Members Present: Council Member Sue Aguilar, Council Member Kenny Anderson Jr.,
Council Member Michelle Erpenbach, and Council Member Dean Karsky
Members Absent: None
Staff Present: Tamara Jorgensen, CMC, Assistant City Clerk; Lorie Hogstad, CMC, City
Clerk; David Bixler, Budget Analyst; and Jim David, Legislative/Operations Manager
1. Call To Order
Committee Chair Kenny Anderson Jr. called the meeting to order at 4:30 p.m.
2. Review and approval of minutes dated May 14, 2013
A motion was made by Council Member Sue Aguilar and seconded by Council Member
Michelle Erpenbach to approve the minutes. Anderson Jr. called for a voice vote and all
members present voted yes. Motion Passed.
3. Tobacco Policy in the Parks by Don Kearney, Director of Parks and
Recreation and Jill Franken, Public Health Director
Don Kearney, Director of Parks and Recreation spoke regarding the tobacco free policy
in the city parks. Kearney stated one of the focal points of stopping tobacco use was to
focus on youth.
Jill Franken, Public Health Director, reviewed and discussed a PowerPoint presentation
encompassing the following slides: Purpose and Strategy with Policy; Researched
Topic-Identified Problem; Needs Snapshot/Resident Survey; Defined Scope of Work;
Developed a Phased Approach; and Report Implementation Success.
Sergeant David Huntimer, Sioux Falls Police Department, spoke regarding the status of
enforcement of the policy. He stated the program is going very well and they have not
received any negative responses. Council Member Dean Karsky asked if this was a
policy or an ordinance. He asked if this was enforceable as an ordinance. Discussion
was held regarding writing citations under 95.032 as copied below.
95.032 AUTHORITY OF DIRECTOR TO PROHIBIT CERTAIN
CONDUCT; NOTICE.
The director may prohibit conduct in those areas of the parks when and where
the director deems conduct dangerous or unduly interfering with another's use
of the parks such as, but not limited to, picnicking areas. A notice prohibiting
activity within
a specific area shall be conspicuously displayed setting forth which activity,
conduct, or games are restricted.

Anderson Jr. asked how it is determined which events fall under these criteria. Huntimer
stated that any event where there are people 18 years of age or younger at that event.
4. Open Discussion
There was none.
5. Adjournment
A motion was made by Council Member Michelle Erpenbach and seconded by Council
Member Sue Aguilar to adjourn the meeting at 4:52 p.m.
Anderson Jr. called for a voice vote and all members present voted yes. Motion Passed.
