Motion 23-259, adoption of County/City Partnership Project 2023-0697 Benchmarks Nicole Gorle, Sr. Legislative Analyst, provided a staff report and explained that approval of this motion will satisfy the Budget condition for the release of 2023 Real Estate Excise Tax (REET II) funds. ACTION: Move to Consent Agenda, General Legislative Session June 21st for consideration 2. Ordinance 23-058, amending Ordinance No. 21-036; relating to a 2023-0622 vacated portion of 99th Avenue NW, a Snohomish County Road Right-Of-Way Deb Bell, Sr. Legislative Analyst, provided a staff report and explained the ordinance would amend Ordinance No. 21-036 to remove the requirement that the County retain a utility easement and to modify the requirement for an access easement on a vacated portion of 99th Avenue NW. ACTION: Move to Regular Agenda, General Legislative Session June 21st, to set time and date for public hearing. Ordinance 23-059, granting a non-exclusive telecommunications 2023-0624 franchise authorizing limited use of the public road rights-of-way in Snohomish County, Washington to Ziply Fiber Northwest, LLC d/b/a Ziply Fiber Deb Bell, Sr. Legislative Analyst, provided a staff report and explained the ordinance would grant Ziply Fiber limited use of the public roads rights-of-way to construct, operate, and maintain a telecommunications system. Ms. Bell noted there is an illustration of the franchise area in Exhibit A of the County Engineers Report. ACTION: Move to Regular Agenda, General Legislative Session June 21st, to set time and date for public hearing. 4. Ordinance 23-063, granting a non-exclusive franchise authorizing 2023-0665 limited use of the public road rights-of-way in portions of Snohomish County, Washington to Mukilteo Water and Wastewater District Deb Bell, Sr. Legislative Analyst, provided a staff report and explained the ordinance would grant Mukilteo Water and Wastewater District limited use of the public roads rights-of-way to construct, operate, and maintain a water distribution and wastewater conveyance system. Ms. Bell noted there is an illustration of the franchise area in Exhibit A of the County Engineers Report. ACTION: Move to Regular Agenda, General Legislative Session June 21st, to set time and date for public hearing. 5. Motion 23-251, authorizing the County Executive to sign 2023-0672 Supplement No. 8 to Professional Services Agreement CCF01-19 with Jacobs Engineering Group, Inc. to provide consulting services for 43rd Avenue SE from SR 524 to 180th Street SE Deb Bell, Sr. Legislative Analyst, provided a staff report and explained the motion would approve and authorize the County Executive to execute Supplement No. 8 to the agreement. Ms. Bell noted the total payments for services for this supplement are not to exceed $1,436,987.00, for a total amended amount not to exceed $2,922,527.00. Motion 23-243, accepting a donation of real property owned by 2023-0649 MSR Foundation, USA, Inc. Deb Bell, Sr. Legislative Analyst, provided a staff report and explained the motion would authorize acquisition of 0.48 acres of real property adjacent to Riverscene Park in Granite Fall and approve the acceptance via donation of the real property owned by MSR Foundation, USA, Inc. to Snohomish County Parks for permanent conservation. ACTION: Move to Consent Agenda, General Legislative Session June 28th for consideration 7. Motion 23-252, approving the Conservation Futures Property Tax 2023-0676 Funds Return to Fund Balance Deb Bell, Sr. Legislative Analyst, provided a staff report and explained the motion would approve the return of unexpended project grant funds to the Conservation Futures Fund, making the balance $1,370,303.48. Ms. Bell noted a substitute motion is proposed due to inconsistencies and Committee Member Mead directed the clerks to enter the substitute motion. ACTION: Move the substitute motion to Consent Agenda, General Legislative Session June 28th for consideration 8. Motion 23-235, approving and authorizing the County Executive to 2023-0597 execute Amendment 3 to the Master Software License and Services Agreement with Progressive Solutions, Inc. Deb Bell, Sr. Legislative Analyst, provided a staff report and explained the motion would approve and authorize the County Executive to execute Amendment No. 3 to the agreement for an additional five-year term with an annual increase of Consumer Price Index or 3%, whichever is greater, through January 10, 2029. Motion 23-249, approving and authorizing the County Executive to 2023-0630 execute Amendment 3 to the Software License and Services Agreement Relating to Automated Cashiering System Deb Bell, Sr. Legislative Analyst, provided a staff report and explained the motion would approve and authorize the County Executive to execute Amendment No. 3 to the agreement for an additional five-year term with an annual increase of 5%, through January 18, 2029. ACTION: Move to Consent Agenda, General Legislative Session June 28th for consideration 10. Motion 23-228, approving a contract with Petrocard Inc. to provide 2023-0626 fueling services for Snohomish County Deb Bell, Sr. Legislative Analyst, provided a staff report and explained the motion would authorize the County Executive to sign the contract in the amount of $35,000,000.00 for furnishing fueling services for the period of June 1, 2023, through December 31, 2026. ACTION: Move to Consent Agenda, General Legislative Session June 28th for consideration 11. Motion 23-253, authorizing approval of Professional Services 2023-0683 Agreement SWMCC 05-23 with Lake Defense Force Corporation for Invasive Aquatic Plant Diving Services Deb Bell, Sr. Legislative Analyst, provided a staff report and explained the motion would approve and authorize the County Executive to sign the agreement and further authorizes the Director of Conservation and Natural Resources to approve and sign contract amendments that is an increase to the original contract amount by no more than 20%. Ms. Bell said the total budget for this agreement is $373,000.00 with estimated expenditures of $103,000.00 in 2023, $135,000.00 in 2024 and 2025. She noted expenditures in 2024 and 2025 at Lake Serene and Sunday will be contingent upon obtaining additional revenue sources. Motion 23-250, authorizing the County Executive to sign 2023-0671 Amendment No. 3 to Professional Services Agreement CC03-21 with Parametrix, Inc. for Supervisory Control and Data Acquisition (SCADA) System Technical Support Services Deb Bell, Sr. Legislative Analyst, provided a staff report and and explained the motion would approve and authorize the County Executive to execute Amendment No. 3 to the agreement thru December 31, 2023, and the total payments for services for this amendment are not to exceed $75,000.00.
