Meeting called to order by Vice Chairperson West at 7:05 p.m. Commissioners Present Commissioners Not Present Staff Present Christy West, Vice Chair Shane Jordan, Chair Theresa Alexander, Planner Patrick Brady Eric Lundin, Planning Support Jordan Granier Daniel Laurant René LeBreton Billy Provenzano 2. Pledge of Allegiance 3. Minutes. Motion by Board Member LeBreton to approve minutes of September 8, 2022 as written; Board Member Brady seconded. A vote of 6 YAYS, 0 NAYS, 0 ABSTAIN approved the minutes. 4. Public Hearings a. V22-24: A request for a variance from Lot Area regulations in the A-6 Single-Family Urban District; for property located at 806 Pine Tree Street, identified as Lot 34, Sq 6 in the Pinecrest Subdivision, by Steven Wilt, Contractor. Vice Chairperson West introduced the item. • Board Member LeBreton noted neither the applicant nor the property owner was present and asked if the item should be postponed until the November meeting. • Eric Lundin recommended that the board hear and discuss the application and then decide whether to postpone the item until the next meeting. • Vice Chairperson West decided to proceed with considering. Vice Chair West directed staff to summarize the information, conclusions, and recommendations contained in the staff report. Eric Lundin provided the summary and noted the staff was recommending a reduction to the size of the encroachment requested by the applicant. Eric Lundin referred the board to the measurements in the table provided in the staff report which included the requirements of the current ordinance and code in column two, the applicant’s proposal in column three, and what the staff is recommending in column four. The staff’s recommendation would meet the requirements of the International Residential Code while also minimizing the requirement. Board Member Brady asked if the neighbor had been contacted and, if so, if they had any concern or opinion. Eric Lundin responded that the staff had not, but the property had been posted and the notice provides details on how to contact the planning department and make a comment if they are unwilling or unable to attend the meeting. Board of Zoning Adjustment Minutes for October 6, 2022 Page 1 of 2 Board Member LeBreton made a motion to approve the variance with the modification that the encroachment be no larger than 40”; the motion was seconded by Board Member Brady. A vote was taken and with the result of 6 YAYS, 0 NAYS, 0 ABSTAIN the motion was approved. 5. Other Business a. Theresa Alexander reminded the board members, especially the two new members, they must complete their annual ethics training and provide the completion certificate by December 31, 2022. Theresa Alexander informed the new members the training could be completed online and that she would provide them a link to the web site by e-mail. 6. General and Public Comments. There were none. 7. Adjournment. Meeting adjourned at 7:21 p.m. on motion by Vice Chairperson West, second by Board Member LeBreton, and a vote of 5 YAYS, 0 NAYS, 1 ABSTAIN. The abstention was by Board Member LeBreton.
