MINUTES Monday, April 11, 2011 Public Services Committee * 5:00 PM Carnegie Town Hall 235 West 10th Street Members Present: Council Member Sue Aguilar, Council Member Kenny Anderson Jr., Council Member Vernon Brown, and Council Member Michelle Erpenbach. Members Absent: None. Staff Present: Debra A. Owen, City Clerk/Chief of Council Operations and Tamara Jorgensen, CMC, Assistant City Clerk Guests: Cheryl Rath, Keith Allenstein, David Pfeifle, Greg VandeKamp, N. Dean Nasser, Jr., Linda Stoops, Jim Entenman, Dean Karsky, Greg Jamison, Lorie Hogstad, Tim Stanga, Rich Oksol, Jeanne Gerkin, Gerald Gerkin, Chuck Armstrong, Steve Caulfield, Brian Deuz, and Brian Tams. 1. Call To Order Council Chair Anderson Jr. called the meeting to order at 5:00 p.m. 2. Review and approval of Minutes March 14, 2011 A motion was made by Council Member Michelle Erpenbach and seconded by Council Member Sue Aguilar to approve the minutes of March 14, 2011. A voice vote was taken and all members present voted yes. Motion Passed. Item 5 was heard at this time. See item for action taken. 3. Council Procedures and Organization Due to time constraints and a schedule conflict in May, this item will be rescheduled to the Public Services Committee Meeting scheduled for Monday, June 13, 2011. 4. Pawn Shop Ordinance Assistant City Attorney Keith Allenstein reviewed the most recent updates received today. Discussion followed. Linda Stoops, Sunset Pawn, gave a Power Point presentation.  Chuck Armstrong, Community Affairs Director for Pawn America, discussed the proposed ordinance amendments. Discussion followed. Steve Caulfield, Chief Operating Officer for Pawn America, addressed the committee. Discussion followed. Brian Deuz, Last Stop CD Shop, discussed the proposed changes to the ordinances and how they would affect his business. Discussion followed. Brad Tams, Loss Prevention Manager for Lewis Drugs, discussed why his organization is in favor of the proposed ordinance changes and the losses that his corporation incurs. Discussion with Allenstein regarding the process and procedures of confiscating items/ searching a pawn shop. Discussion followed. Attorney Dean Nassar has spoken previously for Sunset Pawn and a few other pawn brokers. Nassar discussed how the proposed amendments would impact the pawn brokers and requested that the committee review the reporting requirements. Some updated information received today has not been fully reviewed. The Pawn Shop Ordinance discussion will continue at the next Public Services Committee Meeting scheduled for Monday, May 9, 2011. Item 3 was heard at this time. See item for action taken. 5. Amendments to Chapter 5, Alcoholic Beverages Lorie Hogstad, Licensing Specialist, reviewed the proposed alcohol amendments with the committee. Discussion followed. A motion was made by Council Member Michelle Erpenbach and seconded by Council Member Sue Aguilar that the following two proposed amendments to Chapter 5, Alcoholic Beverages, move forward to the City Council for consideration: Sec. 5-13. Sunday and Memorial Day sales permitted by certain on-sale dealers; and Sec. 5-16 - Sunday and Memorial Day hours of sales of malt beverages permitted for off-sale dealers. A motion was made by Council Member Vernon Brown and seconded by Council Member Michelle Erpenbach to amend the main motion by adding Sec. 5-2, Classification and Fees, to the original main motion. A substitute motion was made by Council Member Vernon Brown and seconded by Council Member Michelle Erpenbach to approve that all recommended ordinance amendments, including setting the license fee increase from $1/person to $1.25/person, are moved forward to the City Council for consideration. A voice vote was taken and all  members present voted yes. Motion Passed. Jim Entenman discussed the proposed alcohol amendments with the committee. He requested that portions of the proposed amendments be sent back to the Committee for additional review and additional public input. Discussion followed. Item 4 was heard at this time. Adjournment A motion was made by Council Member Vernon Brown and seconded by Council Member Michelle Erpenbach to adjourn the meeting at 6:49 p.m. A voice vote was taken and all members present voted yes.
