberg called the meeting to order at 4 p.m. 2. City Council Open Discussion Council Member Theresa Stehly spoke about attending the Cosmopolitan Club’s recent honoring of Loila Hunking with the Distinguished Service Award for 2019. She also reminded the public about the programs offered by the City of Sioux Falls Housing Division available to income eligible homes. Stehly also spoke about the upcoming “Sioux Falls Sings” program to be held at the University of Sioux Falls on Sunday, November 29, 2019, at 4 p.m. as well as her experience watching the live taping of the White Wall Sessions. Council Member Pat Starr also spoke about his attendance at the Cosmopolitan Club’s ceremony and a separate opportunity to attend an event here in Sioux Falls that hosted a foreign trade delegation led by the Egyptian Ambassador. 3. Presentations A. Microblading by Alicia Collura, Assistant Director of Public Health Presentation: Approximately 15 minutes followed by discussion Collura stated that City Ordinance Chapter 122 covers tattoos and does not address microblading; the purpose of the presentation is to explain what microblading is and why it should be incorporated into Chapter 122. The existing ordinance requires a license for tattoo establishments and the artists, annuals inspections, and other requirements such as physical space, sterilization, and equipment and materials. Overall, the purpose of the ordinance is to ensure sanitation and safety. According to the Food & Drug Administration, "microblading is performed with a configuration of needles attached to a handle, often described as a blend between a scalpel and a fine-tooth comb, to manually create small cuts that resemble eyebrow hairs that are then filled in with ink to achieve the appearance of fuller brows." Furthermore, the National Environmental Health Association recommends classifying microblading as tattooing because, like tattooing, administration in unhygienic conditions can lead to a host of blood borne  pathogens as well as other common infections. Accordingly, the State of South Dakota recently incorporated microblading into the definition of a tattoo artists and tattooing. Other states and communities similarly include the regulation of microblading. Locally, it is estimated there are 12 microblading artists working in cosmetology or make-up offices and several are already licensed. Health conducted a public meeting with microblading artists on August 12, 2019, where no concerns were raised although additional ordinance language was recommended. Recommendations included: 1) add microblading to existing definition of tattooing (122.001); 2) consider adding requirement of blood borne pathogen training, and; 3) clean up language – align with State Administrative Rules. Health will be proposing an ordinance in the near future to address microblading. Discussion followed about: clarification of recent State Rule changes, photographs of microblading; application requirements; the requirement for a permanent facility for licensure; annual inspections; scope of the license; and training requirements for other industries. B. Phase 3 Greenway Update by Jon Jacobson, Confluence and Don Kearney, Director of Parks & Recreation Presentation: Approximately 15 minutes followed by discussion Kearney provided an introduction to the presentation by explaining: 1) similar to Phases One and Two of the Downtown River Greenway, the proposed Sioux Steel site redevelopment project has presented another opportunity for the City of Sioux Falls to implement Phase 3 of the Greenway Master Plan—Phase 3 is a “BHAG” for the Park’s Department; 2) the conceptual planning of Phase 3 completed to date has been paid for by the “Loretta Bradfeldt Estate Gift” presented to the Park’s Department; 3) the proposed Phase 3 improvements are to be a part of the “Public Safety & Phase 3 Greenway Bond”; and, 4) the next step in Phase 3 plan development will be to proceed into permitting approvals. Jacobson discussed the planning and design history of the Greenway from 1976 to 2011. He noted that the 2004 Greenway Plan updated the overall greenway master plan and identified the Downtown zone as an important public space redevelopment area. Between 2004 and 2017, detailed Downtown Greenway Planning and two phases of design and construction occurred. In March 2017, new FEMA mapping was effective. As part of hydrology planning and permitting, several objectives were identified: 1) update of existing mapping & new mapping for potential flooding areas; 2) improve identification and characterization of flood hazards; and, 3) determine where improvements can and cannot occur. Benefits to the process included: a better understanding of downtown Sioux Falls flood risks; improved regulation of development and/or improvements; and, protection of public health, safety, and welfare. Jacobson reviewed the Phase One and Two projects which were completed in 2012 and 2014, respectively. He noted that an important part of the work that was done were water quality improvements and other environmental projects between 2011 and 2014. As a result, private development was completed between 2013 and 2017. Since then, the Arc of Dreams was placed and Riverfest is an annual event. There has been a sizable economic impact from these two phases to the city.  Phase Three planning to date has included: 1) the update of FEMA flood mapping for the City of Sioux Falls in 2017 has necessitated new approvals for continued construction of Downtown Greenway improvements; 2) coordination with Sioux Steel and Lloyd Companies has been on-going for 2019; 3) construction of public access to the west side of the Big Sioux River is an important goal of the 2004 Greenway Master Plan in the Downtown area and the Sioux Steel redevelopment allows for this opportunity; 4) preliminary Phase Three planning is complete and now the permitting approval process needs to begin; and, 5) the Phase Three project budget is anticipated to be between $7 million to $10 million dollars. Jacobson concluded with an overview of the anticipated planning, design, and construction schedule. Discussion followed about: Phase One and Two costs; timing of the project with bonding; contingency amounts associated with each of the bond projects; how unused funds may be used; impacts of the project slowing down or stopping; timing of the bond ordinance; purpose of the low-head dam and reasons for addressing it; timeline for completion of initial planning and design; the permitting process with federal, state, and local agencies; whether additional design work is required before bidding; possible impacts of a recession on bond rates and sales tax revenue; and, reasons for using one bond for the safety center, fire station, and river greenway improvements. 4.
